Employment law is a diverse area that is controlled by judicial decisions, as well as legislative enactments. In an effort to manage the risks that they face, health care providers should be familiar with evolving topics in employment law.

! Americans with Disabilities Act - The Americans with Disabilities Act (ADA) prohibits employers with fifteen or more employees from discriminating against “qualified” individuals with disabilities. An employer is required to make reasonable accommodations for physical or mental limitations, when such limitations are known by the employer and accommodations would not impose an undue hardship on the business. An employer found in violation of the ADA may be required to pay compensatory, as well as punitive, damages.

! Employment at Will - While an employee hired in Colorado for an indefinite period of time works “at will,” allowing an employer to terminate the employee without cause, this doctrine is quickly eroding away as courts are recognizing more and more exceptions to the general rule. Health care providers must be careful when providing employee handbooks that outline an organization’s procedures and policies, and in making implied promises of long-term employment. Additionally, Colorado has passed a law protecting an employee from being discharged for engaging in lawful activities off of the work-site and during nonworking hours.

! Liability for Payment of Wages - Under most circumstances, the wages earned by an employee must be paid within ten days following the close of a pay period. Upon termination, employees are usually entitled to be paid almost immediately. Failing to comply with the wage laws may result in payment of penalties, besides payment of compensation due to the separated employee. Moreover, the wage laws have been interpreted to allow a separated employee to sue a company’s officers, personally, for unpaid wages.

Both the IRS and Colorado provide guidelines for determining the existence of an employer/employee relationship or an employer/independent contractor relationship. Senate Bill 10-124 enacts the "Michael Skolnik Medical Transparency Act of 2010" to extend reporting requirements to many health care professionals who apply for or renew a license, certification, or registration, on or after July 1, 2011. What you should know about the credit card processing industry.

VISA/MC ANTI-TRUST SETTLEMENT AND CREDIT CARD SURCHARGES.

If your practice was taking credit cards between January 1, 2004 and November 28, 2012, you have probably already received “Legal Notice about a class Action Settlement” by mail. You may also receive solicita-tions which look like official notices, but which are actually a rather sneaky marketing ploy. These are from companies wanting you to sign over a percentage (up to 33%) of your portion of the settlement money in exchange for their handling your paperwork, or credit card proces-sors looking to get your business. Know the difference!

Here are the basics of the situation… In 2005, several companies initi-ated a Class Action Lawsuit against MasterCard and Visa (and their member banks) alleging that they violated laws by conspiring to set interchange prices, and by imposing rules that limited merchants ability to steer customers to other payment method (an anti-trust lawsuit). In November 2012, the Federal court handling the case agreed to consider a proposed $6.05+ billion settlement.

The proposed settlement involves two funds (a Cash Settlement for dates above, and an Interchange Fund for transactions for 8 months beginning July 29, 2013). In addition, the settlement requires Visa and MasterCard to give businesses permission to levy a surcharge when they accept credit cards. It is important to note, however, that the following states all have laws which prohibit most merchants from imposing sur-charges: California, Colorado, Connecticut, Florida, Kansas, Maine, Mas-sachusetts, New York, Oklahoma and Texas. (Colorado Revised Statutes 5-2-212 prohibits most Colorado merchants from imposing surcharges.)When and if the anti-trust settlement receives final approval (potentially in September 2013), you will receive a claim form via mail or e-mail. You

will be required at that time to complete a claim form (either by mail or electronically) to receive a piece of the Cash Settlement. You may preregister at the official website (www.paymentcardsettlement.com) but it is not mandatory. If you would like to learn more about proposed settlement, go to the official website or call 800-625-6440 for answers to frequently asked questions and additional information. Operators are also available. Be very careful of taking action on any notice you receive prior to verify-ing the settlement status at that website.

EUROPAY, MASTERCARD® AND VISA® (EMV),

The sophisticated integrated-circuit (IC) “chip” technology that will eventually replace the magnetic stripe on credit cards that has been the standard in the United States since 1960. EMV technology uses dynamic data (versus static data that is on a magnetic stripe and is easily stolen these days) and will reduce credit card fraud and identity theft. EMV has already replaced magnetic-stripe cards in 60 countries (including Canada and most of Europe), and the card associations (such as Visa, MasterCard, Discover and American Express) have all announced phase-in plans for the EMV technology for the United States. The basics of these phases are as follows:

1. Credit card issuers began issuing EMV chip cards in January 2013, and EMV technology will eventually require changes in terminal equipment in order to read these chips. For now, all cards issued will continue to have the magnetic stripe on them also.

2. Processors do not have to have the programming in place until April 2013, and manufacturers of the equipment will be working to refine their technology.

3. Merchants: your office is not actually mandated to accept EMV cards – but the final milestone (and the only one affecting your practice) will be October of 2015, when fraud liability begins shift-ing to the merchant if EMV is not utilized.

You will receive calls implying that you need to purchase new equip-ment now, but as outlined above, these changes are being phased in slowly. It will be more cost-efficient to wait until at least April 2013, when your processor has the certified programming to support EMV technology and the equipment options are wider. (Never lease equip-ment. We often see merchants paying $30-$75 monthly on a non-cancellable 48 month-lease and then having a buyout at the end of the lease. Why pay$1,500-$4,000 for EMV equipment you can own for as low as $225 with adapter (looks similar to a pin pad) for EMV/

contactless readers as low as $150. The EMV/contactless readers will allow patients to wave their credit card or cell phone across the reader (i.e. google wallet, etc.).

PCI stands for “Payment Card Industry” and PCI standards (regulated by MasterCard®, Visa® and Discover®) are designed to protect card-holder identity and reduce credit card fraud. These PCI standards mandate:

• All merchants complete an annual compliance questionnaire (to ensure that you are protecting customers’ cardholder information)

• You do not store full unencrypted card numbers on your com-puter anywhere (in excel file or in dental software).

• Your credit card receipts (both merchant and customer) must truncate the account number (i.e., must not show the entire credit card number).

• If you have an online system for accepting payments, you must have a quarterly computer scan completed by a certified company to ensure that your firewalls and computer system cannot be easily com-promised.

CALCULATE YOUR EFFECTIVE RATE:

Have you ever wondered how much you truly pay to take credit cards? It is a complex industry, and many processors compound this with con-fusing statements and misleading rate quotes. To calculate your true effective rate: Add all the costs and fees on your credit card processing statement (include AMEX and monthly statement fees, PCI compliance, etc.) and divide that number by the total dollars processed that month;Example: $272 ÷ $9876 = 0.0275 or 2.75% effective rateIf this percentage is higher than 2.1% -- you may be paying too much. If you accept more than 30% debit cards, rate should be lower than 2.1%.

The Campaign Finance Reform Act establishes rules on contributions to PACs (Political Action Committees) in Colorado. The maximum contribution an individual can make to a PAC is $550 per election cycle (every two years). For example, an election cycle is from December 2012 to December 2014. Corporate/business checks are allowed as well as checks from individual accounts. A husband and wife may make a single $800 contribution if the contribution is done from a joint checking account. Each family member may contribute with their own personal account, but only one contribution can be made from a joint account. In addition, contributions can be made directly to candidate campaigns by individuals up to $400 each two-year election cycle ($200 for the primary election and $200 for the general election). Please include your current address, profession/employer with your contributions to make it easier for the candidates to properly report.
