1 CREATIVE OPPORTUNITY The creative opportunity is open to Victorian Aboriginal artists. Applicants must be Aboriginal or Torres Strait Islander. This is a special measure under section 12 of the Equal Opportunity Act 2010 (Vic).The Ballarat Line Upgrade Alliance (the Alliance) is seeking an artist or collective (the Artist) to develop a series of public works that will be delivered within the public realm across the five (5) stations that form part of the Ballarat Line Upgrade. It is expected that these public works will explore Aboriginal themes, connect with local communities, and deliver a high quality creative legacy for present and future generations. The Artist will be responsible for developing the concept and working alongside the Alliance’s landscape architecture team to produce designs that can be realised in the forecourts of the stations. The creative opportunity is suitable for creative practitioners at mid-career or senior level.

The Regional Rail Revival (RRR) program, is a joint initiative of the Australian and Victorian governments that will see upgrades across all regional passenger train lines in Victoria. As part of the RRR program, the Ballarat Line Upgrade (BLU) includes a series of improvement works to the Rockbank, Bacchus Marsh, Ballan, and Wendouree stations, with a new station being built at Cobblebank. The project is being delivered by Rail Projects Victoria (RPV), on behalf of the Victorian Government, in alliance with Lendlease, Coleman Rail and SMEC, and V/Line (the Alliance).

1.1 THE COMMISSIONThe commission is for the development of creative concepts and designs only, and these will be applied in the public realm areas, including station entrances and forecourts, at each of the five (5) stations. The commissioned designs at each station will play an important role in creating a sense of arrival at each of the stations. The design should inspire an experience of journey across the Ballarat Line.

This appendix to this document includes indicative concept plans for Rockbank, Bacchus Marsh and Ballan station precincts to assist artists in responding to Stage 1 of this Creative Brief. Plans for all stations in the scope will be provided at Stage 2 to inform concept development.

While the commission is for concept and design, this EOI requires initial concept ideas only (please refer to section 1.4 for submission process). The project teams delivering the landscape build program will fabricate and implement the creative work. The material palette that the Artist will have to work with includes:

Paved areas comprising blue stone, colour-treated and un-treated concrete, and sandblasted banded concrete

Pre-cast concrete low seating walls Potential to consider interfaces with soft landscape areas.

1.2 THEME: THE SEVEN SEASONSThe Alliance acknowledges that the Kulin People have a rich system of knowledge and understanding of country and its ecology. This living cultural knowledge encompasses biodiversity, climate, land and waters, people and culture. The Seven Seasons relate to climatic features and ecological events such as plant flowering, fruiting, and animal behavioural patterns that naturally occur at different times across the year. Celestial arrangements and the changing angles of the sun can also inform understanding of the Seven Seasons. These Seven Seasons include: Iuk (eel), Waring (wombat), Guling (orchid), Porneet (tadpole), Buath Gurru (grass flowering), Kangaroo-apple, and Biderap (dry) season.

The Artist will engage with the Seven Seasons through the concept and designs for public realm works at each of the stations. The Artist should offer a holistic approach that supports a line wide identity, but each creative intervention should respond uniquely to the local area character and design principles of the individual stations. Artistic responses must be considerate and respectful of the customs and culture of Traditional Owners.

1.3 SUBMISSION PROCESSStage 1: Expression of InterestIn this first stage, artists are asked to respond to the creative brief in text only. The requirements are listed below:

1. In no more than 600 words, tell us how your proposed concept responds to the creative brief including the theme and material palette, local site context or line wide identity

2. In no more than 400 words, provide a description of your current artistic practice and why this project is of interest to you

3. Any preliminary or rough sketches that may help you illustrate your proposal (we do not expect detailed drawings or concepts at this stage)

4. No more than five (5) images of your previous work

5. You may provide links to websites showcasing your work

6. All submissions must be received by 5 PM Friday 23rd November 2018, anything received after this date will not be considered

7. Submissions must be sent by email to: [email protected]

From this process, a shortlist will be selected by the BLU Creative Advisory Panel.

Only shortlisted submissions from Stage 1 will proceed to Stage 2.

Stage 2: Concept Development In this stage, the shortlist will be asked to develop their concepts through the following process:

1. 1000 word (max) describing the concept, including how the concept will be integrated with the built form and public realm, and the creative and cultural approach

2. Visual renders or images of your proposed artwork

3. Suggestions for community engagement that may support the realisation of concept.

The shortlist may be asked to present their concepts in person to the BLU Creative Advisory Panel as part of this process.

