Court Calendar 2018 Court of Queen’s Bench of Alberta - Sitting Dates

Sittings of the Court of Queen’s Bench of Alberta for the trial of civil and criminal cases, and for the hearing of motions and other business will open at the times and locations listed below.

Where the opening day of a Court sitting week is a holiday, the sitting will commence on the following day. Unless otherwise noted, sittings commence at 10:00 a.m.

Special Chambers are held on Mondays at 1:30 p.m. in the first, second and fourth weeks of the month, as well as Thursday at 2:00 p.m. in the second week of the month

Alberta Indigenous Court Worker Program

The Indigenous Court Worker program delivers province wide services to Indigenous people who are involved in the justice system in either family or criminal court. The program is intended to facilitate and enhance access to justice by assisting Indigenous people to obtain fair and culturally sensitive treatment in the justice system, especially during the court process. The Indigenous Court Worker Program has both a criminal and family component. The Program has been in existence in Alberta for over 35 years.

Alberta Indigenous Criminal Court Worker Program

Objective Indigenous Court Worker Program seeks to facilitate and enhance access to the justice system by Indigenous people involved in the courts and to ensure they receive fair, equitable and culturally sensitive treatment.

• Provide all eligible Indigenous persons appearing in court a program of counselling, other than legal advice in relation to court procedures, rights under the law and availability of legal aid or other resources and referral thereto of such persons who have been charged with an offence under any federal or provincial statute or municipal by-law.

• Assist Indigenous people to understand their right to speak on their own behalf or to request legal counsel; to better understand the nature of the charges against them; and the philosophy and functioning of the criminal justice system.

• Assist in enhancing the awareness and appreciation by those involved in the administration of the criminal justice system of the values, customs, languages and socio-economic conditions of Indigenouss.

Cost There is no cost in accessing this service.

Key Criteria • Clients must be of Indigenous ancestry.

What happens after? (only if required) • The Indigenous client will be provided with information on the nature of the

charges, rights, court procedures, roles and responsibilities, alternative justice options and possible outcomes.

• The client will be provided with information and availability of legal and community social resources and make client referrals to these services as required.

Alberta Indigenous Family Court Worker Program

Objective Indigenous Court Worker Program seeks to facilitate and enhance access to the justice system by Indigenous people involved in the Alberta Provincial Family Court and to ensure they receive fair, equitable and culturally sensitive treatment.

• Provide a culturally appropriate province-wide program for Indigenous individuals or families appearing on child protection, parenting, contact or guardianship matters before the Provincial Court of Alberta Family Division.

• Provide Indigenous clients with language interpretation services, and assistance in understanding Family Court procedures and the individual’s legal rights and privileges.

• Provide advice, assistance, non-therapeutic counselling and support to Indigenous individuals or families involved in Provincial Family Court regarding the facilities, programs and resources available in the community.

Cost There is no cost in accessing this service.

Resolution Services - Information Services

Information Services is offers assistance for Albertans to find appropriate information on court procedures and legal service options, assistance locating and filling out court forms and referrals to other community legal resources. These services are available for both family and non-family issues.

Information Services is available throughout the province and provides assistance through the phone (CALL), website (CLICK) or in-person (COME IN).

COME IN – In-person Self Help

Objective Information Services provides information, materials, assistance and referrals to the general public (particularly self-represented parties), the legal community, the judiciary and government offices/agencies regarding court procedures and documentation required for most legal matters.

Civil (non-family) and criminal issues: Information Services staff provides information and assistance locating forms and general guidance on the use of court forms. Referrals are provided to non-government agencies to obtain legal advice.

Family Law issues: Information Services has available all the prescribed forms for court applications under the Family Law Act and the Interjuridictional Support Orders Act as well as a number of fill in the blank forms to assist individuals with various applications under The Divorce Act. Most forms and packages are also available on the RS website www.rcas.alberta.ca in a fillable format.

Court clerks prepare the order and ensure it is filed with the court and that copies are provided to the parties, often on the day it is ordered.

Resolution Services - Assessment Services

Assessment Services works directly with self-represented individuals and families to find appropriate solutions for family law issues. Families are provided with information regarding court process, dispute resolution options, community resources, educational programs aimed at assisting parents in reducing parental conflict and developing child-focused parenting plans. Assessment Services offices are located in 13 regions throughout the province with additional circuit locations, often co-located with the Courts.

Objective Assessment Services provides assistance to individuals parenting apart to resolve parenting disputes and to access the Court system when required. Intake consultations happen in person, by phone or other electronic means. Information is provided about options, programs and supports while assessing clients’ safety needs and the needs of children. Discussions promote dispute resolution options empowering clients whenever possible to be in charge of the decisions.

