AT a meeting of the Executive Council held in theExecutive Council Chambers, at Perth on 28th Sep-temb:er, 1978, the following Order in Council wasauthorised to be issued :-

Forests Act, 1918-1976 .

ORDER IN COUNCIL .F.D. 332/73; L. & S. 1990/77 .

WHEREAS by the Forests Act, 1918-1976, it isprovided that a dedication under the said Act ofCrown Land as a State forest may be revoked inwhole or in part in the following manner-

(a) the Governor shall cause to be laid on theTable of each House of Parliament a pro-posal for such revocation.

(b) after such proposal has been laid beforeParliament the Governor, on a resolutionbeing passed by both Houses that suchproposal be carried out, shall by Order inCouncil revoke such dedication .

And whereas His Excellency the LieutentantGovernor did cause to be laid on the Table of eachHouse of Parliament, his proposal dated the fifthday of October, 1977, for the revocation in part ofthe dedication of Crown Lands as State forest : Andwhereas after such proposal had been laid beforeParliament a resolution was passed by both Housesthat such proposal should be carried out : Now,therefore, His Excellency the Governor with theadvice and consent of the Executive Council dothhereby revoke in part the dedication of CrownLand as State forest No. 22 described in theSchedule hereto .

The possession of, or progress towards, an appropriate tertiary level academic qualification will be considered a factor,increasing in importance with the level of classification, when determining efficiency of applicants in the Clerical Division .

a) Applications also called outside the Service under section 24.(b) The promotion will date from the first working day following the retirement of the present occupant .(c) Appointment to this position is conditional on the item being vacated by the present occupant .(1) A four year university degree in Agricultural Science or approved equivalent . Experience in vegetable or potato

extension or research would be an advantage .(2) LOCATION : Initially South Perth but following a period of training applicant could be required to take up an

appointment in one of the major south west centres, Bunbury, Albany or Manjimup .(3) Master of Psychology (Clinical) degree from the University of Western Australia or qualifications deemed equivalent .

(6) Prisons experience will be a deciding factor in assessing applicants .(7) Diploma in Applied Science (Physics, Chemistry or Biology) or other approved equivalent qualifications and relevant

experience.(8) Applicants must have served an engineering apprenticeship with three years subsequent experience in the engineering

field and been engaged during that time in manufacture and repair of engines, boilers and machinery . The holdingof/or substantial progress towards a Diploma in Engineering from a recognised technical institution or a Ministry ofTransport Certificate as a Marine Engineer would be an advantage .

(9) Eligibility for registration with the Dental Board of Western Australia .(10) Achievement Certificate or equivalent including Maths and English essential with preference for Certificate of Sec-

ondary Education with considerable experience in handling livestock ; or progress towards a Diploma from a recog-nised Agricultural College or approved equivalent with some experience with livestock. Minimum age 21 years .

(11) Furnished single accommodation is available at reasonable rental . Married applicants will be assisted in findingsuitable accommodation.

(12) A minimum of seven years experience in a child or related Welfare agency.Knowledge and understanding of the juvenile judicial system of W.A .

(13) Applicants should have a Diploma from a recognised School of Surveying with approved experience in hydrographicsurveying .

(14) LOCATION: Perth and required to travel within the metropolitan area with occasional visits to country centres .(15) At least three years experience in programming and systems analysis and design of computer systems is essential .

Programming should be related to COBOL, EXTENDED BASIC + and FORTRAN . A tertiary qualificationin an area related to computing or progress towards same and experience in the area of systems programming wouldbe advantageous .

AMENDMENT OF THE RULES OF THE SUPREME COURT,1971 .

1 . In these rules, the Rules of the Supreme Court, 1971 reprinted inthe Government Gazette on 9th August 1976 pursuant to the Reprintingof Regulations Act, 1954, and as amended from time to time, * arereferred to as the principal rules .

