PUBLIC HEALTH & SAFETY COMMITTEE Date and Time: Monday, June 17, 2019, at 5:15 pm, (Council Chambers) Members Present: Rasmussen (C), McElhaney, Peckham, Herbst, Kellbach Others Present: Alfonso, Rayala, Goede, Bliven, Kujawa, Mielke Minutes of previous meetings. (5/20/19) Peckham requested the motion in the minutes related to Brenda Graveen’s license be clarified by adding: “whose application is being held for possible future review.” Motion by Kellbach, second by Herbst to approve the minutes of the previous meeting on 5/20/19, as revised. Motion carried 5-0. Consider approval or denial of various license applications Rasmussen stated there are four denial recommendations for Operator’s Licenses this evening. She stated Brenda Graveen was denied for a third OWI conviction in January of 2019, with the first two being within a 10 year window. She indicated Ms. Graveen submitted evidence of rehabilitation for review by the Police Chief, however, he has chosen to uphold the denial recommendation. Brenda Graveen stated she has had an Operator’s (bartender) License for 25 years without marks against her. She stated three years ago she invested $45,000 to become co-owner of Crusin 1724 and works 60 to 72 per week at the establishment, making her license essential as this is her sole income. Chief Bliven explained due to how recent the third conviction was he felt more time needed to elapse before reconsidering her license. He stated OWI convictions substantially relate to being a bartender relative to drinking and driving and the impact it has on the community. Graveen stated as the owner of the bar, no one is allowed to drink behind the bar and she does not drink while working. Herbst questioned what the circumstances were of the stop in January. Graveen stated the offense date was actually July 6, 2018, but she was not sentenced until January 8, 2019. She explained she was done bartending and went to a different establishment where there was a friend who had been over served, so she drove the individual home. She indicated she blew .062 which is under .08. She stated she pled guilty, went above and beyond with counseling through ATTIC. She noted Judge Huber did not impose the 2 year probation that would typically go along with the sentence because he felt she had gone above and beyond the requirements and testing. She stated she no longer owns a vehicle and walks to work every day or takes cabs. Rasmussen pointed out the criteria says that once you’ve reached that third OWI conviction in a 10 year period, because it substantially relates to the service of alcohol, we have upheld denials and treated everyone the same. She stated if the committee wished to approve her license they would need to make a motion to remove her from the batch and vote on it separately. There was no motion. Amber Wolf stated she was recommended for denial of her renewal due to a pending charge of physical abuse to a child (exempt offense) which goes to court on June 24, 2019 and per her attorney will be dropped down to a misdemeanor. She explained she is a single mom of a child who has severe behavioral issues and she struggles a lot with her attacking her and having to try to defend herself. She stated without the renewal of the license she has a possibility of losing her job of three years at Holiday Gas and could subsequently lose her housing. Rasmussen questioned if Chief Bliven would reverse his recommendation if the charge was reduced to a misdemeanor. Bliven stated it would depend on what the misdemeanor was since a battery charge is an exempt offense, but he was willing to reevaluate it. Peckham requested Ms. Wolf be removed from the batch to vote on separately. Motion by Peckham, second by McElhaney to renew the license for Amber Wolf contingent upon a reduction in her charge to a misdemeanor upon her court hearing on June 24, 2019. Motion carried 5-0. Rasmussen stated the other two denials were for an Operator’s License for Sanja Ermeling and Aileen Meyer. It was noted neither of these individuals were present to appeal and will remain in the batch. Motion by Kellbach, second by Peckham to approve or deny licenses as recommended by staff. Motion carried 5-0.