Services may include • Safety screening for family violence • Information on options and services for resolving child-related disputes • Information on the effects of separation and conflict on children • Assistance with negotiating agreements and resolving disputes • Assistance with court applications such as parenting, guardianship, contact,

child support or enforcement of time with a child • Assistance with arranging court dates • Referral to a Caseflow Conference (Edmonton, Calgary and Grande Prairie

only) • Referral to In-Court Assistance services provided by Family Court

Counsellors, including preparation of court presentations and assistance in Provincial Court courtrooms

Key Criteria • Available to Albertans with dependent children with family law issues

relating to their children. • Mandatory by regulation in Calgary, Edmonton and Grade Prairie for self-

represented parties filing: (i) a Family Law Act claim for parenting, contact or guardianship or (ii) an application under the Extra-Provincial Enforcement of Custody Orders Act respecting the enforcement or variation of a custody order or the making of a custody order in Provincial Court.

Family Court Assistance

Objective Assessment Services provides several services to assist self-represented parties with their court matter and ensure courtroom matters flow smoothly.

• Family Court Counsellors (FCCs) - Provincial Court, Family Family Court Counsellors help self-represented parties in the Provincial courtroom navigate their family law matter. FCCs meet with the parties before court to discuss the issues, promote collaboration, explore options and make referrals, including to mediation if possible. They assess the parties’ readiness for court, and assist the parties to prepare for the courtroom experience. They assist the court by introducing the parties, providing a summary of the matters to be addressed, noting helpful resources when possible for the court, and facilitating referrals.

• Caseflow Conference (limited locations) Caseflow Conference is a program in the Provincial Court of Alberta and is required in Calgary, Edmonton & Grande Prairie. It is also mandatory for Familiy Law Act applications filed in Calgary Court of Queen's Bench. It is an alternative to a docket appearance in court before a judge. Matters are set to Caseflow Conference when someone without a lawyer applies to the Provincial Court about a child- related matter. Represented parties may use the program if they wish. The Caseflow Conference is a meeting which provides the parties the opportunity to talk about the issues in a private, less formal atmosphere than a courtroom. Parties are provided information regarding resources available to help them in resolving their dispute such as mediation and attending courses. If the parties consent, a draft court order can be created for a judge to review. The parties do not have to appear in court for the judge’s review.

Cost There is no cost to participants.

Resolution Services - Dispute Resolution Services

Dispute Resolution Services is a group of programs offered by Alberta Justice and Solicitor General in collaboration with the Courts of Alberta. Dispute Resolution Services’ programs help Albertans to find appropriate solutions for family and non-family issues that may otherwise require court intervention. Programs are located in multiple cities across Alberta and are available to qualifying parties at no cost.

Provincial Court Civil Mediation

Objective Provincial Court Civil Mediation offers mediation at no charge to parties with civil claims in the Provincial Court. The program aims to help parties reach a negotiated settlement instead of going to trial. The program is available throughout Alberta.

Mediations are carried out by trained and skilled practitioners whose names are listed on a roster. A team of two mediators guides the parties through the mediation process. The program is governed by Regulation 271/97 of the Provincial Court Act.

Cost There is no cost to the parties.

Key Criteria • For the matter to be eligible for mediation, a Dispute Note must be filed in

the Provincial Court.

Access Referrals to the programs may come in three ways:

• The Court may direct the action for mediation • The Mediation Co-ordinator may refer the action for mediation • Parties may request a mediation appointment at the time they file their

Notice of Claim or Dispute Note

What happens after the Mediation? If the matter settles at mediation, an agreement is drafted and placed in the court file. If the matter does not settle, a party may choose to have their matter heard

Family Mediation

Objective Families are provided with the opportunity to meet with a Mediator who assists them to communicate, negotiate and to cooperate focusing on the needs of the child(ren) when resolving disputes. Mediators encourage parties to work collaboratively and avoid the adversarial court process. At the end of their mediation session, participants are provided with a Mediation Report that summarizes any agreements made. The Mediation Report is not signed, however parties are informed how to use the Report to obtain a Court Order or binding agreement should they wish to do so. Mediation usually occurs in person but may occur via telephone or video conferencing when appropriate and available.

Issues that may be addressed in Family Mediation:

• Parenting plans • Communication • Contact (time with a child) • Child support issues • Spousal support • Guardianship • Some property matters

Cost There is no cost to families who meet Resolution Services financial eligibility criteria.

Key Criteria • Must have at least one dependent child (under 18 years of age, or 18 years

and over and eligible for continued child support. • One party must have a gross annual income of less than $40,000. • Mediation cases are screened for appropriateness for mediation. • Participation is voluntary and both parents must agree to participate in

mediation. • Available to parties who are considering or have commenced actions in

Provincial Court or Court of Queen’s Bench. • Court action is not required to participate in the mediation process.

Parties are encouraged to seek independent legal advice regarding any agreements that are reached in mediation. If both parties agree, they may choose to incorporate the terms of their Mediation Report into an enforceable consent Court Order.

Lawyers may attend with their clients as support persons.

