Most of our time over the past quarter has been spent on hy-drofracking, as has been the case for more than the past year. The issues have been heating up, however, as comments on the New York State DEC’s draft regulations are due by December 12th. The KLA, after much analysis, discussion and meetings, sent our com-ments to the DEC and numerous government officials on October 26th. A copy of this letter was sent electronically to all KLA mem-bers with email addresses on file and it is also posted on our web-site, www.keukalakeassoc.org.,and Facebook page We are follow-ing up with a face to face meeting with the DEC in Albany on De-cember 5th. Jim Barre, Chairman of the KLA Hydrofracking and Well Disposal Committee, has his regular update in this newsletter. Just to make the KLA’s position perfectly clear: we think that hy-drofracking should not be allowed within 4,000 feet of the Keu-ka Lake Watershed. As the Scientific American Magazine recently noted: “Drilling for natural gas has gotten ahead of the science needed to prove it safe.” Peter Landre’s article emphasizes that our water quality is exceptional and we want to keep it that way!
As reported previously, the KLA has become a member of the Fin-ger Lakes Regional Watershed Alliance, which has been formed to represent the nine inhabited Finger Lakes in a number of mutually beneficial efforts. This Association is also submitting its comments on the DEC’s draft regulations, which are entirely supported by the KLA. We feel that this regional effort to protect all of the finger lakes and their watersheds provides a significant economic interest base.

President-Elect and Water Quality Chair Bill Laffin provides his up-date and highlights the significant resources which the KLA com-mits to our water testing program with assistance from Cornell Co-operative Extension. Entries must be received by January 31, 2012. Limit 3 photos per entrant. Digital photos should be taken with a 3.5 mega pixel or larger camera, at highest possible resolution. After uploading the image to your computer, save it as a .tif or .jpg file, leave it unedited, and send it on a CD-ROM to the KLA office at P.O. Box 35, Penn Yan, NY 14527. Traditional 4x6 35mm color prints may also be submitted. You may also re-submit photos that were previously not selected. Upon our receipt of your CD or prints, you will be sent a form releasing the photo(s) for use by the KLA. Photos not selected for use in the calendar may be placed in the photo gallery on the KLA website or in the newsletter. Past entries may also be considered for use in future calendars.

KLA Continues to Demand a Prohibition of Hydrofracking in the Keuka Lake Watershed
The Keuka Lake Association has asked in its Comments submitted to the New York State Department of Envi-ronmental Conservation (DEC) to prohibit High Volume Horizontal Hydraulic Fracturing for natural gas (HVHF) in the Keuka Lake Watershed. The KLA Hydrofracking and Well Disposal Committee believes that the unknown science about HVHF makes HVHF for natural gas too risky in the Watershed. KLA representatives met with NYS Senator Tom O’Mara and NYS Assemblyman Phil Palmesano and discussed the concerns relating to HVHF for natural gas in the Keuka and the other Finger Lakes’ Watersheds. The KLA specifically asked for their help in prohibiting HVHF in the watershed. We discussed the value of our watershed and the importance of the wineries, tourism and agriculture in the region. Both Senator O’Mara and Assembly-man Palmesano indicated their support for our position. They asked the KLA to closely work with the DEC. The KLA is actively participating in the Finger Lakes Regional Watershed Alliance’s efforts to prohibit HVHF in the entire Finger Lakes Watershed. Keuka Lake Watershed residents should understand that the initial efforts of the Hydrofracking and Well Dispos-al Committee were related to the Marcellus Shale Play. However, the Utica Shale Play, which lies beneath the Marcellus Shale Layer, is also of prime interest to the energy companies for its natural gas potential. The Utica Shale Play is thicker and extends further north and east of the Marcellus Shale Play and lies beneath Rochester and Syracuse. Again the KLA has and is focused on the threats to the Keuka Lake Watershed waters and aquifers. There are additional threats to the quality of life issues around the lake, and residents should address these issues with their respective town and county officials. Many towns around the lake have enacted moratoriums and are con-sidering prohibitions. Please contact your State, county and local officials to voice your opinions. The KLA Website now contains the names and contact information for many of these officials. The KLA, through the help of Doug DeFranco and our Communications Committee, is getting pertinent