THE MINISTER OF ENERGY AND MINERALRESOURCES,
Menimbang:bahwa untuk melaksanakan ketentuan Pasal 127Undang-Undang Nomor 4 Tahun 2009 tentangPertambangan Mineral dan Batubara, perlumenetapkan Peraturan Menteri Energi dan SumberDaya Mineral tentang Penyelenggaraan UsahaJasa Pertambangan Mineral dan Batubara;
Considering:That to implement the provisions of Article 127 ofLaw Number 4 of 2009 concerning Mineral andCoal Mining, it is necessary to issue a Regulationof the Minister of Energy and Mineral Resourcesconcerning the Conduct of Coal and MineralMining Services Business;

Menetapkan:PERATURAN MENTERI ENERGI DAN SUMBERDAYA MINERAL TENTANG
PENYELENGGARAAN USAHA JASAPERTAMBANGAN MINERAL DAN BATUBARA.

BAB IKETENTUAN UMUM
Pasal 1
CHAPTER 1GENERAL PROVISIONS
Article 1
Dalam Peraturan Menteri ini yang dimaksuddengan:
In this Regulation of the Minister:
1. Jasa Pertambangan adalah jasa penunjangyang berkaitan dengan kegiatan usahapertambangan.

3. NoncoreMining Services Business meansany services business other than miningservices business that provides services insupport of mining business activities.
4. Usaha Pertambangan adalah kegiatandalam rangka pengusahaan mineral ataubatubara yang meliputi tahapan kegiatanpenyelidikan umum, eksplorasi, studikelayakan, konstruksi, penambangan,pengolahan dan pemurnian, pengangkutandan penjualan serta pascatambang.
4. Mining Business means any mineral orcoal business activity that includes the stagesof general surveys, explorations, feasibilitystudies, construction, mines, processing andrefining/smelting, hauling and sale as well aspostmining.
5. Penyelidikan Umum adalah tahapankegiatan pertambangan untuk mengetahuikondisi geologi regional dan indikasi adanyamineralisasi.
5. General Survey means a stage in miningactivities to know regional geologicalcondition and indications of mineralization.
6. Eksplorasi adalah tahapan kegiatan usahapertambangan untuk memperoleh informasisecara terperinci dan teliti tentang lokasi,bentuk, dimensi, sebaran, kualitas dan sumberdaya terukur dari bahan galian, sertainformasi mengenai lingkungan sosial danlingkungan hidup.
6. Exploration means a stage in miningbusiness activities to find specific andaccurate information about locations, shapes,dimensions, distribution, quality andquantified resources of excavated materials aswell as information on social environment andthe environment.
7. Studi Kelayakan adalah tahapan kegiatanusaha pertambangan untuk memperolehinformasi secara rinci seluruh aspek yangberkaitan untuk menentukan kelayakanekonomis dan teknis usaha pertambangan,termasuk analisis mengenai dampaklingkungan serta perencanaan pascatambang.
7. Feasibility Study means a stage in miningbusiness activities to find specific informationabout all of the relevant aspects, wherebyeconomic and technical feasibility of miningbusiness, including environmental impactassessment as well as postmining plans maybe determined.
8. Konstruksi Pertambangan adalahkegiatan usaha pertambangan untukmelakukan pembangunan seluruh fasilitas
operasi produksi, termasuk pengendaliandampak lingkungan.
8. Mining Construction means a miningbusiness activity to build all of the productionoperation facilities, including control of
environmental impacts.
9. Penambangan adalah bagian kegiatanusaha pertambangan untuk memproduksimineral dan/atau batubara dan mineralikutannya.
9. Mine means a part of mining businessactivities to produce minerals and/or coal andtheir associated minerals.
10. Pengolahan dan Pemurnian adalahkegiatan usaha pertambangan untukmeningkatkan mutu mineral dan/atau batubaraserta untuk memanfaatkan dan memperoleh
mineral ikutan.
10. Processing and Refining/Smelting meansa mining business activity to improve thequality of minerals and/or coal and to utilizeand find associated minerals.

