1 EXECUTIVE SUMMARY

JTL Environmental Services (JTL) has conducted a Phase II Environmental Site Assessment (ESA) on behalf of Heights Metal Works for the property located at 1212 E. 28th Street in Houston, Harris County, Texas. The assessment was performed in general accordance with the scope and limitations of the American Society for Testing and Materials (ASTM) Standard E 1903-02. The property consists of approximately 15,000 square feet of land currently developed for commercial use. At the time of the reconnaissance, the unoccupied Site consisted of a single-story metal warehouse. A Phase I ESA was prepared by JTL on February 20, 2013. The Phase I assessment identified no recognized environmental condition in connection with the site as described below. However, based on the lack of subsurface information, at the request of Heights Metal Works a limited Phase II ESA was conducted to form the presence or absence of site contaminants. The scope of the Phase II ESA was intended to address the environmental condition of subsurface soils and groundwater at the site. Subsurface soils and groundwater were collected and analyzed for the following indicator contaminants: Total Petroleum Hydrocarbons (TPH) by TCEQ Method TX1005; Volatile Organic Compounds (VOCs) by EPA SW846 Method 8260B and RCRA (8) Metals by EPA SW846 Method 6010B. The laboratory results of the samples collected indicated no contaminant concentrations above the TCEQ Protective Concentration Levels for soil or groundwater. JTL recommends that no further environmental assessment is necessary at the Site.

2 INTRODUCTION

JTL conducted a Phase II Environmental Site Assessment (ESA) at the property located at 1212 E 28th Street, Houston, Harris County, Texas. The purpose of the Phase II ESA was to determine the presence or absence of contaminants in the subsurface related to the activities that have occurred at or in the vicinity of the subject property. This report documents the scope of work, field investigation activities, laboratory analyses and evaluation of data with respect to the recognized environmental condition assessed. The assessment was conducted in general accordance with ASTM Standard E 1903-02, Standard Guide for Environmental Site Assessments: Phase II Environmental Site Assessment Process.

2.1 SITE DESCRIPTION

The property address is 1212 E. 28th Street in Houston, Harris County, Texas. The Site consists of approximately 15,000 SF of land. The western portion of the Site is occupied by an approximately 7,900 SF metal warehouse which contains several areas built out as office space. The building is currently unoccupied containing numerous wooden pallets and general debris. The eastern portion of the Site has a gravel surface and is enclosed by a metal siding fence. The southeast portion of the Site is covered by a metal roofed cover The United States Geological Survey (USGS), “Houston Heights, Texas” Quadrangle, 7.5 minute series topographic map dated 1980, was reviewed. According to the contour lines on the topographic map, the property is located approximately 65 feet above mean sea level. The contour lines in the area of the property indicate the area is basically flat with a gentle slope to the southeast. Figure 1 illustrates the site layout.

2.2 PROJECT BACKGROUND A Phase I ESA was prepared by JTL and issued on February 20, 2013. The Phase I assessment identified no recognized environmental conditions in connection with the site.

• However, based on the request of Heights Metal Works and the lack of confirmatory subsurface information, a Phase II ESA was conducted at the subject property.

2.3 PURPOSE AND SCOPE

The purpose of the Phase II ESA was to determine the presence or absence of contaminants in the subsurface related to the paint manufacturing activities that have occurred at the subject property. JTL relied upon the previously discussed background information to develop the scope of work for this investigation. The general scope of the Phase II ESA consisted of a limited subsurface investigation to include soil and groundwater sampling and analysis.

3 ASSESSMENT ACTIVITIES

Field investigation and sampling activities were conducted on February 22, 2013, under the supervision of Mr. John Lembcke, Environmental Scientist for JTL. Drilling of three (3) soil borings was performed by Best Drilling of Houston, Texas. Locations of the soil borings are illustrated on Figure 1. The three (3) soil borings were advanced to a maximum depth of 28 feet below ground surface (bgs). The soil probes were collected at 5-foot intervals with a 2-inch diameter sampler. The soil borings were designated borings SB-1 through SB-3. Groundwater was encountered during the advancement of these soil borings at approximately 25 feet below ground surface (BGS) therefore temporary groundwater wells were installed. The JTL field scientist observed the probing procedures to visually classify soils in accordance with the Unified Soil Classification System. The soil stratigraphy at the subject site was generally constant between soil borings. All reusable sampling equipment was decontaminated prior to each boring using a phosphate-free detergent and rinsing in distilled water. Upon completion of the investigation, all soil borings were abandoned by backfilling with bentonite pellets. A total of three soil samples were collected and labeled according to the boring and depth interval of sample retrieval. Soil samples were transferred into laboratory-supplied glassware consisting of wide-mouth, pre-cleaned jars with teflon seals and preweighed volatile organic analysis 40 mL glass vials with polytetrafluoroethylene (PTFE) lined caps. Three groundwater screening samples were collected for Volatile Organic Compound analysis in 40 mL glass vials with PTFE-lined caps. The groundwater samples were labeled according to the boring of sample retrieval. In addition, three groundwater screening samples were collected for metals analysis into 1000-milliliter wide-mouth plastic bottles with nitric acid preservative. The samples were labeled with date, time, and identification number and placed in a cooler with ice while awaiting transportation to the analytical laboratory. Proper sample handling was accomplished under chain-of-custody protocol. The samples were transported to the state-certified laboratory facilities of Accutest Laboratories, Inc., in Houston, Texas. The soil and groundwater samples were analyzed for the following indicator contaminants: Total Metals by Method 6010B; TPH TX1005 Method; and Volatile Organic Compounds (VOCs) by Method 8260B. The detected compounds were compared to the Texas Commission on Environmental Quality (TCEQ) Texas Risk Reduction Program (TRRP) Tier 1 Protective Concentration Levels (PCLs). A complete copy of the laboratory analytical report is provided in Appendix B, and a summary of the analytes detected in soil is provided in Tables 1 and 2.

