MOTION OPENING OF PARLIAMENT OF

MALAYSIA BY HIS MAJESTY THE YANG DI-PERTUAN AGONG

ADDRESS OF THANKS The Minister without Portfolio (Enche' Khaw Kai Boh): Mr President, Sir, it is my privilege now to introduce the first item of parliamentary business in this

first session of Dewan Negara to be held in these new Houses of Parliament, and to move that an humble Address be presented to His Majesty the Yang di-Pertuan Agong as follows: "Your Majesty,

We, the President and Members of the Senate in Parliament assembled, desire humbly to thank Your Majesty for this most magnificent building here in Your Majesty's capital town of Kuala Lumpur which Your Majesty in graciously declaring open on this day, the 2nd of November, 1963, has dedicated forever to the purposes of the Parliament of Malaysia".

I move this motion in a spirit of deep respect and gratitude to His Majesty the Yang di-Pertuan Agong for his gracious act this morning in declaring open, dedicating and handing over this noble building as the permanent home of the Parliament of Malaysia.

In doing so, may I express on behal of all the Members of this House our warmest thanks to His Majesty not only for His Majesty's thoughtful Address on this memorable day but also for presenting to us and to our Honourable Members in Dewan Ra'ayat this splendid gift which His Majesty himself described as "a worthy setting

indeed for the expression and achieve­ment of our ideals". In fact, looking around me at the restful atmosphere and plush cushion seats of this House, I am rather apprehensive of the increa­sing factor for the inducement of respectful silence in the Members of this House. However, I trust that with the tasks ahead of us in Malaysia and the zest and eloquence of the Members on both sides of this House, this unlikely event will not occur.

Members of this House who sat in the former Parliament of the Federation of Malaya will remember with affection the old Chamber we have left behind us where a great experiment on democracy began its electrifying course in this country. That is now a part of our history. Compared with this stately House the old Chamber seems now to have a humble beginning, but I hope that the atmosphere of friendly give and take (sometimes not so friendly) and the respect for the dignity and authority of the House which was so characteristic of the old Chamber will continue in this newer and grander setting.

The physical aspect of the House has changed and the membership of this House has grown from 38 to 50. Today the Members of the old Dewan Negara have observed the swearing in of six new Members from Singapore, Sarawak and Sabah and together we sit jointly for the first time as the Upper House of the new Parliament of Malaysia. This is indeed a truly historic moment in the history of Malaysia, and I take this opportunity of extending the warmest possible welcome to all the new Mem­bers. {Applause). In doing so, I am sure that we will carry on all the fine traditions of Parliament already estab­lished in a spirit of loyal and devoted service to the nation and people of Malaysia.

As Members of the Parliament of Malaysia we hold positions of great responsibility and trust particularly in these difficult days when Malaysia has become a target for an unearned and hostile policy of confrontation from our close neighbour. To counter this hostility and to uphold the dignity and honour of our country we must show in

every way that throughout Malaysia there is a strong and abiding spirit of national unity. We must have faith, unswerving faith, faith in freedom, faith in our ideals, and faith in God. It is essential to show our unmistakable determination to stand firm. In fact the meeting of our Parliament for the first time today, Parliament with represen­tatives from all the States of Malaysia, is in itself an exemplary demonstration of our national unity, our unswerving faith and sense of destiny and mission about Malaysia. Composed as it is of many parties, this House will undoub­tedly hear many arguments and diffe­rences of opinion on many issues, for that after all is the way of democracy, and it is our democratic right and duty to debate the details of our policy and programmes, but combined together this Parliament speaks and acts for the whole nation of Malaysia. As Members of this House, let us never fail to forget this fact, for this is the reason for the responsibility, the trust and the confi­dence the people of Malaysia have delegated to us.

Mr President, Sir, I have every confidence that the sessions of this House over which you have the dis­tinguished duty to preside will be conducted is such a way as to strengthen always the spirit of national unity, to justify constantly the leadership and counsel we are called upon to give, and to fulfil to the best of our ability the earnest aspirations of our people that the nation of Malaysia will be an example to the world of peace and happiness, progress and prosperity. Whatever differences of party there may be, these are the aims and objects which must guide and unite us in the Parliament of Malaysia. As we work together, let us always remember that those few things that might divide us are nothing compared to the great principles and policies which unite the free world. Together, let us work for this future, pledging to the world peace and justice, prosperity and trade, all achieved in a political climate that honours the ideals of freedom and dignity of man.

