Key Guiding Questions
S How to manage transboundary resources in disputed areas?
S What are best practices?
S How far along are we in having these?
S What are the trade-offs to consider?
S What is at risk if we don’t develop a management system?
S What should ocean policy be on this issue?
![Page 10: Ocean Policy and Transboundary Resource Management Grace Mallor… · Ocean Policy and Transboundary Resource Management Tabitha Grace Mallory, Ph.D. China Ocean Institute and University](https://reader033.vdocuments.site/reader033/viewer/2022060417/5f1460602b9c8368d50605b3/html5/thumbnails/10.jpg)
Transboundary Resources
S Fish
S Other marine biota
S Marine mammals
S Seabirds
S Sea turtles
S Some resources like coral,
mangroves, sea grasses that are
in disputed areas
![Page 11: Ocean Policy and Transboundary Resource Management Grace Mallor… · Ocean Policy and Transboundary Resource Management Tabitha Grace Mallory, Ph.D. China Ocean Institute and University](https://reader033.vdocuments.site/reader033/viewer/2022060417/5f1460602b9c8368d50605b3/html5/thumbnails/11.jpg)
Most Challenging Issue?
![Page 12: Ocean Policy and Transboundary Resource Management Grace Mallor… · Ocean Policy and Transboundary Resource Management Tabitha Grace Mallory, Ph.D. China Ocean Institute and University](https://reader033.vdocuments.site/reader033/viewer/2022060417/5f1460602b9c8368d50605b3/html5/thumbnails/12.jpg)

Management
![Page 13: Ocean Policy and Transboundary Resource Management Grace Mallor… · Ocean Policy and Transboundary Resource Management Tabitha Grace Mallory, Ph.D. China Ocean Institute and University](https://reader033.vdocuments.site/reader033/viewer/2022060417/5f1460602b9c8368d50605b3/html5/thumbnails/13.jpg)
Governance and Institutions
S Environmental governance: guiding the behavior of human actors away from socially undesirable outcomes toward the achievement of socially desirable ends
S Do we need to have a government to have governance?
S No! Sometimes governments can detract from good governance—can be too bureaucratic, deadlocked, corrupt
S Governance can arise without public authority
S Also created through negotiation and imposition
S Governing institutions (regimes): arrangements or systems to perform functions of governance, such as assigning roles and guiding interactions
S Informal: social norms
S Formal: laws, rules, regulations
![Page 14: Ocean Policy and Transboundary Resource Management Grace Mallor… · Ocean Policy and Transboundary Resource Management Tabitha Grace Mallory, Ph.D. China Ocean Institute and University](https://reader033.vdocuments.site/reader033/viewer/2022060417/5f1460602b9c8368d50605b3/html5/thumbnails/14.jpg)
Environmental Problems
S Two main types of
needs for environmental
governance
S To manage natural
resources (like fish)
S To manage
―externalities‖ or
negative side-effects
of behavior (like
pollution)
![Page 15: Ocean Policy and Transboundary Resource Management Grace Mallor… · Ocean Policy and Transboundary Resource Management Tabitha Grace Mallory, Ph.D. China Ocean Institute and University](https://reader033.vdocuments.site/reader033/viewer/2022060417/5f1460602b9c8368d50605b3/html5/thumbnails/15.jpg)
SCS Fish Problem SCS catch estimated at 10
million tons officially
But with illegal, unreported,
unregulated (IUU) catch,
possibly 16 million tons
Global total: 81.5 million
tons (marine capture)
Total fishing vessels 1.77
million
Total resource availability:
5–30% of 1950s levels

SCS Governance and Institutions
S How should we govern
the SCS so that we can
avoid further depletion
of fish stocks and move
toward more sustainable
management?
S What institutions should
we create for this
purpose?
