ACTION BY THE ZONING COMMISSION (ZC): On March 6, 2014 this item was on the Consent Agenda. There was one person Attorney Gregory Mitchell, in attendance who was in opposition to the request so Staff gave a brief presentation. Mr. Mitchell, who was representing some of the shopping center and residential property owners, of El Bosque Way LLC, spoke in opposition to the application. Mr. Mitchell stated his client was not sufficiently informed about the proposal and requested a 60-day postponement to speak with the applicant and to fully understand the request. A representative for the Buckeye Real Estate investments was there, however, the agent of record for the applicant was not present to respond to the opposition. The ZC agreed with the postponement to allow sufficient time for the applicant to resolve any outstanding issues with the shopping center or adjacent residential property owners. The ZC motioned to postpone 60 days to May 1, 2014 which was carried by a vote of 9-0. Subsequent to the hearing, staff researched the Courtesy Notice mail manifest for signatures of those within 300 feet of the property. Certified mail receipts for the Property Owner that objected to the application were signed, “received” and therefore the Property Owner did in fact receive notice. At time of publication the agent for the applicant indicated that he was in the process of scheduling a meeting with this Property Owner to identify any concerns he may have. ACTION BY THE ZONING COMMISSION (ZC): On May 1, 2014 this item was on the Regular Agenda. The applicant’s Agent indicated he did meet with the adjacent residents and the person in opposition to the request and provided them with additional information. No one came to the hearing to object to the application. The agent agreed to the recommended Conditions of Approval and the ZC recommended support with a vote of 8-0. PUBLIC COMMENT SUMMARY: At the time of publication, staff had received 2 phone calls from the public regarding this project, inquiring about the proposed development. Intensity: The request is consistent with the Floor Area Ratio (FAR) of 0.50 for the CH/5 land use designation. The previously approved, and existing 317,688 square feet equates to a FAR of approximately 0.18 (317,688 / 1,738,044 square feet or 39.90 acres = 0.18). The subject 39.90 acre site could develop with a total of 869,022 square feet based on the maximum allowable FAR of 0.50 with PDD(39.90 ac x 43,560 x .50 = 869,022 square feet).

Special Overlay District/ Neighborhood Plan/Planning Study Area: The subject site is not within located within a special overlay district, neighborhood plan, or special planning area. 2. Consistency with the Code - The proposed use or amendment complies with all applicable standards and provisions of this Code for use, layout, function, and general development characteristics. The proposed use also complies with all applicable portions of Article 4.B, SUPPLEMENTARY USE STANDARDS. Subject to the recommended Conditions of Approval, the proposal will be in compliance with the ULDC. The proposed DOA to add square footage, amend the site plan, and add a new access point from SR7/US441 is not in conflict with any portion of the ULDC, and is consistent with the stated purpose and intent of the ULDC for function, and general development characteristics with all applicable portions of Article 4.B, Supplementary Use Standards. 3. Compatibility with Surrounding Uses – The proposed use or amendment is compatible and generally consistent with the uses and character of the land surrounding and in the vicinity of the land proposed for development. The proposed amendment was found to be compatible and generally consistent with the uses and character of the land surrounding and in the vicinity of the land proposed for amendment. The proposal will not negatively affect the adjacent properties. With the recommended Conditions of Approval the proposed modifications will not create any incompatibility issues and remain generally consistent with the current uses in and around the development. 4. Design Minimizes Adverse Impact – The design of the proposed use minimizes adverse effects, including visual impact and intensity of the proposed use on adjacent lands. The DOA request to modify the site plan to accommodate the new access point, add 3,110 square feet for a mezzanine of Building A, and add a new Ground Mounted Sign creates no additional impacts with the modification. The development pattern previously established by the shopping center has been maintained. The proposed driveway access is not anticipated to generate any additional traffic counts however a new southwest bound right turn lane onto Palmetto Park Road will be required to mitigate the new access point. The applicant is working within the framework of an existing MUPD and the proposed changes to the Site Plan will not create adverse effects, including visual impact and intensity of the proposed use on adjacent lands. 5. Design Minimizes Environmental Impact – The proposed use and design minimizes environmental impacts, including, but not limited to, water, air, storm water management, wildlife, vegetation, wetlands and the natural functioning of the environment. ENVIRONMENTAL RESOURCE MANAGEMENT COMMENTS: VEGETATION PROTECTION: The property has been previously developed. WELLFIELD PROTECTION ZONE: The property is not located with a Wellfield Protection Zone. IRRIGATION CONSERVATION CONCERNS AND SURFACE WATER: All new installations of automatic irrigation systems shall be equipped with a water sensing device that will automatically discontinue irrigation during periods of rainfall pursuant to the Water and Irrigation Conservation Ordinance No. 93 3. Any non stormwater discharge or the maintenance or use of a connection that results in a non stormwater discharge to the stormwater system is prohibited pursuant to Palm Beach County Stormwater Pollution Prevention Ordinance No. 93 15. ENVIRONMENTAL IMPACTS: The site has no outstanding contamination issues.There are no significant environmental issues associated with this petition beyond compliance with ULDC requirements. 6. Development Patterns – The proposed use or amendment will result in a logical, orderly and timely development pattern.