Mr President, Sir, in presenting this motion to the House thanking His

Majesty the Yang di-Pertuan Agong for the gracious gift of this Parliament buildings I wish to reaffirm our unswer­ving loyalty, allegiance and affection to His Majesty as the Supreme Head of Malaysia.

Enche' Ahmad bin Haji Taff: Yang Berhormat Tuan Yang di-Pertua, saya dengan sukachita-nya menyokong cha-dangan yang di-kemukakan oleh Yang Berhormat Menteri yang tidak ber-jabatan Senator Khaw Kai-Boh untok menyampaikan uchapan terima kaseh kapada Seri Paduka Baginda Yang di-Pertuan Agong. Tuan Yang di-Pertua, dan ahli2 persidangan yang berhormat. Kami menjunjong tinggi atas kebijak-sanaan Seri Paduka Baginda Yang di-Pertuan Agong yang telah me-ngurniakan bangunan yang permai dan indah ini ada-lah sa-suai dengan masa dan keadaan dengan terbentok-nya negara baharu kita Malaysia. Bangunan yang tersergam ini, Tuan Yang di-Pertua, ada-lah menjadi lambang atau simbol ke'adilan serta menunjokkan kema'amoran dan ketenteraman dalam negara bagi seluroh ra'ayat di-serata wilayah Malaysia, dan lagi, Tuan Yang di-Pertua, dengan sumpah dan ikrar yang di-akui dalam Dewan ini ada-lah menjadi tanggong-jawab kita semua mempertahankan kehormatan dan kedaulatan Perlembagaan Negara kita Malaysia dengan mempunyai ta'at setia yang tidak berbelah bahagi kapada negara dan kapada ka-bawah Duli Yang Maha Mulia Seri Paduka Baginda Yang di-Pertuan Agong.

Tuan Yang di-Pertua, ada-lah men­jadi kewajipan kapada kita semua menentang sa-barang anchaman, baik dari luar negeri atau pun dari dalam, sama ada anchaman itu dengan gerakan atau pun fahaman yang berlawanan dengan chita2 kita seluroh ra'ayat Malaysia yang berpadu dan berazam mengekalkan ketenteraman dan mem-berikan kema'amoran kapada ra'ayat seluroh-nya.

Dewan Yang Berhormat, saya lagi sa-kali menyatakan dengan sukachita-nya menyokong penoh chadangan yang

di-kemukakan oleh Menteri Yang Berhormat tadi, terima kaseh. (Tepok).

Enche' T. H. Tan: Mr President, Sir, it gives me great pleasure to speak in support of the motion before the House this morning.

Those of us who have followed the evolution of parliamentary practice here note with gratitude and satisfaction the progress our country has made since the day of appointed Councils. It was not so long ago in terms of history that our country was served by people specially selected or favoured by the Colonial Power. Today we have had proper elections since 1955.

This magnificent building, Sir, is a monument to parliamentary progress and shows that parliamentary democ­racy is here and has come to stay. Members of this House are glad to note that at last the Senate has come into its proper place on the same floor as the Lower House in the same manner as the two Houses in the Mother of Parliaments in England.

Mr President, Sir, as the Party Whip in the Senate, it gives me very great pleasure to add my warm welcome to that expressed by the Honourable Minister to the new Members from Sabah, Sarawak and Singapore. Their long experience and advice will, I assure them, be received in the right spirit in this House. (Applause).

Enche' Amaluddin bin Darus: Tuan Yang di-Pertua, saya mengambil ke-sempatan pada hari ini untok bersama2

mengalu2kan dengan menyokong atas Usul yang di-kemukakan oleh Yang Berhormat Menteri yang tidak ber-jabatan dan menguchapkan terima kaseh sa-tinggi2-nya kapada Duli Yang Maha Mulia Seri Paduka Baginda Yang di-Pertuan Agong berkenaan pemberian bangunan baharu Parlimen bagi negara kita ini.

