ORDniANCE
BE it enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows:-
1. TIlls Act may be cited as the Fauna and nora Shorttitle.
Protection (Amendment) Act, No. 49 of 1993.
2. The long title to the Fauna and Flora Protection
Ordinance (hereinafter referred to as the " principalenactment") is hereby repealed and the following long
title substituted therefor:-
.. AN ORDINANce TO PROVIDE FOR THE PROTECTION,
CONSERVATION AND PRESERVATION OF THE FAUNA AND
FLOHA OF SRI LANKA; FOR THE PREVENTIO!'l OF TH~
COMMERCIAL EXPLOITATION OF SUCH FAUNA AND
FLORA; AND TO PROVIDE FOR MATTERS CONNECTED
THEREWITH OR Ii<CIDENTAL THERETO.".
3. Section 2 of the principal enactment is hereby amended
as follows:-
(1) in subsection (1) of that section. by the omission of
paragraph (e) thereof. and the substitution therefor. of the following paragraphs:-
If (e) a Refuge; or
(f) a Marine Reserve; or
(g) a Buffer Zone. " ;
(2) by the repeal of paragraph (a) of subsection (4)
thereof. and the substitution therefor of the
following paragraph:-
.. (a) the limits of any Strict Natural Reserve.National Park, Nature Reserve, Jungle
Corridor Refuge. 'Marine Reserve or Buffer

4. The following new section is hereby inserted immedi
ately after section 2 of the principal enactment and shallhave effect as section 2A of that enactment:-

are to be provided within any National

5. Section 3 of the principal enactment is hereby amendedas follows:-
(1) in subsection (1) of that section by the repeal of
paragraphs (a) and (c) thereof and the substitutiontherefor, of the following paragraphs:-
c' (a) no person shall be entitled ;to enter anyStrict Natural Reserve or Nature Reserve, orin any way to disturb the fauna and floratherein;
(c) no animal shall be hunted, killed or taken, andno plant shall be damaged, collected ordestroyed in a Strict Natural Reserve,destroyed, in a Strict Natural Reserve,
(2) by the repeal of subsection (2) of that section;
(3) in subsection (3) of that section, by the substitution,for all the words from "Nature Reserve or JungleCorridor" to the end of that subsection, of thewords "Nature Reserve, or in or over any Stateland in any Sanctuary, being a right which was soacquired by such person prior to the date of theestablishment of such. Nature Reserve or Sanctuary. "; and
(4) m the marginal note to that section, by the substitution for the words "Jungle Corridors, NationalParks, Sanduaries and Intermediate Zones.". of

6. The following new section is hereby inserted immediately after section 3, and shall have effect as section 3A ofthe principal enactment:-

7. Section 5A of the principal enactment is herebyrepealed and the following section substituted therefor:-

5A. (1) No person shall enter or remainwithin any Nature Reserve except under theauthority and in accordance with the conditions of a permit issued by the prescribedofficer on payment of the prescribed fee.

.. (k) construct or manage any tourist hotel or provide any services or facilities similar to theservices or facilities provided by a touristhotel ".
(2) in subsection (2) of that section, by the substitutionfor the words "Nature Reserve or JungleCorridor, ", of the words" Nature Reserve, JungleCorridor, Refuge, Marine Reserve or Buffer Zone, " ;
(3) by the insertion immediately after subsection (3) ofthat section, of the following subsection:-
"(4) Any person who acts in contravention ofthe prov-isions of this section shall be guiltyof an offence and shall on conviction be liable toimprisonment of either description for a term notless than one year and not exceeding five years. " ;and

9. Section 7 of the principal enactment is hereby amendedas follows:-
(1) in subsection (1) of that section-

10. Section 8 of the principal enactment is hereby repealed and the following section substituted therdor:-
.. Acts prohi- 8. No person shall from any road or landbited inricinityof outside a Strict Natural Reserve, NationalNational Park, Nature Reserve, Jungle Corridor, Re-Reserve. fuge, Marine Reserve or Buffer Zone, hunt,
shoot, kill or take any wild animal in suchStrict Natural Reserve, National Park, Nature Reserve, Jungle Corridor, Refuge,Marine Reserve or Buffer Zone.".

11. The following new section is hereby inserted immediately after section 8 of the principal enactment and shallhave effect as section SA of that enactment:-
"Naturetrails.
8A. (1) The Director may provide roadsand tracks within a National Reserve to benature trails for the use of any person whodesires to travel on foot to study or observethe fauna and flora therein:
Provided that the State shall not be liablefor any injury or damage sustained orincurred by any person using such trail.
(2) No person shall use any such naturetrail unless he has obtained a permit issuedby the Director upon the payment of the prescribed fee.
(3) Regulations may be made specifyingthe manner in which any person may usesuch nature trail. ".

