This presentation will deal with these and other governmental audits, including what they include, the provider’s rights and responsibilities, and how to handle the audit. The new Independent Informal Dispute Resolution Process will also be discussed, including when it is available, how it is conducted, and how to prepare properly. In addition, the latest regulatory case law will be discussed, including how a single word can impact your date of correction, how to prove your date of correction when the survey is late, and how to avoid the most common deficiencies.

Two recent opinions out of the Florida Supreme Court (Shotts v. OP Winter Haven and Gessa v. Manor Care of Florida, Inc.) attack the use of arbitration agreements in long term care facilities. Despite federal policies encouraging arbitration, these decisions create new avenues to more easily invalidate arbitration agreements in the long term care setting. This presentation explains the substantive and procedural impacts of these decisions and provides guidance on how to protect your facility’s ability to arbitrate.

Along the way, attendees will learn about resources available to help health care facilities improve their level of preparedness and response.

All skilled nursing facilities will be required to have a QAPI program by 2013 in accordance with the Affordable Care Act. In order to assist nursing homes to fulfill this new mandate to improve their services, CMS is in the process of developing and testing materials and resources for QAPI that will eventually be sent to all nursing homes. Florida’s four nursing homes’ participation in the CMS demo will be highlighted, with their year-long experience of QAPI implementation and discussion by a QAPI grant consultant. A key concern for discussion is how to overcome consumer advocates’ skepticism of a provider-driven QAPI process.

Many questions remain unanswered as we sort through health reform’s complicated requirements and sometimes unwritten rules. A couple of the most influential trends in health care today are Accountable Care Organizations (ACOs) and Value-Based Reimbursement (VBR). ACOs are meant to redistribute the risk in managing episodes of care. Concurrently, Value-Based Reimbursement is being introduced as an approach in which regulators inspect post-discharge care and how patients are managed. This presentation will review the current thinking on VBR, compare the past with the present and the likely future, and discuss key metrics that can help providers prepare for and excel in this new environment.
