Background

• $13.4 million component of the larger $20 million GTA Aboriginal Housing Program

• Developed in partnership between MBDC, MMAH, and TWC Inc.• Builds on the findings, outcomes, and principles established

through the GTA Aboriginal Housing Consultation• Complements the other two components of GTA Aboriginal Housing

Program:– Aboriginal Home Repair Program-GTA (to be launched

November/December 2009)– Aboriginal Downpayment Loan Program-GTA (launched August 24,

2009)

Principles• Application of Principles:

– Program restricted to Aboriginal Service Providers (ASPs) under Aboriginal Control

– Proponents must define how principles will be incorporated into projects

– Enhanced scoring assigned to projects that clearly reflect the principles– Mandatory conflict of interest attest statements and proponent

declaration statements to be completed by all Program applicants– At least one applicant reference from Aboriginal community

Purpose• Create affordable rental accommodation under Aboriginal control• Help off-set the capital construction cost associated with new

development• Promote a range of affordability for those at different income levels• Encourage development in areas well served by amenities, including

those specifically targeted to the Aboriginal community• Reduce the back-log on existing social housing waiting lists• Encourage diversity through the mix of affordable/market and

Aboriginal/non-Aboriginal units• Promote the more efficient utilization of the existing building stock

(through adaptive reuse) and acquisition and rehabilitation (currently vacant rental buildings)

• Add/create affordable rental units for larger families

Program Requirements

• Eligible proponents:– Non-profit Aboriginal organizations in which Aboriginal people are key

decision-makers (Board or Senior Management)– Partnerships between Aboriginal and non-Aboriginal groups with

Aboriginal partner retaining control:• Partners can be private-sector organizations• Partners do not need to be Aboriginal focused or controlled

– Must have a permanent office already in the GTA– Must already be providing services to the Aboriginal Community in the

GTA

• Eligible development:– Projects must be built in the GTA– New construction– Conversion of a non-residential building to residential– Rehabilitation/renovation of existing vacant rental buildings– Acquisition of condominium units – Can take any form (apartment building, townhouse, stacked

townhouse)– Condominium registrations are permitted– Mixed projects are permitted (affordable/market, Aboriginal/non-

Aboriginal)– Mixed-use projects are permitted (commercial/institutional with

residential) if commercial/leased space is < 10% of gross floor area of building

• Projects NOT eligible for funding:– Nursing or retirement homes– Existing Social Housing developments (SHRA Regulated)– Shelters or crisis care facilities– Ownership housing– Stage 2/transitional housing– Housing built outside the GTA– Housing built on reserves in the GTA– Housing built on sites that would would require:

• An Official Plan Amendment• Substantial environmental remediation

• Unit and building design:– Units must be self-contained with private kitchen and bath– Units must meet minimum sizes as set out in the Ontario Building

Code, although larger is recommended (no maximums)– Units should target large and small families (followed by seniors and

singles)– Buildings should incorporate energy efficiency features– Building should incorporate accessibility features

• Eligible tenants:– Aboriginal households, including status or non-status Aboriginal

Canadians, First Nations, Métis, and Inuit peoples – Households living off-reserve and in the GTA, and who are on, or

eligible to be on, an existing social housing waiting list– Households paying a minimum of 20% of their income on rent (at time

of occupancy)

• Rents:– Must not exceed 75% of Average Market Rent (AMR) by unit type and

municipality– Individual units can rent at < 75% AMR– Must remain affordable for a minimum of 20 years– Must include utilities– Future rent increases governed by Residential Tenancies Act

• Equity contribution:– Varies based on proponents:

• 0% required for non-profit ASPs• 5% for partnerships

• Construction or mortgage financing may also be required:– Must be secured prior to allocation of Program funding

Funding

• Form of funding available:– Grants of up to $10,000 for proposal development– Forgivable capital loans for project construction

• Grants (Aboriginal Rental Proposal Development Funding):– Only awarded to short-listed proponent under R-EOI– Only flowed after signing of Agreement– Funding reimbursed to proponents as expenses incurred– May only be used for proposal development expenses under Request for

Proposals (RPF)– Can be stacked with CMHC Seed Funding

• Forgivable capital loans:– Awarded to proponents successfully chosen under RFP – Forgivable after 20 year affordability period– Only provided for affordable, Aboriginal units– Must enable proponents to maintain rent levels at 75% of AMR (or less)– Can be ‘stacked’, when allowed by funding agency

• Loan amounts vary based on unit size:– Bachelor units: maximum $110,000/unit – 4 + bedroom units: maximum $150,00/unit

• Total funding request to MBDC must not exceed $4.4 million

• No geographic pre-allocation of grant or capital funding between GTA municipalities

• No funding available for ongoing operating costs• Flow of funding:

– No funding flowed until proponents sign Aboriginal Rental Contribution Agreement (ARCA) and Mortgage Agreement (MA)

– No funding flowed until proponents secure conventional construction/mortgage financing (if required)

– No funding flowed until proponents provide clear Phase 1 and, if required, Phase 2 Environmental Site Assessment (ESA)

– Allocated in accordance with Flow of Funding Schedule

• Flow of Funding Schedule – proponents without land– “Preconstruction Funding” up to 25% of total allocation subject to:

• Up to 75% of purchase price of land • Up to $150,000 in three equal installments of up to $50,000 for soft costs

– “Development Funding” up to 90% (cumulative) of total allocation:• 25% of loan available upon receipt of Building Permit• 25% of loan available upon completion of structural framing• 15% of loan available upon receipt of Occupancy Permit

– “Hold-back Funding” of final 10% of total allocation• Final 10% of total allocation released in accordance with Construction Lien

- Ineligible applicants directed to Fairness Advisor (if requested)• Submissions scored by PRC using forms provided:

- Minimum 60% passing score • Recommendations to MBDC Board of Directors for approval• Short-listed applicants issued proposal development funding

• Application structured in ‘booklet’ format• No written submission other than the Forms provided• Failure to provide requested information and/or submitting non-

requested information may result in disqualification• “Project Summary Form” (Appendix A) must be first page of

submission:– Used to determine eligibility– Establish proponent profile

• “Project Submission Form” (Appendix B) used for evaluation and scoring purposes

• Reference Forms (Appendix C) must be completed and signed by references, not proponent

• Additional Forms to be completed and signed as per instructions
