ORDINANCE NO. 039, s. 2000

AN ORDINANCE REGULATING THE OPERATION OF THREE-WHEELED MANUALLY OR ENGINE OPERATED BIKE, TRIBIKE, PEDICAB, TM BIKE WITH SIDECAR LOCALLY KNOWN AS "PADYAK" IN THE MUNICIPALITY OF RAGAY.

Be it ordained by the Sangguniang Bayan of Ragay, Province of Camarines Sur, that-

ARTICLE I - TITLE AND SCOPE OF ORDINANCE:

SECTION 1. TITLE OF ORDINANCE - This Ordinance shall be known as "An Ordinance Regulating the Operation of "Padyak" in the Municipality of Ragay.

SECTION 2. SCOPE OF ORDINANCE -The provisions of this code shall control, enforce, direct and supervise the operations of three-wheeled manually or engine operated bike, tribike, pedicab, TM bike with sidecar locally known as "padyak" as a local public utility vehicle.

ARTICLE II - DEFINITION OF TERMS

SECTION 3. WORDS AND PHRASES DEFINED. As used in this ordinance.

(a). "Padyak" shall refer to any three-wheeled manually or engine operated bike, tribike, pedicab, TM bike with a two-seated sidecar propelled by human power or by engine.

(b) "Subdivision roads" shall mean streets or passage ways in subdivisions and/or housing project areas.

(c) "Barangay Road" shall includes feeder road, access road, and small street within the barangay.

(d) "Main streets" are streets continuously and regularly used for all types of vehicular traffic as distinguished from alleys and narrow traversing streets.

(e) "Driver" shall mean any person operating or in actual physical control of the "padyak".

(f) "Owner" or "Operator" shall mean the actual legal owner who operated three-wheeled manually or engine operated bike locally known as "padyak" in whose name such vehicle is duly registered.

(g) "Highway" shall mean the Quirino Highway

ARTICLE III - PROHIBITIONS

SECTION 4. RESTRICTIONS - No "padyak" shall be allowed to enter, pass or utilize any highway, national or provincial road or any main street in the municipality.

SECTION 5. "Padyak" shall only be allowed to operate in subdivision roads, barangay roads, callejons, allyes and small side streets within the municipality, provided, however, that no person below 18 years of age shall be allowed by any owner or operator to drive "padyak" use as a local public utility vehicle.

SECTION 6. REGISTRATION - Every manually or engine operated three-wheeled bike known as "padyak" must be registered with the Municipal Treasurer's Office showing the following:

(a). Name of Owner

(b) Complete address of the Owner

(c) No. of units applied

(d) Name of authorized driver and address

For such registration, a registration fee of fifty (P50.00) pesos for engine operated padyak, and twenty five (P25.00) pesos for manually operated padyak shall be collected, and aside from these, there shall be levied and collected a Mayor's Permit fee of Fifty (P50.00) Pesos per unit, payable annually by the owner thereof and the payment to be made not later than the last working day of January of every year. The registration fee shall not include the expenses for a Plate Number to be provided by the Municipal Treasurer's Office for the first year of the registration. The Plate Number shall be attached outside the "padyak" either in front of the sidecar or at the back of the bike.

Sticker shall be provided by the Office of the Municipal Treasurer for every renewal of the registration of padyak,

Loss of the Plate Number issued to the operator/owner of the padyak shall require him/her to secure another issuance of plate number upon payment of the same amount being collected for the issuance of plate number for padyak.

A penalty equivalent to twenty-five (25%) percent of the Mayor's Permit fee shall be charged per unit registered late.

Provided that no registration shall be accepted without presentation of a barangay clearance secured from the barangay where such operator/owner of the padyak resides.

ARTICLE IV - PENALTY

SECTION 7. PENALTY - Any owner or operator or driver who violated any provision of this ordinance shall be fined the amount of Two Hundred (P200.00) Pesos for every violation.

For unregistered padyak, aside from the fines imposed, the unit shall be impounded at the Municipal PNP Station compound until such time that the owner/operator had registered such padyak.

ARTICLE V - FINAL PROVISIONS

SECTION 8. REPEALING CLAUSE - All ordinances, rules, orders and regulations or parts thereof contrary to or inconsistent with any of the provisions of this ordinance are hereby amended, modified and/or repealed accordingly.

SECTION 9. SEPARABILITY CLAUSE - If any provision of this ordinance or the application thereof to any person, barangays or circumstances is held invalid, the remainder of this ordinance and the application of such provision to other persons or circumstances shall not be affected thereby.

SECTION 10. EFFECTIVITY - This ordinance shall be in full force and effect after publication in a local newspaper.
