DEAR MEMBERS :

The FCBA is off and running this year under its new CommitteeCo-Chairs, and many of the Committees will be profiled inupcoming issues of the FCBA Newsletter (including photos ofthe co-chairs). Thanks to all the dedicated volunteers who haveagreed to lead these important groups, reflecting the energy anddiversity of this bar. A full listing of the new Committee Co-Chairs appears in this newsletter, and we hope to see goodparticipation at the CLEs and other Committee activities theyare planning for this year.

A few other Committee items to note:

� The former “Online Communications Committee” is now operating under a newname – the “IP-Based Communications Committee,” under the leadership ofJamie Hedlund, Carol Mattey, and Christi Shewman.

� A new ad hoc committee on Judicial Practice has been formed to highlight theincreasing importance of court decisions and recent judicial trends, to be led by SamFeder, Robert Pettit, and John Rogovin.

� Two committees are ramping up their efforts this year to plan more events andactivities: the Legislative Practice Committee, under the leadership of Paul Nash,Mark Rubin, and Johanna Shelton; and the Relations with Other BarAssociations Committee, led by Edgar Class, Mark Del Bianco, and Jenell Trigg.

Please contact any of the Co-Chairs to volunteer or provide suggestions for Committeeactivities.

Finally, the FCBA is looking for volunteers for upcoming events, including its Octoberreception honoring FCC Bureau Chiefs and a spring event celebrating its 70thAnniversary. Due to the rise of Internet-enabled applications, the demand forbroadband continues to grow and moreconsumers rely on broadband thannarrowband (i.e., dial-up) Internetaccess. For policymakers andbusinesses alike, the question of what“pipes” other than DSL and cablemodem connections (which often relyon fiber optic networks after the lastmile) will enter this importantmarketplace is a critical question. Thetwo principal candidates touted by theFCC as third broadband pipes—Broadband over Powerline and wirelessspectrum—remain largely works inprogress. In terms of broadband overpowerline, there are still only a fewconsumer trials now taking place,leaving room for doubt as to whetherthis technology will ever thrive. As forwireless broadband, there are lots ofdifferent promising wirelesstechnologies, ranging from satellite tomobile wireless to fixed wirelessconnections, but like the case ofbroadband over powerline, very fewconsumers have yet adopted suchtechnologies. This event will evaluatethe likely success and notablechallenges for the contenders for the

2004-2005 FCBAFoundation AnnualReportThe Federal Communications BarAssociation Foundation had anotherspectacular year, serving as animportant charitable resourcesupporting education and children’sissues, primarily in the District ofColumbia. These important publicservice goals could not have beencontinued without the generouscontinued support of individual FCBAmembers and their firms andcompanies. The Foundation’s officialmission remains to:

Support worthwhile educational andcommunications-related projects,particularly those directed towardstudents and younger children in theDistrict of Columbia, through financialcontributions and volunteer services; and Foster greater public awareness andunderstanding of the development ofcommunications technology, resourcesand law, and the role of communicationslaw practitioners.

During the past year, the Foundationserved these goals in numerous ways. Itawarded $135,000 in collegescholarships to students from fourpublic high schools in the District ofColumbia. The Foundation alsoawarded $16,600 in stipends to four lawstudents working in summerinternships at governmentcommunications agencies. In addition,Foundation volunteers each monthmade meals for the homeless at Martha’sTable, and to deliver meals to thehomeless through McKenna’s Wagon.Foundation volunteers also arrangedoutings with the Martha’s Table YouthGroup.

TRUSTEESA Board of Trustees from the FCBAmembership governs the Foundation.This year, our Trustees were PaulaBoyd, James Coltharp, DianeDavidson, Scott Delacourt, Joe

Di Scipio, Praveen Goyal, Dee May,Ruth Milkman, Maureen O’Connell,Loretta Polk, Mark Van Bergh, CaraVoth, and myself, Greg Vogt. MarkVan Bergh was Chair-Elect andTreasurer; Scott Delacourt wasSecretary. Joe Di Scipio served asAssistant Treasurer and Paula Boydserved as Assistant Secretary.

Stan Zenor and Heidi Kurtz continuedto provide excellent support for theFoundation.

FCBA President Harry Martin andTreasurer Jim Blitz were invaluable intheir steadfast support of theFoundation’s work.