The site currently supports a shopping center. The applicant is requesting a modification of Building A to add a mezzanine, add an access point from SR7/US441, and add a new Ground Mounted Sign from a Financial Institution to a Retail Use including a Pharmacy. The development pattern previously established by the shopping center has been maintained with the current request as no significant change is proposed to the design or appearance of the shopping center. However the Traffic Division will require a new right turn lane to Palmetto Park Road with this request. The proposed amendment will result in a logical, timely and orderly development patterns. 7. Adequate Public Facilities – The extent to which the proposed use complies with Art. 2. F, Concurrency. ENGINEERING COMMENTS: TRAFFIC IMPACTS There would not be any additional traffic impacts resulting from this application, since there would be no change in the intensity of the shopping center. Existing driveways are expected to see either same or a decrease in turning movements, since the proposed additional driveway would share some of the burden.

REQUIRED ENGINEERING RELATED PERMITS The Property Owner shall obtain an onsite Drainage Permit from the Palm Beach County Engineering Department, Permit Section, prior to the issuance of a Building Permit.

The Property Owner shall obtain a permit from the Florida Department of Transportation for access onto S. R. 7. PALM BEACH COUNTY HEALTH DEPARTMENT: No Staff Review Analysis FIRE PROTECTION: No Staff Review Analysis. SCHOOL IMPACTS: No Staff Review Analysis. PARKS AND RECREATION: No Staff Review Analysis. CONCURRENCY: Concurrency has been approved for 72,013 sq. ft. of retail, 18,000 sq. ft. of Financial Institution, 20,000 sq. ft. of Professional Offices, 825 Sq. ft. of Government Services and 2,725 sq. ft. of Outdoor Entertainment. The proposed amendment complies with Article 2.F, Concurrency. 8. Changed Conditions or Circumstances – There are demonstrated changed conditions or

circumstances that necessitate a modification.

The subject site is a previously developed commercial site adjacent to other commercial sites along an intensely developed commercial corridor. The applicant states, “There is interest from potential retail tenants to create retail bays at the south end of the Plaza, which necessitates the need for an additional access point along SR441. Although the building area and trip count will not be increasing, the potential addition of retail bays along the south face of the plaza will increase vehicular activity at that end of the Plaza. Providing the requested driveway access will facilitate orderly vehicular movement in and out of West Boca Square.” CONCLUSION: Staff has evaluated the standards listed under Article 2.B.2.B 1-8 and determined that there is a balance between the need for change and the potential impacts generated by this change. Therefore, staff is recommending approval of the request. Staff has also determined that any of the potential impact and incompatibility issues will be adequately addressed subject to the recommended Conditions of Approval as indicated in Exhibit C-2.

