1.0 EXECUTIVE SUMMARY Watts Architecture & Engineering (Watts) was retained by Generation Development Corporation to perform a pre-renovation survey for asbestos-containing materials (ACM) and polychlorinated biphenyls (PCBs) in caulks and sealants of the American Building at 85 Silo City Row in Buffalo, NY. The purpose of the survey was to identify ACM and PCBs within the proposed project limits as part of the due diligence process and for the preparation of the design documents for the project. The survey included the structures known as Building 1 and Building 2 at the Silo City Complex. Adjacent concrete silos were not included in this survey. The former American Malting Company Buildings 1 and 2 are located on the north side of the former Childs Street (now Silo City Row) adjacent to the Buffalo River. Building 1 was originally built in 1906 and consisting of two five story sections (north and south sections). In 1923 the southern portion of Building 1 was demolished and replaced with Building 2, an eight story flour mill structure constructed of reinforced concrete. The complex was not in active use at the time of the Watts site visits and appears to have been vacant for several decades. No power, lights or utilities were available. Limited portions of the buildings were not accessible due to safety or structural concerns. Building 1 was as the American Elevator Malt House Company Warehouse used to prepare malt to sell to brewers. In 1922 the Russell-Miller Milling Company purchased the complex, which was subsequently extended and converted for flour production. The south wing of the original malt house was demolished in 1922. The 1923 addition of Building 2 converted the complex to flour production. Field survey work was conducted between January 14 and 24, 2020 and included the following:

• Visual site inspections to identify suspect ACM and PCBs that were identified to be within the project limits.

• Collection and laboratory analysis of bulk samples for asbestos and PCBs, as appropriate.

• Documentation of asbestos and PCB bulk sample locations on drawings and chain-of-custody forms; and

• Photographs.

ASBESTOS-CONTAINING MATERIALS

The inspection conducted by Watts’ personnel included the collection of two-hundred twenty-two (222) bulk samples of suspect ACM within the project limits. ACM is defined as any material containing more than one percent (1%) of asbestos.

Based on review of laboratory analysis and visual observations, the following ACM were identified within the Silo City American Building 1 and Building 2: Building 1 American Elevator and Malt House White exterior parge coating. The asbestos-coating was observed on the brick façade on the east, north and west elevations of Building 1, including corresponding walls on raised roof structures on the main roof. The initial laboratory analysis via ELAP Method 198.1 on samples of the white exterior parge coating collected by watts’ in January 2020 detected vermiculite in the material. Additional samples were collected and submitted for ELAP 198.8 analysis. During ELAP 198.8 analysis, the material was found to be asbestos-containing. The white exterior parge coating was determined to be friable and was observed to be in poor condition and extends over approximately 29,650 square feet of Building 1. The extent of coverage varied from surface to surface, as follows:

• West Elevation: 10,700 square feet. • North Elevation: 10,200 square feet. • East Elevation: 8,750 Square feet.

Total: 29,650 square feet. Pre-formed pipe insulation. Asbestos-containing pre-formed pipe insulation was observed on exposed piping. The pre-formed pipe insulation was determined to be friable and was observed to be in fair to poor condition. Pre-formed pipe insulation was observed in various locations in Building 1, total of approximately 250 linear feet. Air cell pipe insulation. Asbestos-containing air cell insulation was observed on piping along the ceilings generally in a north-south direction and along the south wall near the entrance to Building 2. The pipe insulation was determined to be friable and was observed to be in fair to poor condition. Damaged sections of air cell pipe insulation was also observed on the floor in former service rooms on the second floor of the building. Approximately 360 linear feet of air cell pipe insulation was observed in Building 1. Pipe insulation debris on the floor. Sections of pre-form pipe insulation and air cell pipe insulation was observed on the floor beneath insulated piping in Building 1. Approximately 3,450 square feet of Building 1 is estimated to have asbestos insulation debris. The debris is friable and in poor condition. 9” x 9” and 12” x 12” floor tiles. Asbestos-containing 9”x 9” and 12” x 12” floor tiles were observed in a suite of laboratory and toilet rooms at the northwest corner on the third floor and in a toilet room on the east-center side of the third floor. The floor tiles were determined to be non-friable and were observed to be in poor condition. The mastic associated with the floor tiles was determined to be non-ACM. Approximately 400 square feet of asbestos-containing floor tiles were observed in Building 1.

