• New industrial relations policy – Fair Work Act legislation –1 July 2009.

• New Modern Awards 1 January 2010.

• Enhances union and industrial tribunal powers– Broad rights to enter the workplace– Automatic union representation of members– Virtual abolition of non-union agreements– Good faith bargaining and union content in agreements– Broader industrial tribunal and arbitration powers

The Half-Wit

A man owned a small farm.

The Workplace Ombudsman claimed he was not paying proper wages to his help and sent an inspector from Fair Work Australia (FWA) to interview him.

I need a list of your employees and how much you pay them," demanded the inspector.

"Well," replied the farmer, "There's my ranch hand who's been with me for 3 years, I pay him $1000 a week plus free room and board.

The cook has been here for 18 months, and I pay her $750 per week plus free room and board.

Then there's the half-wit who works about 18 hours every day and does about 90% of allthe work around here.

He makes about $10 per week, pays for his own room and board and I buy him a bottle of whisky every Saturday night.“

"That's the guy I want to talk to, the half-wit," says the FWA inspector.

Phase 2 Construction –Restoring the law(lessness)

• ABCC being abolished – January 2010.

• Wilcox QC appointed to hold inquiry for smooth transition to Fair Work Australia – separate FWA Division for Construction.

• Report released (3 April 2009) with recommendations, including:– New steps to compulsorily gather evidence. – Division to be overseen by a new advisory body.– Lower penalties for breaching the law.– 5 year sunset for Specialist Division.

– Unions ’24/7’ entry to workplaces if assisting HSRs– Unions investigating ‘alleged’ OHS breaches– Unions inspecting ‘documents’ on entry