information out to its membership through e-mails. ESTHER N. WAHLIG KEUKA LAKE WATERSHED SCHOLARSHIP The goal of this scholarship, sponsored by the Keuka Lake Association, is to assist a graduating senior high school student who is planning to enroll in a four year program (may include a two year college with plans to transfer to a four year institution) and who is planning on pursuing a career in general environmental scienc-es or limnology or water quality/watershed management. Eligible applicants include senior students graduating from high schools in the Keuka Lake Watershed, including Haverling Central School, Dundee Central School, Penn Yan Academy, Prattsburgh Central School, Hammondsport Central School or senior students whose parents are Keuka Lake Association members. The one-time $1000 scholarship will be awarded in one installment upon satisfactory completion of the first semester and submission of a transcript sent to the Keuka Lake Association office for review by the com-mittee. The selection committee is composed of five members appointed by the Keuka Lake Association and will meet in April of the student’s graduating year. The committee must receive application forms by April fifteenth of the graduating year. By June first the committee will send the selected recipient a letter and forward a copy to the guidance department of the appropriate school. Students should submit an application for the scholarship to the Keuka Lake Association by mail to P. O. Box 35, Penn Yan, NY 14527. The application must include a letter of recommendation from one of the applicants teachers and a 250 to 300 word essay describing the students interest in his or her selected field of study and how the student plans to apply that knowledge either in a future career or for enriching his/her ap-preciation in the environmental sciences or water quality/watershed management. An application is available on our website and it will be included in our March newsletter.
As we near the end of 2011, the KLA Membership Committee sends a much deserved thank you for your support this past year. Our membership is the highest it has been in the last five years with existing members renewing, past mem-bers rejoining and many non-members coming on board. We believe that this interest is a show of support as to where the KLA has focused its efforts. From member surveys conducted this year, it is clear that Hyrofracking in the Keuka Watershed is the number one issue that is on the minds of members. Members also indicated that they are satisfied with the types and intensity of communication the KLA has been having with government and regulatory agencies regarding this issue. Even with this activity, the KLA still heavily focuses it resources on water quality, water safety, monitoring of invasive (lake) species, lake level control and numerous other issues that potentially impact the quality of Keu-ka Lake and the Keuka Watershed. Again, thank you for your support and have a wonderful holiday season. E-mail & Telephone Inquiries The KLA Office receives many interesting inquiries. We try, as much as is possible, to pass the inquiry off to the KLA Director or Consultant who can best answer your questions - so don’t hesitate to ask!
The results of the deep water base line sam-ples have been reviewed and no abnormalities were found in the 100 parameters tested. Everything was below the detectable threshold. The KLA has also been given access to the test data from the Penn Yan Munic-ipal Water System. They use the same lab as KLA so we have a good feeling about the quality of their test results. The KLA is also in the process of getting simi-lar data from the Hammondsport Municipal Water Sys-tem. Keuka Lake Water Quality Testing under the leadership of Cornell Cooperative Extension continues to be one of the KLA’s most important missions and highest expenses. As previously reported, in 2011 we have added new tests and test parameters to our water testing program. Our budget for water sample testing has increased from $7500 in 2010 to $9000 in 2011 to $14000 in 2012.
The testing for e.coli has not been done this year due to the bankruptcy of the lab we previously used. While other labs are available to do this test, the logistics of getting all of the samples taken and then delivered to the lab while the samples are still viable make it very difficult. We will continue to examine our options. The validity of this particular test has been discussed in length by the Keuka Lake water Quality Committee and the conclusion is that because Keuka Lake is an open source lake with no natural filtration the test does not given an accurate picture of the lake’s overall health – only the point at which the test was tak-en. The waste water inspection program is about 98% of what protects the lake.
