    The promulgation of the Rule of Procedure on Small Claims Cases by the Supreme Court is a refreshing change. It is a grab bag of innovations in the field of law as it provides for a much simpler procedure of litigation for small claims by doing away with appeals and barring the presence of counsel during hearings. As such, it requires greater participation from judges in resolving conflicts.

    Thus, this handbook is a welcome tool for judges and clerks of court in the field and enables them to put into effect such innovatory rules. This will go a long way in providing access to the courts and delivering timely and complete justice to our people.

    Once more, the Philippine Judiciary Academy (PhilJA) is grateful to the United States Agency for International Development (USAID) and the American Bar Association Rule of Law Initiative (ABA ROLI) for their unwavering support in the training of judges and court personnel on their roles and responsibilities in the entire small claims process.

    FILING FEES FOR SMALL CLAIMS CASES

    1. Aside from the fees prescribed under Sec. 8 (a) and Section 10 (a) of Rule 141 as amended, Legal Research fees, Victims Compensation fees and Mediation fees, additional filing fees for frequent filers shall be collected.

    If more than ten (10) small cl aims are filed by one party in the court station within the calendar year, an additional filing fee of P500.00 shall be paid for every claim filed after the tenth (10th) claim, and an additional P100.00 or a total of P600.00 for every claim filed after the twentieth (20th) claim, and another P100.00 or a total of P700.00 for every claim filed after the thirtieth (30th) claim, and another P100.00 for every tenth additional case thereafter, progressively and cumulatively, but the total filing fees shall not exceed P20,000.00. In no case shall a party pay filing fees of more than P20,000.00 per claim in a calendar year.1

    Example: from 11th to 20th claim - additional P500.00 from 21st to 30th claim - additional P600.00

    (P500 + P100) from 31 st to 40th claim - additional P700.00

    (P500 + P100 +P100)

    from 41st to 50th claim additional P800.00

    (P500+P100+P100+P100)

    so on and so forth 1,400th claim - P20,000.00

    3.

    Each party filing a claim shall declare in the Statement of Claim the number of small claims cases that party filed in the court station within the calendar year.2

    4.

    In no case shall a party, even if declared an indigent, be exempt from the payment of the P1,000.00 fee for service of summons and processes in civil cases.3
