OVERVIEW

As administrators of institutions of higher learning, and pursuant to the PALS mission of uplifting the standards of legal education, law deans are expected to engage in professional development and continuing education, and to encourage their faculty to do so as well. In this regard, PALS is undertaking a series of faculty development workshop on legal education.

This workshop to be held in Butuan City, the Regional Center of Caraga, is intended to engage the Mindanao law deans and law professors in a national conversation on matters that will shape Philippine legal education in the years to come: indigenous peoples, Bangsamoro and the peace agreements, law school administration and teaching methodologies. This workshop also seeks to draw insights from experts in other disciplines, particularly on issues affecting the indigenous peoples, Bangsamoro and on conflict sensitivity and transformation, in recognition of the potential for interdisciplinary and multicultural dialogue to enrich legal discourse and practice.

3:50 p.m. 2nd Session: The State of Indigenous Peoples, Challenges in the Framework of the UN Declaration on Indigenous Peoples and Remedies Available under International Mechanisms

The Declaration on the Rights of Indigenous Peoples was adopted by the UN General Assembly on 13 September 2007, a decision which comes as a result of more than twenty years of work by indigenous peoples and the UN system. This ensures that States take all the necessary measures to implement the rights of indigenous peoples in accordance with international human rights instruments without discrimination. This sessions provides us the situation of indigenous peoples in the Philippines and globally, challenges in the UN-DRIP frameworks and remedies available for violations of IP rights

5:00 p.m. 3rd Session: Customary Laws and How this can be Interfaced under the Philippine Legal System, especially in the context of the Indigenous Peoples Rights Act (IPRA, RA 8371)

This session aims to tackle the interfacing of customary laws and the formal legal system, especially since RA 8371, or the Indigenous Peoples Rights Act of 1997, and other laws recognized the application of customary laws and traditional practices. Yet the reality is far from ideal, when the formal legal system discriminates against those practicing customs and traditions, and access to justice of those in the margins of society remains elusive.

6:00 p.m. 4th Session: The Bangsamoro Basic Law as Proposed and The Prospects for Peace under this Framework

The proposed Bangsamoro Basic Law is a result of a long and arduous process of seeking peace in the Bangsamoro homeland. Yes, the draft proposal already poses a lot of constitutional questions that provides another gridlock at the legislative level and possibly, the Supreme Court. This session seeks to enlighten the members of the law faculty on what are the prospects for lasting peace in Mindanao under this BBL.

The legal environment is rapidly changing, and so are the students. In an age where students are increasingly opting to read their cases on their gadgets and ready answers are just a google search away, do traditional law teaching methods still work in the face of new technologies and decreasing attention spans? What are the new teaching strategies currently being employed to prepare students to work in a globalized, interdisciplinary setting? This session will tackle outcomes-based and student-centered teaching and learning methods and explore how they can complement the traditional Socratic method.

9:45 a.m. 6th Session: Conflict Sensitivity and Conflict Transformation: The New Paradigm Towards Resolution of Issues and Conflicts

As members of the legal profession, issues and conflicts are what we encounter regularly, but as we seek to become arbiters for peace and human rights in our law schools and what we convey to the law students, it is important to know about what conflict sensitivity and conflict transformation are. Do we continue to be the traditional harbingers of conflicts, or intend to transform conflicts towards productive outputs for social development?

10:45 p.m. Focus Group Discussion (Working Break) Participants will convene in small groups according to these groups based on the session topics to exchange ideas, experiences, best practices, and recommendations on how to move forward.

How can law schools integrate conflict sensitivity and conflict transformation in the law schools subjects and as we teach and practice law?

What can be possible roles of law schools and faculty toward peace in Mindanao and in other conflict-affected areas in the country?

How can law schools inculcate among its faculty and students becoming culturally sensitive, especially to indigenous peoples, the Bangsamoro and other marginalized sectors? In general, has discrimination as an issue being discussed and incorporated as a policy in our institutions?

As members of the legal profession, we are comfortable with the formal legal system, but how can we address issues and concerns regarding interfacing traditional and customary laws in the formal legal structures?