SCHOOLS AND SCHOLARSHIPSAs noted above, the Foundationawarded $135,000 to eleven collegescholarships this year to students fromfour D.C. public high schools. Thisyear’s recipients are identified in theattachment. Through generousdonations from member companies andfirms, the Foundation was able toprovide a laptop computer to thesescholarship winners as well.

The Foundation’s college scholarshipsare awarded based upon a number ofcriteria, including the student’s ability tosucceed in college, past academicsuccess, attendance record at school,participation in school activities, serviceto the community and financial need.Each year, a group of Trustees interviewcandidates in person before selectingscholarship winners. Diane Davidson,was the head of the Foundation’sScholarship Committee, who oversawthe entire scholarship award process.

The Foundation also continued itsmentoring program for scholarshipwinners. Each scholarship recipient waspaired with an FCBA member as his orher personal mentor. These mentors areavailable to help support these studentsin their transition to college. Theprogram was administered this year byScott Delacourt. Mentors arevolunteers from FCBA members, who

ably help to shepherd these studentsthrough their higher educationexperience.

ST IPENDS FOR SUMMERINTERNSAs noted above, the Foundation alsoawarded $16,600 in stipends from theChairman Robert E. Lee ScholarshipFund for four law school interns inunpaid government positions over thesummer. This year’s recipients are MarlaA. Hackett of Washington and LeeUniversity School of Law, who will beworking in the Policy Division of the FCCMedia Bureau; Matthew Gregoline ofIndiana University School of Law –Bloomington, who will be working in theU.S. Department of Justice, AntitrustDivision, Telecommunications and MediaSection; Alexis Sáinz of GeorgeWashington University Law School, whowill be working in the OrganismoSupervisor de Inversión Privada enTelecomunicaciones (OSIPTEL), thePeruvian national telecommunicationsregulatory agency, in the Office of PolicyRegulation and Strategic Planning; andChristy Schinka of the Tulane UniversityLaw School, who will be working in theFCC Wireline Competition Bureau in theTelecommunications Access PolicyDivision. Each law student will receive astipend in the amount of $4,000.00 tohelp defray his or her expenses duringtheir summer internship. In addition, theFoundation selected Ms. Hackett toreceive this year’s Max Paglin Award,representing an additional stipend of$600.

Praveen Goyal headed up the internshipprogram. Over 20 applicants werescreened by a Foundation committeebefore the final four were selected basedon financial need, work for acommunications-related agency, academicachievements, community service.

COMMUNITY SER V ICE Continuing a long-standing tradition,the Foundation sponsored numerousvolunteer events for FCBA membersover the past year. Volunteerscontinued to make meals for the

homeless at Martha’s Table each month.In addition, volunteers organized todeliver meals to the homeless in theDistrict each month through McKenna’sWagon, a mobile soup kitchen operatedby Martha’s Table.

The foundation also conducted adonation campaign to assist in the reliefefforts of the Indonesian Tsunami thatoccurred in December 2004. Donationswent to Save the Children earmarkedfor the tsunami relief effort.

FOUNDAT ION VOLUNTEER OFTHE YEARAt the luncheon on June 6th, DianeDavidson was recognized as theFoundation’s Volunteer of the Year. Asnoted above, Diane was instrumental inorganization and running the collegescholarship process. She has spentcountless hours supporting Foundationprograms. Through her dedication, andbuilding on contributions from pastBoard Members, she has ensured thatthe college scholarship program isadministered in a professional andaccountable manner.

FUNDRAIS INGThe Board of Trustees maintained itscommitment to fund scholarships eachyear out of current donations rather thandrawing down the Foundation’s reserves.As a result, fundraising was critical tofulfilling the Foundation’s mission. RuthMilkman took the lead in a fundraisingeffort that resulted in a record level ofdonations to support scholarships in asingle year. FCBA members generously donatedover $3,200 to our annual givingcampaign and contributed nearly$9,000 through the membership duescheck-off.

The Foundation also benefited from the18th Annual Chairman’s Dinner honoringFCC Chairman Michael K. Powell whichwas held on December 2, 2004 at theWashington Hilton’s InternationalBallroom. This year’s special guestsincluded FCC Commissioners KathleenAbernathy, Kevin Martin, and JonathanAdelstein, as well as Ambassador DavidGross and Assistant Secretary MichaelGallagher. The event raised $39,500 forthe Foundation’s Scholarship fund.

