Environmental Protection (BelvoirAmphitheatre) Exemption Order 1999

Made by the Minister with the approval of the Governor in ExecutiveCouncil under section 6 of the Act.

1. Citation

This order may be cited as the Environmental Protection(Belvoir Amphitheatre) Exemption Order 1999.

2. Definitions

In this order —

“AS 1055.1-1989” means the Australian Standard sodesignated, and as amended from time to time, that ispublished by the Standards Association of Australia, andincludes a reference to an Australian Standard made insubstitution for it;

“Belvoir Amphitheatre” means the venue of that name in theShire of Swan, as indicated on the plan in Schedule 2, andincludes the area of land adjacent to that venue indicated onthat plan;

“commencement” means the day on which this order comesinto operation;

“concert” means a musical, dance or vocal event held at theBelvoir Amphitheatre that has a duration of more than onehour;

“dB” means decibel;

“Director” means the Director of the Pollution PreventionDivision of the Department of Environmental Protection,141 St George’s Terrace, Perth, Western Australia;

“L Aeq, 1 min” means the equivalent continuous A-weighted soundpressure level in decibels as specified in AS 1055.1-1989determined over a measurement period of one minute with

sound level measuring equipment that complies withSchedule 4 to the Noise Regulations;

“L Ceq, 1 min” means the equivalent continuous C-weighted soundpressure level in decibels as specified in AS 1055.1-1989determined over a measurement period of one minute withsound level measuring equipment that complies withSchedule 4 to the Noise Regulations;

“Noise Regulations” means the Environmental Protection(Noise) Regulations 1997;

“promotion” means a musical, dance or vocal event held at theBelvoir Amphitheatre that has a duration of not more thanone hour;

“reporting period” means (except in the first entry in the Tableto clause 3(1) of Schedule 1) a period beginning on 1 Julyof each year and ending on the following 30 June duringwhich this order is in operation;

“sound level”, in relation to a concert or promotion, means thelevel of noise emitted by the concert or promotion;

“venue operator” means Jingle Holdings Pty Ltd(ACN 009 244 660).

3. Declaration of exemption

(1) Part V of the Act and, subject to clause 9 of Schedule 1, theNoise Regulations are declared not to apply to the sound levelsproduced by concerts and promotions held at the BelvoirAmphitheatre.

(2) The declaration under subclause (1) is subject to the conditionsspecified in Part 2 of Schedule 1.

4. Requirement to comply with conditions

The venue operator is required to comply with the conditionsspecified in Part 2 of Schedule 1.

5. Review of order

The Minister is to carry out a review of the operation andeffectiveness of this order —

(a) in respect of the period from commencement to30 June 1999; and

(b) in respect of each reporting period,

within 3 months after the end of that period.

6. Revocation and repeal

The declaration under the Environmental Protection (BelvoirAmphitheatre) Exemption Order 1997 is revoked, and that orderis repealed.

Schedule 1 — Conditions of exemption[cl. 3(2)]

Part 1 — Preliminary matters

1. Interpretation of certain references to concerts and promotions

Except in clauses 5(3), (4) and (6) and 10, a reference in this Scheduleto a concert or promotion is taken to include a reference to any soundchecking and testing, practising or rehearsing that takes place at theBelvoir Amphitheatre in connection with the concert or promotion.

2. Calculation of sound units

(1) Except as stated in subclause (2), the number of sound units producedby a concert or promotion is, for the purposes of this Schedule, theaggregate of the sound units produced in each minute of the concert orpromotion determined according to the LAeq, 1 min or LCeq, 1 min soundlevels (whichever results in the greater number of sound units inrespect of any sound level produced by the concert or promotion) asset out in Table 1 and Table 2 to this subclause.

(2) The number of sound units produced in respect of any period duringwhich a concert or promotion is held after 10 p.m. is double thenumber of sound units that would be produced for that period inaccordance with subclause (1).


Part 2 — Conditions of exemption

3. Number, nature and frequency of concerts and promotions

(1) Except as stated in subclauses (2) and (3), the venue operator is toensure that concerts and promotions are programmed and held sothat —

(a) the number and nature of the concerts and promotions heldduring each reporting period are such that the number ofsound units produced by them does not exceed the numberspecified for the period in column 2 of the Table to thissubclause;

(b) concerts and promotions do not produce more than 200 soundunits in any period of 14 days;

(c) concerts are not held on more than 2 consecutive days; and

(d) during the period from commencement to 30 June 1999, aconcert or promotion during which more than 15% of thesound levels produced exceed the prescribed sound level isnot held on more than 4 occasions.