From this process, an Artist will be commissioned to progress to Stage 3. The preference is for one (1) commission, however multiple commissions may be entered into at the discretion of the Alliance.

Stage 3: Design and ImplementationThe commissioned Artist will attend four (4) to six (6) workshops with the Alliance design team, which will include site visits. The workshops are envisaged to involve the following:

Initial briefing with the Alliance design team (includes site visits)

Artist presents detailed concept designs to the Alliance

Engagement with Traditional Owners including Registered Aboriginal Parties (RAPs) and Aboriginal communities

Alliance design team documents designs in collaboration with the Artist

Artist presents interpretative material accompanying concept designs.

Schedule and timings will be discussed in detail with the Artist upon award of contract. More sessions may be added depending on project requirements.

Engagement with Traditional Owners will be facilitated by the Alliance.

1.4 ARTIST FEESStage 1: Expression of InterestFees will not be paid for the submission of an Expression of Interest (EOI).

Stage 2: Concept Development The shortlist selected from the EOI to proceed to Stage 2: Concept Development will be paid an honorarium of $3000 (GST incl.) to develop their concepts. The honorarium will be paid upon submission of a concept that meets the requirements set out at 1.3 Submission Process.

Stage 3: Design and ImplementationThe total commissioning fee payable to the commissioned Artist(s) will be commensurate with the scope of services to be provided and the artist’s level of experience, public profile and standing with the Victorian Aboriginal community. The total commissioning fee for all works (inclusive) will range from $50,000 to $75,000 (inclusive of GST).

Documentation and construction costs of the project will be covered by the Alliance.

2 CONTEXTUAL INFORMATION

2.1 ROCKBANK STATION (REBUILD)Rockbank Station is located adjacent to the existing Ballarat rail line approximately 1km north-west from the existing residences of Rockbank. The station is approximately 800m south from the Western Freeway. The forecourt and station entry are central features of Rockbank Station. The composition and arrangement of furniture, paving materials and planting has been designed to create welcoming spaces for people and passengers. There are three seating nodes on the perimeter of the station entrance which are accentuated by blue stone paving. Further integrated seating is located beyond the stairs.

The arrangement of natural boulders – a symbol of the local geology – presents a tactile design element in the forecourt. Larger boulders (2.5m) have been positioned as gateway elements and these transition to smaller boulders (0.75m) towards the entrance. This transition, along with the contrasting paving surfaces, provides form and informal direction for passengers.

The use of natural boulders and tall native trees introduces strong natural elements into the built environment. These natural elements offer texture, shade and vertical structure to the station forecourt. The Artist may choose to reference these natural elements in their concept designs.

2.2 NEW STATION AT COBBLEBANKThe new station at Cobblebank is situated south of the Western Freeway, less than 10km west of Rockbank Station. The Station Precinct is currently underdeveloped and the existing uses in the area are predominantly industrial, but residential areas are steadily growing in the vicinity.

The forecourt of the new station at Cobblebank has been designed to serve as a connection to the future town centre. The overpass is considered a visual continuation of Station Street, a gesture and linked connection to the future civic space. The tree planting along Station Street will continue through the forecourt and provide visual connection with the overpass.

The new station forecourt features quality coloured concrete paving with textured banding. Seating nodes are positioned throughout the forecourt, some accentuated by coloured concrete paving, and timber seating has been located near trees to provide shade. On the western side of the forecourt, curved garden beds will provide topography and relief to the flatness of the forecourt.

The existing site of the station is flat and sparse with predominantly native grassland, scattered native shrubs and small trees. The future character of the area will be vastly different, with large commercial, retail and civic buildings as well as higher density residential development. The Artist may consider change and transformation in context of the new station at Cobblebank and future town centre.

2.3 BACCHUS MARSH STATION (UPGRADE)Bacchus Marsh Station is located 1.2km south of the Bacchus Marsh town centre and 400m south of the Werribee River. The station is surrounded by a mixture of land uses including residential, farming and industrial zones.

The public realm design of Bacchus Marsh Station reinforces the relationship between the new and the old through materiality and form. The heritage character of Maddingley Park, the turntable and existing station buildings are referenced in a contemporary public realm design which acknowledges the station’s European past.

