Whereas various Writ Petitions were filed, praying to direct

the respondents to adjust them on various posts which they are/were

holding and to with draw show cause notices issued to them or have

to readjust guest teachers who have been relieved due to various

Brief facts of the case are that some of the guest teachers

who were not having subject combinations or the requisite

qualifications, required under the relevant Service Rules at the time of

initial appointment on guest faculty basis including those who

completed the subject combination or the requisite qualification

subsequently while continuing on the said post as guest teacher, were

issued show cause notice for terminating their services. In addition to

this, some of the guest teachers, against whom regular teachers were

appointed on promotion or otherwise, were also relieved.

Subsequently, all the categories of teachers mentioned above filed

various Civil Writ Petitioners (CWPs) in the Hon'ble High Court and

the same have been disposed of with the following order dated

05.08.2011:-

"All these writ petitions are disposed of with a direction to

the petitioners to appear before the respective authorities which have

issued show cause notice in each case. The said authorities, after

obtaining replies to the respective petitioners to the show cause

notice, shall forward the case to the Director, Elementary Education,

by fixing a date of hearing before the Director in consultation with the

Director, Elementary, thereafter, would afford due opportunity of

hearing to the petitioners and pass an order in accordance with law.

The petitioners shall be at liberty to raise all the pleas that they may

wish to urge against the proposed action. Needless to mention that

the Director in accordance with law. If any of the petitioner makes a

request for being represented by a counsel, the same shall be

considered by the Director and appropriate order made thereon. The

interim order passed in favour of the petitioners shall continue till the

date of decision by the director."

The present petitioner filed CWP No. 8203 of 2011 titled as

Smt. Minakshi V/ s State of Haryana and others and the same was

Naresh Kumar V/s State of Haryana decided on 05.08.2011 as

detailed above. She was appointed as S.S. Mistress on 16.10.2006 in

GSSS Chhatar (find) and still continuing as guest teacher there she

did not fulfill the qualification prescribed under service rules at the

time of appointment as guest teacher. Later on she acquired the

qualification by clearing subject combination in the year 2008 while

continuing as guest teacher.

I have gone through the Hon'ble Punjab and Haryana High

Court Order dated 05.08.2011 passed in CWP No. 4587 of 2011 as

detailed above, Hon'ble Punjab and Haryana High Court order dated

30.03.2011 passed by 1st Division Bench in CWP No. 6090 of 2010

tided as Tilak Raj V/s State of Haryana, order dated 23.11.2011

passed in CWP No. 6613 of 2011 titled as Smt. Suman Rani V/s State

of Haryana & Others, application of the said incumbent dated

26.09.2011 and various instructions and guidelines issued pertaining

to the appointment/adjustment of guest faculties in schools. Since

the petitioner has now acquired prescribed qualification while

continuing as guest teacher. Hence, it would be just, fair and

equitable to re-adjust Smt. Minakshi on the said post in accordance

with adjustment guidelines of the Department dated 02.12.2008 and

the said incumbent. Smt. Minakshi will continue upto 31.03.2012

only as per judgement in Tilak Raj's case (Supra).