(2) The number of sound units produced in a reporting period may exceedthe maximum specified in the Table to subclause (1) (or thatmaximum as reduced by the operation of subclause (3)), by no morethan 72 sound units.

(3) If subclause (2) applies in respect of a reporting period (the “relevantreporting period” ), the number of sound units specified in the Tableto subclause (1) in respect of the reporting period that follows therelevant reporting period is to be reduced by twice the number ofsound units by which the maximum is exceeded in the relevantreporting period.

(4) In subclause (1)(d) —

“the prescribed sound level” means —

(a) a LAeq, 1 min sound level of 95 dB; or

(b) a LCeq, 1 min sound level of 105 dB.

4. Appointment of approved persons for concerts and promotions

The venue operator —

(a) is to appoint one or more persons, who are approved by theDirector, to assist the venue operator in managing the soundlevels produced by concerts and promotions;


(b) is to ensure that at least one person who is approved underparagraph (a) is present at each concert or promotion and thatone such person who is present at a concert or promotion isdesignated as the Manager for the purposes of that concert orpromotion; and

(c) is to ensure that it is a condition of the hire of the BelvoirAmphitheatre for a concert or promotion that the hirer is toallow the venue operator and the Manager to take anymeasures, in relation to managing the sound levels producedby the concert or promotion, that are necessary forcompliance with this order.

5. Time and duration of concerts and promotions

(1) The venue operator is to ensure that a concert does not begin before10 a.m. or end after 11 p.m., except a concert that begins on31 December may continue until 2 a.m. on 1 January.

(2) The venue operator is to ensure that a promotion does not beginbefore 10 a.m. or end after 8 p.m.

(3) The venue operator is to ensure that any sound checking and testing,practising or rehearsing (“the preliminaries” ) that takes place inconnection with a concert or promotion —

(a) has a duration that does not exceed 2 hours; and

(b) except as stated in subclause (4), takes place at a time that isas close as is practicable to the time when the concert orpromotion is to begin.

(4) If a concert or promotion is to begin on any day before 12 p.m., thepreliminaries may, subject to subclause (3)(a), take place on theprevious day between 12 p.m. and 6 p.m.

(5) If the preliminaries do not take place during a continuous period, aperiod, other than a period referred to in subclause (6), during whichthe preliminaries are suspended is part of the duration of thepreliminaries for the purposes of subclause (3)(a).

(6) A period —

(a) during which the preliminaries are suspended because of badweather or equipment failure; or

(b) between the end of the preliminaries and the beginning of theconcert or promotion to which they relate,

is not part of the duration of the preliminaries for the purposes ofsubclause (3)(a).

6. Monitoring, measuring and recording of sound levels duringconcerts and promotions

(1) The venue operator is to ensure that the LAeq, 1 min and LCeq, 1 min soundlevels produced by a concert or promotion are monitored and, to theextent practicable, continuously measured during the concert orpromotion.


(2) The venue operator is to ensure that a permanent record, in a formapproved by the Director, is made of the measurements taken undersubclause (1).

(3) The venue operator is to retain a record made under subclause (2) andis to give a copy of it, on written request, to the Director or the chiefexecutive officer of the Shire of Swan.

(4) Subject to subclause (5), the sound levels produced by a concert orpromotion are to be monitored and measured from the sound mixingdesk, which the venue operator is to ensure is not more than 30 metresfrom the primary speaker banks used for the purposes of the concertor promotion.

(5) If the primary speaker banks are in 2 or more locations, the venueoperator is to ensure that the sound levels are monitored and measuredby a sound level meter positioned at each location not more than30 metres from the speaker banks.

(6) The venue operator is to ensure that the measuring microphone ofeach sound level meter used for monitoring and measuring soundlevels produced at a concert or promotion is positioned between 2.2and 2.5 metres above ground level.

7. Venue operator is to ensure sound levels do not exceed certainlimits

(1) The venue operator is to ensure that at a concert or promotion —

(a) the LAeq, 1 min sound levels produced do not exceed 105 dB andat least 85% of those sound levels do not exceed 100 dB; and

(b) the LCeq, 1 min sound levels produced do not exceed 115 dB andat least 85% of those sound levels do not exceed 110 dB.