12. Pascatambang adalah kegiatan terencana,sistematis dan berlanjut setelah akhir sebagianatau seluruh kegiatan usaha pertambanganuntuk memulihkan fungsi lingkungan alamdan fungsi sosial menurut kondisi lokal diseluruh wilayah penambangan.
12. Postmining means a planned, systematicand sustainable activity after partial or totalcompletion of mining business activities torestore the natural environmental functionsand social functions to conform to the localcondition throughout the mining areas.
13. Reklamasi adalah kegiatan yang dilakukansepanjang tahapan usaha pertambangan untukmenata, memulihkan, dan memperbaikikualitas lingkungan dan ekosistem agar dapatberfungsi kembali sesuai peruntukannya.
13. Reclamation means an activity that isperformed throughout the stages in the miningbusiness to organize, restore and repair thequality of the environment and ecosystem toenable them to return to their originalfunctions of zoning.
14. Lingkungan Pertambangan adalahlindungan lingkungan pertambangan yangmerupakan instrumen untuk memproteksilingkungan hidup yang terkena dampakkegiatan usaha pertambangan pada wilayahsesuai dengan Analisis Mengenai DampakLingkungan atau Upaya PengelolaanLingkungan dan Upaya PemantauanLingkungan.
14. Mining Environment meansenvironmental conservation that constitutes aninstrument to protect the environment of anarea that is affected by the impact of miningbusiness activities through an EnvironmentalImpact Assessment or an environmentalmanagement effort and an environmentalmonitoring effort.
15. Keselamatan dan Kesehatan Kerja
adalah instrumen yang memproteksi pekerja,perusahaan, lingkungan hidup, danmasyarakat sekitar dari bahaya akibatkecelakaan kerja, dan bertujuan mencegah,mengurangi, bahkan menihilkan risikokecelakaan kerja (zero accident).
15. Occupational Safety and Health means an
instrument to protect workers, companies, theenvironment, and surrounding communitiesfrom danger arising from occupationalaccidents, and that aims to prevent, minimize,and even achieve zero risk of occupationalincidents (zero accident).
16. Izin Usaha Jasa Pertambangan, yangselanjutnya disebut IUJP, adalah izin yangdiberikan kepada pelaku usaha jasapertambangan untuk melakukan kegiatan
usaha jasa pertambangan.
16 Mining Services License, hereinaftercalled an IUJP, means a license that isissued to a mining services business actor,under which mining services business is
conducted17. Surat Keterangan Terdaftar, yang
selanjutnya disebut SKT, adalah suratketerangan tanda terdaftar yang diberikankepada Perusahaan Usaha Jasa PertambanganNon-Inti.
17. Certificate of Registration, hereinaftercalled SKT, means a statement ofregistration that is issued to a Noncore MiningServices Business Company.
18. Klasifikasi adalah penggolongan bidangusaha jasa pertambangan berdasarkan kategorikonsultan, perencana, pelaksana danpengujian peralatan.
18. Classification means the grouping ofmining services business areas into thecategories of consultant, planner, operator andequipment tester.
19. Kualifikasi adalah penggolongan usahajasa pertambangan berdasarkan kemampuanjenis usaha jasa pertambangan yang dapat

20. Badan Usaha adalah setiap badan hukumyang bergerak di bidang pertambangan yangdidirikan berdasarkan hukum Indonesia danberkedudukan dalam Wilayah NegaraKesatuan Republik Indonesia.
20. Entity means any legal entity that engagesin the field of mining, established under thelaws of Indonesia and domiciled in theterritory of the Republic of Indonesia
21. Perusahaan Jasa Pertambangan Lokaladalah perusahaan jasa yang berbadan hukumIndonesia atau bukan berbadan hukum, yangdidirikan di kabupaten/kota atau provinsi,yang seluruh modalnya berasal dari dalamnegeri dan beroperasi dalam wilayahkabupaten/kota atau provinsi yangbersangkutan.
21 Local Mining Services Company meansany services company that is an Indonesianlegal entity or nonlegal entity and that isestablished in districts/cities or provinces, ofwhich all of the capital is domestically owned,and provides services within the territory ofthe relevant districts/cities or provinces.
22. Perusahaan Jasa PertambanganNasional adalah perusahaan yang didirikandan berbadan hukum Indonesia yang seluruhmodalnya berasal dari dalam negeri danberoperasi di wilayah Republik Indonesia ataudi luar wilayah Republik Indonesia.
22 National Mining Services Companymeans any company that is established andincorporated (legal entity) under the laws ofIndonesia, of which all of the capital isdomestically owned, and provides serviceswithin the territory of the Republic ofIndonesia or outside the territory of theRepublic of Indonesia.
23. Perusahaan Jasa Pertambangan Lainadalah perusahaan yang didirikan danberbadan hukum Indonesia yang sebagianatau seluruh modalnya dimiliki oleh pihak
asing.
23 Other Mining Services Company meansany company that is established andincorporated (legal entity) under the laws ofIndonesia, of which a part or all of the capital
is foreign owned.24. Izin Usaha Pertambangan, yang
selanjutnya disebut IUP, adalah izin untukmelaksanakan usaha pertambangan.
24 Mining Permit, hereinafter called anIUP, means a permit under which miningbusiness is conducted.
25. Izin Usaha Pertambangan Khusus, yangselanjutnya disebut IUPK adalah izin untukmelaksanakan usaha pertambangan di wilayahizin usaha pertambangan khusus.
25. Special Mining Permit, hereinafter calledan IUPK, means a permit under whichmining business in a special mining permitarea is conducted.
26. Menteri adalah Menteri yangmenyelenggarakan urusan pemerintahan dibidang pertambangan mineral dan batubara.
26. Minister means the minister administeringgovernmental affairs in the field of mineraland coal mining.
27. Direktur Jenderal adalah DirekturJenderal yang bidang tugas dan tanggung
jawabnya meliputi kegiatan pertambanganmineral dan batubara.
27. Director General means the DirectorGeneral whose duties and responsibilityinclude mineral and coal mining activities.
Pasal 2 Article 2
(1) Penyelenggaraan usaha jasa pertambanganbertujuan untuk:
(1) The conduct of mining services business shallhave the purposes to:
a. menunjang kelancaran dalampelaksanaan kegiatan usahapertambangan;