Tuan Yang di-Pertua, sa-sunggoh-nya sudah tetap-lah menjadi kebanggaan kapada kita semua sa-bagai ra'ayat yang menchintai demokrasi supaya ia berjalan dan kekal di-dalam negara kita ini. Sa-buah Parlimen yang bukan sahaja chantek dan indah, tetapi dia

juga yang dapat kita banggakan sa-bagai lambang dan jalan demokrasi dalam negara kita yang di-chintai ini. Dalam pada itu, Tuan Yang di-Pertua, ingin juga saya menyatakan bahawa bagi kita di-dalam sa-buah negara yang demok­rasi, sa-buah Parlimen yang indah, bangunan yang chantek di-dalam-nya ada Dewan yang molek saperti ini tidak-lah menchukupi, yang penting ia-lah pelaksanaan2 demokrasi baik dalam Dewan sidang2 meshuarat atau dalam bentok kenegaraan kita harus sa-imbang perjalanan-nya saperti tujuan kita mengujudkan lambang kita yang indah dan chantek. Tuan Yang di-Pertua, di-dalam sa-buah negeri yang demokrasi, sa-tiap2 anggota yang di-pileh oleh ra'ayat boleh berchakap dengan bebas dalam bangunan Parlimen, hendak-nya biar-lah di-dalam negara yang demokrasi kita ini yang mempunyai bangunan yang indah dan chantek mempunyai pula alat2 yang lengkap serba serbi-nya untok menyampaikan kapada ra'ayat yang mewakilkan wakil-nya dalam bangunan Parlimen untok menyampaikan pendapat mereka bahawa ra'ayat itu dapat pula hak demokrasi yang sa-betul2-nya dan sa-tepat2-nya. Apa yang saya ketahui pernah di-kata orang, Parlimen yang tidak mempunyai berita2 di-dalam akhbar2, perbinchangan2 yang berlaku di-dalam Parlimen yang tidak dapat lapangan di-dalam akhbar sama-lah saperti jam di-dinding yang tidak berbunyi, oleh yang demikian indah-nya Parlimen kita ini tidak-lah hanya menjadi indah dalam bentok rupa, tetapi hendak-lah merupakan dalam bentok kata2 pada perbuatan sa-hingga ra'ayat negeri ini tidak sahaja berbangga dengan ujud-nya sa-buah Parlimen, tetapi dia berbangga segala sa-suatu yang berlaku dalam Parlimen negara kita ini akan dapat di-ne'mati bersama sa-bagai hasil bagi kepentingan ra'ayat dalam dunia demokrasi.

Tuan Yang di-Pertua, sa-lain daripada kita telah mengujudkan bangunan baharu ini saya berharap juga di-dalam negara kita ini supaya ujud-nya kebe-basan persurat khabaran yang benar2

yang membolehkan sa-tiap ra'ayat mengikuti dengan benar dan betul segala perkembangan politik yang

berlaku di-dalam negara kita, jika perkembangan dalam negeri kita ini dalam persurat khabaran tidak me-muaskan maka erti Parlimen bagi sa-buah negara yang demokrasi tidak-lah memuaskan bagaimana yang di-mak-sudkan demokrasi yang sa-benar2-nya oleh sa-tiap ra'ayat yang chintakan demokrasi dan ingin berparlimen di-dalam negara-nya. (Tepok).

Enche' Athi Nahappan: Tuan Yang di-Pertua, I have great pleasure in supporting the motion of the Honou­rable Minister and in associating myself with the views expressed by Senator Enche' T. H. Tan.

Sir, this is a great day to the nation. It is a day when we re-affirm our conviction and faith in parliamentary democracy by establishing this standing Monument to which not only we in our life time will pay our reverence but also our children and their children hereafter. There were critics when the idea was conceived to construct the Parliament at this site. Some felt that this serene beauty of the Lake Gardens was being encroached upon by the building of large roads into it and putting up a very large building right in the heart of the Garden. But today we see that that criticism does not stand. In fact, the creation of this building has added beauty to the atmosphere and also a great prestige to the area. We will be witnessing in the years ahead people from different parts of the country coming here to pay their respect and homage to the place where the laws of the country are being made. This will be the place where parliamentary democracy will be taking a firm root through constitutional process and by the application of fundamental liberties enshrined in our Constitution.