12. Section 9 of the principal enactment is herebyamended as follos:-

carry out any development activity of anydescription whatsoever, without obtainingthe prior written approval of the Director. ".
(2) Every application for approval, undersubsection (1) to commence a developmentactivity shall be accompanied by an InitialEnvironmental Examination or Environmental Tmpact Assessment, a:; the case p~ay
be, in terms of the National EnvironmentalAct, No. 47 of 1980. relating to such development activity. The Director shall have regardto such environmental impact assessment indeciding whether or not to grant approval forthe commencement of the developmentactivity to which that assessment relates. ".
14. Section 10 of the principal enactment is herebyamended as follows:-
(1) by the substitution for paragraph (a) thereof, of thefollowing new paragraph:-.. (a) any provision of this Part of this Ordinance
other than the provisions of section 6 .or " ;
(2) in paragraph (c), thereof by the substitution for thewords .. to any Intermediate Zone or Sanctuary; ",of the words .~ ,to; any Sanctuary; " ; and
(3) by the substitution, for all the words from "shall beguilty" to the end of that section, of the words"shall be guilty of an offence and shall on conviction be liable to a. fine not less than ten thousandrupees and not more than twenty thousand rupeesor to imprlsonmeilt~ofeither description for a termnot less than two years and not more than five yearsor to both such fine and imprisonment."..

17. Section 12 of the principal enactment is hereby repealed and the following section substituted therefor:-
" Protectionof elephantsand buffaloesin areas outside NationalReserves andSanctuaries.
12. (1) Save as is hereinafter provided, noperson shall in any area outside a NationalReserve or Sanctuary-
(a) hunt, shoot, kill, injure or take anyelephant; or
(b) without a licence, in that behalf fromthe Director, capture any buffalo.
(2) Every licence under IUbsection (1)
shall be issued in the prescribed form 011
payment of the prescribed fee and shall
continue in force for such period and within
such limits and may be subject to such con
ditions as the Director may consider neces
sary or expedient to insert therein for the
protection and preservation of buffaloes.
(3) The holder of a licence under subsec
tion (1) (b), shall not later than fifteen
days after the expiry of the licence,
return the expired licence to the Director or
the prescribed. officer, and intimate to him
the particulars of any buffalo captured by
him.

18. Section 13 of the principal enactment is hereb,amended in paragraph (a) of subsection (1) of that sectionby the substitution, tor the words" either free or on paymentof", of the words "on payment of".
19. Section 15 of the: principal enactment is hereby reo
pealed.
20. Section 16 of the principal enactment is hereby repealed and the following section substituted therefor:-
"Killing or 16. Any person who in the exercise of anytaking of right conferred by or under section 13 orelephantsand section 14, kills or takes any elephant orbuffaloes buffalo, shall forthwith report such killing orto bereported taking to any police officer entitled to offi·forthwith. date in the area within which such killin]
or capture took place or to any prescribedofficer and to the Director. ",
21. Section 17 of the principal enactment is herebjamended as followsr-s-
(1) in subsection (3) of that section by the omission 0\the words "deer or fowl" wherever it occurs in thatsubsection; and
(2) by the substitution for the marginal note to the secttion of the following marginal note:-
"Property in elephants and buffaloes killed or takeaunder. Part II. ".
22. The following new section is hereby inserted immetdiately after section 19 of the principal enactment and shaDhave effect as section 19A of that enactment:-

(2) Any person who contravenes the provisions of subsection (1) shall be guilty ofan offence and shall on conviction be liableto a fine not less than thirty thousandrupees and not more than fifty thousandrupees or to imprisonment of either description for a term not less than two years andnot exceeding five years or to both suchfine and imprisonment.
(3) This section shall have effect as if itformed part of the Customs Ordinance andthe provisions of that Ordinance shall applyaccordingly.".
23. Section 20 of the principal enactment is herebyamended by the substitution, for all the words from "shallbe guilty" to the end of that section, of the followingwords:-
"shall be guilty of an offence and shall on convictionbe liable to a fine not less than one hundred thousand
rupees and not more than two hundred and fifty thousandrupees or to imprisonment of either description for a
term not less than two years and not exceeding five years
or to both such fine and imprisonment, and where any
person who is convicted of an offence mentioned inparagraph (a) of this section in respect of the killing or
taking of any elephant is found by the court to be in
possession of that elephant or its carcase or tusks or
tushes, the court may make order directing such elephant,
carcase, tusks, or tushes to be delivered to the possession
or custody of any officer of Government to be held by that
officer for and on behalf of the State.".
24. Section 21 of the principal enactment is herebyx
amended in subsection (1) of that section, by the substitu-

obtained in .accordance with. the provisions of thissection, shall be guilty of an offence and shall onconviction be liable to a fine not less than one hun
dred thousand rupees and not more than two hun
dred thousand rupees or to imprisonment of either
description .for' a term not less than two years and
not exceeding five years or to both such fine and
imprisonment.";
(2) by the renumbering of subsection (8) of that sectionas subsection (9) ; and
(3) by the insertion immediately after subsection (7) ofthat section,' of the following new subseCtion:-

23. Section 24 of the principal enactment is herebyamended by the repeal of subsection (3) of that section.and the substitution therefor, of the following subsection:-
" (3) Any person who has in his possession a tusk ortush which has not been registered shall be guilty of anoffence and shall on conviction be liable to a fine not lessthan thirty thousand rupees and not exceeding one hundredthousand rupees or to imprisonment of either descriptionfor a term not less than two years and not exceeding fiveyears or to both such fine and imprisonment. ".