sebagaimana dimaksud pada ayat (2) huruf a,meliputi:

Pasal 4
Part TwoTypes and Fields/Lines
Article 4
(1) Pengusahaan Jasa Pertambangan
dikelompokkan atas:
(1) Mining Services Business Operations shall be
classified as:
a. Usaha Jasa Pertambangan; dan a. Mining Services Business; and
b. Usaha Jasa Pertambangan Non-Inti. b. Noncore Mining Services Business.
(2) Jenis Usaha Jasa Pertambangan sebagaimanadimaksud pada ayat (1) huruf a meliputi:

a. Konsultasi, perencanaan, pelaksanaandan pengujian peralatan di bidang:
a. consultancy, planning, operation andequipment testing in the fields/lines of:
1. penyelidikan umum; 1. general survey;
2. eksplorasi; 2. exploration;3. studi kelayakan; 3. feasibility study;
4. konstruksi pertambangan; 4. mining construction;
5. pengangkutan; 5. hauling;
6. lingkungan pertambangan; 6. mining environment;
7. pascatambang dan reklamasi;dan/atau
7. postmining and/or reclamation;and/or
8. keselamatan dan kesehatan kerja. 8. occupational safety and health.
b. Konsultasi, perencanaan, dan pengujianperalatan di bidang:
b. Consultancy, planning, and equipmenttesting in the fields/lines of:
1. penambangan; atau 1. mine; or

2. pengolahan dan pemurnian. 2. processing and refining/smelting.
(3) Bidang Usaha Jasa Pertambangansebagaimana dimaksud pada ayat (2) terdiriatas sub-bidang sebagaimana tercantum dalamLampiran I Peraturan Menteri ini.
(3) Fields/Lines of Business of Mining Servicesas intended by section (2) shall include sub-fields/sub-lines as listed down in Attachment Iof this Regulation of the Minister.
(4) Bidang Usaha Jasa Pertambangan Non-Intiadalah bidang usaha selain bidang usaha jasapertambangan sebagaimana dimaksud padaayat (2) dan ayat (3).
(4) Fields/Lines of Business of Noncore MiningServices shall be the fields/lines of businessother than the lines of business of miningservices as intended by section (2) and section(3).
BAB IIIPENGGUNAAN DAN KEGIATAN JASA
PERTAMBANGANPasal 5
CHAPTER IIIENGAGEMENT AND ACTIVITIES OF
MINING SERVICESArticle 5
(1) Pemegang IUP atau IUPK dalam melakukan
kegiatan usahanya dapat menggunakan jasapertambangan setelah rencana kerjakegiatannya mendapat persetujuan dariMenteri, gubernur atau bupati/walikota sesuaidengan kewenangannya.
(1) In the performance of their business activities,
Mining Permit holders or Special MiningPermit holders may engage in mining servicesupon obtaining approval of their workingplans from the competent Minister, governorsor districts/mayors.
(2) Pemegang IUP atau IUPK sebagaimanadimaksud pada ayat (1) wajib menggunakanPerusahaan Jasa Pertambangan Lokaldan/atau Perusahaan Jasa PertambanganNasional.
(2) Mining Permit holders or Special MiningPermit holders as intended by section (1) mustengage Local Mining Services Companiesand/or National Mining Services Companies.
(3) Dalam hal tidak terdapat Perusahaan JasaPertambangan Lokal dan/atau PerusahaanJasa Pertambangan Nasional sebagaimanadimaksud pada ayat (2) pemegang IUP atauIUPK dapat menggunakan Perusahaan JasaPertambangan Lain.
(3) Where no Local Mining Services Companiesand/or National Mining Services Companiesas intended by section (2) are available,Mining Permit holders or Special MiningPermit holders may engage Other MiningServices Companies.
(4) Pemegang IUP atau IUPK dapatmenggunakan Perusahaan Jasa PertambanganLain sebagaimana dimaksud pada ayat (3)setelah melakukan pengumuman ke mediamassa lokal dan/atau nasional tetapi tidak adaPerusahaan Jasa Pertambangan Lokaldan/atau Perusahaan Jasa PertambanganNasional yang mampu secara finansialdan/atau teknis.
(4) Mining Permit holders or Special MiningPermit holders may engage Other MiningServices Companies as intended by section(3) upon announcement in the local and/ornational mass media where no Local MiningServices Companies and/or National MiningServices Companies are financially and/ortechnically capable.
(5) Dalam hal Perusahaan Jasa PertambanganLain mendapatkan pekerjaan di bidang jasapertambangan sebagaimana dimaksud padaayat (4) Perusahaan Jasa Pertambangan Lainharus memberikan sebagian pekerjaan yangdidapatkannya kepada Perusahaan Jasa
Pertambangan Lokal sebagai sub-kontraktorsesuai dengan kompetensinya.