Consider request to have outdoor Anniversary Party, August 24, 2019 - 101 Pub, 101 N 3rd Avenue (Cheryl Fehl) Cheryl Fehl, owner, stated they held this party for the first time last year without any incidents. She indicated they would like to hold this party again with the double snow fences, ID checks and wristbands. There will be music outside as well, which would conclude by 9:00 pm. Motion by Kellbach, second by Peckham to approve the request for outdoor party at 101 Pub on August 24, 2019. Motion carried 5-0. Discussion and possible action regarding Formal Expression of Concern - Cop Shoppe Pub, 701 Washington Street (Rod Carlson) Rasmussen stated when an establishment gets to 100 demerit points a formal expression of concern is issued. She explained there were two citations within a week in April for failure to summon police when there was an incident/fight at the establishment. She noted each of those violations carry 50 points. Tami Ness, Agent, stated there is zero tolerance for drinking behind the bar while bartending and at an employee meeting she has incorporated a rule to not engage in arguments with unruly patrons, instead to not allow it to escalate and ask them to leave immediately. Brian, bartender, stated he was in the cooler stocking at the time of one of the incidents and did not have any forewarning that something was going occur and was not informed until about 15 minutes after the parties had left. A female bartender stated she was working during the second incident and felt now that she should have called police when the people began arguing. She indicated she has called police on other occasions and this time was just an error in her judgement. If someone creates a disturbance we will take a picture and share it with all the bartenders so we all can see the individual to be kept out of the establishment. Tami Ness stated both bartenders talked with officers and she met with Chief Bliven to discuss it. Rasmussen stated the committee wants to see a cooperative relationship going on between the establishment and the police department. The police are always available as a resource when employees need assistance in recognizing when things are getting out of hand and a call needs to be made. She pointed out if concerning things continue to happen and demerit points continue to accumulate without a clear plan by management to correct and improve, they could risk the possibility of suspension or revocation. Chief Bliven stated he had a good meeting with Ms. Ness regarding the impact of the points and the expectations in terms of contacting police. He pointed out whether or not someone wants the police called should not be the measure of when you are calling. If there is a physical fight, call the police. Operations Report from Fire Department for May 2019 No discussion, report placed on file. Tavern Activities / Compliance Checks / Law Enforcement Activities Chief Bliven presented the Tavern Report for May1, 2019 through May 31, 2019 (See attached). Chief Bliven stated in response to last month’s meeting he had meetings with both the owners of Cop Shoppe and Jalapeno’s, as well as 101 Pub, and discussed the demerit point system, the importance of contacting police, and offered our services to come in and train staff on de-escalation tactics, fake IDs, recognizing intoxicated people and the importance of not over serving. Jalapeno’s had a staff meeting to discuss this information with the employees. Communications None Adjourn Motion by Herbst, second by Peckham to adjourn the meeting. Motion carried unanimously. SPECIAL PUBLIC HEALTH & SAFETY COMMITTEE Date and Time: Tuesday, June 25, 2019, at 5:00 pm, (Council Chambers) Members Present: Rasmussen (C), Peckham, Herbst Members Excused: Kellbach, McElhaney Others Present: Alfonso, Rayala, Goede, Bliven, Brenda Graveen, Jeffery Otto Discussion and possible action to reconsider recommendation for Operator License Renewal for Brenda Graveen and Amber Wolf Rasmussen stated both these applicants were recommended for denial at our last Public Health & Safety Committee meeting. After further research and given that both of these applicants are renewals, we decided to reconsider the recommendations. She noted one individual, Amber Wolf, had a pending matter in court. Goede stated Amber Wolf called and informed the Clerk’s Office that her charge was reduced to a misdemeanor disorderly conduct. Goede indicated she confirmed this on CCAP. Rasmussen noted Wolf was approved contingent upon the reduction to a misdemeanor, so she is approved and we do not need to reconsider anything for her. Rasmussen noted Ms. Graveen submitted some additional information for the committee to review in advance of this meeting. She stated as an alternative to a non-renewal of the license, based on discussion that Ms. Graveen has had with the Clerk’s Office, she has agreed to a voluntary 15 day suspension of her Operator’s License. Rasmussen stated if the committee decided not to accept her offer and to uphold the denial of the license, we would have to go through a revocation hearing. Alfonso explained the current license year ends June 30, 2019 and she is entitled to a due process hearing on the non-renewal. If they choose to uphold the denial and because we cannot hold that hearing before June 30th, she should be renewed with the understanding that the city would likely seek to subsequently revoke her license through the revocation hearing process. Rasmussen summarized Ms. Graveen does not own a car and no longer drives and has offered to accept a voluntary 15 day suspension of the license. Peckham commented based on review of the additional information we received and especially with the offer of voluntary suspension, he would approve her renewal. Brenda Graveen commented she has tried to go above and beyond just serving drinks as a bar owner. The last three years she has raised $67,000 out of Crusin for good causes in the community, such as Honor Flight and the Women’s Community. Jeffery Otto, co-owner and agent of Crusin, stated he has been in this business for 40 years and Ms. Graveen is by far the most responsible person he has found. Both Graveen and Otto thanked the committee for their reconsideration. Motion by Peckham, second by Herbst to approve the renewal of the Operator’s License for Brenda Graveen with a 15 day voluntary suspension. (The suspension is from July 1st through July 15th) Motion carried 3-0. Adjourn Motion by Herbst, second by Peckham to adjourn the meeting. Motion carried unanimously. Meeting adjourned at 5:12 pm.

LIQUOR LICENSE REVIEW SUBCOMMITTEE OF THE PUBLIC HEALTH & SAFETY COMMITTEE

 Date & Time: Wednesday, July 10, 2019, at 5:15 pm., Birch Room Members Present: Rasmussen, Peckham, Alfonso, Rayala, Bliven, Goede Members Excused: Kujawa Others Present: Mark Craig, Tu Uong, Tuan Uong, Roxanne Lutgen, Lori Weyers, Jonathan Reinke, New Chee Lor, Mai Yang Lor Review application(s) for “Class B" Beer and Liquor license(s) and recommendation of application and/or granting of available "Class B" Beer and Liquor license(s) Rasmussen stated the recommendations of this committee will go forward to the Public Health & Safety Committee on Monday, July 15, 2019. Lemongrass Asian Fusion LLC This business premise is 316 3rd Street, formerly occupied by J. Gumbo’s. Mark Craig introduced brothers Tuan Uong, of Wausau and Tu Uong from California. Tu stated the premise is currently under construction, everything is going to be brand new, and they anticipate opening in approximately 90 days. It will be a full bar with Asian food and drinks. He indicated they will want a Sidewalk Café permit, as well. Craig commented it will have a City Grill kind of California feel! Motion by Peckham, second by Rayala to approve the Class B Beer & Liquor license for Lemongrass Asian Fusion LLC. Motion carried 6-0. Northcentral Technical College Lori Weyers introduced Roxanne Lutgen, Vice President of Finance and Jonathan Reinke, (Chef Jon) who teaches the second year culinary students who will be using this license to learn restaurant and hospitality service. Rasmussen noted this application is for Class B Beer/Class C Wine license that are for restaurants, not a full liquor license. Rayala added this license type does not have a quota. Roxanne Lutgen stated Advisory Committee members and local employers, those who hire NTC students, have requested dining instruction that has an alcohol service component. She stated there are currently two existing culinary lab kitchens and serving areas, plus our new addition would all be part of the premise description. She noted several of the other Wisconsin technical colleges also have liquor licenses for this component within their programs. She indicated we are currently adding the new space for fall of 2019 and the addition will be complete no later than December 1st. They requested the issuance of the license prior to the start of fall semester culinary arts classes which would be September 1st. Lutgen stated they have procedures for secure storage of the liquor and a policy for ID checking and will partner with local law enforcement, with whom we have a close relationship. Chef Jon stated we are partnering with the YMCA for their retiree’s luncheon which will take place during our class period and it makes our restaurant more attractive to the community when we have the full service available. It will teach the students how to pour it, serve it, how to judge customers, and how to react. Weyers stated the service of alcohol will always be as part of our curriculum and training, not just for someone to have a drink. (Rayala exited for another meeting.) Motion by Bliven, second by Peckham to recommend approval of a Class B Beer/Class C Wine License for Northcentral Technical College. Motion carried 5-0. Newch’s Eatery LLC The business premise is 1810 Merrill Avenue, formerly occupied by Wanda’s Chapter Two. New Chee Lor stated he currently operates a food trailer and is looking to have a new location. He intends to open as an Asian fusion restaurant using local farmers and breweries and will also offer Asian style mixed drinks. (Rayala re-entered the meeting.)

