Mandatory Grants: WSP/ATR

What is a Mandatory Grant ?

Mandatory Grants are paid by the Seta if the company fulfils the requirements to

receive the grants.

In order to qualify to receive the mandatory grant, the levy-paying employer has to meet the following criteria:

• Be registered in terms of the Skills Development Levies Act.

• Be an up-to-date levy-payer that is registered in terms of the Skills Development Levies Act. The skills development levy is imposed to encourage learning and development in South Africa and is determined by the employers’ salary bill. The levy is 1% of the salary bill. Companies with a wage bill of less than R500 000 do not have to pay this levy.

• All levy payments need to be up to date at the time of the approval and for the reporting period.

• Employ a skills development facilitator internally or externally .

• The WSP and ATR are submitted by the required deadline of 30th April each year .

• Any employer who has a recognition agreement with a trade union will have to provide proof that WSP and ATR have been subject to consultation with recognised trade unions and they have been signed off by the relevant union

Page 13: PowerPoint Presentation 20… · Title: PowerPoint Presentation Author: Given Ngomane Created Date: 3/19/2020 12:46:27 PM

What happens if you don’t submit or don’t submit on time?

• If the employer does not claim a mandatory grant by the deadline date, the

SETA must immediately (in terms of the relevant regulations) transfer the employer’s unclaimed mandatory grant funds to the discretionary grant fund.

• In terms of the relevant regulations, requests for extensions and late grant submissions will NOT BE ACCEPTED by the SETA.

• The penalty for submitting mandatory grant applications late is losing the grant in full.

• The only exception to this is where an application for the WSP is submitted within 6 months of registration in the case of an employer who has registered for the first time in terms of section 5(1) of the Skills Development Levies (SDL) Act.

• Businesses that wish to remain B-BBEE compliant and require Skills Development to be recognised on their B-BBEE Scorecard must submit the mandatory grant to the respective SETA before 30 April.

What is a Pivotal Training Plan and Report

• PIVOTAL Programmes mean professional, vocational, technical, and academic

learning programmes that result in occupational qualifications and may include a knowledge component that is normally delivered at a further education and training college or a university as well as structured learning in an accredited training centre of an approved workplace. Examples of the type of learning are, Professional Learning would be a BCOM for Accountants, Vocational Learning would be the National Certificate Vocational obtained from an FET college,

Training Learning would be N4 Electrical Engineering and Academic Learning would be the MBChB required for Medical Doctors that can only be studied at University.

• A Pivotal Training Plan – A strategic plan aligned to industry-specific scarce skills that may be required within the business. The plan serves as a summary of predictable training that will take place in the financial year after submission, in this case 2020.

• A Pivotal Training Report – A Scarce Skills report articulating the outcomes of the preceding year’s Pivotal Training Plan, in this case for 2019.

• The pivotal programmes assists in identify the needs of the sector in terms of what programmes we need to fund in the Discretionary Grant .

CHALLENGES WITH EVALUATION APPLICATIONS: PROOF OF TRAINING:

This is the main reason for delays in approval of applications for

payment:

1. Large number of inaccurate / incorrect pages• Duplicates of the same proof submitted even after sending a

query letter

• e.g. 20 certificates for the same tractor training for different

employees , (X)

• e.g. 1 invoice + 10 certificates + 5 pages of attendance

register for the same First Aid training done (X)

• Documentation for the incorrect year

• Still received unrelated documents

• DO NOT SEND ANY proof of payment, remittances, statements, registration forms, enrolment forms, program information, ID

copies, contracts, agreements, accommodation invoices, flight

invoices, petrol/ toll gate slips, catering/refreshment invoices etc.

All the above listed are not acceptable