The FCBA was able to raise over $4,000this year from holding a Casino Night atthe annual FCBA Seminar at KingsmillResort in Williamsburg, Virginia. TheFoundation also benefited greatlythrough the efforts of the YoungLawyer’s Committee for their initiativein selling FCBA Polo Shirts to benefitthe Foundation.

Due to the efforts of Joe Di Scipio, forthe first time in the fall of 2005, theFCBA Foundation will be eligible toreceive contributions from theCombined Federal Campaign, theannual charitable giving programsponsored by the federal governmentthat allows government employees tocontribute to any organization on thelist of approved charitableorganizations.

The 9th Annual FCBA FoundationHonorable Robert E. Lee MemorialGolf Tournament was held on Monday,

June 20, 2005. The group returned toBull Run Country Club in Haymarket,Virginia, raising nearly $20,000 for theFCBA Foundation’s Scholarship Fund.The tournament is named in memory offormer Federal CommunicationsCommission Chairman, Robert E. Lee,who passed away in April 1993 afterserving on the FCC for almost thirtyyears. The Golf Tournament planningcommittee, chaired by Alan Campbell,made the event another success thisyear.

The 2004 Charity Auction held onNovember 18, 2004, was the mostsuccessful to date, raising well over$70,000 for The Charitable Coalitionfor Children with Cancer.

The Charitable Coalition for Childrenwith Cancer is comprised of four non-profit organizations with the shared goalof meeting the needs of children withcancer and their families in Washington,D.C. The four organizations that formthis collation are: Teardrops to Rainbows;the John Quadrino Foundation; TheInova Fairfax Hospital for ChildrenPediatric Oncology Fund; and The Make-A-Wish Foundation. These organizationsprovide financial and emotional supportto children with cancer and their familiesthrough a variety of programs andservices.

The planning committee co-chairs werePam Slipakoff (chair), Ryan Wallach,Jason Friedrich, Steve Hitchcock, DavidDon, Cara Voth, Jason Scism, EdgarClass, and Jennifer Tatel.

McKenna’s WagonSeeking Volunteersfor August 28McKenna’s Wagon is a mobile soup andsandwich wagon that goes “on location”to deliver food to the needy. For thosewho have volunteered, it has been awonderful experience and a great way tohelp the needy in the D.C. community.

The Wagon is a white van that is loadedup with sandwiches, snacks and soup.We meet at Martha’s Table at 4:45 pm incomfortable clothes and shoes. Martha’s Table is located in a yellowbuilding at 2114 Fourteenth Street, NW,in the District, near the intersection of14th and U Streets. On-street parking isavailable.

Upon arrival we get assignments (some ofus will distribute snacks and sandwiches,others will serve soup), and put on apronsbefore we depart in the van to 5th andNew York Ave., NW (near the newConvention Center). We are driven byone of our experienced volunteers and thetrip to distribution location takes about10-15 minutes.

We serve about 30-75 people per visitincluding a few mothers who come forfood for their families. The area is wellpatrolled by police. The food distributionis conducted in an efficient, calm andorderly fashion and many of the peoplewe serve are quite appreciative of ourefforts. Once we serve all of the food, wedo a clean up of the immediate area. Totaltime for the distribution takes about one

hour and we usually return to Martha’sTable by or before 6:30 pm.

We would love to have you join us on oneof our upcoming food runs: 9/25, 10/23,11/27 and 12/25. If you are able tovolunteer for one of these dates, pleasesend an e-mail to [email protected] [email protected].

Volunteer Outreachfor Martha’s Table –August 28Many of us are stretched for time thesedays, but why not consider spending afew hours on a Sunday to help the FCBAFoundation’s partner charities? Forseveral years now, the FCBA has beenproviding volunteers to Martha’s Tableand McKenna’s Wagon. Theseorganizations rely on the good work ofour members each month, so grab afriend, colleague or family member andjoin your fellow FCBA volunteers!

Martha’s Table feeds hundreds of hungry,homeless adults and children on thestreets of Washington daily, through itsmobile soup kitchen. Children andfriends are also welcome. We will begin at

10:00 am and work until 1:00 pm.Martha’s Table is located in a yellowbuilding at 2114 Fourteenth Street, NW,in the District, near the intersection of14th and U Streets. On-street parking isavailable. Volunteers are asked to bringsandwich fixings (bread and sandwichmeat) with them, as the center often runsout of donated food.

graduated with a double major Bachelorof Science Degree in ElementaryEducation and Spanish.

