Action: On motion made by Mr. Engel and seconded by Mr. Bowers, the Pilot Board approved the minutes of the November 12, 2019 Pilot Board meeting, in the form presented to the meeting.
At 8:32 a.m. Mr. Zahn announced that the Pilot Board would go into executive session pursuant to §551.071 of the Texas Government Code to deliberate agenda items 4a, 4b, and 4c.
At 8:59 a.m., the Pilot Board reconvened in Open Session.

4a. License Renewal of Captain Trip Webb: Staff recommended approval of the renewal of Captain Webb’s’ expiring Branch Pilot’s license to the Governor per Texas Transportation Code Sec. 70.040.
Action: On motion made by Mr. Squires and seconded by Mr. Bowers, the Pilot Board approved Staff’s recommendation.
4b. Appointment of Captain Justin Anderson from the Deputy Branch Pilot Pool: Staff recommended approval of the appointment of Captain Justin Anderson from the Deputy Branch Pilot Pool to the Aransas-Corpus Christi Pilot’s Deputy Branch Pilot Training Program.
Action: On motion made by Ms. Hilliard and seconded by Mr. Squires, the Pilot Board approved Staff’s recommendation.

This memorandum provides you with additional information regarding the following items on the

Agenda Item 5.a. Capt. Kenneth T. Olson Pilot License Renewal:
Texas Transportation Code Sec. 70.040 provides, in part, that if a Branch Pilot applies in writing
and qualifies, the Pilot Board shall recommend renewal unless the Pilot Board determines there is
probable cause not to renew the license. Probable cause not to renew a license exists if the Pilot
Board finds that the license holder: (1) does not possess a qualification required by this chapter for
pilots; or (2) has a disability that will affect the license holder's ability to serve as a pilot.
The qualifications for a Branch Pilot License are set forth in Texas Transportation Code Sec.
70.032. To be eligible for a License as a Branch Pilot, a person must:
(1) be at least 25 years of age;
(2) be a United States citizen;
(3) as of the date the license is issued, have resided continuously in the state for at
least two years;
(4) have at least two years' service as a deputy branch pilot under the supervision
of a state-commissioned pilot serving the Port of Corpus Christi; 6

(5) have controlled the navigation of vessels such as the person would pilot;
(6) have extensive experience in the docking and undocking of vessels;
(7) be in good mental and physical health;
(8) have good moral character; and
(9) possess the requisite skill as a navigator and pilot to perform competently and
safely the duties of a branch pilot.
In making a recommendation to the Pilot Board for a Branch Pilot License renewal, PCCA Staff
focus on the eligibility requirements in Texas Transportation Code Sec. 70.032 (7), (8), and (9)
above. PCCA Staff verify the eligibility requirements in Texas Transportation Code Sec. 70.032
(7), (8), and (9) to ensure Capt. Olson has maintained his qualifications to serve as Branch Pilot
on the Corpus Christi Ship Channel.
Texas Transportation Code Sec. 70.032 (7) states that a Branch Pilot must be in good mental and
physical health. PCCA Staff verify this eligibility requirement by reviewing the U.S. Coast
Guard’s National Maritime Center database which includes merchant mariner credentials as well
as USCG medical certificates. Capt. Olson’s medical certificate was issued on November 6, 2019,
and is valid until 2024. See “Enclosure 1”.
Texas Transportation Code Sec. 70.032 (8) states that a Branch Pilot must have good moral
character. PCCA Staff verify this eligibility requirement by performing a criminal background
checks for Branch Pilots seeking license renewal. PCCA’s Director of Security utilizes the
services of a third-party consultant rather than the Texas Crime Information Center (TCIC)
database because TCIC is limited to law enforcement purposes. As of January 29, 2020, Capt.
Olson has no criminal history indicating a lack of good moral character.
Texas Transportation Code Sec. 70.032 (9) states that a Branch Pilot must possess the requisite
skill as a navigator and pilot to perform competently and safely the duties of a Branch Pilot. PCCA
Staff perform multiple steps to verify this eligibility requirement.
First, PCCA Staff review USCG’s National Maritime Center database to ensure the Branch Pilot
has maintained his/her merchant mariner credentials. Capt. Olson’s First Class Pilot License was
last renewed on March 5, 2016, and expires March 5, 2020. See “Enclosure 1”.
Second, PCCA Staff search the USCG Administrative Law Judge (ALJ) database for records of
decision involving the Branch Pilot’s mariner credentials (that may not appear in the NMC
database). As of the date of this memo, there are no records of decision against Capt. Olson’s
credentials.
Finally, PCCA Staff review Pilot Review Board records since the Branch Pilot’s last renewal for
a history of incident investigation and/or disciplinary recommendations against the Branch Pilot
up for renewal. PCCA Staff reviewed Pilot Review Board records dating back to March 15, 2016
(date Capt. Olson’s expiring Branch Pilot License approved by Pilot Board). According to the
Pilot Review Board records, Capt. Olson was involved in single incident in 2017 where a vessel’s