Pasal 6 Article 6
Dalam hal pemegang IUP atau IUPKmenggunakan jasa pertambangan berbentuk orangperseorangan hanya dapat melakukan kegiatan
jasa pertambangan sebagai berikut:
Mining Permit holders or Special Mining Permitholders in the engagement of mining services witha sole proprietorship may only entrust the soleproprietorship to perform the following miningservices activities:
a. Jenis usaha jasa pertambangan konsultasi atauperencanaan; dan/atau
a. mining services business in the fields/lines ofconsultancy or planning; and/or
b. Usaha Jasa Pertambangan Non-Inti. b. Noncore Mining Services Business.
Pasal 7 Article 7
(1) Setiap pemegang IUP atau IUPK yang akanmemberikan pekerjaan kepada perusahaan
jasa pertambangan didasarkan atas kontrakkerja yang berasaskan kepatutan, transparandan kewajaran.
(1) Provision of work by any Mining Permitholders or Special Mining Permit holders tomining services companies shall beundertaken by a work contract under theprinciples of propriety, transparency andfairness.
(2) Pemegang IUP atau IUPK dilarang menerimaimbalan (fee) dari hasil pekerjaan yang
dilakukan oleh pelaku usaha jasapertambangan.
(2) At no time shall any Mining Permit holders orSpecial Mining holders collect fees from work
performed by mining services business actors.
Pasal 8 Article 8
(1) Pemegang IUP atau IUPK dilarangmelibatkan anak perusahaan dan/atauafiliasinya dalam bidang usaha jasapertambangan di wilayah usaha pertambanganyang diusahakannya, kecuali denganpersetujuan Direktur Jenderal atas nama
Menteri.
(1) At no time shall any Mining Permit holders orSpecial Mining holders involve theirsubsidiaries and/or affiliates in the fields/linesof mining services business in mining areasthey commercialize, unless granted approvalof the Director General on behalf of the
Minister.
(2) Anak perusahaan dan/atau afiliasinyasebagaimana dimaksud pada ayat (1)merupakan badan usaha, yang mempunyaikepemilikan saham langsung denganpemegang IUP atau IUPK.
(2) Subsidiaries and/or affiliates as intended bysection (1) shall be business entities havingdirect ownership of shares of Mining Permitholders or Special Mining holders.
(3) Persetujuan Direktur Jenderal atas namaMenteri sebagaimana dimaksud pada ayat (1)dilakukan apabila:

a. tidak terdapat perusahaan jasapertambangan sejenis di wilayahkabupaten/kota dan/atau provinsi

2) memiliki modal kerja yang cukup;dan
2) have adequate working capital; and
3) memiliki tenaga kerja yangkompeten di bidang pertambangan,
3) have competent workers in the fieldof mines,
sesuai dengan yang dipersyaratkan olehpemegang IUP atau IUPK,
as required by Mining Permit holders orSpecial Mining holders;
(4) Persetujuan sebagaimana dimaksud pada ayat(3) diberikan setelah pemegang IUP atauIUPK:
(4) Approval as intended by section (3) shall begranted upon Mining Permit holders orSpecial Mining holders:
a. melakukan pengumuman lelang jasapertambangan ke media massa lokaldan/atau nasional tetapi tidak ada yangberrninat atau mampu secara finansialdan teknis;
a. making announcements for the auction ofthe mining services in the local and/ornational mass media, and no oneexpresses interest or is financially andtechnically capable;
b. menjamin tidak adanya transfer pricingatau transfer profit dan telah dilaporkankepada Direktur Jenderal.
b. guaranteeing that no transfer pricing ortransfer of profits that has not beenreported to the Director General.
Pasal 9 Article 9
Ketentuan lebih lanjut mengenai tata cara danpersyaratan permohonan persetujuan keikutsertaananak perusahaan dan/atau afiliasinya dalam usaha
jasa pertambangan sebagaimana dimaksud dalamPasal 8 diatur dalam Peraturan Direktur Jenderal.
Ancillary provisions for procedures andrequirements for participation of subsidiariesand/or affiliates in mining services business asintended by Article 8 shall be governed byRegulation of the Director General.
Pasal 10 Article 10
(1) Pemegang IUP atau IUPK Operasi Produksiwajib melaksanakan sendiri kegiatanpenambangan, pengolahan dan pemurnian.
(1) Production Operation Mining Permit holdersor Special Mining holders must perform itsown mine activities, processing and
refining/smelting.
(2) Pemegang IUP atau IUPK Operasi Produksidapat menyerahkan kegiatan penambangankepada usaha jasa pertambangan terbatas padakegiatan:

(3) Pengupasan sebagaimana dimaksud pada ayat

(1) Pelaku usaha jasa pertambangan harusmendapatkan klasifikasi dan kualifikasi darilembaga independen yang dinyatakan dengansertifikat.
(1) Mining services business actors must obtainclassification and qualification as declared bycertification from an independent institution.
(2) Dalam hal lembaga independen sebagaimanadimaksud pada ayat (1) belum terbentuk maka
klasifikasi dan kualifikasi dilakukan olehMenteri, gubernur atau bupati/walikota sesuaidengan kewenangannya.
(2) Where an independent institution as intendedby section (1) is not yet formed, classification
and qualification shall be undertaken by thecompetent Minister, governors orregents/mayors.
Pasal 13 Article 13
(1) Klasifikasi Usaha Jasa Pertambangan terdiriatas:
(1) The classification of Mining ServicesBusiness shall include:
a. konsultan; a. consultant;
b. perencana; b. planner;
c. pelaksana; dan c. operator; andd. penguji peralatan, d. equipment tester,

(1) Pelaku usaha jasa pertambangan sebagaimanadimaksud dalam Pasal 3 dapat melakukankegiatannya setelah mendapatkan IUJP dariMenteri, gubernur, atau bupati/walikota sesuaidengan kewenangannya.
(1) Mining services business actors as intendedby Article 3 may perform their activities uponobtaining a Mining Services License from thecompetent Minister, governors, orregents/mayors.
(2) IUJP diberikan oleh Menteri kepada pelakuusaha jasa pertambangan sebagaimanadimaksud dalam Pasal 3 ayat (2) huruf b danhuruf c, dan ayat (4) untuk melakukankegiatan usaha jasa pertambangan di seluruhwilayah Indonesia.
(2) A Mining Services License shall be issued bythe Minister to a mining services businessactor as intended by Article 3 section (2) item(b) and item (c), and section (4) to performmining services business activities throughoutthe territory of Indonesia.
(3) IUJP diberikan oleh gubernur kepada pelakuusaha jasa pertambangan sebagaimanadimaksud dalam Pasal 3 ayat (2) huruf a danhuruf c, dan ayat (3) untuk melakukankegiatan usaha jasa pertambangan dalam
wilayah provinsi yang bersangkutan.
(3) A Mining Services License shall be issued bythe governors to a mining services businessactor as intended by Article 3 section (2) item(a) and item (c), and section (3) to performmining services business activities within the
territory of the relevant province.
(4) IUJP diberikan oleh bupati/walikota kepadapelaku usaha jasa pertambangan sebagaimanadimaksud dalam Pasal 3 ayat (2) huruf a danhuruf c, dan ayat (3) untuk melakukankegiatan usaha jasa pertambangan dalamwilayah kabupaten/kota yang bersangkutan.
(4) A Mining Services License shall be issued bythe regent/mayor to a mining servicesbusiness actor as intended by Article 3 section(2) item (a) and item (c), and section (3) toperform mining services business activitieswithin the territory of the relevant district/city.
Pasal 16 Article 16
(1) Pelaku Usaha Jasa Pertambangan Non-Intisebagaimana dimaksud dalam Pasal 4 ayat (1)huruf b dapat melakukan kegiatannya setelah

(4) SKT diberikan oleh bupati/walikota kepadapelaku Usaha Jasa Pertambangan Non-Intisebagaimana dimaksud pada ayat (1) untukmelakukan kegiatan Usaha JasaPertambangan Non-Inti dalam wilayahkabupaten/kota yang bersangkutan.
(4) A Certificate of Registration shall be issuedby the regents/mayors to Noncore MiningServices Business Actors as intended bysection (1) to perform Noncore MiningServices Business activities within theterritory of the relevant district/city.
Pasal 17 Article 17
(1) IUJP atau SKT diberikan untuk jangka waktupaling lama 3 (tiga) tahun dan ataspermohonan yang bersangkutan dapatdiperpanjang.
(1) A Mining Services License or Certificate ofRegistration shall be issued for a period of notexceeding 3 (three) years and uponapplication by the holder may be extended.
(2) Permohonan perpanjangan IUJP atau SKTharus diajukan dalam jangka waktu palinglambat 1 (satu) bulan sebelum IUJP atau SKTberakhir.
(2) An application for extension of a MiningServices License or Certificate of Registrationshall be submitted at the latest 1 (one) monthprior to expiration of the Mining ServicesLicense or Certificate of Registration.
(3) IUJP atau SKT yang telah diberikan kepadapelaku usaha jasa pertambangan dilarangdipindahtangankan kepada pihak lain.
(3) A Mining Services License or Certificate ofRegistration that has been issued to a miningservices business actor shall not be assignedto another party.
(4) IUJP atau SKT diberikan berdasarkanpermohonan:

a. baru; a. a new application;
b. perpanjangan; atau b. extension; or

Pasal 18 Article 18
Permohonan IUJP sebagaimana dimaksud padaPasal 17 ayat (4) diajukan secara tertulis kepadaMenteri, gubernur, atau bupati/walikota sesuai
dengan kewenangannya berdasarkan format danpersyaratan sebagaimana tercantum dalamLampiran II A, Lampiran II B, Lampiran II C, danLampiran II D Peraturan Menteri ini.
An application for a Mining Services License asintended by Article 17 section (4) shall besubmitted in writing to the competent Minister,
governors, or regents/mayors in the the formatsand requirements stipulated in Attachment II A,Attachment II B, Attachment II C, and AttachmentII D of this Regulation of the Minister.
Pasal 19 Article 19
Permohonan SKT sebagaimana dimaksud dalamPasal 17 ayat (4) diajukan kepada Menteri,gubernur, atau bupati/walikota sesuai dengankewenangannya berdasarkan format dan
persyaratan sebagaimana tercantum dalamLampiran III A, Lampiran III B, Lampiran III C,dan Lampiran III D Peraturan Menteri ini.
An application for a Certificate of Registration asintended by Article 17 section (4) shall besubmitted in writing to the competent Minister,governors, or regents/mayors in the formats and
requirements stipulated in Attachment III A,Attachment III B, Attachment III C, andAttachment III D of this Regulation of theMinister.
Pasal 20 Article 20
(1) Dalam hal permohonan IUJP sebagaimanadimaksud dalam Pasal 18 atau permohonanSKT sebagaimana dimaksud dalam Pasal 19telah lengkap dan benar, Menteri, gubernur,
atau bupati/walikota sesuai dengankewenangannya melakukan evaluasi sebelummemberikan persetujuan atau penolakan IUJPatau SKT.
(1) Where an application for a Mining ServicesLicense as intended by Article 18 or anapplication for a Certificate of Registration asintended by Article 19 is already complete
and correct, the competent Minister,governors, or regents/mayors shall makeevaluations prior to granting approval orrejection of Mining Services Licenses orCertificates of Registration.
(2) Proses pemberian persetujuan atau penolakanIUJP atau SKT sebagaimana dimaksud padaayat (1), Pasal 18 dan Pasal 19 ditetapkandalam jangka waktu paling lama 14 (empatbelas) hari kerja, terhitung sejak permohonandan persyaratan diterima dengan lengkap danbenar.
(2) The granting of approval or rejection ofMining Services Licenses or Certificates ofRegistration as intended by section (1),Article 18 and Article 19 shall be processed ina period not exceeding 14 (fourteen) workingdays counted from when the application anddocumentation are received completely andcorrectly.
Pasal 21 Article 21
(1) Dalam hal berdasarkan hasil evaluasisebagaimana dimaksud dalam Pasal 20,ternyata diperlukan klarifikasi lebih lanjut,khusus untuk permohonan usaha jasapertambangan dengan klasifikasi Pelaksanadan Penguji peralatan dapat dilakukan
verifikasi.
(1) Where upon the results of evaluation asintended by Article 20, it is found that furtherclarification is required, only applications formining services business with theclassification of Operator and equipmentTester will be verified.
(2) Verifikasi sebagaimana dimaksud pada ayat (2) Verification as intended by section (1) shall

b. reverted by Mining Services License holdersor Certificates of Registration holders with awritten statement prior to expiration of therespective validity period of the MiningServices License or Certificates of