When asked what her favorite thing aboutcollege was, Noemy said, “my overallcollege experience. Living on campus andgoing to my classes. Interacting withfellow classmates and professors before andafter classes. The opportunity to becomemore independent and responsible. Theseare all experiences that have molded theperson I have become.”

Noemy plans to start working as a thirdgrade elementary school teacher in theFrederick County Public Schools System.She also plans to further her education bypursuing her Masters in Education.

Elizabeth Doherty is a graduate ofTheodore Roosevelt Senior High Schooland graduated from Temple University onMay 19, 2005 with a B.A. in Arts and aB.A. in African American Studies.

Elizabeth enjoyed the life-long friendshipsshe developed in college and herexperiences working in televisionproduction.

Elizabeth is interested in finding a job intelevision production while continuingher education through graduate school.She recently attended the FCBA’s SpringLuncheon and Annual Meeting where shewas introduced by Foundation Chair,Greg Vogt.

Andre Turner attended Spingarn SeniorHigh School and graduated from AlabamaA&M University on May 14, 2005 inNormal, Alabama with a Bachelor ofScience degree in Engineering.

This past spring, Andre was involved in aproject called “NASA’s Great MoonbuggyRace” held at the U.S. Space and RocketCenter in Huntsville, AL. Andredescribed the project in his own words,“In our first year we finished in about25th place, so for our second year we setthe goal of finishing in the top ten. Weredesigned our moonbuggy with themajor improvement being the shaft driveversus conventional chain drive. Beingthe first to use the shaft drive we escaped

all the normal chain popping problemsexperienced by other team and came inninth place. As a second year driver onthe moonbuggy, I personally aspired to dobetter than top ten but we had torqueproblems and consequently could not getenough power from the high geared shaftdrive. Andre plans on attending the Universityof Alabama in Huntsville to begingraduate studies in Mechanical/AerospaceEngineering. His desire is to obtain aPh.D. and then begin a lifelong career inresearch and teaching.

Andre also wanted to convey his gratitudeto the FCBA Foundation for believing inhim and helping him graduate.

Volunteer for Free Legal Clinic on August 13The FCBA organizes volunteers to spend three hours once a quarter helpinglower income indviduals through a clinic sponsored by the DC Bar. Our nextFCBA volunteer date for the Walk In legal clinic is Saturday, August 13. Wehave moved to a new location. At the new location, we co-volunteer with theFederal Communications Commission and other members of the private bar.Attorneys receive a half-hour overview/orientation beginning at 9:30 am overbagels and juice. Volunteers are expected to assist clients only during the timethey are at the clinic.

The new location is the Max Robinson Clinic, which is located at 2301 MartinLuther King, Jr. Avenue, S.E., Washington, DC 20020. The clinic has the samesponsor and in the same format, but we will be at a different location to help theDC Bar better allocate volunteers.

It is a great opportunity to spend a few hours and get so much more in return.Clients are appreciative and you can actually learn some practical advice andtalk to clients who are every day people. As always, encourage your colleaguesto help out.

You must either be a member of the DC Bar, have an application pending to theDC bar, or be an employee of the federal government to provide advice. Thosewho are not DC bar members, paralegals and law students are needed, however,to provide intake and triage. Law students can have the opportunity to sit in onadvice sessions. Dress is casual, but respectful. Bring a pen.

Leo ResnickLeo Resnick, a longtime communicationslawyer and FCBA member, died on July 4,2005 at age 91. Leo spent his early careerat the Federal Communi-cationsCommission, most notably as the hearingexaminer who presided over the 1952merger of United Paramount Theatres andABC Television. That merger created aconglomerate network that competedwith the older and, as of that time, moreestablished CBS and NBC networks. Leo

is remembered as an even-handed,thoughtful and respected judge, who wasat all times considerate of witnesses andcounsel. He subsequently left the FCC in1953 to establish his private law practice,where he practiced the way that hejudged, with fairness, consideration anddevotion to the public interest. A solopractitioner, Leo associated himself withwell respected communications law firmsthroughout his career, and spent the lastthree years practicing as Counsel withBorsari & Paxson before retiring in 1991.

Leo was a Phi Beta Kappa graduate ofColumbia University and ColumbiaLaw School, and was a Navy veteran ofWorld War II. He was predeceased byhis wife of 50 years, Vita NathansonResnick, who passed away in 1993.Survivors include his son James Resnickof Pennsauken, N.J., and daughterSusan Rimaud of Paris, France, a sister,and five grandchildren.
