In exercise of the powers conferred upon me under rule 34 (1) of Haryana School Education, Rules,

2003, sanction is hereby accorded to grant permanent recognition to Tagore Public High School,

Chaharwala (Sirsa) run by Managing Committee, Tagore Education Society, Vill. Chaharwala, Distt. Sirsa for classes 9th to

10th under BOSE pattern with effect from 01.04.2018 under following terms and conditions:-

TERMS & CONDITIONS:-

1. This permanent Recognition is granted that on the subject to the condition that the documents/information furnished by the school authorities are factual and not devoid of truth in any way. However. if any information at any stage, is found contrary to the facts the recettnition would be relifoked fort*trith.

2. The school shall follow the courseOf study as per syllabus prescribed by the affiliated board. 3. The school shall charge re es and funds as declared to the appropriate authority at the time of application for recognition and display the

same on the notice board of the school and shall not increase the fees dwing the any academic session. In case of any change in the fee structure the school shall inform to the appropriate authority in the month of January for the next academic year and will also issue printed receipts of fees/funds to the students.

4. Salary shall be paid as per declaration at the time of seeking recognition. 5. No capitation fee and other charges shall be charged, from the children/parents. 6. School shall be open for admission without any disorimination based on religion, caste, race, place of birth any other whimsical. 7. Managing Committee shall not allow to run two schools affiliated by different board/council in the same premises. 8. Managing Committee shall not close down the schbol or and existing class during the academic session without the prior approval of the

Appropriate authority. 9. The school shall be open for inspection for the inspecting officer authorized by the Director/Appropriate Authority. 10. Recognition so granted shall be reviewed after every 10 years. 11. No financial assistance shall be granted by the Department to the school. 12. School premises shall not be used for commercial purpose and anti National activities. 13. Approval of Managing Committee shall be obtained from the appropriate authority in case of any change in the committee. 14. The Managing Committee shall follow the instructions issued by Government/Director from time to time and supply the information to the

Govt./Department as required. 15. In addition to above the Managing Committee shall abide by the provisions of Haryana School Education Rules, 2003 and amendments if

any thereafter. The Managing Committee shall be liable for disciplinary action in case of violation of any provisions of the rules. 16. School will provide ramp within six months otherwise recognition will stands withdrawn. 17. If any information, at any stage found Contrary to the Fact's the recognitionwoulgtbe revoked forthwith. 18. That the number of students in classroom shall not be more than the students calculated on the 10 square feet per student for secondary

and Senior Secondary Schools and 9 Square feet per student of elementary state. 19. The managing committee shall abide by the provisions of Haryana School Education Rules 2003(amended) & R.T.E. Rules 2011 and

amendments it any thereafter. The Managing shall be liable for disciplinary action in case of violation of any provision of the rules.

Memo No. 6/12-2016 PGT-I (4) Dated, Chandigarh, the j ---//--"c Whereas, name of Ms. Monika Dalai D/o Sh. M.S. Dalal was recommended for

appointment as Post Graduate Teacher in Physics at Merit No. 64 by the Haryana School Teachers Selection. Board, Panchkula vide letter No. 2/1/2013-HSTSB/2013/CA dated 20/03/2013 in pursuant to Advt. No. 1/2012. While recommending the names of selected candidates the Haryana School Teachers Selection Board, Panchkula had made an observation as under:-

"The selected candidates have not been medically examined and no special enquiry into their antecedents had been made. The documents pertaining to their qualifications, 4 years Teaching Experience, HTET, age, Caste/Category and Universities as claimed by them in their application forms may please be got checked/verified from the issuing authorities, before they are allowed to join their duty. A copy of the appointment letter issued to the candidate may also be endorsed to the Commission."

As per Haryana State Education School Cadre (Group-B) Service Rules, 2012, the educational qualification for the post of Post Graduate Teachers for direct recruitment has been prescribed as under:-

Post Graduation with atleast 50% marks in relevant subject and B.Ed. from a recognized university (except PGT Computer Science); AND Matric with Hindi/Sanskrit or 10+2/B.A./M.A. with Hindi as one of the subject; AND Certificate of having qualified Haryana Teacher Eligibility Test (HTET)/ School Teachers Eligibility Test (STET). Consistent good academic record.

Further, the candidates having 4 years teaching experience were given relaxation as one time measure and they were also eligible for appointment to the post of Post Graduate Teacher as the said posts were advertised 1st time after the formulation of new Service Rules i.e. Haryana State Education School Cadre (Group-B) Service Rules, 2012 provided that such person shall have to qualify the Haryana Teacher Eligibility Test (HTET) and B.Ed. by 1st April, 2015 (now extended upto 1.1 April, 2022) and if they fail to do so, their appointment shall stand terminated automatically without giving any further notice.

As per application form submitted by Ms. Monika Dalal D/o Sh. M.S. Dalai, she was selected on the basis of 4 years teaching experience after getting the aforesaid one time relaxation and a part of teaching experience possessed from Arya Sr. Sec. Shiksha Sadan, Atta, Panipat i.e. from 01.12.2007 to 25.07.2009.

