To: Regional Board Date: October 31, 2012 From: Bruce Simard, GM of Development Services Kim Frech, Chief Financial Officer Subject: Blueberry First Nations Proposal for Additions to Reserve RECOMMENDATION(S): That the Regional Board respond to Ratcliff & Company thanking them for the opportunity to comment on the proposed additions to reserve by the Blueberry First Nations, and advise that the Regional District has no objections, questions or concerns regarding the proposal. BACKGROUND/RATIONALE:
Further to Directive 10-1 of the Aboriginal Affairs and Northern Development Canada, the Blueberry First Nation, represented by Ratliff & Company, has submitted the attached information to consult with the Regional District concerning proposed additions to the existing reserve. Obtaining reserve status for these lands will transfer jurisdiction to the federal government under the Indian Act. Where requested by a municipality (or First Nation), there is a requirement to negotiate in areas such as, joint land use planning/bylaw harmonization, tax considerations, service provision and future dispute resolution. However, municipal governments do not have a general or unilateral veto over the granting of reserve status. There are no matters recommended for negotiation in this proposal.

Official Community Plan: “Agriculture Rural” in Rural OCP Bylaw No. 1940,2011 Zoning: A-2 (Large Agricultural Holding Zone) Zoning Bylaw No. 1000, 1996 ALR: within the ALR (separate consultation made to the ALC)
FINANCIAL CONSIDERATION(S): Total Land Taxable Value: $548,750 (land only- no improvements exist) Service Areas: Solid Waste Buick Arena NP Leisure Pool
*All of which are on improvements only so no tax effect.

Legislative Regional Admin Fiscal Services RD Development Electoral Area Management of Development Emergency Planning Building Inspection Weed Control Grants to Community Organizations
Relative to the total tax revenues of Electoral Area B, the loss of $90.87 would not be a reasonable justification to require a net tax loss adjustment.