A more formal planting approach has been adopted for Bacchus Marsh Station. The selection of vibrant specimen species, native hedge-like planting and featured deciduous trees continues the landscape palette of Maddingley Park.

The northern forecourt extends from the existing station building through to the platform entrance and new overpass. This forecourt features blue stone paving, furniture and banded aggregate within concrete paving. English oak trees flank the western edge of the forecourt, frame the existing turntable and continue across the rail line to the southern forecourt, to extend the landscape character of Maddingly Park into the station. The landscape theme continues in the southern forecourt.

The Artist may consider both the Aboriginal and post-contact character and geographies of the area.

2.4 BALLAN STATION (UPGRADE)Ballan Station is located between Stead Street and the level crossing on Cowie Street. The station is located approximately 400 metres to the south of Ballan Town Centre.

Ballan Station’s public realm design references the contrasting context of the area; from the orderly structure of Ballan’s streets to the north and the rural farmland character to the south.

Key existing station features have been retained in the new design including the water tower, existing station building and maintaining the sight lines and vista to the town centre.

The composition of paved banding and specimen planted gardens reinforces the ordered nature of the Ballan street network and the garden identity of the Ballan Township. The banding and gardens will create a sense of transition from township to farmland. The Artist may choose to explore this transition through a strong graphical response or consider a more conceptual approach.

2.5 WENDOUREE STATION (UPGRADE)The existing Wendouree Station is near an Industrial Use Zone on the northern western rural-urban fringe of Ballarat.

Wendouree Station will be upgraded through landscape improvements. The entrance to Platform 1 will be improved by providing a larger elevated forecourt that is separate from a lower forecourt space and the carpark.

The lower forecourt space is being modified to accommodate additional trees and low garden beds. The composition and location of tree planting and garden beds, will provide shade, reduce the heat island effect and create separation between the forecourt and vehicle traffic.

3 SELECTION PROCESS AND LEGAL INFORMATION

3.1 SELECTION PROCESSOnce submissions have been received, the BLU Creative Advisory Panel will shortlist an applicant or applicants to develop their concept. The Panel may comprise BLU Alliance (chair), Rail Projects Victoria, Creative Victoria, Office of the Victorian Government Architect (OVGA) and an Aboriginal arts and culture specialist invited by the Alliance. The BLU Creative Advisory Panel will then make a recommendation to the Alliance. The Alliance will manage artist contracts, construction documentation and fabrication/installation of the artworks.

The following points will be considered in the selection process: Response to brief – the submission demonstrates a clear understanding of the Project, themes,

and the nature of the commission

Site-specific – the concept responds to the local character and history of the site

Community responsiveness – the concept demonstrates respectful responses to the outcomes of community and stakeholder engagement, including Aboriginal cultural heritage

Practical – the scope of the submission is realistic and can be delivered on time and budget

Appropriate – the artwork’s content and messaging are suitable for display in high profile public places

Visibility – the concept can be reproduced at large scale and remain vibrant and legible in a public space

Originality – the submission offers a new and innovative interpretation of themes

Previous work – the Artist has demonstrated potential to deliver high quality outcomes

Flexibility and collaboration – the Artist’s ability to work in a flexible and collaborative way to ensure successful completion of the commission; noting project conditions and requirements are subject to change

Communication and responsiveness – the Artist’s willingness to communicate effectively within agreed timelines

Level of standing and respect – the Artist’s work is accepted as being consistent with cultural values of Victorian Aboriginal communities.

3.2 IMPLEMENTATIONThe Artist, if successful, will be required to sign a contract with the Alliance for the delivery of the commission. The Artist must follow all reasonable requests made by the Alliance. The Artist must work with the Alliance to support construction documentation and fabrication/installation of the artwork.

3.3 PROJECT TIMINGApproximate timing for key milestones is provided below. Schedule and timings will be discussed and confirmed in detail with the artist upon award of contract. The Artist is to confirm their availability to work during the specified period and meet the milestones.

3.4 COPYRIGHT, IMAGES, CONFIDENTIALITY

3.4.1 COPYRIGHT Copyright of the artwork remains with the Artist however by undertaking this commission, the expectation is that the Artist provides Rail Projects Victoria and the Alliance full rights to use images of the artwork and/or images of the artwork in situ, without restrictions (excluding commercial purposes).Ownership in the physical artwork produced for the Commission vests in the Alliance and will be transferred to the State of Victoria or delegate Authority or Franchisee.