2 . Rules 3, 4, 5, 9, 10 and 11 of these rules shall come into opera-tion on the 1st day of January 1979 and the remaining rules shall comeinto operation on the day on which these rules are published in theGovernment Gazette .

3 . The principal rules as amended by rules 4, 5, 9, 10 and 11 ofthese rules shall apply to and in relation to causes and matters com-menced on or after the day on which those rules come into operationand also to and in relation to causes and matters then pending in theCourt other than those causes and matters that are entered for trial orhearing before that day .

4 . Order 29 Rule 8 of the principal rules is amended-(a) by adding after the rule designation, "8" the paragraph desig-

nation, "(1)" ; and(b) by adding the following paragraph:-

(2) The Court may also give a direction under Order 36Arelating to expert evidence .

5 . Order 33 Rule 10 of the principal rules is amended by addingafter the word, "inspection" in subparagraph (d) of paragraph 1 thewords, "or the disclosure or non-disclosure of expert evidence" .

6 . Order 34 Rule 12 of the principal rules is amended by subs-tituting for the passage "The certificate shall be in the Form No . 21 withsuch variations as circumstances may require ." In paragraph (1), thepassage, "The certificate shall be in such form and contain such informa-tion as the Master may direct ."

7 . Order 34 Rule 13 of the principal rules is amended by deletingthe words, "which he shall attach to the pleadings and" in line 3 ofparagraph (1) .

8 . Order 34 Rule 14 of the principal rules is amended-(a) by adding after the word "shall" in line 3 of paragraph (2)

the passage, ", subject to paragraph (3)," ; and(b) by adding after paragraph (2) the following paragraph-

Medicalevidence inactions forpersonalinjuries .

11 . The principal rules- are amended by adding after Order 36 thefollowing Order:-

Evidence Act, 1906 .2. (1) This rule applies to medical evidence in actions for personal

injuries .(2) Unless the Court otherwise directs, a party must serve on the

other parties, in accordance with this rule, copies of all medical reportsthe substance of which that party intends to rely on at the trial orhearing .

(3) Copies of the medical reports mentioned in paragraph (2) shallbe served not later than the following times-

(a) where the report is in existence before the action is enteredfor trial-

(i) if the report is that of the party entering the action-the time of entry ;

(ii) if the report is that of another party-the expiration ofthe time limited by Order 33 Rule 9 for an applicationto countermand the entry or such later time as may befixed by an order made on any such application ;

(b) where the report comes into existence after the action isentered for trial, as soon as practicable thereafter .

(4) Where the Court gives a direction under paragraph (2), theCourt, if satisfied that it is desirable to do so, may direct that, in lieuof serving a copy of any medical report, the substance of all or anymedical evidence that a party intends to rely on at the trial or hearing bedisclosed in writing to such other parties and within such period as theCourt may specify .

(5) Except with leave of the Court, or pursuant to a direction of theCourt, or where all other parties agree, no witness may give medicalevidence at the trial or hearing of a cause or matter unless the substanceof that evidence has been disclosed in writing to all other parties withinthe time limited by a direction under paragraph (4) or, where no suchdirection has been given, a reasonable time before trial .

(6) Paragraph (5) does not apply where a party has in accordancewith paragraph (2) and paragraph (3) served a copy of a medicalreport containing the substance of the evidence .

(7) The Court may, if it thinks fit, treat the fact that a medicalreport contains statements by the party against whose interest theevidence is to be led or hearsay evidence as to the manner in whichthe personal injuries were sustained, or that it contains other evidencethat would not be admissible at the trial, as a sufficient reason for givinga direction under paragraphs (2) or (4) or granting leave under para-graph (5) .

(8) Where a party applies for a direction under paragraph (2), theCourt may inspect the report the subject of the application without dis-closing its contents to any other party ; and an affidavit in support ofany such application shall not be required .

(9) Nothing contained in this rule requires evidence to be disclosedto a defendant who has not entered an appearance .

3 . (1) This rule applies to expert evidence other than medicalevidence in actions for personal injuries .