Since this article is due to the printers prior to the November Keuka Watershed Improvement Cooper-ative (KWIC) Meeting, waste water inspection results are only through October Year to Date. At that point slightly more that 70% of the Keuka Lake Zone One Inspections have been completed. If you have re-ceived your notice of Inspection Due, please contact your municipalities’ inspector to have your system in-spected. There are penalties for non compliance so please get your system inspected.
The Waste Water Inspector’s use of the new software continues to improve. A few minor system glitches were discovered in October but quickly reme-died by the software developer.
The complaint of silt in the water along the east side of Keuka Lake was investigated by Yates County Soil and Water Conservation District (YCSWCD). By the time YCSWCD met with the adja-cent homeowner, the silt had abated. It was evident however, that an effective erosion protection plan was not in place during the home construction process. It is the home owner who is ultimately responsible for all activities on their property. However, if neighbors do not report issues on a timely basis little can be done to correct the problem. Town Code Enforcement Officers need to be more vigilant on this issue. The Town of Jerusalem via its Steep Slopes Law is very good at preventing this type of problem. All towns around Keu-ka Lake need to have a steep slopes ordinance to help protect the lake.
The KLA has proposed a budget item for 2012 for a grant to YCSWCD for the use of an airboat for invasive plant identification and removal in the summer of 2012. The use of an airboat was a success this summer.
The KWIC Board has approved creating several basic waste water system designs. These would be bid out to engineering firms to get price quoted. This would allow property owners a chance to better antici-pate engineering costs for new and replacement sys-tems.
Last spring the KLA received a few comments from concerned members regarding the impact of bub-blers that are used to prevent freezing near permanent in lake structures. The concerns regard bubblers on one property causing the lake to remain open on adja-cent properties. This can have an adverse impact on ice fishing, ice boating, skating, water fowl migration and other winter activities on the lake. After some re-search, we have found that there is no state or local law that governs this issue, nor is there likely to be in the future. So our recommendation is to be a good neighbor and adjust your bubbler so it only has an im-pact within your water rights line.

PFD REMINDER: Please keep in mind the new law that went into effect two years ago:
SAFETY EQUIPMENT REMINDER: Now that you have winterized your boat and put it away, you might want to review your inventory of safety equipment to see if anything should be replaced for the upcoming 2012 season (time to get those items onto your Christmas lists now while they are fresh in your mind). Also think about any other new safety equipment that you might have seen this summer that you should have for next summer - marine radio, depth finder, new spot lights, etc FALL / WINTER BOATING AND NAVIGATING: If you continue boating activities this fall, please keep in mind a number of safety concerns: WATER TEMPERATURE - Make sure you are properly dressed and outfitted as the lake temperatures begin to drop rapidly (please see the water tempera-ture graph on the KLA website). It has historically dropped from the 40's down into the 30's from No-vember through March. LAKE LEVELS - As you navigate any waters this winter season, make sure you are on the lookout for shallow areas or uncovered obstacles due to the lower lake levels. Shallow water marker buoys may not be present if they have been taken out by NYS Parks for the winter months (which then get reset in the spring). LESS ASSISTANCE OUT THERE - This time of year, since there are fewer people around, cries for help or distress may go unanswered for some time. Prepare yourself for anything to happen and assume it will be awhile before help can get to you. BOATER SAFETY COURSES: There may not be many safety courses held locally during the winter months, but please plan on attending one in the spring if you cannot find one this winter. Also, please watch the future NYS Legislative Sessions to see if an Assembly Bill (previously A5889) resurrects and begins to move through the legislative approval process or not. This previous Bill required any-one born after January 1, 1992 to hold a Boater Safety Course Certificate in order to operate any "mechanically propelled vessel". Whether or not this ever becomes law in NYS, it still is a great idea for EVERYONE to take and pass a Boater Safety Course. HAVE A GREAT WINTER!
