(b) a railway, canal, telegraph or other workor undertaking that connects a province withanother province, or that extends beyond the

(d) a ferry between a province and anotherprovince or between a province and a coun-try other than Canada;
(e) aerodromes, aircraft or a line of air trans-portation;
(f) a radio broadcasting station;

a bank;(h) a work that, although wholly situatedwithin a province, is before or after its exe-cution declared by Parliament to be for thegeneral advantage of Canada or for the ad-vantage of two or more provinces;

Application 4. (1) This Part applies to every organiza-tion in respect of personal information that
(a) the organization collects, uses or disclos-es in the course of commercial activities; or
(b) is about an employee of the organizationand that the organization collects, uses ordiscloses in connection with the operation ofa federal work, undertaking or business.

4.1 (1) Where a certificate under section38.13 of the Canada Evidence Actprohibitingthe disclosure of personal information of a spe-cific individual is issued before a complaint isfiled by that individual under this Part in re-
spect of a request for access to that information,the provisions of this Part respecting that indi-viduals right of access to his or her personalinformation do not apply to the information thatis subject to the certificate.

Certificatefollowing filingof complaint
(2) Notwithstanding any other provision ofthis Part, where a certificate under section38.13 of the Canada Evidence Actprohibitingthe disclosure of personal information of a spe-cific individual is issued after the filing of acomplaint under this Part in relation to a re-
quest for access to that information:(a) all proceedings under this Part in respectof that information, including an investiga-tion, audit, appeal or judicial review, are dis-continued;
(b) the Commissioner shall not disclose theinformation and shall take all necessary pre-cautions to prevent its disclosure; and
(c) the Commissioner shall, within 10 daysafter the certificate is published in theCanada Gazette, return the information tothe organization that provided the informa-
tion.

18. (1) The Commissioner may, on reason-able notice and at any reasonable time, auditthe personal information management practicesof an organization if the Commissioner has rea-sonable grounds to believe that the organizationis contravening a provision of Division 1 or isnot following a recommendation set out inSchedule 1, and for that purpose may
(a) summon and enforce the appearance ofpersons before the Commissioner and com-pel them to give oral or written evidence onoath and to produce any records and thingsthat the Commissioner considers necessary
for the audit, in the same manner and to thesame extent as a superior court of record;
(b) administer oaths;
(c) receive and accept any evidence and oth-er information, whether on oath, by affidavitor otherwise, that the Commissioner sees fit,whether or not it is or would be admissible ina court of law;
(d) at any reasonable time, enter any premis-es, other than a dwelling-house, occupied bythe organization on satisfying any security
requirements of the organization relating tothe premises;
(e) converse in private with any person inany premises entered under paragraph (d)and otherwise carry out in those premisesany inquiries that the Commissioner sees fit;and
(f) examine or obtain copies of or extractsfrom records found in any premises enteredunder paragraph (d) that contain any matterrelevant to the audit.
18.
