As I begin my duties as PHCC Ohio President, I would like to thank Rocco, Debbie, Mary & Joyce for all of their efforts and hard work to have another successful convention. I would also like to thank my co-chair, Ed Reid of ACCA Ohio, and all of the committee members for

taking their valuable time to help put the convention together.I thought the three day format and the evening expo was a very exciting change to the convention

and hope the members and vendors liked it as well. It was also an honor to have PHCC National President, David Dugger, attend our convention and see how we do things in Ohio…I think he had a great time. Congratulations to all of our award winners and their hard work to make our industry better.

Most of all, I would like to thank all of the members for taking time to attend the convention and learn how to “Stay Ahead of the Pack”. If you have never attended a convention, try to in the future. It’s well worth it.

Stay Ahead of the Pack….. (Great theme by Ron Schmitt) really reflects the value of being a PHCC member. When I became a member several years ago and started attending chapter meetings, I was learning so many things to help our business, such as ideas to improve our business, keeping up with code changes, legislative changes and so much more that keeps us ahead of the non-member competition and make it better for our business, employees and customers. Visit both our state and national websites, there are a lot of resources and benefits available for members to take advantage of and use everyday. Attend all of the chapter meetings you can and if you know another contractor who would be a good member, invite them to come along to check it out.

Legislation. Yes, legislation. In May, we have our Ohio Frank Alexander Legislative Day in Columbus and National Legislative Day in Washington D.C. This is our chance to meet with lawmakers and speak with them or their staff about legislation that will affect our industry and customers. I will always remember a quote I once read, “There are three kinds of people - people who make things happen, people who watch things happen and people who wonder what happened.” As PHCC members we can “Make Things Happen” when more of us get involved. If at all possible, attend Legislative Day and contribute to the Specialty Contractors Coalition PAC.

In the upcoming year, I am looking forward to working with the board to focus on the most important issues for our membership so all of us can “Stay Ahead of the Pack”.

The National Labor Relations Board is continuing its recent assault on employers’ rights to make and enforce traditional human resource policies and procedures

previously considered by most to be lawful. Your employee handbook, for example, may no longer be compliant with the NLRB’s view of the law.

Under the guise of protecting the rights of non-union employees to engage in “protected concerted activities” and to combine together for “mutual aid and protection” per Section 7 of the National Labor Relations Act, the NLRB has struck down traditional handbook policies thereby increasing the power of the NLRB to regulate non-union employers. Yes, the National Labor Relations Act is applicable to non-union employers as well as those having collective bargaining relationships. The NLRB is attempting to facilitate employees’ efforts to “speak out” about wages, hours and conditions of employment and to bring unions into their workplaces. Some of the most recent actions of the NLRB have struck down or limited employer policies and practices which:

• Limit what employees may say about his/her employer, its business and managers in social media such as Facebook. (Most employers desire to take action against employees badmouthing their business and management team).

• Prohibit employees from discussing their wages and benefits with fellow employees.

• Require employees not to discuss with fellow employees and to keep confidential information and their involvement in ongoing company investigations such as for harassment. (Most employers now request confidentiality to preserve the integrity of the investigation).

• Define the “at-will” relationship as permitting the employer to terminate that employment

relationship at any time for any reason and states that the at-will relationship cannot be changed in any way. (Most policies now state this and require employees to sign “Acknowledgments”).

In each of the above circumstances, the NLRB now considers the policy to restrict employees’ rights to “come together,” “speak out” and “form and join” a union – considered a stretch by most management employment attorneys. These employers found themselves defending unfair labor practice charges with the risk of having to reinstate terminated employees and paying to them back wages and benefits.

Most of these NLRB actions have been spawned by the recent appointment of NLRB Board members appointed by President Obama during Senate recess – a controversial maneuver. The aggressive interpretations of the law also have resulted from Washington further empowering agencies such as the NLRB and Department of Labor to be more relevant.

What is an employer to do? Be sensitive to this new wave of Section 7 NLRB decisions bestowing additional rights upon employees. Be careful not to discipline or retaliate against an employee for lawfully speaking out even if distasteful to you. Structure your policies and practices as narrowly as possible to avoid what the NLRB considers overreaching or rights encroachment. Publish a disclaimer along with your policies stating that the policies are not intended to interfere with Labor Act rights. And, finally, watch for the developments in the months to come regarding court decisions possibly overturning these NLRB decisions and watch for changes in the make-up of the NLRB Board.

Despite promises from both sides of the “aisle” to work on a compromise plan to keep us from falling over the “fiscal cliff,” we went flying over it at midnight on

December 31st like Calvin & Hobbes flying down the hill in his little red wagon. Thankfully, a parachute deployed before we crash-landed at the bottom of the cliff.

The parachute that was deployed is formally known as the American Taxpayer Relief Act of 2012 (ATRA) (even though it wasn’t signed into law until January 2, 2013). This article will discuss some of the provisions included in the legislation.

The legislation makes permanent for 2013 and beyond the Bush-era tax rates for those single taxpayers with taxable income of $400,000 or less ($450,000 married taxpayers, $425,000 for heads of households). Income above these levels will be taxed at 39.6%.

ATRA raises the top rate for capital gains and dividends from 15 percent to 20 percent. The 20 percent capital gains rate will only apply to those taxpayers whose income exceeds the $400,000(S)/$450,000(MFJ)/$425,000 (HOH) thresholds mentioned earlier. Those taxpayers who fall below the top of the 15% income tax rate will continue to pay no tax (0% rate) on capital gains and dividends.

One of the things I was most worried about and that I watched very closely was how Congress was going to address the alternative minimum tax (AMT) system. Without the AMT “patch” in ATRA, upwards of 30 million more taxpayers (including many of those considered to be “middle-class”) would have been subject to the AMT and would have paid an average of $3,700 in additional income taxes. Thankfully, they addressed the problem and made a more permanent patch for AMT including annual adjustments for inflation.

ATRA also addressed estate and gift tax issues. It declares a maximum federal estate tax rate of 40 percent while allowing an exclusion of $5 million and adjusted annually for inflation for those who pass after December 31, 2012.

Here are additional provisions that ATRA extended. These

were either scheduled to expire at the end of 2012 or had already expired at the end of 2011.- American Opportunity Tax Credit (AOTC): Qualified

taxpayers receive a credit of 100% of the first $2,000 of qualified tuition and related expenses and 25% of the next $2,000 (total maximum credit of $2,500) for each eligible student. This applies to the first 4 years of post-secondary education.

- Child Tax Credit - $1,000 per qualifying child, not adjusted for inflation. All of the other modifications of the credit, including the refundable component, were extended through 2017 by the ATRA.

- Child & Dependant Care Credit – The credit rate is 35% with a cap of $3,000 for one qualifying individual and $6,000 for two or more qualifying individuals. The credit amount is still subject to the adjusted gross income (AGI) limitations.

- Earned Income Tax Credit – This refundable credit and all its’ provisions for low-income earners was extended through 2017 as well.

- Employer-Provided Education Assistance – Up to $5,250 of employer-provided education assistance excluded from income and employment taxes of the employee.

- State & Local Sales Tax Deduction – Extended through 2013, this provision allows the taxpayer to elect to claim their state & local sales taxes instead of their state & local income taxes as an itemized deduction.

Some of the business tax provisions extended include:- Section 179 expensing – The higher expensing and

investing limits were extended for 2 years. For 2012 and 2013 the limits are: deductions of up to $500,000 with an investment limit of $2 million.

- Additionally, the bonus depreciation provision was extended through 2013. It allows an additional “bonus” depreciation of 50% of the asset’s purchase price. To be eligible, the asset placed in service must be new.

- Work Opportunity Tax Credit (WOTC) – Employers hiring an individual within a targeted group are eligible for a credit equal to 40 percent of first-year wages up to $6,000.

Under the Heroes Act of 2011, the WOTC can be as high as $9,600 for qualified veterans.

- 100% exclusion on the gain from the sale of qualified small business stock as long as the stock was held for a minimum of 5 years.

There is one other item of interest in the ATRA of 2012 that directly applies to our industry. The non-business energy tax credit (IRC 25C), which had expired at the end of 2011, was revived by the ATRA of 2012. It was reinstated retroactively and applies to qualifying purchases on a taxpayer’s principal residence or second home (not allowed on new construction) made on or before December 31, 2013.

The credit rate for windows, exterior doors, insulation, and other systems designed to reduce heat gain or loss is 10% of the materials costs, with a $200 credit amount limit on windows. Heat pumps, central air conditioners, water heaters, and stoves using biomass fuel to heat a residence have a credit limit of $300. Natural gas, propane, or oil furnaces and hot water boilers have a credit limit of $150. Qualified advanced main air-circulating fans have a credit limit of $50.

However, a couple of qualifiers here. One, the “original,” smaller credit is the one that came back (maximum $500). Two, if a taxpayer has previously taken the credit and reached the $500 maximum, they are not eligible for any additional credit under this provision.

These are just some of the tax provisions included in the American Taxpayer Relief Act of 2012. There are many more that space does not permit us to cover in this article. Please check with your CPA or tax professional to see how this law affects you and your business.

The Contractor of the Year Award is given to the individual contractor member who has demonstrated over and over his or her willingness to serve PHCC, the industry and their community with their time and talent.

Steve Guy started working at his father’s plumbing and HVAC contracting business in high school and continued working during the summers and breaks while attending college. After being discharged from the Army, he resumed his college studies at night, while working in the field during the day for the family business. He earned a B.S. in Business Administration with a minor in Management and Psychology.

From the field, he moved into the office as an estimator in 1973 and then moved into project management in 1978. Steve’s younger brother started his own business and took several customers with him when he left. Steve and his father continued to run the business up until his father retired in 1981.

In early 1984, he went to work as an estimator for then union contractor, Wat-Kem Mechanical. He worked as an hourly employee until late 1985, and in 1986, he bought in as a 50% partner in Wat-Kem and became sole owner in 2005.

He’s been chairman of the OVCEF, Sec/Treasurer of the Dayton Area Association of Plumbing and Mechanical Contractors, member of the American Society of Plumbing Engineers, member of the ABC National Mechanical Council and the ABC National Green Building Committee.

The PHCC Contractor Service Award is given to the PHCC member who has demonstrated his or her willingness to serve PHCC and the membership with their time and talent.

For the first time, an entire company, not an individual, won this award.

Dunlevey, Mahan and Furry are a strong advocate and supporter of PHCC. Over the years, their company has presented at local PHCC chapters and numerous conventions, including this year, written articles for PHC Ohio Magazine and has provided a key member benefit for close to 20 years.

According to one of the nominations, “they are a strong advocate dedicated to small business and PHCC members.”

The Manufacturers’ Representative Award is given to an individual who has supported PHCC, the plumbing- heating-cooling industry and our members.

Todd Salsberry was nominated more than once and according to one nomination, “he continually provides outstanding customer service, is a true professional and is very knowledgeable.”

US Consolidated was founded in 1920, making them the oldest continual manufacturers’ representatives in our industry in the United States. The current owners, Jerry Sulecki and Todd, have owned the company for 20-plus years and take great pride in their long-term relationships with all parts of the industry and the State of Ohio.

US Consolidated is dedicated to representing world-class manufacturers such as Basco Shower Doors, Fluidmaster, Aker Fiberglass and Acrylic and TOTO Toilets.

They are charter members of AIM/R, the Association of Industry Manufacturers Representatives and have served on numerous Advisory Councils, both with their manufacturers and industry partners, as well as members of many local, state and national industry organizations.

Although this award is usually given to a specific company, there have been many occasions that an individual with a company is recognized for their efforts…including 2012.

Scott Middleton has been with Robertson Heating Supply for 20 years and currently holds the title of Vice President of Marketing. He started off in the warehouse as a sales trainee unloading cast iron tubs where, according to our winner, he only dropped 2 and 1 special order!

Dear PHCC Members: My how fast the year has

gone. Everyone said it would, but at the beginning it seemed far away. It has been a great year for me, meeting new people and getting to know friends better. This organization has a great group of people in it - true professionals that care about their jobs and even more about their profession. They give countless hours of their time to promote the different causes and areas of concern of our profession. These include writing letters to political leaders to making trips to Columbus and Washington DC to promote our way of life.

We sometimes don’t realize all the effort that goes into getting policies made or even introduced to the political parties. Many hours are spent just getting the right people to see its importance and relevance to our everyday lives. There is always room for more involvement in your local, state and national chapters for good concerned people. If there is anything I have learned this year, it is that it takes good dedicated individuals acting as a team to accomplish great things.

If there is one thing I can persuade our members to do, it would be to get involved. Your help and time is needed at all levels of our group to support and make us strong. You don’t have to start at the top or middle, just get involved. Maybe on a committee, as an advisor, or even just offer to help. This will make our PHCC stronger and better with new innovative ideas and energetic members.

I would like to thank the Cincinnati chapter for having my wife and me down for their installation dinner. What a fun night with a great group of fellow plumbers.

We are very blessed to have a great staff with Mary, Debbie and Rocco. They make the whole process run smooth while making us look good. I deeply appreciate all their help and guidance throughout the year. I would like to thank all the members for their support and trust in me in this position.

LEGISLATIVE One of the most important benefits of membership with PHCC is advocacy on behalf of the Plumbing-Heating-Cooling industry. PHCC Ohio works behind the scenes every day with lawmakers, regulators and agency officials to protect your industry.

Lead Rule PHCC had several discussions with representatives of the Ohio Department of Health regarding the Department possibly taking over the Lead regulation program from the federal government. PHCC provided the industry perspective and continued to review any potential legislation similar to that introduced in past sessions.

Backflow Advisory Committee | Irrigation Contractors Thanks to PHCC members Luke Grabill and Joe Schmitt and feedback from numerous members, PHCC has been able to work closely with the Committee and chief plumbing official Ralph Reeb on drafting lawn irrigation backflow certification rules and requirements that will be administered by DOC. There will be a 6 month to 1 year timetable to write the rules and requirements.

PHCC Ohio is a membership organization of active plumbing-heating-cooling contractors committed to the continuous improvement of our industry and society’s quality of life through ongoing education, training, and political action.

Residential Contractor Licensing PHCC, along with ACCA Ohio, worked very hard to make residential licensing a reality last year. Our legislative agents, Palmer McNeal and Kitty Zwissler, have and continue to meet with several key state Senators and Representatives about sponsorship and support of residential licensing legislation. They will continue to have discussions with the Governor’s legislative staff, key house and senate legislative staff and OCILB personnel to work on the proposed legislation.

At the end of the 2012 session, Rep. Bill Patmon (Cleveland) introduced HB 604 (Residential Construction Contractors Licensure). Rep. Patmon did not seek input or assistance from PHCC or ACCA Ohio in creating the bill to require licensure of residential construction contractors.

OUPS One Call Legislation SB 354, sponsored by Sen. Coley, and HB 458, sponsored by Rep. Sprague were put on the fast track in the last weeks of the 2012 session. After numerous meetings, both pieces of legislation moved through their respective house, with HB 458 being sent to the Governor for his signature.

Stakeholders, involved in past years, intended to improve the call before you dig system, formed another coalition to again discuss potential changes to the law. PHCC was part of the coalition and participated in the meetings and closely monitored the potential impact of any actions suggested by the coalition, and any language which became part of the new law. Special thanks to member Ciro Grandini for his analysis and feedback.

Mechanical Contractors PHCC maintained contact with the leadership from the Mechanical Contractors Association of Cleveland. Communications centered on what is best for our industry and members and how we could best work together.

OCILB PHCC worked with OCILB Secretary Carol Ross and drafted a letter to send to local Building and Health Departments urging them to require the commercial contractor license to perform residential work. Currently, 177 departments require the commercial license to perform residential work.

Ohio Legislative Day More than 25 contractors from ACCA and PHCC participated in the 5th Annual event. Legislative Day is a one-day event with an issues briefing kicking off the event and an evening reception at the Statehouse Crypt. Together, members took their leadership in the PHC industry and our pro-business message to the Statehouse. PHCC is grateful to those members who took time away from their busy schedules to advance the interests of our industry.

Ohio Specialty Contractors PAC is the political action committee for our association. It provides financial support to elected officials who understand and support the issues of the

PHC and HVAC industries. Your PAC ensures the voices of our members are heard on all industry related issues.

Thanks to PHCC and ACCA members, over $5,700 was raised for the Ohio PAC in 2012.

CODES Residential Code of Ohio PHCC continued to provide input at the regular meetings of the Residential Construction Advisory Committee (RCAC). PHCC worked with ACCA Ohio to ensure welding and brazing requirements were kept out of the final draft of the RCO. Additionally, PHCC looked at two other problematic provisions including Shower Liner Tests (312.9) and Shower Drains.

Ohio Plumbing Code PHCC has been working with Ohio’s chief plumbing official, Ralph Reeb, and the State of Ohio regarding concerns about the Ohio Plumbing Code. In particular, the focus has been on the lack of direct involvement of the plumbing industry in the code change process.

In response, PHCC Ohio created a Code/Backflow Committee (Ron Schmitt, Herman Bohinc, Drew Nieman, Dana Williams, Rodger Sweitzer, Joe Schmitt and Jeff Heger) to work with the state, offer ideas and give input to the code change process and backflow issues.

MEMBERSHIP A membership plan includes both recruitment and retention programs (current retention rate is 83%). Membership is an ongoing process which requires the full support of Association leadership and the membership. Members of the Board need to be involved in membership (recruiting, retention, activities and projects). Maintaining this direction will not only stabilize the membership, but it will ensure continued growth of the organization.

Introductory Membership PHCC offered a Membership up to 50% off the full rate for the first year of membership. With the current economy, we wanted to offer contractors the “experience” of PHCC at a reduced rate to increase the exposure to the value of membership in our Association. To date, one new member has joined under the introductory membership.

Benefit of the Month PHCC members and chapters continued to promote PHCC benefits that included: Ohio Convention, Legislative and Regulatory Efforts, Speedway Fuel Program, Quality Service Contractors (QSC), Education and Training, PHCC Contractor Locator, Legal Services Plan, License Bond Program, Office Depot, Central Messaging, Workers Comp Group Program, and Ohio Legislative Day.

New Benefits added in 2012 included: PHCC Safety Lessons and National Purchasing Partners.

Famous Supply Expo PHCC Members and staff participated at the annual Famous Supply Expo on Sept 10-11 to promote PHCC and recruit new members.

OAPI Conference PHCC members and staff participated at the Ohio Association of Plumbing Inspectors annual conference to promote PHCC.

PHCC Member Tim Frecka was featured on WKYC Channel 3 and the NEWS. Frecka Plumbing is converting cars and trucks to run on compressed natural gas, at about $2 per gallon. Tim is bringing his fleet of 10 service vans to CNG-One [a local company that is converting cars and trucks to run on compressed natural gas] and expects to recoup the cost of conversion, about $6,000 per truck, in a few years.

COMMUNICATIONSOhio PHC Magazine continues to be published four times per year at no cost to PHCC Ohio with a distribution of 7,000 plus. New features continue to be added.

Website PHCCOhio.org now has a new look! More user-friendly and a dedicated consumer section are some of the enhancements. We continue to emphasize the importance of using a professional, licensed, insured, PHCC member and offer various tips on selecting and working with a PHC professional.

Facebook PHCC Ohio continues to increase its presence on the social media site. PHCC currently has over 40 “likes.” Social media is another resource to provide updates and information as well as have members interact with one another.

FINANCIALS The goal of the Treasurer, with the help of the executive committee, board and executive director, are to enhance the income of the organization while minimizing expenses. The economy was still a challenge and PHCC ended the year with a net-loss. All programs were down in revenues with increases seen in member services and royalties. Although we experienced a net-loss, reserves were not used this year to make up any income deficits.

INVESTMENTS AND CD’S Current total holdings stand at $233,638. The Investment Committee met on a regular basis in 2012 and at the beginning of 2013 to review our holdings and assess the future.

Our investment portfolio made several gains early in 2012, but by the end of the year saw some significant losses. The Committee continues necessary action to “ride out the storm.” The Committee will continue to monitor our holdings and make adjustments, with the approval of the Board of Directors.

PHCC NATIONAL ASSOCIATION PHCC Ohio Presented Award PHCC Ohio was presented with a PHCC National Chapter Excellence Award at the National Convention. The inscription of the award states, “In Recognition of Outstanding Service to PHCC Members.” The award was presented to PHCC Ohio President, Greg Eisenhart, during the annual Chapter Leadership Lunch.

PHCC National Board of Directors Joe Schlueter, Schlueter Plumbing and Heating, completed his second year as National Zone 1 Director.

Blue Ribbon Membership Task Force Executive Director, Rocco Fana, has been asked to serve a second term to develop an action plan to advise PHCC National President, David Dugger, what action the national association should take to improve the total contractor membership experience. Contractor, Craig Lewis, (Texas PHCC) is chairing the Task Force again.

Association Executives Council A member of the AEC for the last 4 years, PHCC Ohio Executive Director, Rocco Fana, was elected as President for 2012-2013. Mr. Fana is also serving on the PHCC National Board of Directors.