(2) For the purpose of determining sound levels under this clause, anynoise from the audience at a concert or promotion, whether in theform of applauding or cheering or in any other form, is not taken intoaccount.

8. Notice to be given if limits are exceeded

(1) If a concert or promotion is held during which more than 15% of thesound levels produced exceed the prescribed sound level, the venueoperator is to give notice, during normal business hours on the nextworking day after the concert or promotion is held, of the extent towhich the sound levels produced by the concert or promotionexceeded the prescribed sound level to —

(a) the chief executive officer of the Shire of Swan; and

(b) the Director.

(2) In subclause (1) —

“the prescribed sound level” means —

(a) a LAeq, 1 min sound level of 105 dB; or

(b) a LCeq, 1 min sound level of 115 dB.


9. Venue operator to ensure compliance of instruments

The venue operator is to ensure that an instrument used for thepurpose of monitoring or measuring sound levels at a concert orpromotion for the purposes of this order is calibrated in accordancewith, and otherwise complies with, Schedule 4 to the NoiseRegulations.

10. Advice to be given to nearby residents

(1) The venue operator is to give written notice to each household withinone kilometre of the stage of the Belvoir Amphitheatre and to theDirector and to the chief executive officer of the Shire of Swan —

(a) during the period from 1 to 15 June of each year, of the timesand dates when concerts and promotions are proposed to beheld during the following period from 1 July to 31 December;and

(b) during the period from 1 to 15 December of each year, of thetimes and dates when concerts and promotions are proposedto be held during the following period from 1 January to30 June.

(2) A notice given under subclause (1) is to include a statement that —

(a) any change to the time or date when a concert or promotionthat is referred to in the notice is to be held;

(b) any cancellation of a concert or promotion that is referred toin the notice; or

(c) any additional concert or promotion that was not referred toin the notice,

will be advertised by the venue operator in The Midland Echonewspaper.

(3) The venue operator is to ensure that any change to the time or datewhen a concert or promotion is to be held, or the cancellation oraddition of a concert or promotion, is advertised in the mannerdescribed in subclause (2) at least one week before —

(a) the concert or promotion was proposed to be held, if theconcert or promotion is to be held later than was proposed orhas been cancelled; or

(b) the concert or promotion is to be held, if the concert orpromotion is to be held earlier than was proposed or is anadditional concert or promotion.


11. Venue operator to obtain report on construction of sound shell

(1) The venue operator is to obtain a written report by a consultingengineer, approved by the Director, that examines the feasibility of theconstruction of a sound shell at the Belvoir Amphitheatre to reducethe level of the noise emissions received at residential premises withinthe vicinity of the Belvoir Amphitheatre from concerts andpromotions.

(2) The venue operator is to ensure that the report deals with —

(a) the design, acoustical characteristics and estimated cost ofconstruction of a sound shell; and

(b) any other matters relating to the feasibility of the constructionof a sound shell that are specified by the Director in writing tothe venue operator.

(3) The venue operator is liable for the cost of obtaining the report.

(4) The venue operator is to submit the report to the Director by30 June 1999.

12. Venue operator to give inspectors access to Belvoir Amphitheatre

(1) The venue operator is to ensure that inspectors and their assistants aregiven access to all areas of the Belvoir Amphitheatre and its carparking facilities for the purposes of performing functions relating tothe monitoring and measuring of sound levels produced by a concertor promotion.

(2) In subclause (1) —

“inspectors” means inspectors appointed under section 88 of the Actor employed by the Shire of Swan.

13. Venue operator to report twice for each reporting period

(1) The venue operator is to give 2 reports in respect of each reportingperiod to the Director and to the chief executive officer of the Shire ofSwan.

(2) The reports are to give details of the record made under clause 6(2)for, and the number of sound units produced by, each concert andeach promotion held in the reporting period —

(a) for the purposes of the first report, during the period from1 July to 30 December; and

(b) for the purposes of the second report, during the period from1 January to 30 June.

(3) The venue operator is to ensure that a report under this clause is givenwithin one month after the period to which it applies.

Made by the Governor in Executive Council.

1. Citation

These regulations may be cited as the Blood and Tissue(Transmissible Diseases) Amendment Regulations 1999.

2. The regulations amended

The amendments in these regulations are to the Blood andTissue (Transmissible Diseases) Regulations 1985*.[* Published in Gazette 8 February 1985, pp. 517-19.

