Police report was taken by Detective Steve Weir of the Pismo Beach Police Department and Investigator A.J. Santana from the San Luis Obispo District Attorney's office. Their conclusion was that Alan's assertions did involve criminal matters and should be further investigated. They asked Alan to provide additional evidence which he did. Alan boxed up all the documents in four boxes and went to the Pismo Beach Police Station as instructed. When he got to the police department, suddenly their attitude changed and he was told it was too much evidence and that he had to reduce it all down to ten pages. The case was filed as a criminal case, but was later dismissed by a deputy district attorney for not having enough evidence.

:f.).herne told us at one time he was the CFO of the HOA of the 6 unit complex. During this time the cl1ecks from the owners for HOA dues were sent directly to the bank. Aherne said he would enter *~·m on the computer. When B&W Management took over he was no longer the CFO as he had r~~ i'gned . They took over the HOA, calling it a corporation,~opting corporate by laws. Aherne said

pdinted out that the current balance in the associations reserve account Wfl-?,. $22,400 and the "Ideal Reserve Balance" was reconunended to be $44,355.

This report also included a "Reserve Contribution Model", which suggested

~ih~at type of increases should be made to bring the reserve account up to thf,~ recommended levels. Woods told me that this study was used to set the

This money belonged ~9 : all of the association members, which would be based on the square fs~tage each association member owned.
