As a part of their public service, Oklahoma state legislators represent the interests of their constituents by responding to requests for redress from grievances, relief from onerous demands, etc., often to the detriment of other constituents and the public in general.

In contrast, your OIADA legislative liaison represents independent dealers’ interests by continuously monitoring activity at the state capitol, either VXSSRUWLQJ�OHJLVODWLRQ�WKDW�EHQH¿WV�our industry, or – just as importantly – actively working to prevent harmful legislation.

A classic example of the process LQYROYHG�D�UHFHQW�6HQDWH�ÀRRU�amendment that was developed to be inserted into a committee substitute for Senate Bill 2374. Had the amendment passed, the impact on our industry would have been decidedly negative.

This particular amendment would have required, in addition to current law, that “for the purposes of any transfer of a motor vehicle, the transferor shall give the following written information to the transferee prior to the transfer of ownership of a motor vehicle:1. A damage statement disclosure of

any frame and/or body damage to the motor vehicle;

2. The date of any frame and/or body damage to the motor vehicle;

3. The date any frame and/or body damage repairs were made or attempted on the motor vehicle;

4. The name and current address of the transferor;

5. The identity of the vehicle, including the make, model, year, body type DQG�YHKLFOH�LGHQWL¿FDWLRQ�QXPEHU�

“In the disclosure required pursuant to this section, the transferor shall also certify that to the best of his or her knowledge:

1. The damage statement disclosure UHÀHFWV�WKH�DFWXDO�IUDPH�DQG�ERG\�damage and repairs to the motor vehicle;

2. T he damage statement disclosure GRHV�QRW�UHÀHFW�WKH�DFWXDO�GDPDJHV�to the motor vehicle;

3. The damage statement disclosure GRHV�QRW�UHÀHFW�WKH�DFWXDO�UHSDLUV�WR�the motor vehicle, or

4. The transferor has no knowledge of any frame or body damage or repairs to the motor vehicle.

“Any transferor willfully giving false or misleading information in the required disclosures pursuant to this section shall be guilty of fraud. In addition, any motor vehicle dealer deemed to have violated any provision of this section shall be required to refund all monies and things of value related to the motor vehicle transfer. 1RWKLQJ�KHUHLQ�VKDOO�SUHFOXGH�WKH�¿OLQJ�of a separate civil action by any person alleged to have been damaged as a result of any violation of any provision of this section.”

The incident was created when a consumer – a close family member of the authoring senator – bought a vehicle that had had some previous damage. The damage had not, at the time of the sale, been entered into the databases of the nation’s vehicle history reporting agencies such as CARFAX and was not known to the dealer who sold the vehicle. After the purchase, the consumer learned of the damage and complained to the senator, resulting in the proposed amendment.

When the amendment came to light through OIADA’s legislative liaison and the scope of the problem was learned, OIADA and industry members became involved. First, the members of the industry directly involved in WKH�YHKLFOH�VDOH�ZHUH�QRWL¿HG��7KH\�promptly moved to correct the problem

by facilitating the backing out of the vehicle sale and providing a full return of the consumer’s outlay. No harm, no foul!

Second, OIADA contacted the senator and presented the industry’s position. The senator was made aware of the virtual impossibility of complying with the damage reporting requirements of the proposed amendment because such information is not generally available at the time of a sale. In addition, the negative impact that fraud and civil action connotations would have on dealers was explained to the senator.

Nevertheless, the senator was determined to submit his amendment.

To counter the effects of the proposed amendment, OIADA’s legislative liaison distributed a memo to the Oklahoma Senate members outlining the association’s opposition to the amendment. To make a long story short, when the senate bill came up for consideration, the amendment was not considered and Senate Bill 2374 passed 45-0 – without the harmful language. The bill later passed the House on a vote of 93-0 and was sent to the governor.

That is just one example of OIADA membership dues working for you. All Oklahoma independent dealers are eligible to become members in the state association. CARFAX Helps TV Station Take Aim at CurbstonerEditor’s note: Curbstoning – sales

of vehicles by unlicensed dealers – is a national problem that takes advantage of consumers and takes money away from state and local governments as well as legitimate dealers. This report from Memphis television station WMC-TV exposing a local curbstoner and explaining the issue to the public is a direct result of the commitment of vehicle history UHSRUW�SURYLGHU�&$5)$;�WR�¿JKWLQJ�curbstoning.

“We brought the issue to the station’s attention,” CARFAX public relations manager Chris Basso said. “Tennessee is one of the biggest hotbeds for curbstoning, but it’s a nationwide problem. Whenever we hear about curbstoners in a particular area, we work to get the word out about the potential problems with the cars these people are selling and how to avoid them.

“Most curbstoners are selling cars reputable dealers won’t touch – cars with hidden damage or rolled-back odometers or such – because they’re trying to make a quick sale. Anyone buying a used car needs to be wary of not only the car but of who they’re buying it from.”

Basso said CARFAX has contacted other media outlets, including stations in Nashville and Phoenix, with similar tips, as part of the company’s ongoing efforts to help educate and warn consumers and dealers about emerging issues involving used cars in their area.

Oklahoma Department of Consumer Credit Update Notice to Lenders

Listed below are changes in the maximum charges a lender may make on items affected by changes in the consumer price index indicators, consumer price index for urban wage earners and clerical workers.

The designated sections and the corresponding dollar amounts effective July 1, 2012 are as follows (2011 amounts are represented by strikeouts and the 2012 amounts are represented by underlines.

PART 2: MAXIMUM CHARGE CHANGES EFFECTIVE 7-1-10 O.S. 14A§ 2-201. Credit service charge for consumer credit sales other than revolving charge accounts (1) With respect to a consumer credit sale, other than a sale pursuant to a revolving charge account, a seller may contract for and receive a credit service charge not exceeding that permitted by this section.(2) The credit service charge, calculated according to the actuarial method, may not exceed the equivalent of the greater of either of the following:(a) the total of (i) thirty percent (30%) per year on that part of WKH�XQSDLG�EDODQFHV�RI�WKH�DPRXQW�¿QDQFHG�which is $1,380.00 $1, 410.00 or less;(ii) twenty-one percent (21%) per year on that part of the unpaid balances of the amount ¿QDQFHG�ZKLFK�LV�PRUH�WKDQ�$1,380.00

In addition thereto, an installment account handling charge shall be allowed not to exceed $18.40 $18.80 per month;

(e) on any loan in an amount in excess of $460.00 $470.00, up to and including $690.00 $705.00, there shall be allowed an acquisition charge for making the loan not in excess of one-tenth (1/10) to the amount of the principal. In addition thereto, an installment account handling charge shall be allowed not to exceed $20.70 $21.150 per month;(f) on any loan in an amount in excess of $690.00 $705.00 but not more than $1,380.00 $1410.00 there shall be allowed an acquisition charge for making the loan not in excess of one-tenth (1/10) of the amount of the principal. In addition thereto, an installment

account handling charge shall be allowed not to exceed $23.00 $23.50 per month.LIMITATIONS ON CREDITOR’ REMEDIES

The Oklahoma Legislature recently completed the process of House and Senate bills being heard in the opposite House of Origin. All bills not heard by the opposite House are now dead for the legislative session. As of April 30, there were 172 House bills and 43 House joint resolutions as well as 205 Senate bills and four Senate joint resolutions still alive for the current legislative session.
