do You Know where Your association documents are?

When you bought a home in Highpointe, you should have received electronic copies of all our governing documents—including the rules and regulations—prior to or at closing. Sometimes these documents get lost among all the other papers you received at closing. And many homebuyers are so involved moving into their new homes, they don’t take the time to read all the fine print.

As a homeowner, you have a right to these documents; so, if you don’t have copies for any reason, please log on to the website to view them.

Of course, it’s your responsibility to provide the association with your current address and phone number (particularly nonresident owners). This enables us meet our obligation to provide all owners with information from the association. It’s very important to have copies of the governing documents because you’ll be expected to know and comply with all rules and regulations of the community. You’ll also want to stay informed by reading all materials provided by the association. It’s our responsibility to make these documents—the bylaws and the covenants, conditions, and restrictions—as understandable as possible, so if there’s anything you don’t understand, please let us know. We’ll be glad to clarify any confusing language or give you other materials that answer your questions.

10 FrequentLY asked questions Regarding MUD #5

WHAT IS A MunICIPAL uTILITIES DISTRICT?

A Municipal utility District (MuD) is a local governmental entity created and regulated by the State. Its general purposes are to finance, own and operate water, wastewater and drainage systems. MuD’s may, among other things, incur debt, levy taxes, charge for services and adopt rules for those

services, enter into contracts, obtain easements, and condemn property in order to accomplish their purposes. HOW BEST CAn OnE COnTACT OuR MuD DISTRICT #5?

The MuD is best contacted through its General Manager, JadCo Management (Joe DiQuinzio, 478-0017; [email protected]); or its Operator, Southwest Water Company (Jeff Garrett, 219-2292, [email protected]).

HOW ARE OuR MuD BILLS CALCuLATED?

The MuD sewer bills are calculated based upon a customer’s winter average water usage. The MuD first determines the amount of water that was used at the customer’s home during the months of December, January and February of each year (the winter averaging period) as shown by the meter readings of

the LCRA. The sewer bill is then calculated based upon the amount of water used during the two lowest water usage months during the winter averaging period. If no winter average is available, because a house was occupied after the winter averaging period, a flat volume of 8,000 gallons is utilized. Once a winter average is established, the winter average volume replaces the assigned volume. If, at any time, actual water use is less than the winter average volume, the sewer bill is based upon the lesser amount. WHAT IS THE EASIEST WAY TO PAY OuR BILL?

Currently, sewer bills may only be paid by check or money order. However, Southwest Water Company is investigating a program that will enable customers to pay their sewer bills by credit card. If this program is cost=effective for the MuD is could be implemented within sixty days.

HOW MAnY BOARD MEMBERS ExIST?

There are five elected Board Members.

WHEn ARE THE BOARD ELECTIOnS?The next election is May 1, 2010. Three positions will

be filled. Candidate packets will be available from the Districts attorney beginning in early February 2010. The tentative deadline for candidate filings is March 1, 2010.

WHAT ARE THE ExISTInG BOARD MEMBERS TERMS DuE TO ExPIRE?

The remaining two Directors terms expire in May 2012.

WHAT ARE THE BOARD MEMBERS PAID?

Directors receive a per diem of $150. This per diem is set by State law.

WHAT ROLE DOES JADCO SERVE?

JadCo Management is the MuD’s General Manager.

WHAT ROLE DOES SWWC SERVE?

Southwest Water Company is the MuD’s utility operator.

Spelunking anyone? Also known as caving, spelunking is a recreational sport exploring wild cave systems and the Boy Scout Troop 280 is headed north to Longhorn Caverns State Park! On March 19th through 21st the Scouts will be pitching camp by Inks Lake for a fun weekend of cave exploration. Come join in the adventure!

For the Cub Scouts the month of March will prove to be full of anticipation and advancement. Scouts in the Webelos Den will be crossing over to the Boy Scouts of America on Monday, March 8th. The young Scouts will be inducted into the Order of the Arrow, a national honor society of the Boy Scouts of America with the goal to establish lifelong ideals of Scouting, and encourage continued participation in Scouting and camping. Congratulations to Christopher J., Daniel G., and Jacob F. for becoming Arrow-Brothers.

1. The appearance and quality of the common areas are known to affect home sales—not just whether and for how much they sell, but how quickly.

2. The more residents complain about dog waste, the more time the manager must spend on enforcement rather than serving the association.

3. uncollected dog waste spreads disease and attracts rodents who feed on pet waste.

WHat is a Community Association?

Some residents think homeowners associations (generally called community associations) exist just to tell them what to do—or not do. Actually, the association is more like a housing management or service-delivery organization that provides three types of services to all residents---owners and renters alike

• Community services - these can include securing trash collection, publishing newsletters, orienting new owners, coordinating community-information meetings, and assisting with recreational and social functions.

• Governance services - these can include ensuring that residents are complying with the association’s governing documents, that the association is adhering to local, state, and federal statutes, enforcing community rules and policies, administering design review policies, and recruiting new volunteer leaders.

• Business services - these can include operating the common property efficiently, bidding maintenance work competitively, equitably and efficiently collecting assessments and assisting the board with reserve funds, budgeting & long-range plans.

Providing these services requires good management, strong planning and organization, and carefully monitoring the association’s affairs. It isn’t easy, but by fairly and effectively delivering these services, community associations protect and enhance the value of individual homes and lenders’ interests in those homes.