4 DATA ANALYSIS & INTERPRETATION

The results of the laboratory analyses are presented in Tables 1 and 2. Boring logs, and laboratory reports are provided in Appendices A and B. Where appropriate, the results are compared with regulatory limits for the chemicals and compounds identified in the applicable media.

4.1 SITE HYDROGEOLOGICAL CHARACTERISTICS

The description of the subsurface conditions provided herein was derived from on-site observations of soil samples and cuttings collected only from the locations where borings were installed. The soil stratigraphy at the subject site was generally constant between soil borings. Based on observations of soil samples and cuttings, the general soil stratigraphy is characterized as follows:

• The upper three feet generally consisted of dark brown backfill material. At approximately 3 feet bgs the soil was a tan silty clay with red mottling. Between 16 and 25 feet, the soils generally consisted of red stiff clay. A sandy clay was again encountered from approximately 25 to 28 bgs.

Groundwater was encountered at approximately 25 feet bgs in each of the three (3) soil borings.

4.2 LIMITED SUBSURFACE INVESTIGATION ANALYTICAL RESULTS

The laboratory analytical results were compared the Texas Commission on Environmental Quality (TCEQ) Texas Risk Reduction Program (TRRP) Tier 1 Protective Concentration Levels (PCLs) for commercial and industrial sites with a 0.5-acre source area. The analytical results of the groundwater sampling, summarized in Table 1, indicate that soil samples contained metal analyte concentrations above the state regulatory levels as described below: As summarized in Table 2 and Table 3, none of the six soil samples collected contained concentrations of the Volatile Organic Compounds (VOCs) or Semi-Volatile Organic Compounds (SVOCs) which were analyzed.

4.3 ESTIMATED LAB VALUES

Analytical results designated with a “J” code on the analytical report and the summary of laboratory results were reported to be below the quantitation limit. Although these compounds were detected, they were present at concentrations too low to accurately quantify. As such, the compounds occurrence at the site is equivocal.

5 CONCLUSIONS AND RECOMMENDATIONS

JTL has performed a Phase II Environmental Site Assessment in general conformance with the scope and limitations of the ASTM Standard E 1903-02 guide for the property located at 1212 E. 28th Street Houston, Texas. Based on an evaluation of the findings of this assessment, the following conclusions and recommendations have been developed. Based on the findings of the limited subsurface investigation, JTL believes that no contaminants of concern are present in the subsurface soil or groundwater at the subject site. No additional site assessment is recommended at this time.

7 WARRANTY

JTL warrants that the findings and conclusions reported herein were conducted in general accordance with ASTM Standard E 1903-02 protocol. These methodologies are described by the standard guide as representing good commercial and customary practice for conducting a Phase II Environmental Site Assessment of a parcel of property for the purpose of evaluating recognized environmental conditions. However, these findings and conclusions contain all of the limitations inherent in these methodologies which are referred to in the standard guide and some of which are more specifically set forth below. The Phase II Environmental Site Assessment has been developed to provide the client with information regarding apparent indications of recognized environmental conditions relating to the subject property. It is necessarily limited to the conditions observed and to the information available at the time of the work. The assessment and conclusions presented herein were based upon the subjective evaluation of limited data. They may not represent all conditions at the subject site as they reflect the information gathered from specific locations. JTL warrants that the findings and conclusions contained herein have been promulgated in accordance with generally accepted environmental investigation methodology and only for the site described in this report. Due to the limited nature of the work, there is a possibility that there may exist conditions which could not be identified within the scope of the assessment or which were not apparent at the time of report preparation. It is also possible that the testing methods employed at the time of the report may later be superseded by other methods. The description, type, and composition of what are commonly referred to as "hazardous materials or conditions" can also change over time. JTL does not accept responsibility for changes in the state of the art, nor for changes in the scope of various lists of hazardous materials or conditions.