Subject: Navigation law amendment effective 11-01-09 Navigation Law § 40 currently requires certain vessels to maintain personal flotation devices, and also man-dates that they be worn in certain circumstances. It does not, however, require passengers of pleasure ves-sels, over the age of eleven, to wear a PFD when the vessel is underway. A 6784, now signed by the Governor, states that “No owner or operator of a pleasure vessel less than twenty-one feet, including rowboats, canoes, and kayaks shall permit its operation, between November first and May first, unless each person on board such vessel is wearing a securely fastened United States Coast Guard approved wearable personal flotation device of an appropriate size when such vessel is underway.”

Critter Corner Keuka’s Old Growth - Dave deCalesta Does it exist?
Gordon Lightfoot sang a paean to old growth forest in his Canadian Railroad Trilogy song - “There was a time in this fair land when the railroad did not run, when the wild majestic mountains stood alone against the sun, long before the white man and long before the wheel, when the deep green forest was too silent to be real.” The KWIC Chairman, Steve Butchko invited me along to look at a patch of “old growth forest” in a ravine above the lake awhile back. We went and looked. Was it? Well, what is old growth forest? What does it look like? What does it do?
Northeastern old growth forest is characterized by: 1) large, tall trees at least 180-200 years old and 18 inches or more in diameter; 2) a stratified forest structure of multiple growth layers throughout the canopy; 3) gaps in the tree canopy caused by natural dis-turbances (ice storms, tornados, wind shear) that produce an uneven-aged mix of big old trees, medium-sized and shorter, young trees; 4) dominance by trees that are shade tolerant (don’t require much sunlight to grow, such as hemlock, sugar maple, and beech); 5) many big and tall dead trees (snags); 6) many large, medium and small logs; and a dense understory of mosses, lichens, shrubs, and wildflowers. Generally old growth areas are larger than 5 acres: if the area is smaller, excess sun-light coming in from lower tree height on the borders favors fast-growing, shade-intolerant trees like black cherry, red maple, birches, aspen, and yellow poplar and plants like blackberries and poison ivy.
Because old growth forest has high diversity of tree species, heights, food sources (fruits, seeds, lichens, mushrooms, and berries) forbs on the ground, litter and much down wood as logs, the huge diversity of associated habitats is home to a great diversity of wildlife: mammals, birds, snakes, amphibians, turtles, insects. None are old-growth obligates (must have old growth as requisite habitat), nor were the larger animals (wolves, mountain lions, caribou, bison, elk) that were extirpated prior to the 1900s because they ate the settlers’ crops, livestock, and the occasional settler or were themselves eaten by the settlers. But where there is old growth, wildlife diversity maxes out. Because of the tremendous amounts of standing and down woody material, old growth areas are carbon sinks, capturing carbon, and lowering the potential for global warming as well as optimizing recycling of nutrients through decay of fallen trees and other plants. Extensive and well-established root systems hold the soil and absorb moisture, acting like a giant sponge by retaining water throughout summer. That way, water doesn’t run off over the ground after rains but rather is stored and slowly released all summer. Old growth forests moderate temperature because of their multi-layered tree can-opy: their understories are warmer in winter and cooler in summer. In the 1700s and 1800s most old growth forests in the East were chopped down to make pastures for livestock, and ara-ble land for crops. Early 1900s pictures of the hillsides above Keuka Lake show row upon row of vineyards with nary a tree in sight. Many of those early vineyards are gone now, replaced by a resurging 80-100 year-old forest that greens the hillsides around Keuka Lake. It’s mostly an oak forest, with a smattering of other less shade tolerant trees, such as red maple and birch, but given another 100-200 years it will slowly revert to old growth, if not harvested, as the shade tolerant hemlocks and sugar maples replace the sun-loving trees. So, did our ravine adventure turn up an old growth forest? Mostly, no. Situated on a narrow