In Need of Protective Services

from abuse, neglect, or exploitation to an extent that
either life is endangered or physical harm, mental

![Page 22: Ohio Attorney General’s Elder Abuse Commission · Ohio Attorney General’s Elder Abuse Commission Adult Protective Services 2018 Legislative Updates. ... •Focus on protectives](https://reader034.vdocuments.site/reader034/viewer/2022050205/5f58157e85d4d1508958cabc/html5/thumbnails/22.jpg)

Understanding the Landscape
▪ Victim’s location (residency matters)
▪ Relationship to the Perpetrator
▪ Family member, friend, Power of Attorney
▪ Guardian of Person/Estate
– Can I interview the victim?
• Need to interact with the guardian
• Identify who can testify
– The role of the Probate Court
▪ Victim’s ability to consent
![Page 24: Ohio Attorney General’s Elder Abuse Commission · Ohio Attorney General’s Elder Abuse Commission Adult Protective Services 2018 Legislative Updates. ... •Focus on protectives](https://reader034.vdocuments.site/reader034/viewer/2022050205/5f58157e85d4d1508958cabc/html5/thumbnails/24.jpg)
Consent as a Defense
• In general, valid/legal consent requires the Adult to act:
– Freely & voluntarily
– Knowingly (true nature of the act)
– Informed consent (mental capacity)
• Consent is negated when:
– Victim lacks capacity to understand the nature and consequences
of one’s acts
– Undue Influence negates consent
![Page 25: Ohio Attorney General’s Elder Abuse Commission · Ohio Attorney General’s Elder Abuse Commission Adult Protective Services 2018 Legislative Updates. ... •Focus on protectives](https://reader034.vdocuments.site/reader034/viewer/2022050205/5f58157e85d4d1508958cabc/html5/thumbnails/25.jpg)
Capacity versus Competency
Capacity
• Ability to accept to decline
treatment
• Determined by clinician based
on adult’s ability to
demonstrate specific
knowledge
• Mental health professional
helpful but not necessarily
required
Competency
• Legal definition established by
the Court
• Clinical recommendation can
influence a judicial ruling on
competency
• The law presumes competence
unless otherwise proven

Incapacitated
• Means a person who is impaired for any reason to the extent that the person lacks sufficient understanding or capacity to make and carry out reasonable decisions concerning the person's self or resources, with or without the assistance of a caretaker. Refusal to consent to the provision of services shall not be the sole determinative that the person is incapacitated.

living which facilitate the provision of food, shelter,
clothing, and health care necessary for life support.