Asbestos-containing floor tiles were observed at the following locations:

• Third floor northwest laboratory (designated as lab 1).

• Third Floor west-northwest laboratory (designated lab 2) beneath a top layer of 12” ACM floor tiles.

• Third floor north toilet adjacent to the north center laboratory (designated as lab 3). • Third floor north shower by lab 3. • Third floor east-center toilet.

Tongue and groove wood flooring with underlying black tar. The asbestos-containing black tar was observed on the underside of the wood tongue and groove flooring in the third floor north laboratory only, an area of approximately 430 square feet. The underlying black tar was determined to be non-friable and was observed to be in fair to poor condition. Fluorescent light fixture gaskets between fixture bodies and lenses. The gaskets were present on the majority of ceiling-mounted fluorescent light fixtures observed throughout Building 1. The gaskets were determined to be friable and appeared to be in good condition. A total of approximately 70 fixtures with a total of 70 square feet of gaskets were observed in Building 1. Exterior window frame caulk. The remnants of caulk between remaining wood window frames and the brick exterior was determined to be asbestos-containing. The majority of windows have been removed and not all window openings have wood window frames remaining. The exterior caulk is intermittent along the window openings. The exterior window frame caulk was determined to be non-friable and was observed to be in poor condition. Approximately 92 window openings are located on Building 1 with an approximately 18 linear feet of 1” caulk (1.5 square feet) per window, total 140 square feet. Window glazing compound on exterior facing windows. Remaining exterior window sashes in Building 1 are all considered to have the asbestos-containing window glazing compound. The window glazing compound was determined to be non-friable and was observed to be in poor condition. Approximately 47 window sashes are present, each with approximately 10 square feet of window glazing compound, total 470 square feet. Seam sealant on silos with flange rings and riveted sections. Seam sealant on two rows of silos of the southeast silos bank with flange rings and riveted sections was determined to be asbestos-containing. The seam sealant was limited to the southern two rows of silos, 7 per row and a total of 14 silos: The remaining 42 silos in this area appeared to have welded sections with no asbestos-containing caulk. The caulk was observed along edges of rings where sections were connected with rivets. The caulk was determined to be non-friable and was observed to be in good condition. Approximately 100 square feet of seam sealant is present on the silos with riveted sections. Flange gaskets. All flange gaskets associated with pipe fittings and valves throughout Building 1 are assumed to be asbestos-containing. Gaskets were not accessible but are assumed to be non-friable and in fair condition. Approximately 100 square feet of asbestos-containing gaskets are assumed present in machinery and components throughout Building 1.

Switch gear insulators. The insulators in switch gears were determined to be asbestos-containing. These components are located in mechanical and control rooms throughout Building 1. The switch gear insulators were determined to be non-friable and were observed to be in good condition. Approximately 150 square feet of switch gear insulators were observed in Building 1. Transite electrical panel backers. The transite electrical panel backers observed in former electrical and control rooms throughout Building 1 are asbestos-containing. The transite panel backers were determined to be non-friable and were observed to be in good condition. Approximately 56 square feet of transite electrical panels were observed in Building 1. Dark gray cementitious electrical panel backers. These components are thicker than the transite electrical panel backers and are also located in former electrical and control rooms throughout Building 1. The dark gray electrical panel backers were determined to be non-friable and were observed to be in good condition. Approximately 18 square feet of dark gray electrical panel backers were observed in Building 1. Cementitious transite shelves. Asbestos-containing cementitious transite shelves were observed in a metal cabinet in the third floor northwest corner laboratory 1. The shelves were determined to be non-friable and were observed to be in good condition. Approximately 8 square feet of cementitious transite shelves were observed in laboratory 1. Cementitious platforms in the laboratory drying ovens. Two separate drying ovens were observed in the laboratory suite at the third floor northwest corner. The platforms were determined to be non-friable and were observed to be in good condition and approximately 4 square feet. Cloth wire insulation on white cementitious lab components. These cementitious components were observed on a work table and in drawers in the third floor northwest corner laboratory 1. The cloth wire insulation was determined to be non-friable and was observed to be in good condition. Approximately 10 square feet of cloth wire insulation was observed on the lab components. Black sound attenuation coating on sink bottoms. Two sinks with asbestos-containing sound attenuation were observed in the third floor northwest corner laboratory suite, total approximately 10 square feet. The sound attenuation coating was determined to be non-friable and to be in good condition. Fiberboard blocks. White fiberboard blocks determined to be asbestos-containing were observed on laboratory countertops in the third floor northwest corner laboratory (laboratory 1). Several blocks were wrapped in paper jackets/original packaging. Approximately 4 square feet of fiberboard blocks were observed in laboratory 1. The fiberboard blocks were determined to be friable and were observed to be in poor condition.

Freight elevator brake shoe pads. The brake shoe pads in the freight elevator mechanical room were confirmed to be asbestos-containing. Approximately 2 square feet of brake shoe material was observed. The brake shoe pads were non-friable and were in good condition. Transite siding on the connecting roof to the adjacent concrete silos. The siding was along the top edge to the adjacent concrete silos. Approximately 150 square feet of siding was observed. The transite siding was determined to be non-friable and was observed to be in poor condition. Fragments of broken siding were observed on the ground. Aluminizer coating on upper roof facades for raised roof structures on the Building 1 main upper roof. Approximately 1,700 square feet of coating was observed. The aluminizer coating was determined to be non-friable and was observed to be poor condition. NOTE: This material was on top of the underlying asbestos-containing white parge coating on brick walls. Flashing tar on the upper penthouse roof at the southeast corner of the Building 1 roof. The flashing tar was observed along the edges of the upper penthouse roof and covered approximately 540 square feet. The upper penthouse roof flashing tar was determined to be non-friable and to be in fair to poor condition. Flashing tar on the roof of the connection between Building 1 and Building 2. The flashing tar was observed along the edges of the connecting roof and covered approximately 450 square feet. The flashing tar was determined to be non-friable and was in fair to poor condition. Building 2 American Flour Mill Pre-formed pipe insulation. Asbestos-containing pre-formed pipe insulation was observed on exposed piping at various locations throughout Building 2. The pre-formed pipe insulation was determined to be friable and was observed to be in fair to poor condition. A total of approximately 600 linear feet of pre-formed pipe insulation was observed in Building 2.

Air cell pipe insulation. Asbestos-containing air cell insulation was observed on piping on the third floor in Building 2. The pipe insulation was determined to be friable and was observed to be in fair to poor condition. Approximately 40 linear feet of air cell pipe insulation was observed in Building 2. Pipe insulation debris on the floor. Sections of pre-formed pipe insulation, air cell pipe insulation and mudded fittings were observed on the floors throughout Building 2. Approximately 2,660 square feet of Building 2 is estimated to have asbestos insulation debris. The debris is friable and in poor condition. Fluorescent light fixture gaskets between fixture bodies and lenses. The gaskets were present on the majority of ceiling-mounted fluorescent light fixtures throughout Building 2. The gaskets were determined to be friable and appeared to be in good condition. A total of approximately 250 fixtures with a total of 250 square feet of gaskets were observed in Building 2.

Exterior window frame caulk. The remnants of caulk between remaining wood window frames and the brick exterior on Building 2 was determined to be asbestos-containing. The majority of windows have been removed and not all window openings have wood window frames remaining. The exterior caulk is intermittent along the window openings. The exterior window frame caulk was determined to be non-friable and was observed to be in poor condition. Approximately 23 window openings are located on Building 2 with an approximately 18 linear feet of 1” caulk (1.5 square feet) per window, total 35 square feet.

Window glazing compound. Remaining window sashes in Building 2 have asbestos-containing window glazing compound. The window glazing compound was determined to be non-friable and was observed to be in poor condition. Approximately 23 window sashes are present, each with approximately 10 square feet of window glazing compound, total 230 square feet.

Flange gaskets. All flange gaskets associated with pipe fittings and valves throughout Building 2 are assumed to be asbestos-containing. All gaskets are assumed to be non-friable and in fair condition. Approximately 100 square feet of asbestos-containing gaskets are assumed installed in machinery and components throughout Building 2.

Dark gray cementitious electrical panel backers. These components are thicker than the transite electrical panel backers and are also located in former electrical and control rooms throughout Building 2. The dark gray electrical panel backers were determined to be non-friable and were observed to be in good condition. Approximately 270 square feet of dark gray electrical panel backers were observed in Building 2.

Transite electrical panel backers. The transite electrical panel backers observed in former electrical and control rooms throughout Building 2 are asbestos-containing. The transite panel backers were determined to be non-friable and were observed to be in good condition. Approximately 30 square feet of transite electrical panels were observed in Building 2.

Fire door insulation. One detached and damaged fire door was observed on the second floor of Building 2, by the west stairwell. Insulation was observed on the floor adjacent to the fire door. Approximately 21 square feet of insulation is in the fire door. The insulation was determined to be friable and was observed to be in poor condition.

Rolled roofing on the main upper roof. The rolled roofing extended across the main upper roof. Sections of roofing are missing and the deck is exposed and covered an area of approximately 5,000 square feet. The rolled roofing on the Building 2 main upper roof was determined to be non-friable and was observed to be in poor condition with sections displaced and the underlying deck exposed.

Flashing tar on the main upper roof. The flashing tar was observed along the perimeter of the main upper roof and covered an area of approximately 540 square feet. The flashing tar was determined to be non-friable and was observed to be in poor condition.

Flashing tar on the high roof. The flashing tar was observed along the perimeter of the high roof at the southeast corner of Building 2, approximately 260 square feet. The flashing tar was determined to be non-friable and was observed to be in poor condition.

* All contractors shall note this material had detectable levels of asbestos present, but was

found to be less than 1.0% asbestos and, therefore, the material is classified as non-ACM. Contractors shall follow federal regulations, including those established by OSHA, for work involving such non-ACM asbestos trace materials.

POLYCHLORINATED BIPHENYLS

Watts investigated the caulk and sealants throughout the proposed work areas to determine if polychlorinated biphenyls (PCBs) were present and will be impacted by the renovation project. A sample was collected from the representative location identified by Watts based on visual observations made at the time of the site visit and the following materials were sampled: Building 1

• Window caulk • Interior door glazing compound

Building 2 • Exterior window frame caulk • Interior window frame caulk • Exterior window glazing compound

None of the materials tested have concentrations of PCBs greater than the current regulatory action level of 50 ppm. Therefore no special handling and disposal considerations with respect to PCBs are required.

GENERAL OBSERVATIONS At the time of the Watts’ site visits, the facility was without power or lights and areas were determined not accessible due to safety concerns, lack of structural integrity in floors and the lower roof on the east side of Building 2. In accessible areas included the Building 1 penthouse above the bank of 56 silos; the southeast area of the fourth floor of Building 1 by the silos and freight elevator; the eighth floor penthouse in Building 2; the south end of building 2 past the bank of 18 solos; and the south end basement in Building 2. Fallen plaster and machinery also cover areas of floors. Piping may also be present in wall or ceiling chases that are not exposed or accessible. Asbestos (pipe insulation and/or flooring) may be present in areas not accessible. Further identification and delineation of asbestos-containing materials may be needed as portions of the facility are accessed and/or non-hazardous debris is removed. No boilers, heating supply systems or similar mechanical components other than apparent steam supply and return lines and hot water piping lines were observed in the buildings. Based on review of historic maps a former boiler house/heating plant may have been previously located to the northeast of Building 1, adjacent to the chimney. This area is an open concrete pad and any former boiler/heating plant has been demolished. It is possible that buried utilities and/or lines may be present at this location. Four separate groups of silos were observed in the complex, consisting of three sets in Building 1 and a single set of silos in Building 2. The set of silos at the south end of Building 2 are partially enclosed by block walls and were not fully accessible. No suspect ACM was observed on accessible portions of the Building 2 south silos. Of the three sets of silos in Building 1 asbestos-containing caulk appeared to be limited to 14 silos in the group of 56 silos at the southwest corner. These units have flange rings with asbestos-containing caulk and riveted sections. The remaining silos in Building 1 (the remaining 42 silos at the southwest corner, six silos at the southwest corner and 10 silos in the connection between Building 1 and Building 2) did not have any apparent flange rings or asbestos-containing caulk or sealants. Included in this report are the following: Drawings indicating approximate bulk sample locations, chain-of-custody forms, laboratory results, laboratory accreditations, and consultant's license and certification. It is the belief of Watts that this testing has identified all ACM, LBP and PCBs within the project limits where work will occur. However, if additional suspect materials are identified during the project that have not been sampled, it is recommended that samples of each material be collected and analyzed for asbestos, LBP or PCBs, as appropriate.

