The Planning Commission of the Parish of Ascension held a Public Meeting on Wednesday,

September 11, 2013 at 6:00 p.m. in the Courthouse East Meeting Room, Gonzales, Louisiana in

a regular session convened.

I. Meeting Called to Order

Meeting was called to order by Chairman Donald Songy.

and Z-3

The subject property is located on the east side of LA Highway 937

approximately one thousand one hundred and sixty feet south of LA Highway 22

in Council District 2 and is zoned Rural (R). The application is on behalf of Jerry

Wayne Dixon, Randal Louis Dixon and Linda Dixon Folse by W.J. Cointment

Surveyors.

The owners are proposing a Family Partition of Lot Z, into Lot Z-1 (11.35 acres),

Lot Z-2 (9.10 acres), and Lot Z-3 (16.86 acres). Lot Z-1 will be kept by Jerry

Wayne Dixon, Lot Z-2 will be kept by Linda Dixon Folse, and Lot Z-3 will be

approximately one thousand one hundred and twenty seven feet west of George

Lambert Road in Council District 6 and is zoned Rural (R). The application is on

behalf of Evans C. Bernadas by Earles and Associates, LLC.

The owner is proposing a Family Partition of an unnamed lot, formerly a portion

of the Robert Hebert Property, into Lot B-1 (0.749 acres) and Lot B-2 (0.748

acres). Lot B-1 will be kept by the applicant and Lot B-2 will be donated to his

son, Jeremy Bernadas. Both lots will be accessed by Emile Road, an existing

twenty (20) foot, proposed forty (40) foot, private servitude of passage.

five hundred and forty nine feet north of Moore Road in Council District 5 and is

zoned Rural (R). The application is on behalf of Fannie Bates by Earles and

Associates, LLC.

The owner is proposing a Family Partition of Tract C-1 into Lot C-1-A (1.000

acre), Lot C-1-B (1.634 acres), and Lot C-1-C (1.459 acres). The applicant will be

donating Lot C-1-B to her daughter, Lisa Bates and Lot C-1-C to her son, Chad

Bates, and retaining Lot C-1-A. All lots will be accessed by Crystal Lane, an

existing fifty (50) foot private servitude of passage.

X. Public Hearing to Approve or Deny the Following Subdivision Final Plat:

A) Sunshine Business Park – Lot SB (60’ Private Servitude of Access)

The subject property is located on the north side of LA Highway 70

approximately one thousand and fifty six feet east of LA Highway 3120 in

Council District 2 and is zoned Mixed Use (MU). The application is on behalf of

Engineer Comments:

Data which is required for Parish roadways which was not supplied:

1) The installation report of one pipe did not specify RCP was put in as required

under the roadway. All other reports for installation of the pipes are adequate.

2) Concrete Cylinders to verify thickness of roadway – reports were submitted

for 6” cylinders, this would be adequate for residential but 8” are required for

thickness, there is sufficient number and data to verify adequacy of the concrete

used.

3) Pipe, bedding, drain structure material certifications

4) Daily installation log of bedding and installation and method of trench backfill

5) Compaction reports on trench backfill

STAFF RECOMMENDATIONS

Staff recommends approval contingent upon the following note being added to the

plat:

“The maintenance of the 50' Private Servitude of Access (Sunshine Blvd.) located

on Lot SB shall remain the individual lot owners until such time as it has been

accepted by the Parish for public maintenance. The approval of this plat does not

infer any acceptance of public maintenance by the Parish for said 50' Private

Servitude of Access.”

Mr. Robby Overall with GWS Engineering, Inc. presented this subdivision final

plat:

Commission Action: Moved Mr. Paul Nizzo, seconded by Mr. Morrie Bishop

and unanimously adopted, to approve this subdivision final plat contingent on

staff comments and recommendations being addressed.

XI. Ordinances – Public Hearing to Recommend Approval or Denial to the Parish

Council Amendments to the Ascension Parish Unified Land Development Code

A) Ordinance SR13-9: Revisions to Development Code, Zoning Tables and

Subdivision Regulations of the Unified Land Development Code pertaining

to Design Regulations for Major Subdivisions:

Mr. Ricky Compton presented and explained changes to the proposed Design

Regulations for Major Subdivisions.

The Commission and Staff discussed the changes made from last month’s

Planning Commission meeting and made further changes at this time.

Commission Action: Moved by Mr. Gasper Chifici, seconded by Mr. Robert

Burgess and unanimously adopted, to recommend to the Parish Council approval

of the proposed revisions to the Unified Land Development Code pertaining to

Design Regulations for Major Subdivisions with changes made as discussed by

the Commission and Staff at tonight’s meeting. (See Attachment A)

XII. Staff Report

A) Discussion about limiting fill on individual lots and within subdivision

development

Mr. Ricky Compton handed to the Commission, Attachment B. He explained the

Strategic Planning Committee is requesting the Planning Commission discuss this

information for correct wording and to send back to the next regularly scheduled

Strategic Planning meeting with the Commission’s recommendation.

Commission Action: Moved by Mr. Gasper Chifici, seconded by Mr. Joshua

Ory and unanimously adopted, to hold a public hearing at the next regularly

scheduled Planning Commission meeting for a recommendation to be sent to

Strategic Planning.

XIII. Engineering Staff Report

A) For Consideration: Ordinance SR13-10: Revisions to the Subdivision

Regulations in the Unified Land Development Code pertaining to Testing

requirements

Mr. Tim Ward presented and explained the proposed revisions to the Unified

Land Development Code pertaining to Testing requirements. (SEE

ATTACHMENT C)

Commission Action: Moved by Mr. Paul Nizzo, seconded by Mr. Jackie

Callender and unanimously adopted, to hold a public hearing at the next regularly

scheduled Planning Commission meeting on proposed Ordinance SR13-10:

Revisions to the Unified Land Development Code pertaining to Testing

requirements.

B) Subdivision Status Report

Mr. Tim Ward gave the following report status on subdivisions:

Residential

- 6 subdivisions are in their bond period (494 Lots)

- 7 subdivisions are under construction (300 Lots)

- 4 subdivisions are approved for construction but haven’t started construction

(240 Lots)

- 2 subdivisions are in construction review (72 Lots)

Total of 1,106 Lots
