STANDARD TERMS AND CONDITIONS

We are pleased that you have selected {KF}tography for your on location photography services. {KF}tography is honored to photograph you and your family in our unique artistic style. This letter sets forth the terms and conditions of our engagement.

Entire Agreement:Entire Agreement: This agreement contains the entire understanding between {KF}tography and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties involved. If the parties want to waive one provision of this agreement that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.

Cooperation: Cooperation: The parties agree to cheerful cooperation and communication for the best possible result within the denition of this assignment. {The photographer will NOT be held accountable for not photographing desired people if there is no one to assist in identifying those individuals or gathering them for photographs. {KF}tography is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to {KF}tography before-hand.

Model Release: The CLIENT hereby grants {KF}tography and its legal representatives and assigns, the ir-revocable and unrestricted right to use and publish photographs of CLIENT or in which the CLIENT may be included, for editorial, trade, advertising, and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The CLIENT hereby releases {KF}tography and its legal representatives and assigns from all claims and liability relation to said photographs.

Limit of Liability: In the unlikely event that the Photographer is injured or becomes too ill to photograph the event, {KF}tography will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all pay-ments received for the event package. {KF}tography takes the upmost care with respect to exposure, trans-portation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond {KF}tography’s control, {KF}tography is limited to the return of all payments received for the event package. The limit of liability for a partial loss of originals shall be prorated amount of the exposures lost based on the percentage of total number of originals.

Weather Policy: If the CLIENT has been contacted and advised to reschedule due to the photographer’s con-cerns about the weather, and the CLIENT still proceeds with the session and it rains, limiting the time and or photos that were able to be taken, the CLIENT will be charged for an additional session at the photographer’s hourly rate of $200 per hour to reschedule or shoot additional photos. Due to photography equipment, it is up to the photographer’s discretion if bad weather persists to cancel the session, during the session.

If the CLIENT has been contacted and advised to reschedule due to the photographer’s concerns about weath-er, and the CLIENT decides to go ahead and reschedule, the CLIENT will not be charged to do so. The CLIENT will then be put on rst alert for their session and be able to have their session even on non-session days.

Exhibition: Requests for photographic images to be used by {KF}tography may be requested in future time. CLIENT grants {KF}tography permission to display selected images resulting from this assignment as an ex-ample of {KF}tography’s work and for entrance into photographic competitions and release all claims to prots that may arise from use of images.

If CLIENT’s photo is requested to be used in any print or online publication, they will discuss this with {KF}tography. {KF}tography grants CLIENT limited rights to use the images in marketing materials with speci-cations that photo by {KF}tography is listed on the images/article. If CLIENT requests to use the image in the distribution of products such as but are not limited to posters, clothing, etc a 5% compensation rate of the total number of sales will apply unless otherwise agreed upon in writing.

Outts: Although there are no additional fees for additional outts, the amount of time it takes to change into these outts does count towards the total amount of the session time.

TTardiness: In the event that the CLIENT is late to the appointment set, the CLIENT’s session will still be for the same scheduled ending time.

Props: The CLIENT is responsible for bringing any props that they would like in their photos.

Appearance: In the event that the CLIENT would like additional photos due to appearance out of our control (hair/makeup, etc.) in the previous session, the CLIENT will be charged for an additional session at the photographer’s hourly rate of $200, to reschedule or shoot additional photos.

LLocation Access and Fees: If the CLIENT wants to do a session at a location that charges for access, the CLIENT will be responsible to cover fees associated with shooting there, and all parking fees. They are also responsible for organizing the access any any permits related to doing so.

CCopyright/Printing Rights: Images produced by PHOTOGRAPHER are protected by Federal Copyright Laws and may not be reproduced in any manner by the CLIENT or others without explicit written permission from PHOTOGRAPHER. The proofs and or prints made by PHOTOGRAPHER or the CLIENT are the CLIENTS for per-sonal use by the CLIENT only. Prints may not be altered, scanned, or manipulated in any way as they still remain copyright of PHOTOGRAPHER.

Again, we look forward to combining {KF}tography’s unique art and style with yours to produce a reward-ing experience and set of photographs. Retainer fee of $________________ due at time of signing. A signed copy of this agreement with an invoice will be mailed to you. Your signature indicates that you have read, understand, and agree to be boundby all of the terms and conditions of this Agreement as pro-vided herein.

Completion Schedule: Editing and CD/DVD creation takes approximately four to six weeks. Prints take approxi-mately 2-4 weeks for order and delivery. Albums take approximately 6-8 weeks to design, order, and deliver. If completion will take longer for any reason, {KF}tography will notify the CLIENT as soon as possible. Initial album designs may take up to 4 weeks or longer to complete. Not more than six (6) weeks following such album selec-tions, CLIENT shall meet with {KF}tography to communicate any design changes desired by CLIENT. Following such meeting, any design changes requested by CLIENT will be charged at a rate of $75 per change.

Any and all defects in the photographs, images, les, or other products provided by {KF}tography shall becommunicated to {KF}tography within one (1) week of clients receipt of same, failing which CLIENT shall bebarred from making any claim for such defects.

Penalty Fees and Charges: There is a $50 charge on checks returned for any reason. {KF}tography is not held re-sponsible for items lost by the US Postal Service/UPS or invalid addresses on contact forms. In this event,the CLIENT must pay $50 for the second set of CD/DVD’s and shipping costs.

Print Ordering: Print orders will be taken at a proong session .This proong session will last 1 hour. During the proong session you will view images on a 50” projection screen. Print ordering is also availale online via CLIENT online gallery. Payment in FULL is required to order any prints/products unless they are included in a package and already paid for in advance.