On the basis of the observation made by the Haryana School Teachers Selection Board, Panchkula, the Department constituted. Document Verification. Committee (DVC) for verification of the academic certificates as well as documents of the schools which have issued the experience certificate. The report/observations of the committee in regard to the experience certificate issued by the school concerned in respect of Ms. Monika Dalai D/o Sh. M.S. From the perusal of details of selected PGT's on the basis of teaching experience issued by the school in question i.e. Three in Physics (nil students' strength in different years) viz-a-viz Number of Students appeared in Board Exams (10+2) from 2008 onwards in subjects concerned and Number of certificates issued may be more than selections from schools, these seems totally unreasonable, unjustifiable and irrational approach of school while issuing teaching experience certificates. For the same, criminal action may be initiated against the school authorities and proceedings of de-recognition of school may also be ordered to be initiated.

As per observation made by the DVC, the matter was forwarded to the Vigilance Department vide Memo No. 6/4-2013-HRL(4) dated 04.09.2015 with the request to inquire the matter and initiate legal action by registering the criminal case against the school authority, however, due to the reason that the Vigilance Department did not reach at any definite conclusion, the Govt. constituted District Level Committee under the Chairmanship of Sub-Divisional Magistrate of concerned District containing two members i.e. District Education Officer and Block Education Officer concerned vide order No. 6/12-2016 PGT-I(4) dated 06.11.2017 and directed to submit progress report in this regard, so that, the matter can reach to finality as soon as possible.

Accordingly, the District Level Committee so constituted submitted its progress report in regard to the candidates selected on the basis of teaching experience possessed from. Arya Sr. Sec. Shiksha Sadan, Atta (Panipat). As per report submitted by the DLC, Ms. Monika Dalal D/o Sh. M.S. Dalai as well as school authorities were unable to produce any corroborative evidence in regard to teaching experience issued to her. Therefore, the experience certificate issued to Ms. Monika Dalai D/o Sh. M.S. Dalai cannot be considered as genuine. Prima-facie, the case is made out for initiation of an appropriate action and to recommend to the Haryana Staff Selection Commission for cancellation of candidature in respect of Ms. Monika Dalai D/o Sh. M.S. Dalai recommended by the Haryana State Teachers Selection Board, Panchkula for appointment as PGT in Physics. But before initiating any action, the show cause notice is hereby served as to why the recommendation for cancellation of the candidature in respect of Ms. Monika Dalai D/o Sh. M.S. Dalai be not made to the appropriate authority. Reply, if any, you want to file in response to this notice may reach in the office of Director Secondary Education not later than 15 days from the date of the receipt of this notice. In case you fail to respond to the notice within stipulated period, it shall be presumed that you have nothing to say/submit in this regard and decision will be taken ex-parte.

The report/observations of the committee in regard to the experience certificate issued by the school concerned in respect of Ms. Rekha Rani D/o Sh. Recognition so granted shall be reviewed after every 10 years. 11. No financial assistance shall be granted by the Department to the school. 12. School premises shall not be used for commercial purpose and anti National activities. 13. Approval of Managing Committee shall be obtained from the appropriate authority in case of any change in the committee. 14. The Managing Committee shall follow the instructions issued by Government/Director from time to time and supply the information to the

Govt./Department as required. 15. In addition to above the Managing Committee shall abide by the provisions of Haryana School Education Rules, 2003 and amendments if

any thereafter. The Managing Committee shall be liable for disciplinary action in case of violation of any provisions of the rules. 16. School will provide ramp within six months otherwise recognition will stands withdrawn. 17. If any information, at any stage found Contrary to the Fact's the recognition would be revoked forthwith. 18. That the number of students in classroom shall not be more than the students calculated on the 10 square feet per student for secondary

and Senior Secondary Schools and 9 Square feet per student of elementary state. 19. The managing committee shall abide by the provisions of Haryana School Education Rules 2003(amended) & R.T.E. Rules 2011 and

amendments it any thereafter. The Managing shall be liable for disciplinary action in case of violation of any provision of the rules.

In exercise of powers conferred under Rule 29 (3) read with Rule 3 of Haryana School Education Rules-2003 Education Department, Haryana hereby permit to add new proposed classes for higher stage. However, it is made clear that such permission will not enable such school to get recognition automatically for which the applicant shall have to fulfill the required conditions.

This letter of permission is based on the undertaking given by the applicant as per details given overleaf. Any violation of the undertaking automatically nullifies the permission. This permission is further subject to 'No Objection' from the 'Competent Authority' regulating the land use of the proposed site.

The permission to add new proposed classes for higher stage is only 'In-principle' approval of the Education Department to allow applicant to initiate steps and provide infrastructure to the new proposed classes of higher stage.

Students should not be admitted only on this permission without getting recognition. The recognition will be granted R.T.E. Rules-12 Appendix-I1 by the Department on fulfillment of prescribed norms as provided in Haryan.a School Education Rules-2003, in the interest of safety, health and welfare of students and other requirements. * The managing committee shall abide by the provisions of Haryana School Education Rules 2003 (amended) & R.T.E. Ruels 2011 and amendments it any thereafter. The Managing shall be liable for disciplinary action in case of violation of any provisions of the rules.

In exercise of the powers conferred by nub-section (1) read with nub-section (2) of section 24 of the Haryana School Education Act, 1995 (Act 12 of 1999), and all other powers enabling in this behalf, the Government of Haryana vide No. GSR 7/1-1.A. 12/99. S24(1)/2003 notified the Haryana School Education Rules-2003 to regulate education 'in all non-Government schools, to promote better organization and development of school education, the manner of admission to recognized schools, fee structure, uniform code of service conditions for employees, adequate infrastructural facilities to be provided to pupils and to follow approved course of studies, in the State of Haryana.