Pemegang IUJP atau SKT dalam melaksanakankegiatan usahanya wajib:

a. menggunakan produk dalam negeri; a. use domestic products;
b. menggunakan subkontraktor lokal; b. engage local subcontractors;
c. menggunakan tenaga kerja lokal; c. employ local workers;
d. melakukan kegiatan sesuai dengan jenis danbidang usahanya;
d. perform activities within their types andfield/lines of business;
e. menyampaikan setiap dokumen kontrak jasapertambangan dengan pemegang IUP atauIUPK;
e. submit any documents of mining servicescontract with Mining Permit holders orSpecial Mining Permit holders.
f. melakukan upaya pengelolaan lingkungansesuai dengan ketentuan peraturan perundang-undangan;
f. use efforts to manage the environment underprovisions of laws and regulations.
g. mengoptimalkan pembelanjaan lokal baikbarang maupun jasa pertambangan yangdiperlukan dalam pelaksanaan kegiatan usaha

g. optimize local expenditures on either mininggoods or services as required in theperformance of their services businessactivities;
h. melaksanakan ketentuan keselamatan dankesehatan kerja sesuai dengan ketentuanperaturan perundang-undangan;
h. implement the requirements of occupationalsafety and health under provisions of laws andregulations;
i. membantu program pengembangan danpemberdayaan masyarakat meliputipeningkatan pendidikan dan pelatihan,
i. assist the community development andempowerment program that includesenhancement of education and training,

health, and local economic growth; and
j. menyusun dan menyampaikan laporankegiatan kepada pemberi IUJP atau SKT.

Pasal 24 Article 24
(1) Kewajiban penyusunan laporan sebagaimanadimaksud dalam Pasal 23 huruf j berupalaporan pelaksanaan kegiatan:
(1) Obligations of preparation of a report asintended by section Article 23 item (j) shall bea report on the implementation of activities:
a. triwulan; dan a. on a quarterly basis; and
b. tahunan. b. on an annual basis.
(2) Laporan triwulan dan tahunan sebagaimanadimaksud pada ayat (1) meliputi:

(1) Pemegang IUJP atau SKT yang diterbitkanoleh Menteri wajib melaporkan IUJP atauSKTnya kepada gubernur ataubupati/walikota tempat kegiatan usahanya.
(1) Minister-issued Mining Services Licenseholders or Minister-issued Certificate ofRegistration holders must report their MiningServices Licenses or Certificates ofRegistration to the governors or theregents/mayors with jurisdiction over theirplace of business.

(1) Menteri melakukan pembinaan kepadagubernur dan bupati/walikota dalammenyelenggarakan usaha jasa pertambangan.
(1) The Minister shall set directions for thegovernors and the regents/mayors in theconduct of mining services business.
(2) Menteri dapat melimpahkan kepada gubernuruntuk melakukan pembinaan kepadabupati/walikota dalam menyelenggarakanusaha jasa pertambangan.
(2) The Minister may assign the governors to setdirections for the regents/mayors in theconduct of mining services business.
(3) Menteri, gubernur atau bupati/walikota sesuaidengan kewenangannya melakukan
pembinaan kepada pemegang IUJP dan SKT.
(3) The competent Minister, governors orregents/mayors shall set directions for Mining
Services License holders or Certificate ofRegistration holders.
(4) Pembinaan sebagaimana dimaksud pada ayat(3), dilakukan dengan cara:

Pasal 28 Article 28
(1) Gubernur wajib menyampaikan laporanpembinaan penyelenggaraan jasapertambangan di lingkup wilayahnya kepadaMenteri.

(2) Bupati/walikota wajib menyampaikan laporanpembinaan penyelenggaraan jasapertambangan di lingkup wilayahnya kepadagubernur.

(2) The Minister may delegate authority to thegovernors to exercise supervision over theregents/mayors for the conduct of MiningServices Business.
(3) Menteri, gubernur atau bupati/walikota sesuai
dengan kewenangannya melakukanpengawasan kepada pemegang IUJP atauSKT.
(3) The competent Minister, governors or
regents/mayors shall exercise supervisionover the Mining Services License holders orCertificate of Registration holders.
(4) Pengawasan sebagaimana dimaksud pada ayat(3) meliputi pengawasan administrasi danteknis.
(4) Supervision as intended by section (3) shallinclude administrative and technicalsupervision.
Pasal 30 Article 30

Article 31
(1) Menteri, gubernur atau bupati/walikota sesuaidengan kewenangannya dapat memberikan

sanctions against Mining Services Licenseholders or Certificate of Registration holderswho are in violation, as follows:
a. melaksanakan kegiatan tidak sesuaidengan IUJP atau SKT; atau
a. perform activities other than inaccordance with the Mining ServicesLicense or the Certificate of Registration;or
b. tidak menyampaikan laporan pelaksanaankegiatan triwulan 3 (tiga) kali berturut-turut;
b. fail to submit quarterly reports on theperformance of activities 3 (three)consecutive times;
c. tidak melaksanakan kewajibansebagaimana dimaksud dalam Pasal 23sampai dengan Pasal 26;
c. fail to meet obligations as intended byArticle 23 through Article 26;
d. memberikan data yang tidak benar ataumemalsukan dokumen.