finger of land between two deep ravines, its trees likely had been cut about 100 years ago. Yes, there were a few really big remnant live and dead hemlocks, and one or two massive logs on the ground. But some of the big trees on the boarder of the narrow strip were spreading oaks the generations-ago farmer left as a source of shade and food (acorns) for his cattle. And most of the oth-er trees were shade intolerant species such as black cherry and red maple. The narrowness of the strip of woods meant that sunlight would always come in from the sides, favoring the shade intolerants rather than the old growth species of hemlock, sugar maple and beech. But many of the Keuka Lake hillside forests could regain old growth status, with all the positive aspects for forest and lake ecology. Just give them another 100-200 years. The Tionesta Scenic and Natural Research Area (http://www.dcnr.state.pa.us/forestry/oldgrowth/tionesta.aspx) in the Al-legheny National Forest between Sheffield and Kane in northwestern Pennsylvania is a 4,000 acre true old growth forest, and the Zoar Valley (http://www.zoarvalley.org) 30 miles south of Buffalo is another. Both are a short drive, and worth a day’s exploration. The southern wall of the Keuka Outlet between Keuka and Seneca lakes is steep and covered with old hemlocks: it certainly looks like old growth. Take a look come spring and judge for yourselves.

Keuka Lake Sampling-We have nearly completed our sampling for the year and added a number of new pa-rameters to our baseline sampling for potential impacts from Marcellus/Utica shale development should it be permitted in the watershed in the future. Overall, lake water quality showed similar levels of water clarity as previous years with the water clarity ranging from the 6 meters to 9 meters range, with the average around 8 meters. This is exceptional clarity and over 3 meters above the pre-zebra mussel levels. Nutrient and algae levels continued to be very low, indicative of an “oligotrophic” or low nutrient status lake. Analysis of barium and chloride were added to our baseline samples from SUNY Brockport for all samples and were found to be at background levels. We also contracted with the Community Science Institute for an extensive baseline scan for gas well impacts on both surface and bottom samples in the center of the lake. There were over 80 parameters tested included metals, detergents, methane, volatile organic compounds, and radioactivity. Given the extremes of the wet spring and droughty summer, the lake level was maintained very well this year per the guide curve. We are investigating upgrades to the automated lake level reporting system at this time and hope to have the upgrades installed by next year.
REMEMBER and REMIND YOUR NEIGHBORS… NYS Bans Open Burning-As of October 14, 2009, open burning, including the use of burn barrels, is prohibit-ed in NYS. The DEC is actively enforcing the law this spring and there are many incidents recently where peo-ple are being ticketed and fined ($100 for first offense). There are some exception to the law including camp-fires less than 3’ high and 4’ diameter; ceremonial/celebratory bonfires; small cooking fires; tree limbs less than 6” and 8’ length (NOT allowed between March 16 and May 14); fires cannot be left unattended and must be fully extinguished; only charcoal or clean, dry, untreated or unpainted wood can be burned. Firewood Import Ban - Due to new invasive forest pest species including Emerald Ash Borer, Hemlock Woolly Adelgid and Asian Longhorned Beetle, firewood is prohibited from being transported more than 50
miles from its source unless it has been heat treated and cer-tified. This is a NYS regulation and is intended to slow the spread of these deadly invasive species. Hemlock Wooly Adelgid-If you have hemlock trees on your property, it is important to inspect them to determine if they have been infested with Hemlock Wooly Adelgid and report your findings to CCE. The HWA forest pest insects are 100% fatal to hemlock trees unless they are treated. Cornell University forest entomologist Mark Whitmore is collecting data on the spread of this pest and working with the DEC on control options. Detection of the pest is relatively easy to do by inspecting the base of the needles and looking for small white dots (see photo). If you suspect you may have HWA on your hemlocks, please contact our office and speak with a Master Forest Owner to confirm.
