I told GMAC that I never agreed to any such modification and had never signed any such documents. 1asked for copies of any paperwork explaining this modification agreement. They then sent me a copy of the 'modification', which was a unilateral decision by GMAC to freeze the rates. I contacted GMAC and told them the modification was illegal and demanded them to abide by the terms of the original note. GMAC asked why I was complaining now, instead of the previous year when the modification was sent to me. I told GMAC that I was receiving dozens of modification offers per month and had shredded them all. I was following the 6 month LIBOR and was anticipating a substantial reduction in my mortgage payment that would pay both principal and interest for about the same monthly payment. GMAC refused to comply so I sued them for the interest correction, which at that time was about $20,000 that I had overpaid in interest. Then GMAC flied bankruptcy and my litigation was thrown in the pile with all the other GMAC creditors. In spring, 2013, 1received notification that Ocwen had taken over servicing my note. 1 called Ocwen to see if the original note was going to be implemented or ifOcwen was going to continue with the GMAC unauthorized modification, freezing my loan interest at 6.125% for the additional five years without my agreement or signed contract. I have talked to so many people at Ocwen and I don't remember who this person was. He/She said Ocwen would send me a copy of the original note I had signed, and which Ocwen would use to service the note. In May, 2013, I received from Ocwen a copy of the original note I signed, which froze the rate at 6.125% for five years. At the end of five years, a one-time adjustment would be made to change the interest rate to 3.875% plus 6 month Libor rounded to one eighth percent. The loan payment would use a 25 year remaining amortization schedule ending in 2034. Also Adjustments could be made every six months. I totally agreed! I had several phone calls with Ocwen from May to September asking for my reduced payment. The only answer I received was that it was being evaluated. In either September or October I contacted Ocwen, and told them that the five year adjustment bad never been made and the interest rate needed to be lowered per the note terms. This person put me on hold, then returned and said that the loan bad been modified in 2008, and the original terms were invalid. Ocwen said they would send me a copy of the modification. The last week of October, 2013, I received a duplicate copy of the original GMAC 'modification' (dated 12-12-2008). I contacted Ocwen again and told them that if they really looked at the 'modification', it was not a mutually agreed document. It was GMAC changing the rate unilaterally. This would be the same as my sending a notice to Ocwen with my unilateral decision to lower my interest to 1% for five years so I can afford the payments. I said I hoped both Ocwen and I agree that both parties must agree to a contract change. Ocwen asked what I was seeking as a resolution. I said I wanted the interest rate retroactively calculated to the terms of the only note that existed, beginning in 2009. The Ocwen representative said they would order a report that would reflect such a calculation. At the end of October, 2013, I received the re-calculated payment schedule. The Ocwen representative told me that the $30K or so difference would need to be deposited by me to complete the revisedpayment schedule. I then told Ocwen that I had overpaid interest for five years, and the overpayment subtracted from the$30K would only be $5K or $6K. This seemed to cause confusion, so I clarified that for five years I have been paying $300to $500 per month more interest than the LmOR rate, and I expected these overpayments to also be applied to the principal.

The Ocwen calculations showed a principal balance of $299,951.57. The interest calculations assumed no principalreduction, but I have paid an additional $7500 principal. If my loan would have been managed per actual LmOR rates, mypresent balance would be $301,462 after the 10-01-2013 payment. I contacted Ocwen regarding the flaws I discovered intheir calculations and they said they would review the case and contact me in the future.

A couple of months (approximately) later I had received no updates, so I contacted Ocwen, and they said they werecalculating the new rate and I would be receiving an updated payment. I called again and asked for the new calculations, andOcwen sent me a history of my payments, which was useless because I already had that. I wanted a new amortization tablereflecting the extra interest I had paid for over four years.

I called in January and gave a brief history of the contents in the document, explained I had been waiting over three monthsfor this new loan calculation. I was then told that I must make a written request for this recalculation. Why wasn't I told thisback on October? Well anyway, written requests are easier to record and trace. Threrefore, here is my written request forOcwen to abide by the terms of my note and here is the summary through the 10-01-2014 payment of the non-LmORcompliant interest I have been paying since 2009:
