Confirmed: - Meets confirmatory laboratory evidence: SARS-CoV-2 RNA in a clinical
specimen using a molecular amplification detection test.Probable (most likely will become “Confirmed”): - Meets clinical criteria (symptoms) AND epidemiologic evidence (exposure)
with no confirmatory laboratory testing performed for COVID-19.- Meets presumptive (antigen, antibody) laboratory evidence AND either
clinical criteria OR epidemiologic evidence.- Meets vital records criteria with no confirmatory laboratory testing

Employees that are at increased risk of severe illness from COVID-19:- Over age 65 - Cancer- Chronic kidney disease- COPD (chronic obstructive pulmonary disease)- Immunocompromised state (weakened immune system) from solid organ
transplant- Obesity (body mass index [BMI] of 30 or higher)- Serious heart conditions, such as heart failure, coronary artery disease, or
cardiomyopathies- Sickle cell disease- Type 2 diabetes mellitus

marrow transplant, immune deficiencies, HIV, use of corticosteroids, or use of other immune weakening medicines
- Neurologic conditions, such as dementia- Liver disease- Pregnancy- Pulmonary fibrosis (having damaged or scarred lung tissues)- Smoking- Thalassemia (a type of blood disorder)- Type 1 diabetes mellitus
1. Can a high-risk employee choose to come to work without additional accommodations? Yes. The employee does not have to identify as high-risk, and even if they do, they may choose to engage in regular employment without additional accommodations.
2. Can a high-risk employee ask for additional protections? Yes. Employers must continue to follow existing law on reasonable accommodations. L&I has long-standing guidance regarding workers’ rights in work environments where they feel unsafe, and the employer’s role in addressing their concerns.
3. Can a high-risk employee ask for an alternate work assignment if additional protections cannot be provided? Yes. This information is also included in L&I’s long-standing guidance on workers’ rights.
4. If a high-risk employee cannot be provided additional protections and there are not alternative job assignments, can the employee access eligible forms of leave? Yes. Employers must provide high-risk individuals with their choice of access to available employer-granted accrued leave or unemployment benefits if an alternative work arrangement is not feasible.
5. Are employers required to provide an accommodation to employees if they are not high-risk themselves, but they live with someone who is? No. Rights for high-risk employees under Governor Inslee’s Proclamation 20-46, as well as workplace safety regulations provided by L&I, do not extend to family members of employees.

Wedding and Funeral Guidance
The update allows wedding and funeral receptions to resume, as long as they meet specific requirements.
• Receptions and ceremonies must be capped at 30 people, or 25% of venue occupancy, whichever is less
• All tables at the reception must be seated by household, with table sizes capped at 5 people
• Facial coverings are required, and social distancing must be maintained
Miscellaneous venues
The guidance allows business meetings, professional development training and testing, and substantially similar activities to occur away from business premises and with additional attendees, as long as all requirements are met.

Eviction Rental Assistance Program (ERAP)
Rental Assistance to help pay up to 3 months of rent. Must have missed one rent payment since March 1st and be under 50% of the Area Median Income to qualify. All funds must be spent by the end of December. More info: [email protected]
Emergency Solutions Grant COVID (ESG-CV)
Additional funds expected in October to provide emergency shelter, rental assistance, utility assistance, application fees, eviction prevention. More information to come soon.