Emerald Ash Borer-The Emerald Ash Borer (EAB) attacks and kills ash trees and has been confirmed in Steuben Coun-ty, but not Yates County at this time. The green beetles bore D-shaped holes in the bark and S-shaped channels under the bark and often you will see woodpeckers activity on ash trees as they feed on them. Swimmer’s Itch - Peter Landre
Over the years, I have had calls from people on the lake with rashes they believe came from swimming in the lake. This is not uncommon and may be what is known as “Swimmer's itch” or cercarial dermatitis. Swimmer’s itch appears as a skin rash caused by an allergic reaction to certain parasites that infect some birds and mammals. These microscopic parasites are re-leased from infected snails into fresh and salt water (such as lakes, ponds, and oceans). While the par-asite's preferred host is the specific bird or mammal, if the parasite comes into contact with a swimmer, it burrows into the skin causing an allergic reaction and rash. Swimmer's itch is found throughout the world and is more frequent during summer months. Most cases of swimmer's itch do not require medi-cal attention. What is swimmer's itch? Swimmer's itch, also called cercarial dermatitis, appears as a skin rash caused by an allergic reaction to certain microscopic parasites that infect some birds and mammals. These parasites are released from infected snails into fresh and salt water (such as lakes, ponds, and oceans). While the parasite's preferred host is the specific bird or mammal, if the parasite comes into contact with a swimmer, it bur-rows into the skin causing an allergic reaction and rash. Swimmer's itch is found throughout the world and is more frequent during summer months. How does water become infested with the parasite? The adult parasite lives in the blood of infected animals such as ducks, geese, gulls, swans, and certain mammals such as muskrats and raccoons. The parasites produce eggs that are passed in the feces of infected birds or mammals. If the eggs land in or are washed into the water, the eggs hatch, releasing small, free-swimming micro-scopic larvae. These larvae swim in the water in search of a certain species of aquatic snail. If the larvae find one of these snails, they infect the snail, multiply and undergo further development. Infected snails release a different type of microscopic larvae (or cercariae, hence the name cercarial dermatitis) into the water. This larval form then swims about searching for a suitable host (bird, musk-rat) to continue the lifecycle. Although humans are not suitable hosts, the microscopic larvae burrow into the swimmer's skin, and may cause an allergic reaction and rash. Because these larvae cannot de-velop inside a human, they soon die. What are the signs and symptoms of swimmer's itch?
Symptoms of swimmer's itch may include:
· tingling, burning, or itching of the skin · small reddish pimples · small blisters
Within minutes to days after swimming in contaminated water, you may experience tingling, burning, or itching of the skin. Small reddish pimples appear within twelve hours. Pimples may develop into small blisters. Scratching the areas may result in secondary bacterial infections. Itching may last up to a week or more, but will gradually go away.
Because swimmer's itch is caused by an allergic reaction to infection, the more often you swim or wade in contaminated water, the more likely you are to develop more serious symptoms. The greater the number of exposures to contaminated water, the more intense and immediate symptoms of swimmer's itch will be. Be aware that swimmer's itch is not the only rash that may occur after swimming in fresh or salt water. Do I need to see my health care provider for treatment?

ADVERTISING IN THE KLA NEWSLETTER
The advertising section of the KLA newsletter is provided as a service to KLA members only. The ads are restricted to 1/4 page, to fit into a 3 3/4 by 4 3/4 . It is the responsibility of the advertiser to contact the KLA office with a request for ad space in an upcoming issue and send a print ready ad. The dead-line for the March 2012 issue is February1st and will be accepted in the order submitted. However, in an attempt to present an inter-esting diversity of ads, the KLA editorial staff reserves the right to limit the number of any specific type of ad in any given issue. KLA also reserves the right to decline acceptance of an ad deemed inap-propriate for the publication. Ad cost for each issue is $50. Thank you to all of the KLA members who have advertised with us.