(2) Except with the leave of the Court or where all parties agree,no expert evidence may be adduced at the trial or hearing of a causeor matter unless the party seeking to adduce the evidence has appliedto the Court to determine whether a direction should be given underparagraph (3) and has complied with any direction given on theapplication.

(3) The application shall be made-(a) if by the party entering the action for trial-before the action

is entered ; or(b) if by another party-not later than the expiration of the

time limited by Order 33 Rule 9 for an application tocountermand the entry or at such later time as may be fixedby an order made on any such application .

(4) Where an application has been made under paragraph (2) theCourt, if satisfied that it is desirable to do so, may direct that-

(a) copy of a report of an expert witness the substance of whicha party intends to rely on at the trial or hearing of a causeor matter be served on, or

(b) the substance of all or any expert evidence that a partyintends to adduce at the trial or hearing be disclosed inwriting to,

such other parties and within such period as the Court may specify .

4 . Paragraph (5) of Rule 2 and paragraph (2) of Rule 3 shallnot apply to evidence that is permitted to be given by affidavit orshall affect the enforcement under any other provisions of these Rulesof a direction given under this Order, but such a direction shall notbe enforceable by writ of attachment or order of committal .

5. The Court may, at or before the trial or hearing of a cause ormatter, direct that the number of medical or other expert witnesseswho may be called at the trial or hearing shall be limited as specifiedby the direction .

6 . The Court may give a direction under Rule 2 or Rule 3relating to part only of the report or evidence of an expert witness .

7 . Where a party is required by Rule 2 or by a direction givenunder that Rule or under Rule 3 to disclose any expert evidence, thatparty may not, after the expiration of the time fixed for disclosureby the Rule or direction, as the case may be, object, on the groundof privilege, to the evidence being disclosed .

8 . An application under this Order, if made before trial, shall bemade by summons .

9 . A direction given under this Order may on sufficient causebeing shown, be revoked or varied by a subsequent direction givenat or before the trial or hearing of the cause or matter .

APPLICATIONS are invited under section 116 ofthe Land Act, 1933-1977 for the leasing of theKing Locations listed in the schedule for the purposeof "Rural Residential" for a term of 21 years atthe rentals shown .The Government and the Local Authority are in

no way responsible for the provision of accessroads, water supply and other services .

The locations are all subject to examination ofsurvey .On compliance with conditions 2 and 3 below

the lessee may surrender his lease with a view topurchasing the land freehold at the price statedin the schedule . Such price to remain valid fora period of three (3) years from the commencementof the lease .

The land is made available for leasing subjectto the following conditions :

(1) The land shall be used only for residentialpurposes consistent with a rural setting.Any produce grown shall be for the useand consumption of the lessee and not forresale and no commercial usage of anykind shall be permitted without the priorwritten approval of the Minister for Lands .

(2) The Lessee shall erect a residence on theleased land complying with the LocalAuthority by-laws within the period offour (4) years from the commencement ofthe lease . However, freehold title to theland may be applied for when a residencehas been erected to "top plate" stage and50% completed to the satisfaction of theMinister .

(3) The Lessee shall, within twelve monthsfrom commencement of the lease, fencethe external boundaries with a stock-prooffence to the satisfaction of the Minister .

(4) The Lessee shall not without the previousconsent in writing of the Minister for Landsassign, transfer, mortgage, sublet or partwith the possession of the demised land .

(5) All irrigation and drainage works andconstructions shall be to the standards andrequirements approved by the Public WorksDepartment and Department ofAgriculture .

(6) The only residence permitted will be thatof the Lessee or a Caretaker .

(7) All buildings, erections, paving, drainageand other works shall be to the approvalof the Local Authority and the lessee shallperform, discharge and execute allrequisitions and works unto the demisedland as are or may be required by anylocal or public authority operating underany statute by-law or regulation .

(8) The rent shall be subject to reappraisalat the end of the seventh and fourteenthyear of the term .

(9) The lessee shall pay actual cost of surveywhen called upon .