(2) Sanksi administratif sebagaimana dimaksudpada ayat (1) berupa:

Pasal 32 Article 32(1) Peringatan tertulis sebagaimana dimaksud
dalam Pasal 31 ayat (2) huruf a dikenakankepada pemegang IUJP atau SKT yangmelanggar ketentuan sebagaimana dimaksuddalam Pasal 31 ayat (1).
(1) Written warnings as intended by Article 31section (2) item (a) shall be issued to MiningServices License holders or Certificate ofRegistration holders who are in violation ofthe provisions as intended by Article 31section (1).
(2) Peringatan tertulis sebagaimana dimaksudpada ayat (1) diberikan paling banyak 2 (dua)kali, dengan jangka waktu peringatan masing-
masing paling lama 1 (satu) bulan.
(2) Written warnings as intended by section (1)shall be issued not exceeding 2 (two) times ata monthly interval.
Pasal 33 Article 33
(1) Dalam hal pemegang IUJP atau SKT sampaiberakhir jangka waktu peringatan tertulissebagaimana dimaksud dalam Pasal 32 ayat(2) belum melaksanakan kewajibannya,Menteri, gubernur atau bupati/walikota sesuaidengan kewenangannya mengenakan sanksiadministratif berupa penghentian sementara
kegiatan atas sebagian atau seluruh bidangjasa pertambangan sebagaimana dimaksuddalam Pasal 31 ayat (2) huruf b.
(1) Where Mining Services License holders orCertificate of Registration holders have notmet their obligations by the time the writtenwarning period expires as intended by Article32 section (2), the competent Minister,governors or regents/mayors shall imposeadministrative sanctions through suspension
of the part or all of the activities of miningservices as intended by Article 31 section (2)item (b).

(2) Sanksi administratif berupa penghentiansementara kegiatan atas sebagian atau seluruhbidang usaha jasa pertambangan sebagaimanadimaksud pada ayat (2) dikenakan dalam
jangka waktu paling lama 2 (dua) bulan.
(2) Administrative sanctions through suspensionof the part or all of the activities of miningservices as intended by section (2) shall beimposed for a period not exceeding 2 (two)months.
(3) Sanksi administratif sebagaimana dimaksudpada ayat (2) dapat dicabut apabila pemegangIUJP atau SKT dalam masa pengenaan sanksitelah memenuhi kewajiban yang telahditentukan.
(3) Administrative sanctions as intended bysection (2) may be withdrawn if the MiningServices License holders or the Certificate ofRegistration holders have within such awarning period already met their obligations.
Pasal 34 Article 34
Sanksi administratif berupa pencabutan IUJP atauSKT sebagaimana dimaksud dalam Pasal 31 ayat(2) huruf c, dikenakan kepada pemegang IUJPatau SKT yang tidak melaksanakan kewajibannyasampai dengan berakhirnya jangka waktupengenaan sanksi penghentian sementara kegiatanatas sebagian atau seluruh bidang jasapertambangan sebagaimana dimaksud dalam Pasal33 ayat (2).
Administrative sanctions through revocation ofMining Services Licenses or Certificates ofRegistration as intended by Article 31 section (2)item (c) shall be imposed against Mining ServicesLicense holders or Certificate of Registrationholders who fail to meet their obligations until theperiod of imposition of sanction throughsuspension of part or all of the activities of miningservices as intended by Article 33 section (2) haselapsed.
Pasal 35 Article 35
Dalam hal di kemudian hari diketahui bahwa datadan informasi yang disampaikan oleh pemegangIUJP atau SKT sebagaimana dimaksud dalamPasal 24 dinilai tidak benar, maka Menteri,gubernur, atau bupati/walikota sesuai dengankewenangannya dapat mencabut IUJP atau SKT.
Where it is found at a later date that data andinformation that are submitted by Mining ServicesLicense holders or Certificate of Registrationholders as intended by Article 24 are deemeduntrue, the competent Minister, governors, orregents/mayors may revoke the Mining ServicesLicenses or Certificates of Registration.
BAB VIIKETENTUAN PERALIHAN
Pasal 36
CHAPTER VIITRANSITIONAL PROVISIONS
Article 36
(1) Pada saat Peraturan Menteri ini mulai berlaku,IUJP yang telah diterbitkan sebelumditetapkannya Peraturan Menteri ini tetapberlaku sampai berakhirnya masaperizinannya dan dalam pelaksanaannya wajibmenyesuaikan dengan Peraturan Menteri ini.
(1) Upon this Regulation of the Minister cominginto effect, Mining Services Licenses thathave been issued prior to the issue of thisRegulation of the Minister shall remain validuntil the license period expires and mustfurther be subject to adjustment to thisRegulation of the Minister.
(2) Pada saat Peraturan ini mulai berlaku,pemegang Kuasa Pertambangan, KontrakKarya, dan Perjanjian Karya PengusahaanPertambangan Batubara yang telah