Children’s Services Mediation Program: Provincial Court

Objective Children’s Services Mediation Program is a joint venture between Resolution Services and the ministry of Children’s Services. .When a child or youth is assessed to be in need of intervention by Child Intervention worker from Children’s Services, the child, youth, guardians, foster-parents and/or others with a significant connection to the child may not agree about the decisions that need to be made. Mediation is an option to resolve these disputes, providing an opportunity for the participants to talk about important issues in a safe, confidential environment. Mediation services can also be accessed in non-court contested cases and throughout the spectrum of child intervention services, including: situations of parent-teen conflict; disputes between caregivers; and highly conflictual custody and access cases. Mediation may occur via telephone or video conferencing when appropriate and available. Mediation in these disputes is enabled through the Child, Youth and Family Enhancement Act.

Cost There is no cost to the parties.

Key Criteria • On contested applications made under the Child, Youth and Family

Enhancement Act a referral can be made by the parent/guardian, caseworker ,judge, youth or lawyers

• On all Children’s Services matters, mediation is voluntary • Cases are screened by Children’s Services for appropriateness for mediation • Support Persons, including lawyers, may attend mediation with consent of

all parties

Access Referral to mediation can be made by any of the potential participants by calling the numbers listed below.

What happens after mediation? When mediation results in an agreement or plan, a summary report is provided to each participant. In Court related matters, the agreement/plan is placed on the child’s file with Children’s Services and pending approval from respective guardians may be shared with the parties’ lawyers or entered into the Court record. In matters that are not before the Court the agreement/plan belongs to the participants and will only be shared with others, including the caseworker, if the participants agree. Participants complete an evaluation at the end of mediation.

Dispute Resolution Officer (Calgary) and Child Support Resolution (Edmonton)

Objective The Dispute Resolution Officer (DRO) program is available in Calgary and the Child Support Resolution (CSR) program is available in Edmonton. Meetings are designed to help parties resolve their child support disputes.

The programs are governed by Court of Queen’s Bench Family Law Practice Note 4 which establishes the criteria for participation. Access to the program may also be available for matters in the Provincial Court.

The parties (and their lawyers, if applicable) meet for one hour with a DRO/CSR officer, who will discuss the matter with the parties, assess the state of their financial disclosure, describe the requirements of the Child Support Guidelines and help parties resolve their dispute. If the parties are able to reach a settlement, the DRO/CSR officer will draft a Consent Order which is submitted to the court for review. If parties are unable to resolve their issues in the meeting, the DRO/CSR officer sets out next step(s) for the parties.

Cost There is no cost to the parties for DRO/CSR meetings.

Brief Conflict Intervention

Objective Brief Conflict Intervention (BCI) is a service for parties who are parenting apart and having difficulties resolving a parenting dispute. Up to ten hours of solution-focused intervention from a specialized, roster clinician is provided.

The clinician helps the parties to better understand the needs of their child(ren) during separation or divorce, to gain greater understanding of the conflict and its effects on their child(ren), and to reach an agreement (when possible) regarding their specific dispute.

The clinician may: • conduct parent, parent-child, and child sessions; • educate about child(ren)’s developmental needs and abilities and the quality

of parent-child relationships; • educate about the adverse effects of parental conflict on child development; • explore family and individual strengths; • examine problem solving skills and conflict resolution style and discuss

new possibilities or alternatives; • assist to resolve identified issues and create (or draft) parenting agreements

that may be made; • explore further options to assist the participants (i.e.: individual therapy,

courses/classes, individual assignments, access resources, etc.); • help focus on parenting in the future.

Cost There is no cost to the parties who meet the Resolution Services eligibility criteria, however the parties are expected to cover their own travel and accommodation costs, if any are required to attend appointments.

dispute • Brief Conflict Intervention may be ordered by the court • Both parents must agree to participate in the intervention

Parenting After Separation (PAS)

Objective Parenting After Separation is a six hour seminar available either in-person or online. The course offers information to parents about the separation and divorce process, the effects of separation and divorce on children, techniques for communication when parenting apart and legal information that effects parents and children. PAS teaches parents the importance of working together to meet children’s health, social, educational and emotional needs. The program encourages parents to attend mediation and to consider other dispute resolution options. A certificate of PAS completion is provided to participants.

Parenting After Separation For Families in High Conflict (PASHC)

Objective Parenting After Separation for Families in High Conflict (PASHC) is a three hour seminar available to parents in Edmonton and Calgary. Parents attend separate sessions. A certificate of completion is issued to participants.

PASHC offers information about the process of separation, how to emotionally disengage from one another and how to identify and renegotiate boundaries. Parents will be encouraged to develop a parallel parenting plan, which can be an effective tool to reduce conflict and minimize the contact between parents.

Course topics include: • The Importance of Protecting Children from High Conflict Situations • Managing Emotions • Setting Boundaries • Parallel Parenting Plans • Conflict-Reducing skills and strategies

Objective Focus on Communication in Separation (FOCIS) is a six hour, skill-based course teaching parents how to communicate effectively while living apart. FOCIS aims to enhance the communication skills of parents, reduce parental conflict and improve long term outcomes for children. Parents completing the course will be able to decrease tension and stress for themselves and their children by reducing conflict through improved communication and problem solving skills. Parents attend separate groups so each parent has a safe place to learn and practice new skills. A certificate of completion is provided at the end of the course.