(10) The lessee shall maintain existing andfuture improvements to the satisfaction ofthe Minister for Lands .

(11) The Minister or his representative mayenter the land for inspection at any reason-able time .

(12) Power is reserved to the Minister for Landsto direct that the number of stockdepasturing on the demised land shall bereduced if the Minister is of the opinionthat the demised land is overstocked toan extent sufficient or likely to causepermanent damage to the land ; failureto comply with any such direction willresult in the forfeiture of the lease .

(13) The public shall have at all times freeand uninterrupted access to the foreshoreof Lake Kununurra .

(14) The lessee shall indemnify the Ministeragainst all claims for damage to propertyor persons arising from the use of theland .

(15) Compensation will not be payable fordamage by flooding of the demised land .

(16) Compensation shall not be payable to thelessee in respect of any improvementseffected by him on the demised land andremaining thereon at the expiration orearlier determination of the lease .

(17) It shall be lawful for the lessee at anytime within the three calender monthsimmediately following the expiration ofthe term or earlier determination of thelease, to take down, remove, and carryaway any buildings, structures, improve-ments and plant the property of the lessee .

(18) On determination of the lease, the lesseeshall fill in, consolidate and level off anyuneveness, excavation or hole caused byhim during the term of the lease or byremoval of his improvements and shallleave the demised land in a clean, neatand tidy condition to the satisfaction ofthe Minister for Lands and shall removeany or all waste matter as required bythe Minister.

A person in the employ of the State must applythrough the Under Secretary for Lands for theGovernor's permission to hold this land . Writtenapproval of the Permanent Head concerned shouldaccompany such application .Applications must be lodged at the Department

(1) That the dump be surrounded on threesides by a wire netting fence not less thantwo metres in height with lockable gatesat its entrance and that the fence and gatebe maintained in good order at all times .

(2) Before any fire is lit under the authorityof this suspension, the area between thelake foreshore and Location 45 and 53 beprotectively burnt.

(3) That the lighting of fires to burn rubbishbe caried out by persons authorised by theShire Clerk .

(4) That a fire unit filled with not less than900 litres of water be present at the siteduring the time that the fire is alight andthat the fire be extinguished with waterbefore the site is left unattended .

(5) No fires to be lit on land subject to thesuspension on a day for which the firedanger forecast issued by the Bureau ofMeteorology in Perth for the area is "Ex-treme" or "Very High" .

(6) That warning signs be erected and main-tained in good condition at the dump en-trance warning : "Unauthorised Lighting ofFires Prohibited, Offenders Prosecuted" .

Town of Northam .Notice to all Owners and/or Occupiers of Land in

the Town of Northam .PURSUANT to the powers contained in section33 of the above Act, you are hereby required on orbefore the 1st day of November, 1978, or withinfourteen days of the date of your becoming owneror occupier should this be after the 1st day ofNovember, 1978, to remove from the land owned oroccupied by you, all inflammable materials or toclear firebreaks in accordance with the followingand thereafter to maintain the land or the firebreakclear of inflammable material up to and includingthe 31st day of March, 1979 .

"Inflammable material" is defined for the purposeof this notice to include bush, timber, boxes, cartons,paper and like inflammable materials, rubbish andalso any combustible matter, but does not includegreen standing trees, or growing bushes and plantsin gardens or lawns .

The penalty for failing to comply with this noticeis a fine of not less than $10, or more than $200and a person in default is also liable, whetherprosecuted or not, to pay the cost of performingthe work directed in this notice if it is not carriedout by the owner or occupier by the date requiredby this notice .

If the requirements of this notice are carriedout by burning, such burning must be in accordancewith the relevant provisions of the Bush Fires Act .

