Board Meeting Minutes of Wednesday, August 8, 2018 The Regular Business Meeting was called to order at 9:40 a.m. by Board President, Tammy H. Brown, held at the Vern Riffe Center for Government, 77 South High St., 31st Floor – Board Room, Columbus, OH 43215. Board Officers and Members – Roll Call: Tammy H. Ms. Burton moved to accept the minutes of the June 6, 2018 board meeting. Mr. Starner seconded the motion. The motion passed unanimously. BOARD PRESIDENT’S COMMENTS Ms. Brown recognized Assistant Attorney General Cheryl Hawkinson for her exemplary legal representation to the Board. Ms. Hawkinson expressed her appreciation for the plaque she received from the Board in recognition of her service. Ms. Brown thanked the Board for their continued work in moving forward. She thanked the office staff for their hard work with handling phone calls and assisting everyone who interacts with all three professions. EXECUTIVE DIRECTOR’S REPORT Mr. Thornton submitted a written report of significant activities occurring since the last Board meeting. He provided updates regarding:

ASSISTANT ATTORNEY GENERAL’S REPORT Ms. Hawkinson updated the Board regarding federal legislation on HR 6515 related to the North Carolina Dental Board case. She updated the Board regarding the Strengthening Career and Technology for the 21st Century Act. She also advised the Board regarding public records. She stated that e-mails sent to the board’s executive director are a public record, unless the communication falls within a certain exception, such as a pending investigation. Once the case is closed, the public record exception ends, and the e-mail becomes a public record.
INVESTIGATIONS Prior to entering into Executive Session, the Board reviewed the summary of cases. Ms. Brown queried the board members to determine if anyone knew the identity of anyone subject to the cases. No board member indicated that he or she believed to have knowledge about anyone subject to the redacted case summaries. EXECUTIVE SESSION

Motion #3 Dr. Mitchell moved to enter Executive Session for the purpose of discussing investigation of charges or complaints against a licensee, regulated individual, or an applicant for the purpose of disciplinary action pursuant to R.C. §121.22.(G)(1), and which requires that such matters be kept confidential under R.C. §121.22(G)(5). Mr. Starner seconded the motion, which passed by roll call vote as follows: Ms. Burton: yes; Dr. Froehlich: yes; Ms. Mayle: yes; Dr. Mitchell: yes; Dr. Prakup: Excused Absence; Mr. Pratt: yes; Dr. Spangler: yes; Mr. Starner: yes; and Ms. Brown: yes. The Board went into Executive Session at 10:41 a.m. and invited Board staff and the Assistant Attorney General to remain in attendance. Mr. Starner left Executive Session for a few minutes.
The Board returned to Public Session at 11:22 a.m. The Board took a break at approximately 11:22 a.m. and returned to Public Session at
approximately 11:37 a.m. B. Board Actions New Cases – 7 CO2017-3559 This case involves an audiologist who partially completed an Ohio utility company’s 30-Day Medical Certification form (“form”) for a patient at the request of the patient’s Mother. The form was to be certified by a licensed medical professional after examination of the patient and only to situations where it was in the licensed professional’s opinion that termination of utility service would be dangerous to the health of the patient. The licensee’s license type was not one of the medical professional types listed on the form. Regarding the form, she:
• did not check either box related to the patient’s medical condition;
• signed “First Name Initial, Last name, Au.D.” on the “Authorized Signature” line;
• printed “Dr. First/Last Name” on the “Name of Licensed Medical Professional” line and “A.xxxxx State of Ohio” on the “Current State License or Certificate Number” line;
• was unable to fax the partially completed form back to the utility company;
• failed to maintain a copy of the partially completed form before providing it to the parent. The utility company received the form completely filled out.
She has been licensed since August 2009. She wishes to settle this matter in lieu of a Notice of Opportunity for Hearing (NOH). She signed a Consent Agreement (Consent) agreeing to the following terms, for violation of Ohio Revised Code (ORC) Chapter 4753.10(I) and (M) and Ohio Administrative Code (OAC) Chapter 4753-9-01(B)(2)(a) and (d):
• Reprimanded;
• Completion of five (5) continuing education (CE) hours in the following areas: two (2) hours in ethics, three (3) hours in documentation and record keeping;
• Proof of the 5 CE hours shall be submitted to the Board office by no later than 60 days from the date the Board executes the Consent. The 5 additional hours of CE shall not be applied towards the 20 hours required for the current licensure biennium, for renewal.

Accordingly, the Investigative Review Group (IRG) recommends approval of the Consent and closing this case. Motion #4 Mr. Starner moved to accept the Investigative Review Group’s recommendation in case number CO2017-3559. Dr. Spangler seconded the motion. Dr. Froehlich abstained. Dr. Mitchell abstained. The motion passed unanimously. CO2018-1430 This case involves a speech-language pathologist (SLP) who documented providing 2 home health speech therapy visits/services, October 24 and 26, 2017, involving one patient, when in fact she had not provided services. The following month while with the patient she noticed the patients’ initials were missing from the October visits. Assuming the patient forgot to sign, she asked the patient to initial the documentation for the 2 October dates. The patient had been in the hospital during the 2 dates; she didn’t know this until her employer brought it to her attention when they terminated her PRN contract on March 2, 2018. Based upon her documentation of providing the 2 services, the home health agency billed for the services. The employer had to correct the billing. She believes the incidents occurred because: 1) It was during a time she was dealing with personal/health stressors. 2) Due to stress, she began filling out visit paperwork ahead of time/in the evenings from home. She wrote her upcoming notes and goals leaving space to fill in accuracy. She has been licensed since April 1998. Accordingly, the IRG recommends offering a Consent with the following terms for violation of ORC 4753.10(E)(1) and OAC 4753-9-01(B)(1), (2)(a):
• 60 day Suspension staying 30 days if all terms below are completed and proof is submitted to the Board office on or before the thirtieth day of suspension:
o CE: 2 hours in record keeping, 2 hours in time management, 2 hours in ethics;
• “Passing” score on the Boards’ open book jurisprudence examination, provided by the Board, related to the licensure requirements for speech-language pathology and audiology under Ohio Revised and Administrative Code Chapters 4753.
No motion was made to accept the Investigative Review Group’s recommendation in case number CO2018-1430. Motion #5 Dr. Froehlich moved to issue a Notice of Opportunity for Hearing in case number CO2018-1430. Ms. Mayle seconded. The motion passed unanimously. Joined Cases – 2 CO2018-1992 and CO2018-5960 CO2018-1992 involves a conditionally licensed speech-language pathologist (“applicant”) who misrepresented herself/practiced prior to conditional licensure. Her application was received February 2, 2018. CO2018-5960 involves a SLP who aided/abetted unlicensed practice of the applicant. The following occurred prior to the applicants’ conditional licensure date, April 9, 2018:
• Applicant was placed in the SLP’s school district by her contract employer on February 13, 2018;
• The special education director of the district asked the applicant/SLP the following until conditional licensure was obtained and until the applicant’s employer found an SLP supervisor for her Supervised Professional Experience (SPE) Year:
o That the applicant shadow the district employed SLP;

o That the SLP allow the applicant to shadow her;
• Both applicant/SLP attended Evaluation Team Report (ETR) and Individualized Education Program (IEP) meetings together. Both dated and typed and/or signed their own name, or a title, on ETR/IEP documents next to the following valid and/or invalid designations:

• Complete the Boards’ open book jurisprudence examination, provided by the Board, related to the licensure requirements for speech-language pathology and audiology under Ohio Revised and Administrative Code Chapters 4753. The results of the examination shall be submitted to the Board office within thirty (30) days of receipt of the exam.

• After evaluating a student and prior to submitting the Summary of Assessment Results to the central office, she signed/dated Page 2 only and failed to review/assure her name was listed as the Evaluator Name on Page 1 of the Individual Evaluator’s Assessment;
• She failed to assure that her name and title speech-language pathologist was listed as the Team Chairperson on the Evaluation Planning Form – School Aged Eligibility Determination;
• She failed to inform the applicant, or her employer, that the applicant should not be signing on the meeting minutes line(s) where the words speech-language pathologist is typed, or written, if the applicant is not a conditionally licensed speech-language pathologist at the time. Seeing another name on her line of IEP paperwork, she failed to say it was wrong and that another page was needed so she could sign on her line. She failed to respect that an IEP is a legal document.

She has been licensed since December of 1994. She agreed to settle in lieu of a NOH and signed a Consent agreeing to the following terms, for violation of ORC 4753.10(D), (E)(1) and (I), and OAC Sections 4753-9-01(A)(5)(10) and (B)(1):
• Reprimanded;
• Complete 2 CE hours in the area of ethics and 2 hours in documentation related to IEPs. Proof of these 4 hours shall be submitted to the Board office 60 days from the date the Board approves the Consent.
Accordingly, the IRG recommends approval of both Consents and closing case numbers CO2018-1992 and CO2018-5960. Motion #6 Dr. Mitchell moved to accept the Investigative Review Group’s recommendation in case number CO2018-1992. Dr. Froehlich seconded the motion. Dr. Prakup was absent. The motion passed unanimously. Motion #7 Mr. Starner moved to accept the Investigative Review Group’s recommendation in case number CO2018-5960. Dr. Mitchell seconded the motion. Dr. Prakup was absent. The motion passed unanimously. CO2018-4255 This case involves a hearing aid fitter who renewed after the January 30, 2018 deadline; she renewed February 14, 2018. She did not submit proof of CE with her late renewal; instead she uploaded a blank License Renewal for Trainee and/or Business Location Notification form. The Board Investigator attempted to contact her via the e-mail, phone number and employer on file regarding the missing CE. The phone number is not valid. She did not reply to both e-mails and no longer works for the employer. A certified letter was mailed to the address on file to contact the board investigator; it was returned marked, “Not Deliverable As Addressed” and “Unable To Forward.” Another potential employer was found and contacted; however, she’d only worked for two weeks. The employer provided a different mailing address for her. A certified letter was mailed; however, it too was not delivered. She has been licensed as a hearing aid fitter since April 2015. Accordingly, the IRG recommends issuing a NOH for a violation of the following:
• ORC 4747.11 and 4747.12(O), failure to notify the Board immediately of any change in address or addresses; violate the code of ethical practice adopted under section 4744.50 of the Revised Code, code of ethics;
• OAC 4747-1-11(C),(3) and (E)(1)(b) and 4747-1-17(B),(D),(E), licensees shall complete the required CE units prior to January thirtieth of the renewal year; failure to submit CE of a licensee who submits the renewal form after February first; failure to update the Board within thirty days of any change of business or home address; failure to comply within thirty days to a request for information from the board and must cooperate fully with any investigation conducted by the board; failure to comply with paragraph (B), (C), or (D) of this rule, may result in disciplinary action by the board, including suspension or revocation of a license.
Motion #8 Dr. Mitchell moved to accept the Investigative Review Group’s recommendation in case number CO2018-4255. Mr. Pratt seconded the motion. Mr. Starner abstained. The motion passed unanimously.

CO2018-4959 This case involves an application for a dealer's license received by a hearing aid fitter who had a previous investigation and enforcement action by the former Ohio Hearing Aid Dealers and Fitters Licensing Board. In light of the prior history with the case, the IRG is recommending that the applicant be issued a conditional dealer's license with the following terms and conditions:
• Grant him a conditional hearing aid dealer’s license that lasts one year from the date of issuance, pursuant to ORC 4747.05(B)(4), after the one-year period has expired and contingent he abides by all terms listed below, of a Consent. After the one year, the license for his business name shall be fully licensed as a hearing aid dealer under R.C. 4747.04(B)(4):

During any period in which his mom/relative does not have a valid Ohio Hearing Aid Dealers or Hearing Aid Fitters license, she will in no way be associated with, own any interest in, provide services to, or assert any control over either directly or indirectly, any other entity owned, operated, or in any way affiliated with his business/business name, or any other entity for which he has a hearing aid dealer’s license;

He shall not allow any person to engage in the fitting, dispensing, or selling of hearing aids unless such person has a valid hearing aid fitter’s license or Trainee permit.

Accordingly, the IRG recommends approval of the Consent and closing this case: Motion #9 Dr. Spangler moved to accept the Investigative Review Group’s recommendation in case number CO2018-4959. Dr. Mitchell seconded the motion. Mr. Starner abstained. The motion passed unanimously. CO2018-5997 This case involves a conditionally licensed SLP who in December 2017 submitted his SPE Report/Log 157 days late. Under a prior case number, and per IRG guidelines, an education letter informed him to extend his SPE by 157 days. Additionally, 10 hours of CE in documentation/record keeping were due with his new Report/Log. His letter also informed that future violations of Chapter 4753 may result in disciplinary action in accordance with Section 4753.10 of the ORC. His extension due date was June 11, 2018. His Report/Log was received 21 days late. 7.5 hours of CE were received 16 days late; the remaining were received the next day. Accordingly, the IRG

recommends offering a Consent with the following terms for violation of ORC 4753.10(M) and OAC 4753-3-07(G)(1) and 4753-9-01(B)(1)(c):
• Reprimand against his conditional license;
• Grant his speech-language pathology license upon completion of all licensure requirements;
• Complete CE: 2 hours in time management and 2 hours in record keeping;
• Complete the Boards’ open book jurisprudence examination, provided by the Board, related to the licensure requirements for speech-language pathology and audiology under Ohio Revised and Administrative Code Chapters 4753;
• CE and a passing score on the exam are due within 60 days of approval of the Consent;
• Failure to comply with these terms, the Board reserves the right to institute formal disciplinary proceedings against him. Any action initiated by the Board based on an alleged violation of the Consent Agreement shall comply with the Administrative Procedures Act, Chapter 119 of the Ohio Revised Code.
Motion #10 Dr. Froehlich moved to accept the Investigative Review Group’s recommendation in case number CO2018-5997 and approved the Executive Director’s addition to audit this licensee’s continuing education hours for the second and third practice period of his SP licensure, e.g., 2019-2020 and 2021-2022. for marketing/referral services – 1 Return Cases – 3 CO2017-02 Robin Douglass, SP.03226 This case involves an SLP who documented on a Treatment Encounter Note the patient’s response to her oral function. She was then informed that the patient was on a medical hold for non-responsiveness. After being informed that the patient was on hold, she modified the patient’s response to the therapy services in the Treatment Encounter Note. She was terminated from employment by her former employer. She has been licensed since October 1986. On August 16, 2017, she was issued a NOH. She requested a hearing and now wishes to settle this matter in lieu of a hearing. She signed a Consent agreeing to the following terms:
• Public reprimanded;
• Complete 12 hours of CE in the following areas: o 2 hours in ethics; o 5 hours in documentation and record keeping; o 5 hours in billing;
• Proof of these 12 hours shall be submitted to the Board office by September 4, 2018. The 12 additional hours of CE shall not be applied towards the 20 hours required for the current licensure biennium, for renewal.
Accordingly, the IRG recommends approval of the Consent and closing this case. Motion #11 Dr. Mitchell moved to accept the Investigative Review Group’s recommendation in case number CO2017-02. Mr. Pratt seconded the motion. Dr. Froehlich abstained. The motion passed unanimously. CO2018-0282 Herndon Durett, A.01297 This case involves an audiologist who failed his 2015-16 Random CE Audit and Failed to Pay $150 Late Renewal/Failed Audit Fee. He did not complete Ethics during 2015-16 (he completed 3.5 hours in 2017). December 6, 2017 the Board denied his fee waiver request and via letter informed him that if the fee was not paid by the January 9, 2018 deadline, a NOH would be issued. The fee was not paid; January 12, 2018 a NOH was issued. It was unclaimed, and the original was not returned. June 1, 2018 via regular mail a letter was mailed to him; it included a copy of the NOH and supporting documents informing that:
• 2 hours of ethics he completed in 2017 have been applied towards his failed audit;
• he must pay the $150 to avoid going to hearing August 8, 2018 to consider revoking his license. Payment was due by midnight June 15, 2018.
He paid the fee a few minutes before midnight on the deadline. He has been licensed since August 2000. As of 2007 he resides and practices in Georgia. Accordingly, IRG recommends withdrawing his January 12, 2018 NOH due to paying the fee and by the June 15, 2018 deadline.

Motion #12 Mr. Starner moved to accept the Investigative Review Group’s recommendation in case number CO2018-0282. Ms. Mayle seconded the motion. The motion passed unanimously. CO2017-4761 Christina Doelling, SP.04052 This case involves an SLP who documented providing fourteen (14) speech language home visit services from April 12, 2017 – May 31, 2017, involving four (4) clients, when in fact she had not provided speech language services and had cancelled the appointments. Based upon her documentation of providing speech language services, her former employer billed for such services and/or had to correct the billing for such services. Her contract was terminated by her former employer on June 28, 2017. She has been licensed since October of 1991. On January 5, 2018, a NOH was issued to her. She requested a hearing and now wishes to settle this matter in lieu of a hearing. She signed a Consent agreeing to the following terms:
• Indefinite suspension;
• She may apply for reinstatement of her license 5 years from the effective date of the settlement agreement (signed by the Board President);
• Upon reapplication for reinstatement, she will submit to a criminal background check;
• She shall complete any continuing education or any other requirement(s) imposed under OAC 4753-3-09(F) required by the Board for reinstatement;
• Upon reinstatement, she shall comply with R.C. 4753 and the rules promulgated thereunder.
Accordingly, the IRG recommends approval of the Consent and closing this case. Motion #13 Dr. Mitchell moved to accept the Investigative Review Group’s recommendation in case number CO2017-4761. Motion #19 Mr. Starner moved to authorize Michael Pratt, Tammy Brown, Gregg Thornton, and Brandy Thomas to attend the International Hearing Society Conference in Glendale, AZ from September 13-15, 2018.