Meet Devion (7/02)Devion is only little in physical size. He is convinced he is the biggest kid around

and that he can do anything anyone else can do. This little man lights up any room he enters with his smile and personality. Devion loves attending church and enjoys singing in the children’s choir. Devion loves playing with other people of any age but he plays in the manner of a child age 4 to 6. He is showing progress in being able to play independently. Devion loves to do almost anything outside. He loves to swim, ride bikes & scooters, play baseball, basketball & football and has even recently tried to water ski! Devion has played 4 seasons of t-ball and one season of basketball since living in our home and loves telling everyone about it. While Devion has wonderful gross motor skills he struggles with his fine motor skills. While Devion has made much progress emotionally he continues to receive weekly therapy to work on social skills and impulsivity.

Devion is very loving and affectionate. He enjoys being with others and would do well in a loving, structured, active home of any ethnic make-up as an only or youngest child.

reFLections: New Work from Sergio Rodriguez

The Mexican American Cultural Center (MACC) will be hosting Reflections, an exhibit of large scale oil paintings by Sergio Rodriguez. There will be an opening reception Saturday, January 30th at 6pm in the main gallery, and the exhibit will be open to the public from January 30th to March 27th. There will also be a gallery talk about Rodriguez’s work given by the artist February 6th at 2pm. Reflections is a personal exploration of Rodriguez’s experience growing up in the border town of Eagle Pass. not having visited his place of birth in 22 years, Rodriguez made a special trip back to Eagle Pass, re-immersing himself in the u.S.-Mexico border culture in order to inspire the work for this particular show. Further explaining the concept for Reflections, Rodriguez says, “such were the dreams that being reared along the border fostered; such were the conditions, history, and influences that permeated me, molded me, filled me, and thus sprung veins through which I think, feel and see … I yield what I Reflections # 1, Temperance

After not being personally fulfilled with pursuit of a degree in business at Southwest Texas State university in San Marcos, Rodriguez stumbled upon the art of drawing, where he found his niche. He went on to receive his BFA in painting from Southwest Texas State university and then his MFA in painting from the Tyler School of Art in Philadelphia. He lives and works out of Austin, Texas.

WHAT WILL THE DOCTOR DO?There’s no cure for sleepwalking, but the doctor can talk to

you about what’s happening and try to find ways to help you sleep more soundly. Most kids just grow out of sleepwalking.

For kids who sleepwalk often, doctors may recommend a treatment called scheduled awakening. This disrupts the sleep cycle enough to help stop sleepwalking. In rare cases, a doctor may prescribe medication to help someone sleep.

HERE ARE SOME TIPS TO HELP PREVEnT SLEEPWALKInG:• Relax at bedtime by listening to soft music or relaxation

tapes.• Have a regular sleep schedule and stick to it.• Keep noise and lights to a minimum while you're trying

to sleep.• Avoid drinking a lot in the evening and be sure to go to

the bathroom before going to bed. (A full bladder can contribute to sleepwalking.)

HOW DO I TAKE CARE OF A SLEEPWALKER?One thing you can do to help is to clear rooms and

hallways of furniture or obstacles a sleepwalker might encounter during the night. If there are stairs or dangerous areas, a grown-up should close doors and windows or install safety gates.

You also might have heard that sleepwalkers can get confused and scared if you startle them into being awake. That’s true, so what do you do if you see someone sleepwalking? You should call for a grown-up who can gently steer the person back to bed. And once the sleepwalker is tucked back in bed, it’s time for you to get some shut-eye, too!

Eleven-year-old Cait was trying to fall asleep when her 8-year-old brother, Doug, came into her room. He looked around a bit, but seemed really out of it. Then Doug went back into the hallway and stood there staring up at the hall light. Little brothers can be weird, but this was really strange. Cait didn’t know what to do. Just then, Cait’s father appeared and explained that Doug was sleepwalking.

WHAT IS SLEEPWALKInG?not all sleep is the same every night. We experience

some deep, quiet sleep and some active sleep, which is when dreams happen. You might think sleepwalking would happen during active sleep, but a person isn’t physically active during active sleep. Sleepwalking usually happens in the first few hours of sleep in the stage called slow-wave or deep sleep. not all sleepwalkers actually walk. Some simply sit up or stand in bed or act like they’re awake (but dazed) when, in fact, they’re asleep! Most, however, do get up and move around for a few seconds or for as long as half an hour.

Sleepwalkers’ eyes are open, but they don’t see the same way they do when they’re awake and often think they’re in different rooms of the house or different places altogether. Sleepwalkers tend to go back to bed on their own and they won’t remember it in the morning. Researchers estimate that up to 15% of kids sleepwalk regularly. Sleepwalking may run in families and sometimes occurs when a person is sick, has a fever, is not getting enough sleep, or is stressed.

IS SLEEPWALKInG A SERIOuS PROBLEM?If sleepwalking occurs frequently, every night or so, it’s a

good idea for your mom or dad to take you to see your doctor. But occasional sleepwalking generally isn’t something to worry about, although it may look funny or even scary for the people who see a sleepwalker in action. Although occasional sleepwalking isn’t a big deal, it’s important, of course, that the person is kept safe. Precautions should be taken so the person is less likely to fall down, run into something, or walk out the front door while sleepwalking.