New Chee stated he will be obtaining a Tavern Entertainment license to have live music for atmosphere while people are eating. He was also seeking a Dance Hall license for private events that may be held there. New Chee indicated they are currently remodeling and their goal was to open July 27, 2019. Goede noted this would go to Council August 13th so he could obtain a Provisional Retail License to begin operating prior to Council and until inspections are complete. Motion by Peckham, second by Rayala to recommend approval of the Class B Beer & Liquor License for Newch’s Eatery LLC. Motion carried 6-0. Adjourn Motion by Bliven, second by Alfonso to adjourn the meeting. Motion carried unanimously. Meeting adjourned at 5:45 pm.

ALCOHOL COMPLIANCE CHECKS

Alcohol Compliance Checks were conducted on June 18, 2019. A total of nine (9) establishments were checked. An additional establishment was attempted, however, it was closed. The result was a twenty-two percent (22%) failure rate: Establishments that passed the Check: Malarkey’s Great Dane Pub and Brewing Campus Pub Kwik Trip #601 (6th Street/Marquardt Road) Fast Fuel Mart (802 E. Wausau Avenue) R Store #31 (207 Central Bridge Street) Applebee’s Restaurant Establishments that failed the Check:

Whiskey River Bar & Grill Day’s Bowl-A-Dome Citations were issued to the bartenders that served the underage person, and Demerit Points assessed to the offending establishments (see below and Demerit Point Record attached). NOTABLE INCIDENTS AT TAVERNS TO WHICH POLICE WERE DISPATCHED.

Cop Shoppe Pub, 701 Washington Street

(1) Event #19078866, 06/19/2019 at 11:28 PM: An anonymous caller reported hearing shouting in the area. An Officer arrived promptly and did not hear or see any disturbance. Several patrons inside the bar were casually drinking. Everyone in the bar denied seeing or hearing any disturbances. No action was taken.

El Jalapeno’s, 300 N. 3rd Street

(1) Event #1908053, 06/23/19 at 1:26 AM: A bar bouncer flagged down an Officer because a woman in the bar was having a seizure. An ambulance was called for her. She is known to go drinking downtown and have seizures while doing so. When she comes out of her seizures, she refuses medical treatment and is released. No law enforcement action was taken.

Glass Hat, 1203 N. 3rd Street

(1) Event #19079437, 06/21/19 at 1:34 AM: An Officer reported stopping to conduct a welfare check on a male that was lying on his back. It was not noted where the male was observed. The male was intoxicated, but left with a female he was with. They left the area in an Uber ride. It was not noted where exactly the male had been observed by the Officer.

Intermission, 325 N. 4th Street

(1) Event #19078343, 06/18/19 at 9:52 PM: Officer Fritsch and I stopped at the bar to attempt to make contact with the bartender that had been working the previous night. A male that had left from the bar in a vehicle got into a hit-and-run crash elsewhere in the city. By watching the city surveillance cameras, Officers were able to track the suspect vehicle back to having been parked on 4th Street, south of Intermission. The operator was observed having patronized the bar. While watching the surveillance, it appeared that the bar’s front door was opening and closing while there were people standing in front, at about 2:55 AM. I eventually made contact with the manager, who had questioned the bartender that had been working that night. He claimed he had just been giving the group of people that were standing outside some food that had been left over. My conversation with the manager included my concern that they do not interact with people outside the bar after closing time. The bar will be monitored at closing time in the future.

Loppnow’s Bar, 1502 N. 3rd Street

(1) Event #19084122, 06/30/19 at 3:10 AM: An Officer responded to the bar for a burglar alarm to the front door. The building was found to be secure. A key holder responded and noted that they had been having troubles with the alarm. A false alarm report will be completed by the Officer.

Malarkey’s. 412 N. 3rd Street

(1) Event #19078332, 06/18/19 at 9:35 PM: Officer conducted an Alcohol Compliance check at the bar. The underage person was denied a sale of a beer.

Timekeeper Distillery, 607 Grant Street

(1) Event #19072541, 06/06/19 at 7:47 PM: A citizen called to complain that the band that was playing at the Distillery was too loud. Officers made contact with the manager, who showed that they had a permit to have the band, and that the band would not get any louder than it already was, and was scheduled to end at 9:00 PM. That information was explained to the citizen. No further action was taken.