mast made contact with the Harbor Bridge which as due to the master’s incorrect air draft
calculation and not the fault of Capt. Olson. See “Enclosure 2”.
Based on the above, it is PCCA Staff’s opinion that Capt. Olson has maintained the qualifications
to serve as Branch Pilot per Texas Transportation Code Chapter 70. PCCA Staff recommend
Olson’s expiring Branch Pilot License be renewed.

Agenda Item 5.d. Capt. Benjamin D. Watson Branch Pilot License:
Texas Transportation Code Sec. 70.032(4) states that in order to be eligible for a Branch Pilot
License, a pilot must have at least two years' service as a Deputy Branch Pilot under the supervision
of a state-commissioned pilot serving the Port of Corpus Christi. The Pilot Board approved the
appointment of Capt. Benjamin Watson from the Deputy Branch Pilot Pool to the Aransas-Corpus
Christi Pilot’s Deputy Branch Pilot Training Program on June 20, 2017. After completing his
riding observer period and obtaining his USCG First Class Pilot Endorsement, Capt. Watson’s
Deputy Branch Pilot Certificate became effective on March 15, 2018. Capt. Watson has served
under the supervision of the ACC Pilots which will end when his Deputy Branch Pilot Certificate
expires on March 14, 2020. Because the next regularly scheduled meeting date occurs after the
expiration of Capt. Watson’s certificate, PCCA Staff recommend the Pilot Board consider Capt.
Watson’s eligibility to serve as Branch Pilot now and issue the Branch Pilot License with an
effective date of March 15, 2020.
As stated above, in making a recommendation to the Pilot Board for a Branch Pilot License, PCCA

Review Board records, Capt. Watson was involved in an allision on January 17, 2019, that was
caused by mechanical failure and not pilot error. See “Enclosure 3”.
Based on the above, it is PCCA Staff’s opinion that Capt. Watson meets qualifications to serve as
Branch Pilot per Texas Transportation Code Chapter 70. PCCA Staff recommend approval of
Capt. Watson’s Branch Pilot License.

OFFICIAL MINUTES OF PORT OF CORPUS CHRISTI PILOT ADVISORY PANEL MEETING
November 13, 2017 The Port of Corpus Christi Pilot Advisory Panel convened at the Ruben Bonilla Center for Global Trade, 222 Power Street, Corpus Christi, Texas, on Monday, November 13, 2017, at 1:00 p.m. Present: Sean Strawbridge

1. Sean Strawbridge called the meeting to order. 2. A safety briefing was given. 3. Capt. Jason Smith (USCG-Sector Corpus Christi) expressed concern regarding the
lack of detail in the July 25 PAP meeting minutes were the Panel reviewed the M/V OCEAN FREEDOM and M/V AP REVELIN incidents. Revised minutes from the July 25, 2017, meeting (with a copy of the Findings and Recommendation approved by the Pilot Board) will be presented at the next PAP meeting.
4. The Panel discussed increasing terms for PAP members from 2 years to 3-4 years. Membership criteria was also discussed. No action was taken.
5. The Panel discussed appointing alternates from opposite watches to make pilot
representation more convenient at Panel meetings. The Panel discussed increasing regularly scheduled PAP meetings bi-annual to quarterly. No action was taken.
6. The Panel discussed necessary changes to the Pilot Advisory Panel Bylaws
including the procedure for filing pilot complaints. Counsel for PCCA and the Pilots will prepare amended bylaws for review at the next PAP meeting. No action was taken.
7. The Panel discussed the following incidents:

a. Barge #255 Explosion: Sean Strawbridge stated that this setting might
not be the right venue (no pilot involved) but we can improve on what we have learned. Mr. Strawbridge also stated that Harbor Safety Committee is reviewing the incident and an after-action review will be available soon. Capt. Jay Rivera stated that the current oil spill recovery equipment wasn’t made for an offshore spill. Capt. Smith reported that the spill has been transferred the USCG District Command. Capt. Smith thanked ACC Pilots and the PCCA for the eyes on the ground. Capt. Smith reported that a full presentation will be given at the Port Commissioner at the meeting on November 14, 2017. No action taken.
b. Surge Incident: HMO received a complaint of a non-PCCA individual allegedly injured while working on a residential bulkhead near Ingleside on the Bay due to a surge from a vessel leaving the La Quinta Terminal. ACC Pilots, Risk Management and Coast Guard all have been notified. The case is ongoing and reports will be forthcoming. No action taken.
c. M/V OCEANA – Allision with Harbor Bridge: Capt. Jay Rivera reported that the allision with the bridge was due to the Master giving Capt. Olsson the incorrect air draft calculations. TXDOT reported no significant damages. The Coast Guard is investigating and will have a report to present at the next Pilot Advisory Panel meeting. No action taken.
d. NOTE: Per the Amended Bylaws, the Panel will vote on whether the above incidents warrant a hearing. Summarily dismissed incidents shall be documented I the formal minutes of the PAP.

1. Mr. Russell Cordo called the PRB meeting to order.
2. A safety briefing was given.
3. Minutes from the December 18, 2018 meeting were presented and approved by the PRB.
4. PRB discussed allision involving the OSG Columbia pushing the OSG #242 and piloted by Pilot
#17 Ben Watson with the M/V Compass docked at Oil Dock #1 on January 17, 2019. Damage
was limited and it was a mechanical error (steering) more than a human error. Joe Harrington
and Capt. Kevin Monaco agreed. Pilot Ben Watson was not aware of a secondary pump issue
until vessel was underway. Vessel was notorious for previous issues. The captain on board was
nit the normal captain. The AIS of the event was reviewed. No quorum was present and action
was delayed. The USCG is investigating and the review board will hold off on further action
until the USCG review is completed.

SUMMARY: Staff requests the Pilot Board review and recommend approval of Captain Ben Watson from Deputy Branch Pilot to Branch Pilot per Texas Transportation Code Section 70.032.
BACKGROUND: Captain Ben Watson will complete the Aransas-Corpus Christi Pilots Deputy Pilot Program on March 14, 2020. During the 2-year period Captain Watson has been under the supervision of State Commissioned Pilots that serve the Port of Corpus Christi. He has honed his skills through an intensive, advanced ship-handling program based on a gradual increase in size and draft of ships. Captain Watson has demonstrated to be a of good moral character and is in good physical and mental health and possesses the requisite skills necessary to safely maneuver vessels through the Port’s waterways. Captain Watson has completed all the requisites to qualify for a Branch Pilot license as outlined in the Texas Transportation Code Sec. 70.032
Because the next regularly scheduled meeting date occurs after the expiration of Capt. Watson’s current Deputy Branch Pilot certificate, PCCA Staff recommend the Pilot Board consider Capt. Watson’s eligibility to serve as Branch Pilot now and issue the Branch Pilot License with an effective date of March 15, 2020.

SUMMARY: On January 14, 2020 Capt. F. Mike Kershaw, a Port/Pilot Liaison consultant, reviewed the Pilot’s master work hours’ logbook for the 4th quarter of 2019 as required by Section V of the Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel adopted October 1, 2014.
BACKGROUND: Section V of the Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel defines the work-rest requirements for Aransas-Corpus Christi Pilots. Section V states that the pilots will keep a master logbook for all pilots and make it available for inspection by the Pilot Board or its representatives upon request. On January 14, 2020 Capt. Kershaw reviewed the Pilot’s master work hours’ logbook for the 4th quarter of 2019. Attached is Capt. Kershaw’s report summarizing his inspection.

The Aransas Corpus Christi Pilots presented computer generatedVessel movement logs for the 4th Qt, 2019 for the determination ofcompliance with POCCA Pilot Board Rules, Sec:70:017, State of Texas Transportation Code.
A random review of all full commissioned pilots as well as a total review of all movements preformed by two commissioned pilots, one from each watch, comprising 285 of 1774 assignments. Zero (0) overages were observed.
Based upon the above-mentioned audit I consider the ACC Pilots to be in compliance with the work rest rules as set forth in the PilotBoard Rules.