Sir, it is very heartening to see in this region, particularly South-East-Asia, that Malaya after attaining her independence, has continuously and consistently shown to the rest of the world its faith in the rule of law, its faith in the fundamental liberties includ­ing the freedom of expression and speech, as provided in our Constitution, its faith in the due process of law—and as a standing symbol we have not lost

our time, our dedication, our deter­mination, in putting up this magnificent temple of Parliament. This is indeed something that is heartening, something that is highly refreshing, because what we witness from the Middle East to the Far East is this process of ostensibly loud dedication to democracy and, thereafter, democracy not standing the test of time and falling victim to expediency and emotional outbursts. As a result, democracy has fallen in a number of countries. What we are witnessing is totalitarianism stepping in in place of democracy, militarism taking over administration, the various forms of guided and controlled and subdued forms of democracy in other countries. Various justifications are given. It has been said that you cannot transplant democratic ideas, which grew in Western countries, overnight in Eastern countries in different atmospheres, in different traditions and in different cultures; and, therefore, they say that there must be, initially, dictatorship, totalitarianism of some kind until people begin to realise the rudiments of democracy. That is the justification that has been presented, where initially democratic institutions were set up and subsequently these institutions have been modified to resort to totalitarian ways. But, here in Malaya, since independence we have not only been firmly wedded to the principles and practice of democracy, but we have continued to show our dedication by firmly establishing this wonderful structure.

Sir, it is appropriate that the New Parliament Building is being opened at a time when the Commonwealth Parliamentary Conference is being held right here—said to be the second Conference in Asia. I hope the dis­tinguished Parliamentarians from all over the Commonwealth from different parts of the world—Parliamentarians who are here and who have witnessed the ceremony this morning and who have seen during their pre-Conference tours for the last ten days our terri­tories—would go away with the impres­sion that we, though a small country, are firmly dedicated to the principles of democracy and that we shall not sacrifice those principles, come what may. They

have seen for themselves in Malaysia the various other institutions through which we are practising democracy.

One of the links of the State is the Legislature, the other two links being the Executive and the Judiciary. Though, after independence, various new insti­tutions, new organisations, to meet the demands of the time have come up in contemporary and modern fashion, the Legislature which makes the laws of the country had somewhat lagged behind in its inadequate facility and it was realised by the Government and, particularly, by the Prime Minister, and steps were taken to rectify this inade­quacy; and the result of it is this building equipped with all the necessary requirements to run an efficient Par­liament. I am particularly happy to note that in the Parliament a very fine Library is created, and I hope that will come into play usefully to the Members of Parliament in their acquisition of knowledge, so that they can play their part more effectively. There are other facilities too being provided and in the course of time and in the light of experience, I am sure they will be kept up-to-date so that the service of the Legislature to the nation will be second to none.

At a time when we are faced with external threats in various guises and forms in the modern terminology of confrontation, we are showing to the world that we do not believe in con­frontation but that we believe in consultations; we are showing to the world that we do not believe in a life-time President but we believe in an elected King; {Applause) we are showing to the world that we do not believe in revolution, but we believe in evolution; we are showing to the world that we do not believe in selection, but we believe in election. Sir, these are not mere empty words, these are not mere lip-service. We are willing to learn, and as we learn, we are prepared to improve, and our leadership in this country has shown that it is wedded to the ideas of the rule of law and will make way for this country to progress through constitutional manner.

It was heartening to hear the Singapore Prime Minister mention the

words "loyal Opposition". Well, we hope that these words will have their true significance. Opposition will have to be loyal to the State, they are His Majesty's Opposition. Some of the Opposition Members right now are fundamentally against the concept of Malaysia. They cannot be His Majesty's loyal Opposition if they are fundamen­tally against the concept of Malaysia. It is a contradiction in terms, it is a contradiction in spirit. So, I hope that with the creation of this Parliament, the Opposition will see light and play its role in the true tradition of parlia­mentary democracy; they will be able to see the wood for the trees; and they will not confuse themselves with issues of party-politics with fundamental issues; in fundamental issues, there is no party link or party lines—these are by-partitions, these are natural; and if they are not able to see this, then they are not seeing the mere essentials, the mere ABC, of Parliamentary democracy.