CONDITIONS OF APPROVAL

Exhibit C Development Order Amendment ALL PETITIONS 1. Previous All Petition Condition of Resolution No. R-94-1089 (Control No 80-114 (G) which currently states: All previous conditions of approval applicable to the subject property have been consolidated as contained herein. The petitioner shall comply with all previous conditions of approval, including original deadlines for Article 5.8 (Palm Beach County Land Development Code), as amended, unless expressly modified. (Previously Condition No. A.1 of Resolution No. R-93-1372, Petition 80-114(F)). (MONITORING) Is hereby amended to read: All previous Conditions of Approval applicable to the subject property, as contained in Resolution R-94-1089 (Control No 80-114 (G), and R-95-0425 (Control No 80-114 (H), have been consolidated as contained herein. The Property Owner shall comply with all previous Conditions of Approval and deadlines previously established by Article 2.E of the Unified Land Development Code and the Board of County Commissioners or Zoning Commission, unless expressly modified. (ONGOING: MONITORING - Zoning) 2. The approved Preliminary Site Plan is dated December 23, 2013. Modifications to the Development Order inconsistent with the Conditions of Approval, or changes to the uses or site design beyond the authority of the Development Review Officer as established in the Unified Land Development Code, must be approved by the Board of County Commissioners or the Zoning Commission. Previous Condition E.1 of Resolution R-1994-1089, Control No. 1980-00114, which currently states: The Property Owner shall provide discharge control and treatment for the stormwater runoff in accordance with all applicable agency requirements in effect at the time of the permit application. However, at a minimum, this development shall retain onsite 100% of the stormwater runoff generated by a three (3) year-one (1) hour storm with a total rainfall of 3 inches as required by the Permit Section, Land Development Division. In the event that the subject site abuts a Department of Transportation maintained roadway, concurrent approval from the Florida Department of Transportation will also be required. The drainage system shall be maintained in an acceptable condition as approved by the County Engineer. In the event that the drainage system is not adequately maintained as determined by the County Engineer, this matter will be referred to the Code Enforcement Board for enforcement. (ONGOING: MONITORING - Eng) Is hereby deleted. [Reason: Drainage is a Code Requirement] 2. No positive outfall shall be permitted into the Palmetto Park Road drainage system unless approved by the County Engineer. Drainage from this project shall be contained onsite with outfall only being permitted into a drainage district subject to their permission and approval. Prior to March 1, 1990, or prior to the issuance of the first Building Permit, whichever shall first occur, the Property Owner shall convey to Palm Beach County, Land Development Division by road right-of-way warranty deed for State Road 7, 200 feet, free of all encumbrances and encroachments on an alignment approved by the County Engineer. Property Owner shall provide Palm Beach County with sufficient documentation acceptable to the Right of Way Acquisition Section to ensure that the property is free of all encumbrances and encroachments. Right of way conveyances shall also include “Safe Sight Corners” where appropriate at intersections as determined by the County Engineer (Previous Condition E.3 of Resolution R-1994-1089, Control No. 1980-00114) [Note: COMPLETED] (DATE: MONITORING - Engineering) 4. All trips traveling north when exiting the site shall turn left onto U.S. Highway 441. Traffic devices to ensure that vehicles may safely cross the southbound lane of U.S. Highway 441 must be acceptable to the County Engineer and the Florida Department of Transportation. (Previous Condition E.4 of Resolution R-1994-1089, Control No. 1980-00114) (ONGOING: MONITORING - Engineering) 5. The Property Owner shall construct on State Road 7 at the project's: a. north entrance a right turn lane, north approach, b. middle entrance a right turn lane, north approach and a left turn lane, south approach c. south entrance a left turn lane, south approach and a right turn lane, north approach All concurrent with the issuance of the first Building Permit. Construction shall be completed prior to the issuance of the first Certificate of Occupancy.
