I read them all at least once a year, take a variety of ethics CLE to keep up to date, and consult the rules and OSB ethics opinions whenever I have a question. I have called OSB ethics counsel with questions, and even hired my own ethics counsel in one instance where I needed specific advice in a tricky situation.

Please describe your experience interpreting and applying other statutes, rules, or regulations:

I do this every day. Because my cases are defended by insurance companies, much of it is highly regulated by statutes and regulations. Also, since these are injury cases, we have to check for and apply regulations to see if any were broken or ignored that impacted my client’s situation.

In addition, I am a trial lawyer, so have to apply the rules of evidence and civil procedure regularly.

Please describe your judicial experience:

None, really. I have judged Mock Trial competitions, which is enough to tell me it is a difficult job, and one to take seriously.

List any regulatory bodies on which you have served:

None, really. I was an office assistant for Office of Administrative Hearings in high school. I helped with the committee writing rules there, but not with much of substance. I assisted with “scribe” work for the committee that was working on amending the Oregon Judicial Code of Ethics while I was in law school, but again, not with much of the substance.

I have practiced in Southern Oregon for about 7 years, and am a trial attorney, so I understand that there are two sides to every story.

I do not have a lot of familiarity with the RPC, but have become more familiar over the last few months as I work on an attorney’s lien case for a colleague where accusations of malpractice are being raised.

I have a lot of experience interpreting regulations, statutes and rules, first as an ERISA attorney, then working with regulatory agencies at Portland General Electric, and now with employment law.

Please describe the nature of your practice: Estate planning, probate and trust administration. I practice primarily on large estates and within those areas work on tax issues, setting up businesses, transitioning businesses and business succession, real estate, and estate and trust litigation.

Please describe your familiarity or experience with the Rules of Professional Conduct: I have read and applied the rules of Professional Conduct and have on occasion called the Bar ethics counsel to discuss issues and get guidance before taking action in a matter. I have assisted my partners and associates interpret the rules of professional conduct on several occasions. While on the executive committee of the estate planning counsel I helped analyze possible suggestions for changes to the Rules of Professional Conduct specifically with respect to representing spouses in estate planning.

Please describe your experience interpreting and applying other statutes, rules, or regulations: I interpret statutes all the time in my practice. I am licensed in Washington and often times have to administer documents that were drafted in other states but have their situs in Oregon. Because so much of my practice has tax issues I interpret the Internal Revenue Code and Treasury Regulations on a regular basis. I also am regularly applying the supplemental local rules and the UTCR’s for my probate and trust administration cases.

Please describe your judicial experience: I do not have any direct judicial experience. I am a trained mediator and have mediated cases for parties. I have consulted as an expert on some malpractice cases, i.e. discussed community standards and the rules of conduct as they apply in my area of expertise and applied them to the facts and circumstances of a case.

List any regulatory bodies on which you have served: I do not recall serving on any regulatory bodies.

Please describe any other experience that you believe qualifies you to serve on disciplinary trial panels: My area of the law is one which sadly, many attorneys think they can dabble in. Additionally, estate planners also often represent multiple generations or branches of the same the family. The area is rife for breaches of the rules of professional conduct and as such I strive to be extremely cognizant of those landmines. I also represent fiduciaries and act as a fiduciary regularly often times at the court’s request, which I believe gives me a good client’s perspective on the duties of the attorney representing them.