First Schedule .Scheme map sheets numbered 6, 7 and 10 are

amended by substituting the proposed zones andreservations as shown on Amendment Scheme MapSheets numbered 6/2, 7/5 and 10/15 respectively .The proposed amendment sets out the zoning

and reservation proposals for a part of the Metro-politan Region Scheme falling within a section ofthe North-West Corridor . The area affected isbounded on the south by the existing urban de-ferred zone at Ocean Reef and Edgewater and onthe north generally by Burns Beach Road ; theWest Coast forms the western extremity while theeastern side is contained generally in part of theparks and recreation reserve along the westernside of Lake Joondalup, in the Shire of Wanneroo.

The proposals are part of the plan contained inthe report "The Planning Structure for the North-West Corridor" prepared by the Authority andwhich are available for purchase (a summary copyis also available free of charge) at the Town Plan-ning Department, 2nd Floor, 22 St. George's Ter-race, Perth. The proposals provide for the exten-sion of the urban deferred zone and the primaryroad pattern, a Central City Area zone whichincludes all the land envisaged for development asthe Joondalup Sub-Regional Centre, and a largeparks and recreation reserve between the west coastand the northward extension of Ocean Reef Road.

ALBANY PORT AUTHORITY ACT, 1926-1976 .

THE Albany Port Authority, acting pursuant to the Albany Port Authority Act .1926-1976, hereby-

(a) revokes the regulations made under the Albany Harbour Board Act, 1926andpublished in the Government Gazette on the 27th April, 1951, asamended by a notice so published on the 27th October, 1960 ; and

(b) makes the regulations set out in the schedule hereunder .

Schedule .

REGULATIONS .1. In these regulations the regulations made under the Albany

Harbour Board Act, 1926, and published in the Government Gazetteon the 30th March, 1951, as amended from time to time thereafterby notices so published, are referred to as the principal regulations .

2. The principal regulations are amended by revoking regulation58 and remaking it as follows-

58 . (1) Subject to subregulation (2) of this regulation, theTonnage Rates payable in respect of each berth occupied by-

(a) a vessel, other than a vessel referred to in paragraph (c)of regulation 57 of these regulations, shall be 1 .25 centsfor each ton of the gross registered tonnage of thevessel, for each six hours or part thereof during whichthat berth is occupied ;

(b) a vessel referred to in paragraph (c) of regulation 57of these regulations, shall be 0.675 cents for each ton ofthe gross registered tonnage of the ship .

(2) Subject to regulations 55, 59 and 61 of these regulations,the minimum Tonnage Rate in respect of each entry of a vesselinto the Port shall be-

(a) in the case of a vessel referred to in paragraph (a) ofsubregulation (1) of this regulation-as if that vesselhad occupied one berth for twenty-four hours, or fiftydollars, whichever is the greater ;

(b) in the case of a vessel referred to in paragraph (b) ofsubregulation (1) of this regulation-fifty dollars . .

3. The principal regulations are amended by revoking regulation59 and remaking it as follows-

59. A whale-chasing vessel is not liable to pay the TonnageRates prescribed by regulation 58 of these regulations, but shall,before the first day of July in each year, or thereafter on firstentering the Port, pay as Tonnage Rates in respect of the year,or part thereof, ending on the thirtieth day of June next follow-ing, $1.20 for each ton of the gross registered tonnage of thevessel . .

7 . The principal regulations are amended by revoking regulation75 and remaking it as follows-

75. The rates of Wharfage and Handling Charges on OutwardCargo shall be as under, but in order to qualify for the rates ofWharfage app'icable thereto, goods wholly manufactured withinthe State and products of the soil of the State, as prescribedin regulation 73A, must be declared as such in such manneras the Board may from time to time require, at the time ofdelivery for shipment .

8 . Regulation 76 of the principal regulations is amended bydeleting the number "30" in line one of paragraph (b), and insertingin lieu thereof the number "40" .

9 . The principal regulations are amended by revoking regulation121 and remaking it as follows-

121 . (1) Where any goods are not removed from any wharf,jetty or shed within the time required by these regulations,there shall, subject to these regulations, be payable to theBoard, as and by way of storage rent in respect of those goods,charges at the following rates :-