Sir, I wish to state this, because our beloved King, at His Gracious Opening Speech today, has advised us to observe the parliamentary principles of "give and take" and carry on in that tradition: we hope, Sir, under your wise guidance, we Members of the Senate will see things in an objective way under this magnificent illuminated roof and debate in an objective way, not being simply carried away by partisan attitude to things, give praise where praise is due, criticise where criticism is due—but not with a deep feeling of hatred, not with a feeling that we cannot reconcile, not with a feeling that we should not reconcile, because in parliamentary democracy, it has always been under­stood that we should allow ourselves to be persuaded and won over by persuasion. If we refuse ourselves to be won over by persuasion, then we are refusing the weapon of democracy to have its effective place.

Sir, I wish to join with the other distinguished speakers in welcoming our new colleagues from the other territories of Malaysia. I am sure they will find that the Senate is a very congenial place, and I am also sure that their wise views will always be appreciated and the nation will benefit.

I submit my humble thanks, along with others, to His Majesty for His Gracious Speech and for having opened this building and providing this for our use. Thank you, Sir. (Applause)

Engku Muhsein bin Abdul Kadir: Tuan Yang di-Pertua, saya mengambil sempena hari yang bersejarah ini, saya rasa shukur dapat bersama2 dengan Ahli2 Yang Berhormat sakalian meng-hadhiri Pembukaan Bangunan Parlimen kita yang di-sayangi ini. Bangunan yang indah dan tersergam ini akan menjadi chogan kemegahan tanah ayer kita Malaysia dan akan menjadi satu pedoman serta pendorong kapada kita sakalian baik dari gulongan pemerentah juga dari gulongan pembangkang. Bersama2-lah kita berikhtiar untok mengindahkan dan menjadikan Malay­sia tanah ayer kita ini megah dan indah sebagaimana indah-nya bangunan ini.

Pada hari ini kita bertuah dapat berkumpul di-sini di-mana semua gulongan kita terutama sa-kali daripada sahabat2 baharu kita dari tiga buah negeri yang baharu ia-itu Singapura, Sarawak dan Sabah berkumpul bersama2

kita dan mudah2an dengan berkumpul bagini akan memberi satu perpaduan yang erat lagi pada masa akan datang.

Berchakap dalam soal Parlimen ini, maka kita merasa megah sebab beberapa buah negeri di-sekeliling kita ini ke-dudokan2 demokrasi berparlimen-nya sedang terugut dan banyak telah terbalek. Tetapi alhamdulillah kita di-sini sa-bagai satu bangsa kechil yang merdeka dan berdaulat dapat mem-pertahankan tujuan2 dan semangat demokrasi berparlimen sa-bagaimana telah kita amalkan semenjak kita merdeka sampai-lah pada hari ini dan kita berharap juga dapat mengamalkan-nya dari satu masa ka-satu masa kekal abadi sa-lama2-nya.

Tetapi di-dalam mempertahankan, di-dalam memperkuatkan dan mem-prektikkan—mengamalkan demokrasi berparlimen ini, mustahak-lah saya rasa Kerajaan sama2 sedar bahawa di-dalam kata2 untok mengamalkan demokrasi yang sa-benar-nya itu, sangat-lah banyak sekarang ini anasir2,

gulongan2 yang chuba menggunakan kata2 demokrasi itu demi kepentingan yang tertentu, demi kepentingan satu gulongan yang tujuan-nya ta' lain dan ta' bukan sa-mata2 hendak menghan-chorkan Malaysia kita ini dan hendak memechahkan perpaduan di-antara ra'ayat sama ra'ayat negeri ini. Banyak kita dengar, banyak kita dapat lihat dan banyak pula-lah yang kita telah alami orang2 yang datang ka-mari kadang2 berchakap, mendesak supaya Kerajaan sunggoh2 mesti-lah memberi-kan demokrasi 100 peratus kapada ra'ayat negeri ini, sunggoh2 memberikan itu memberikan ini pada hal perkara itu memang telah di-berikan oleh Kerajaan kapada ra'ayat 100 peratus tetapi orang2 yang berchakap itu apabila keluar pula daripada rumah Parlimen— ini maksud saya bukan rumah baharu ini tetapi rumah yang lama—keluar dari Dewan Parlimen, Dewan Ra'ayat atau Dewan Negara pergi ka-kampong2

menjalankan peranan membuat ucha-pan2 yang sa-balek-nya lansong berten-tangan dengan apa yang di-chakapkan itu.