For amendments to 29 January 1999 see 1997 Index to Legislation of Western Australia, Table 4, p. 123.]

3. Regulation 6 amended

Regulation 6 is amended by deleting “the Schedule” andinserting instead —

“ Schedule 1 ”.

4. Schedule replaced

The Schedule is repealed and the following Schedule is insertedinstead—

“Schedule 1 — Blood donor declaration

There are some people in the community who MUST NOT give bloodas it may transmit infections to people who receive it. So before yougive blood we need you to answer some questions to ensure that it willbe safe for people to be given your blood or blood products. The


following questions are a vital part of our effort to eliminate thesediseases from the blood supply.

Even though there are a lot of questions they are all important and youneed to answer every question on the form truthfully and to the best ofyour ability. Answering these questions truthfully is importantbecause there are severe penalties including fines and/or imprisonmentfor giving false or misleading answers to any of the questions.

Under the powers conferred by the Local Government Act 1995 and by all otherpowers, the Council of the Shire of Gingin, resolved on the 21st day of January 1999,to repeal the Standing Orders for the Shire of Gingin published in the GovernmentGazette on 2nd December 1983 and to make the following local laws.

(g) At the time of subdivision the subdivider shallmake arrangements to the satisfaction ofCouncil for storm water drainage, includingnutrient stripping vegetation within detentionbasins.

(h) At the time of subdivision of the land into surveystrata lots, effluent disposal envelopes (indicat-ing the location for any leach drains) shall beestablished for each lot to Council’s satisfaction.In establishing the location of these envelopes thelocal topography and the location of leach drainson adjoining properties shall be taken intoaccount. No extension/relocation of this envelopeshall be permitted.

(i) Prior to the occupation of any dwelling landown-ers are required to provide their own liquid andsolid waste disposal systems to Council’s and theDepartment of Health’s specification andsatisfaction. All leach drains will be required tobe contained fully within the effluent disposalenvelopes identified and approved by Council atthe time of subdivision.

(j) At the time of subdivision Council shall requestthe subdivider to—• prepare a Fire Management Plan to thesatisfaction of Council,• the subdivider shall make arrangements to thesatisfaction of the Bush Fires Board and theLocal Government for financial contributionstowards the purchase of fire fighting equipment.

(k) Boundary fencing shall be maintained so as toprevent the escape of stock.

(l) Purchasers of strata lots shall be advised inwriting by the subdivider that a farm operateson the neighbouring property to the east andrequire, the purchasers to acknowledge theexistence of the farm and the “right to farm” theproperty by endorsing the written notice, a copyof which is to be lodged with Council.

(m) The subdivider shall develop a ManagementStatement in consultation with the Counciladdressing the following issues—• Building Design Guidelines• Keeping of Animals• Management of common land• Maintenance of private roads• Rubbish collection• Management of community centre and shop• Implementation of the Landscape Management

Plan,



• Other issues as required by Council, and

• Fire Management Plan.

(n) The application of fertilisers on the land byeither an individual property owner or the BodyCorporate shall only be done in accordance withthe Landscape Management Plan.

(o) In addition to establishing and managing thearboretum, common areas on the property are tobe managed as a farm as is currently the casewith neighbouring properties. These activitiesentail the use of fertilisers, pesticides andherbicides, which, subject to other statutorycontrols, are permitted activities. However, theuse of chemicals is to be minimised whereverpossible and organic farming methods are thepreferred solution.

(p) At the time of subdivision Council shall requestthe subdivider to prepare a Landscape Manage-ment Plan taking into account soil types, landprofiles, drainage, nutrient retention and firehazards to the satisfaction of Council.

(q) No trees or shrubs shall be felled or removed fromthe site except where—

• required for approved development works;

• establishment of a fire break is required byregulation or by-law;

• trees are diseased or dangerous, or

• required by the approved Landscape Manage-ment Plan.

(r) Tree planting in accordance with a LandscapeManagement Plan shall be undertaken oncommon property and strata lots by thedeveloper prior to subdivision. The LandscapeManagement Plan shall thereafter be maintainedand implemented by the Body Corporate.

(s) Large grazing animals such as cattle and horses,with a propensity to damage vegetation andfencing shall not be permitted.

(t) With the intention of preventing land degrada-tion, Council may, with advice of AgricultureWestern Australia, require reduction in stocknumbers on the land.

