OSHA Update-Two New Rules

• Under a final rule released Sept. 11, 2014 beginning in 2015, employers will be required to report all in-patient hospitalizations and amputations to OSHA.

• Previously, employers had to report to OSHA within eight hours any work-related fatalities and in-patient hospitalizations of three or more employees.

OSHA Update-New Rules

• The new rule retains the reporting of fatalities, but adds requirements for employers to report to OSHA within 24 hours all in-patient hospitalizations, amputations and loss of an eye.

OSHA Update-New Rules

• The final rule also updates OSHA's list of industries that are partially exempt from injury and illness recordkeeping requirements. The update entails OSHA switching from the industry classification system it currently uses (SIC) to determine exempt industries to the newer and more broadly used North American Industry Classification System (NAICS).

• Note: This change was not adopted in MN

Machine and Machinery Guarding (1910.212)

1910.212(a)(1)

• Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices ,electronic safety devices, etc.

1910.212(a)(2)

• General requirements for machine guards. Guards shall be affixed to the machine where possible and secured elsewhere if for any reason attachment to the machine is not possible. The guard shall be such that it does not offer an accident hazard in itself.

Respiratory Protection (1910.134)

• OSHA’s respiratory protection rule applies to employers whose employees wear any type of respirator, regardless of frequency or use, reason for use, duration of use or whether or not they are mandatory or voluntary users.

• The employer must develop and implement a program which provides for evaluation of hazards, selection of respirators based on hazards, employee training, medical evaluation, fit testing and inspection and maintenance.

• There are significant differences in requirements for voluntary versus mandatory users.

• A written program is required.

Opening Conference

• Will describe OSHA’s General Duty Clause or 5(a)

– All employers shall provide a workplace free from recognized hazards.

• OSHA will talk to employees alone or with union representatives, no management representatives allowed.

– These employees need to be free from any type of retaliation, discrimination, etc. from talking to the inspector.