Intellectual Property Rights in materials produced for the Commission will be dealt with in a manner consistent with the Whole of Victorian Government Intellectual Property Policy (2012). Accordingly, the Artist will retain ownership of the intellectual property rights in the material produced for the Commission; subject to the Artist granting to the State of Victoria and the Alliance a non-exclusive, perpetual, irrevocable, worldwide and royalty free licence to use images of the artwork and/or images of the artwork in situ, (and sub-licence to use images of the artwork and/or images of the artwork in situ) produced for the Commission, for the purposes of the Regional Rail Revival Program (excluding commercial purposes).

3.4.2 INDIGENOUS CULTURAL AND INTELLECTUAL PROPERTY RIGHTSThe Alliance and Rail Projects Victoria acknowledge Indigenous Cultural and Intellectual Property Rights through the following principles:

1. Respect

2. Indigenous control

3. Communication, consultation and consent

4. Interpretation, integrity and authenticity

5. Secrecy and confidentiality

6. Attribution and copyright

7. Proper returns and royalties

8. Continuing cultures

9. Recognition and protection.

3.4.3 DOCUMENTATION OF ARTWORKSEach artwork may be documented by still and moving image. Images will be shared with the artist. The sharing of documentary images and select information concerning the commission with third party

organisations for presentations, education or academic purposes, knowledge sharing, or archiving, will be at the discretion of Rail Projects Victoria and the Alliance. Appropriate consent forms will be provided with parental consent sought for any imagery of children under the age of 16.

3.4.4 CREDITING OF ARTWORKSIn all instances, Rail Projects Victoria and the Alliance will aim to correctly credit the Artist as the creator of the artwork in a reasonably prominent position near the Artwork. The Artist should indicate to the Alliance how they wish to be credited.

If the artwork involves the use of any Indigenous cultural intellectual property, Rail Projects Victoria and the Alliance will display acknowledgement in a reasonably prominent position near the installed Artworks which identifies the appropriate custodial interest and permitted use.

3.4.5 SOCIAL MEDIARail Projects Victoria and the Alliance’s digital channels will be used to promote the commission(s). The Artist must be aware that their artwork will be shared on social media through these channels. Rail Projects Victoria and the Alliance are not responsible for any reposting of images outside channels associated with the Project. Where practical, the Project will endeavour to appropriately tag and credit images of the artwork. It is expected that the Artist employs appropriate discernment and judgement when posting images relating to the commission on social media.

3.4.6 PUBLICITY AND MEDIA RESPONSIBILITIESThe Artist must not directly publicise details of the commission, including via media or social media, without prior approval by the Alliance and Rail Projects Victoria. The Artist should be willing to participate in media, social media, and events to promote their work in context of the Project, as required by the Alliance and Rail Projects Victoria. Appropriate media support and training can be provided.

3.4.7 CONFIDENTIALITY REQUIREMENTSThe Artist will (and will ensure that its employees, agents and advisers will):

Use and reproduce Confidential Information only to perform its obligations under this Agreement Not disclose or otherwise make available Confidential Information other than to personnel who have

a need to know the information to enable the Artist to perform its obligations under this Agreemento All Confidential Information will remain the property of the Alliance and/or Rail Projects

Victoria and all copies or other records containing the Confidential Information (or any part of it) must be returned by the Artist to the Alliance and/or Rail Projects Victoria on termination or expiry of this Agreement

The Artist acknowledges that the Alliance and/or Rail Projects Victoria will be entitled (in addition to any other remedy it may have) to seek an injunction or other equitable relief with respect to any actual or threatened breach by the Artist of this requirement and without the need on the part of Alliance and/or Rail Projects Victoria to prove any special damage.

3.5 MAINTENANCE, DISPLAY, DECOMMISSIONING

3.5.1 MAINTENANCE OF ARTWORKSThe maintenance of project sites remains the responsibility of the Project and land manager, as appropriate. All reasonable measures will be taken to ensure that commissioned artworks are maintained in accordance with standard maintenance procedures.

3.5.2 DECOMMISSIONING OF ARTWORKSThe works will be installed in the public realm and may be decommissioned in the future at the discretion of the asset owner. Works will be photographed following installation and a digital copy of images will be provided to the Artist.