7. Adding two new definitions to Schedule 1

—Interpretations—of the Scheme Text as follows—

(a) Between the definitions of “Afforestation” and “Board” insert the following—Arboretum—Means a garden of shrubbery and trees, especially of rare trees, plantedand maintained for their aesthetic and scientific value.

(b) Between the definitions for “Gazetted Date” and “Health Studio” insert the follow-ing—Guesthouse—Means a building utilised for the purpose of providing holiday accom-modation and typically offering full board for guests. The building would becharacterised by individual suites which are serviced by centralised dining (not beinga public restaurant) and other facilities. Suites would not be self contained and occu-pation would generally be reliant on services provided by management.

(b) The location of the approved building envelope shall be such that——it has regard for the locations of building envelopes delineated on the Sub-

division Guide Map.—no additional clearing or disturbance will take place within the Landscape

Protection or Creekline Protection as defined on the Subdivision Guide Plan.—is consistent with the building setback areas referred to in by Clause 5.1

“Table 2—Development Standards”.—the location of the building envelope and low fuel zones will not affect the Tree

Preservation Areas defined on the Subdivision Guide Map.—the location of the building envelope will not detract from the environmental

quality of the area or from the amenity of adjoining residences.—it has regard for the capability and suitability of the land.

(c) In the event that a future landowner wishes to relocate a building envelope to aposition different to that shown on the Subdivision Guide Plan, Council will re-quire a revised landscaping plan to be submitted demonstrating suitable screening.Once approved by Council the plan is to be implemented by the landowner inaccordance with Council’s requirements.

(d) All on-site effluent disposal systems shall be located no closer than 100 metreshorizontal separation from the watercourse as defined on the Subdivision GuidePlan and 2m vertical separation from the highest known groundwater levels.

(e) If an on-site effluent disposal system cannot achieve a 100m horizontal separa-tion from a watercourse on the Subdivision Guide Plan, then Council will require,as a condition of building approval, that an approved alternative system be usedto the specifications of the Health Department to be located no closer than50 metres horizontal separation from the watercourses as defined on the Subdivi-sion Guide Plan.

(iv) (a) Within the Landscape Protection, Creekline Protection and Tree PreservationAreas defined on the Subdivision Guide Plan, no indigenous trees or substantialvegetation shall be felled or removed except where——trees are dead, diseased or dangerous;—the establishment of a fire access track is required under regulation or by-law.

(b) The removal of indigenous trees or substantial vegetation for any purposes other thanthe above exceptions shall require the consent of Council, and as condition of grantingconsent, Council may require the planting and maintenance, for a period of at least 3years, of endemic native trees of species and in locations approved by Council.


(c) Council will not permit fencing along property boundaries where such fencing willgo through the Landscape Protection, Creekline Protection or Tree PreservationAreas as defined on the Subdivision Guide Plan unless to comply with Provision(vi)(c).

(v) (a) Council may request the Commission impose conditions at the time of subdivisionwhich will ensure the implementation of those initiatives contained within theBush Fire Management Plan included within the Amendment Report.

(b) Bush fire facilities shall be constructed to a standard approved by Council in ac-cordance with Council’s “Standard of Fire Protection Guidelines” and may includea contribution to the upgrading of fire equipment.

(c) Council shall require that individual landowners are responsible for the mainte-nance of a Strategic Firebreak where it crosses the landowner’s lot.

(d) Limited clearing may be required by Council around dwellings to establish lowfuel zones. The size of each low fuel zone shall be determined by reference to theBush Fire Management Plan. The low fuel zones shall be kept free of debris andmaintained to a standard approved by Council and where required are not to in-trude into the Tree or Creekline Preservation Areas.

(e) Council may request the Commission to impose a condition at the time of subdivi-sion requiring the subdivider to make arrangements to the satisfaction of Councilto ensure prospective purchasers, in the transfer of lots, are aware of the firemanagement guidelines of the Homeowners Bushfire Survival Manual and theAustralian Standard 3959-1991—“Construction of Buildings in Bushfire ProneAreas”.

(f) Council shall require the construction of unlocked gates where fences cross theStrategic Firebreak to the specifications and satisfaction of the Bush Fires Boardin accordance with the Bush Fire Management Plan.

(vi) (a) With the intention of preventing agricultural practices detrimental to the amen-ity of the land, rural pursuits and the keeping of animals for commercial gainshall not be permitted without the approval in writing of Council. The Councilmay impose limits on stocking or any other conditions in the light of prevailingseasonal conditions.