29. The following new sections arc hereby inserted immediately after section 21 of the principal enactment, and shallhave effect as sections 24A and ~4n of that enactment:--

24·\. (J) Upon registration of a tusk ortush in accordance with section 24, everyperson who has in his possession a tusk ortush shall obtain a licence in respect of suchtusk or tush.
(2) The licence shall be obtained on application made to the prescribed officer, in theprescribed form, on payment of the prescribedfee.
(:~) Every prescribed officer shall maintain a register in respect of the licensing oftusks' and tushes.

(e) has in his possession or under his control, the hide or skin. of any suchmammal or reptile killed or taken,or the horns or antlers of such mammal; or
(1) exposes for sale, any such mammal orreptile or any part of such mammalor reptile; or
(g) purchases the hide or skin of any suchmammal or rep.tile for the purposeof tanning or preparing such hide orskin for use,
shall be guilty of an offence and shall on conviction be liable to a fine not less than tenthousand rupees and not exceeding thirtythousand rupees or to imprisonment of eitherdescription for a term not less than two yearsand not exceeding five years, or to both suchfine and imprisonment.
The provisions of this section shall notapply to any domestic anunal as defined insection 11.
31. Any person who in any area outside aNational Reserve or a Sanctuary-

(2) Such permit shall not be issued exeept for the promotion of scientific knowledgeincluding ,supplies to foreign museums,
foreign zoological gardens in exchange for
supplies to local museums or local zoological
gardens.

(1) No person shall after the date ofthe coming into force of this section, have inhis possession or custody or under his control' any animal in excess of the prescribednumber, except under the authority and inaccordance with the conditions of a permitissued in the prescribed form, by theDirector on payment of the prescribed fee:
Provided that where any person has in hispossession, or custody or under his controlany animal, in excess of the prescribednumber, prior to the date of the coming intoforce of this section, such person shall within a period of three months from the dateof the coming into force of this sectionobtain 3. permit under subsection (1).
(2) The Director Or any prescribed officershall have the power to-
(a) enter, inspect and search any premises on which any animal is heingkept under the authority of a permitissued under subsection (1) andsatisfy himself that the conditions ofthe permit are being complied with;
(b) seize any animal found in suchpremises, in contravention of theprovisions of the permit issuedunder subsection (1).
(3) The Director may order the confiscation of any animal seized under subsection(2) after such inquiry as he may deemnecessary Any person aggrieved by theorder of the Director may within fourteendays of the confiscation, give notice inwriting to the Director that he intends to'Institute action in the appropriate courtag~ such:-eonfiscation.

In this subsection, "relevant conviction H
means the conviction consequent to whichany property is forfeited under subsection(1). The Director shall take possession, onbehalf of the State, of any property vestedin the State under this section.

Section 66A of the principal enactment is herebyamended by the substitution for all the words from "shallbe guilty" to the end of that section, of the words "shallbe guilty of an offence and shall on conviction be liable toa fine not less than ten thousand rupees and not more thantwenty thousand rupees or to imprisonment of either description for a term not less than one year and not exceedingtwo years or to both such fine and imprisonment. " .
59. Section 66B of the principal enactment is herebyamended by the substitution for the words "not exceedingtwenty rupees. ", of the words "not less than five hundredrupees and not more than one thousand rupees. ".

(a) to require any person possessing, carrying or using a gun to produce thelicence issued in respect of such gunundexany written law;
(b) to enter and search any premises inwhich he has reasonable groundsfor believing, that any person ismanufacturing, selling, repairing orhas in his possession any unlicensed gun;
(c) to stop and search any boat, vessel orconveyance in which he suspectsthat any unlicensed gun is beingcarried;
(d) to take into custody any unlicensedgun and produce Such gun at thenearest police station or divisionalsecretariat.
(2) Any person who-
(0) fails to produce a licence Inrespect of any' gun in blklpossession; or
(b) refuses to allow tbe search u~·
any premises; or

(c) fails or refuses to stop any boatvessel or conveyance whcrcalled upon to do so by arofficer referred to in subsectior(1), in contravention of the

67. In the principal enactment for the word" Ceylon ",wherever that word occurs in that enactment there shallbe suhstituted the words "Sri Lanka ".
68. In the principal enactment for the words "Crownland II wherever those words occur in that enactment thereshall he substituted the words "State land ",