Bagitu juga-lah saya nampak saperti pandangan2 yang mengatakan minta supaya Kerajaan membebaskan lagi siaran2 uchapan di-sini, siaran2 akhbar di-dalam negeri ini supaya jangan-lah di-kongkong. Saya tidak nampak satu ketika pun, satu masa pun atau satu perbuatan Kerajaan pun yang chuba hendak mengkongkong siaran2 surat khabar atau sa-bagai-nya. Ini-lah yang mustahak kita ingat bersama bahawa di-dalam kita hendak mengembangkan demokrasi sekarang ini, dalam kita hendak memperkuatkan tujuan2 asas2

demokrasi sekarang ini, ada-lah dahulu-nya memang ada di-mana2 sahaja yang chuba dengan menggunakan kata2 yang halus, hendak menggunakan dasar2

demokrasi yang tulin ini untok tujuan2

yang sa-balek-nya, ini-lah yang mus­tahak sama2 kita tentang. Kita telah banyak melihat perpechahan di-merata2

dunia dan kita mahu di-Malaysia ini semua gulongan ra'ayat akan dapat hidup bersatu padu. Tujuan kita yang besar ia-lah satu sahaja ia-itu mahu melihat ra'ayat negeri Malaysia kita ini bersatu padu aman dan ma'mor kekal abadi merdeka dan berdaulat.

Dato' Dr Cheah Toon Lok: Mr President, Sir, a few hours ago, we saw the official opening of the Parliament House by His Majesty the Yang di-Pertuan Agong. It was an historic hour. It was an hour charged with emotions of loyalty and thanks to His Majesty for giving us this magnificent building.

Now, we are assembled here to affirm our thanks by the humble presentation of a resolution to His Majesty the Yang di-Pertuan Agong for this magnificent building. I wish to associate myself with the sentiments expressed by my fellow Senators.

Sir, in this part of the world ten million people are progressing, evolving, towards a new democracy and they are aspiring to be free people in a free world. This building is the expression of their hope, and I hope one day the spirit of human progress and the spirit of brotherhood will permeate throughout this part of South East Asia. Thank you. (Applause).

Enche' Nik Hassan bin Haji Nik Yahya: Tuan Yang di-Pertua, saya menyokong chadangan yang di-bawa bagi menyembahkan uchapan ka-bawah Duli Yang Maha Mulia Seri Paduka Baginda Yang di-Pertuan Agong di-atas uchapan pembukaan bangunan baharu ini kerana saya rasa ada-lah satu saat yang bersejarah bagi Parlimen kita ini dalam perubahan-nya daripada ban­gunan Parlimen yang lama kapada bangunan yang baharu ini. Dan satu saat yang bersejarah bagi kita kerana kita membuka bangunan Parlimen yang baharu ini di-dalam saat kita di-tentang hebat oleh jiran yang berdekatan dengan kita. Pembukaan bangunan baharu kita ini jelas sa-kali menjadi satu chabaran kapada negara itu bahawa kita tetap berdiri sa-bagai sa-buah Kerajaan yang berpegang tegoh kapada dasar demokrasi berparlimen walau pun dalam saat anchaman yang di-datangkan daripada mereka itu.

Saya harap bukan sahaja kita mem-punyai bangunan yang baharu yang lengkap dengan alatan2, tetapi saya harap supaya Kerajaan menchukupkan pegawai2 di-dalam urusan Parlimen ini supaya segala urusan kerja kita menjadi

baharu dan membawa kapada satu perubahan baharu dengan keadaan yang lengkap serba serbi-nya. Umpama-nya siaran daripada keputusan meshuarat kita ini lekas di-keluarkan supaya dapat di-bachakan kapada satu masa yang sangat singkat dan bagitu juga pegawai2 bagi menterjemahkan ucha-pan2 di-dalam Dewan ini sa-patut-nya di-tambah dan di-beri latehan yang sa-chukup2-nya supaya menjadi satu Parlimen yang lengkap yang paling baharu sa-kali di-Tenggara Asia ini.