(b) Council will only permit the keeping of animals in areas that area already sub-stantially cleared and pastured so as not to conflict with Clause (iv).

(c) Council will impose fencing requirements as a condition of its approval to protectsubstantive vegetation in the Landscape Protection, Creekline Protection and TreePreservation Areas as defined on the Subdivision Guide Plan.

(d) Provision of an adequate water supply to the stock will also be required as a con-dition of approval to keep stock.

(vii) (a) Council will request the Commission impose a condition at the time of subdivisionthat requires the preparation of a Landscape Plan for the site.

(b) The Council will require the planting and maintenance, for a period of at least3 years, of the Landscape Protection and Creekline Protection Areas as defined onthe Subdivision Guide Plan, using endemic native trees of species and in locationsapproved by Council as shown on the Landscape Plan which will be required as acondition of subdivision.

(c) Commencement of development within the Landscape Protection and CreeklineProtection Areas as defined on the Subdivision Guide Plan shall require the priorapproval of Council. Development shall be deemed to include preclusion of Ripar-ian rights by damming, diversion or other impediment to water flow, regardingthe natural banks, clearing and construction of bridges, fencing or any form ofmarine structure.

(viii) (a) All buildings and water tanks constructed within the zone shall be sympathetic toexisting landscape elements (namely landform and vegetation) in terms of theirdesign, materials and colour.

(b) All buildings and water tanks shall be constructed of roof and external wall mate-rials, comprising earth brown or green vegetation colours or finishes.

(c) All residential buildings shall be single storey except where it can be proved toCouncil that a variation to the height restriction would not adversely affect thevisual amenity of the locality from McLeod Road Tourist Route.

(d) All buildings and water tanks shall be sited to maximise the natural screeningeffect of vegetation and topography.

(e) Proposals to vary the height restrictions pursuant to Special Provision viii(c) shallbe accompanied by such plans, elevations and sketches as is determined by theCouncil to assess the effect on the visual amenity and the natural screening effectof vegetation and topography including any proposed landscaping.

(ix) Council may request the Commission to impose a condition at the time of subdivisionrequiring a Drainage and Nutrient Management Plan to be prepared and implementedthat addresses the drainage requirements on the site and addresses impacts on localwater regions for both during the subdivision construction phase and upon completionof the works.


(x) Council may request the Commission to improve a condition at the time of subdivisionrequiring the battleaxe leg be constructed, paved and drained to the satisfaction ofCouncil.

(xi) Any proposed clearing of roadside vegetation for the provision of underground/over-head power to the total site to be developed as part of connection to the reticulatednetwork, will require the prior consent of Council or alternative location of such serv-icing infrastructure so as to avoid the loss of vegetation.

(xii) The subdivider making arrangements to the satisfaction of Council to ensure prospec-tive purchasers and successors in title are aware that general farming and intensiveagricultural pursuits are conducted adjacent to the site and in the area generally andall current and future landuses and development within this zone shall be designedand conducted in such a manner so as to not create conflict with these landuses andadversely impact on the rural amenity of the area

(xiii) A surveyor’s plan (pre-calculated drawing) shall be lodged with Council prior to theclearance of diagrams of survey and show Landscape Protection, Creekline Protectionand Tree Preservation Areas, Strategic Firebreaks, .01 metre PAW and roads and drainsas proposed and as required by Council for approval.

Improvements to Irrigation supply: Shire of Donnybrook/Balingup-Mumballup

NOTICE OF AUTHORISATION TO RAISE FULL SUPPLY LEVEL AT GLEN MERVYN DAM

In accordance with the provisions of the Water Agencies (Powers) Act 1984, the Minister for WaterResources has authorised the Water Corporation to construct the following works—

• Raise the existing crest level of Glen Mervyn Dam of two metres to a new level of 203 metres(AHD). In doing so, raise the current full supply level from RL 199.7 metres to RL 201. 5metres and increase the storage area by 8.4ha (about 20%).

• Rebuild the upper section of the spillway.

• Undertake remedial measures to the outlet works and to the embankment drainage.


• Raise the Collie—Preston Road Causeway.

• Raise the Best Road Crossing.

• Reorganise recreational facilities.

The location of the proposed works is at Glen Mervyn Dam, approximately 17 kilometres south ofCollie.

The works will improve the supply of water to the Preston Valley Irrigation district.