Bull Falls Brewery, 901 E. Thomas Street (1) Event #19082593, 06/27/19 at 8:55 PM: An Officer made contact with the manager

in regards to some graffiti that was on the back of their fence. The manager wanted a computer entry made, but no report was necessary. He would get in touch with the Inspections Department to see what action needed to be taken.

The Bar and Grill, 1025 S. 3rd Avenue

(1) Event #19070283, 06/02/19 at 11:52 AM: The bar manager called to report that there was a male on the premises that he wanted removed. Officers responded and located a male that had been standing at the door to the bar, swearing. The manager just wanted the male removed from the property. The male had also been asked to stay off the nearby property for the apartments. The male was told to leave and not come back, under threat of being issued a citation or being arrested. The male left the area.

Day’s Bowl-A-Dome, 1715 Stewart Avenue

(1) Case #19005679, 06/18/19 at 8:03 PM: Officers conducted an Alcohol Compliance check. An underage person was able to purchase an alcoholic beverage from the bartender. The bartender was cited for serving an underage person. Twenty-five (25) Demerit Points were assessed to the bar.

Whiskey River Bar and Grill, 5512 Stewart Avenue

(1) Case #19005672, 05/09/19 at 2:12 AM: Officers conducted an Alcohol Compliance check. An underage person was able to purchase an alcoholic beverage from the bartender. The bartender was cited for serving an underage person. Twenty-five (25) Demerit Points were assessed to the bar.

Campus Pub, 1110 W. Campus Drive

(1) Event #19078318, 06/18/19 at 9:10 PM: Officers conducted an Alcohol Compliance check. The underage person was denied a sale of an alcoholic beverage.

Labor Temple, 318 S. 3rd Avenue

(1) Event #19079409, 06/20/19 at 11:27 PM: A female called the Police after seeing a male that was an “ex” drive through the parking lot of the bar. The male has a parole condition that prohibits contact with the female. When the female saw the male enter the parking lot, she went outside and yelled to him that he was in violation. The male left the area in his vehicle. Contact was made with the male later, who stated that he was not aware that the female was at the bar, and when he saw her, he left. He never got out of his car, and never said anything to her. He advised he would no longer go near the bar.

Showtime Gentlemen’s Club, 1709 Merrill Avenue (1) Case #19005307, 06/07/19 at 9:15 PM: An Officer was already at the bar, in

response to a parking complaint by the management. The Officer was advised by a male patron that there was a fight occurring inside the bar. Officers responded and made contact with the problem patron and a bouncer/DJ. The employee related that the patron had come into the establishment and was getting a thirty minute private dance. During the private dance, he had to be warned not to touch the dancer. Shortly after the warning, the male exposed his genitals during the dance. The male was then told to leave the premises. He did, but returned after changing his pants. He was removed from the bar a second time, but returned. The third time, the bouncer grabbed the patron around the head and escorted him out. The Officer that was on scene for the parking complaint witnessed the patron being escorted out. The patron was arrested for Disorderly Conduct. I am assessing fifty (50) Demerit Points to the bar for waiting until the third time of having to remove the problem patron and still not involving the Police.

(2) Case #19005317, 06/08/19 at 1:12 AM: The bouncer called back reporting that the same problem patron that had been arrested in the previous entry had returned again. He had come back into the bar, was refused service and asked to leave. The patron yelled at the bartender, and continued yelling as he left and was walking across the street. The male left in a vehicle as the Officers were responding. He was located and stopped, and arrested a second time. He was booked in for Disorderly Conduct and misdemeanor Bail Jumping.

ALCOHOL BEVERAGE DEMERIT POINTS ASSESSED Whiskey River Bar & Grill and Day’s Bowl-A-Dome were each assessed twenty-five

(25) Demerit Points as a result of failing Alcohol Compliance Checks. Both are now carrying twenty-five Demerit Points. Showtime Gentlemen’s Club was assessed fifty (50) Demerit Points for Failing to Notify Police. They are carrying fifty (50) Demerit Points.