2.0 ASBESTOS-CONTAINING MATERIALS Sampling and Laboratory Methodology A NYSDOL-certified asbestos inspector from Watts collected bulk samples of all suspect ACM that was identified to be associated with the project limits. Bulk samples were collected using simple hand tools from each matrix identified as a potential ACM. Samples were delivered with the proper chain-of-custody forms to AmeriSci Richmond, Midlothian, VA and to EMSL Analytical located in Depew, NY. Both facilities are New York State-accredited laboratories that are a participants in the Environmental Laboratory Approval Program (ELAP) and National Voluntary Laboratory Approval Program (NVLAP). All materials, except ceiling tiles and non-friable organically bound (NOB) materials, were analyzed using Polarized Light Microscopy (PLM) using Method 198.1. Ceiling tiles and NOBs, which include, but are not limited to, flooring materials, mastics, and caulks underwent gravimetric reduction and were analyzed by Polarized Light Microscopy (PLM) Method 198.6. Any ceiling tiles or NOB materials that were found to be negative under PLM were then analyzed by Transmission Electron Microscopy (TEM) Method 198.4. The New York State Department of Health (NYSDOH) protocol requires analysis by TEM if the PLM analysis does not confirm the presence of asbestos. Samples of surfacing materials such as joint compound, plaster and parge coatings/surfacing materials were examined optically at the analytical laboratory for the presence of vermiculite. Samples of exterior parge coating that contained vermiculite were analyzed via Method 198.8 for surfacing material that contains vermiculite (SM-V). This section includes information on all suspect ACM sampled. This section contains the following: a Homogeneous Materials List containing the homogeneous materials identified, their corresponding sample numbers, and whether or not they are ACM, as well as drawings identifying the approximate locations of asbestos bulk samples. Where possible, Watts visually inspected the identified ACM to assess its condition. The condition of the ACM was classified as good, fair or poor. The requirement for each designation is as follows: Good: Material with no visible damage or deterioration or showing very limited damage or

deterioration. Fair: The surface of the material is crumbling, blistering, water-stained, gouged, punctured or

otherwise damaged with the damage covering less than one tenth of the surface if the damage is evenly distributed or up to 25% of the material if the damage is localized.

Poor: The surface of the material is crumbling, blistering, water-stained, gouged, punctured or

3.0 POLYCHLORINATED BIPHENYLS (PCBs) IN CAULKS Sampling and Laboratory Methodology The Environmental Protection Agency (EPA) regulates PCBs and considers any debris generated from construction materials manufactured with PCBs derived from building renovation projects with a concentration of greater than 50 parts per million (ppm) as PCB bulk product waste. The Toxic Substances Control Act (TSCA) regulations (40 CFR Part 761) prescribes requirements for the proper management of PCB materials, including their handling and disposal. PCB bulk product waste at concentrations >50 ppm must follow specific storage, transport and disposal requirements. Watts collected five (5) bulk samples of suspect PCB-containing caulks and sealants that were identified within the project limits. Bulk samples were collected using simple hand tools from each matrix identified as a potential PCB-containing material. The samples were analyzed by Schneider Laboratories in Richmond, Virginia. Schneider Laboratories is a New York State Department of Health (NYSDOH) approved laboratory and participant in the National Voluntary Laboratory Approval Program (NVLAP). The samples were analyzed using USEPA SW-846 Method 8082, PCBs. The following table identifies all suspect materials identified, their corresponding sample numbers, and individual PCB Aroclor analytical results:
