LEGITIMATE SELF DEFENSELegitimate self defense consist of “reasonable” defensive actions taken by a person in an attempt to protect himself or another person from imminent unlawful battery. The “threat” can be executed by means of either deadly or non-deadly force.



The correct & lawful self defense, which will involve an escalation of force, will be dictated by the “perceived” degree and type of unlawful force being imminently threatened or being applied by a criminal.




Unlike a battle field were deadly force can be applied solely on appearances civilians must use appearances (looks) and behaviors (actions) to act immediately and decisively using a type and an amount of force reasonably required to keep you from getting hurt. Appearances do not change quickly but behavior can change quickly.

LEGAL IMPLICATIONS & SOCIAL RESPONSIBILITIES

“Ohio’s Concealed Carry Law” “Self Defense: Depending on the specific fact of the situation, an accused person may claim that the use of deadly force was justified to excuse his or her action, which would otherwise be a crime. Self defense or the defense of another is an affirmative defense that an accused may assert against a criminal charge for an assault or homicide offense.”

“The term “affirmative defense” means the accused, not the prosecutor must prove by preponderance of the evidence that he acted in self defense or in the defense of another. In other words, the defendant must proved that it is more probably than not that his use of deadly force was necessary due to the circumstances.”

“Whether this affirmative defense applies to the situation or whether it will likely succeed against criminal charges depends heavily on the specific facts and circumstances of each situation. The Ohio Supreme Count has explained that a defendant must prove three conditions to establish that he acted in defense of himself or another.”


OHIO REQUIREMENTS FOR SELF DEFENSE AND USE OF FORCE

3. Duty to retreat. Must show that they did not have a duty to retreat or avoid the danger.

• Presumption of self-defense is a rebuttable presumption. Prosecutor not the defendant carries the burden of producing evidence contrary to the fact that the law presumes.

• A person is barred from recovering money (suing) if their injury arises from their criminal behavior, including injuries sustained by acts of the intended victim. If you injure an innocent bystander (hit by a stray bullet) you may be ordered to pay damages to that person.