![Page 17: Ocean Policy and Transboundary Resource Management Grace Mallor… · Ocean Policy and Transboundary Resource Management Tabitha Grace Mallory, Ph.D. China Ocean Institute and University](https://reader033.vdocuments.site/reader033/viewer/2022060417/5f1460602b9c8368d50605b3/html5/thumbnails/17.jpg)
Types of Institutions/Regimes
S Constitutive: provides a broad guiding framework across a wide variety of issues
S UN Convention on the Law of the Sea (UNCLOS) (1982/1994)
S Established 200 nm exclusive economic zone (EEZ)
S Operational: provides more detailed set of guidelines for a specific issue
S The Agreement for the Implementation of the Provisions on UNCLOS Relating to the
Conservation and Management of Straddling Stocks and Highly Migratory Fish Stocks
S ―Fish Stocks Agreement‖ (1995/2001)
S Regional Fisheries Management Organizations (RFMOs)
S The Agreement to Promote Compliance with International Conservations and
Management Measures by Fishing Vessels on the High Seas
S ―Compliance Agreement‖ (1995/2003)
S Flag states required to monitor their fishing vessels
![Page 18: Ocean Policy and Transboundary Resource Management Grace Mallor… · Ocean Policy and Transboundary Resource Management Tabitha Grace Mallory, Ph.D. China Ocean Institute and University](https://reader033.vdocuments.site/reader033/viewer/2022060417/5f1460602b9c8368d50605b3/html5/thumbnails/18.jpg)
Other Key Fisheries Instruments
S Non-binding
S FAO Code of Conduct for Responsible Fisheries (1995)
S FAO International Plans of Action (IPOAs)
S Reducing Incidental Catch of Seabirds in Longline Fisheries (1998)
S Conservation and Management of Sharks (1998)
S Management of Fishing Capacity (1998)
S Prevent, Deter and Eliminate Illegal, Unreported and Unregulated Fishing (2001)
S Binding
S Agreement on Port State Measures to Prevent, Deter and Eliminate Illegal,
Unreported and Unregulated Fishing (2009/2016)
S Plus others!
![Page 19: Ocean Policy and Transboundary Resource Management Grace Mallor… · Ocean Policy and Transboundary Resource Management Tabitha Grace Mallory, Ph.D. China Ocean Institute and University](https://reader033.vdocuments.site/reader033/viewer/2022060417/5f1460602b9c8368d50605b3/html5/thumbnails/19.jpg)
Assessing Institutional Effectiveness
S Outputs: measures to address the problem (e.g., laws and regulations)
S Outcomes: effect on behavior (e.g., decreased fishing)
S Impact: effect on the problem itself (e.g., more plentiful stocks)
S Illustrative example: Convention on Biological Diversity (CBD)
S Output: Agreed on goal to create marine protected areas that cover at least 10 percent of coastal and marine lands by 2020
S Outcome: 4 percent protected by law, 1 percent fully enforced (Our Ocean 2018)
S Impact: ―Biodiversity … continues to decline in every region of the world, significantly reducing nature’s capacity to contribute to people’s well-being.‖ (Intergovernmental Science-Policy Platform on Biodiversity and Ecosystem Services (IPBES) 2018 Report) (okay, slightly unfair)
![Page 20: Ocean Policy and Transboundary Resource Management Grace Mallor… · Ocean Policy and Transboundary Resource Management Tabitha Grace Mallory, Ph.D. China Ocean Institute and University](https://reader033.vdocuments.site/reader033/viewer/2022060417/5f1460602b9c8368d50605b3/html5/thumbnails/20.jpg)
Performance Standards
S Efficiency – is the institution cost effective?
S Equity – is the institution fair? Distributive consequences to winners
and losers
S Participation – are the relevant stakeholders involved?
S Transparency – can outsiders assess performance?
S Accountability – are administrators accountable to public authority?
S If these are not present, can undermine institution
![Page 21: Ocean Policy and Transboundary Resource Management Grace Mallor… · Ocean Policy and Transboundary Resource Management Tabitha Grace Mallory, Ph.D. China Ocean Institute and University](https://reader033.vdocuments.site/reader033/viewer/2022060417/5f1460602b9c8368d50605b3/html5/thumbnails/21.jpg)
Governance Challenges
S Collective action problems: pursuit of individual interests leads to
undesirable outcome for the group
S ―Tragedy of the commons‖ (Hardin)
S Solve though social norms; privatization; regulation
S But how to allocate privatized resources? Who is included?
S Free-rider problem
S Solve though dominant actor/hegemon; incentives; negotiation
S But what if others disagree with hegemon? Who pays for incentives? How to
ensure compliance with negotiated agreements?
![Page 22: Ocean Policy and Transboundary Resource Management Grace Mallor… · Ocean Policy and Transboundary Resource Management Tabitha Grace Mallory, Ph.D. China Ocean Institute and University](https://reader033.vdocuments.site/reader033/viewer/2022060417/5f1460602b9c8368d50605b3/html5/thumbnails/22.jpg)
Governance Challenges
S Institutional interplay
S Horizontal: governance systems at the same level dealing with different
issues that overlap or affect each other
S Example: capture fisheries; aquaculture; shipping; recreational use like
swimming or sailing; seabed mining; marine pollution
S Establish new regimes, or reform existing regimes? Fragmentation versus
marginalization
S Vertical: governance systems across different levels dealing with the
same issue
S Example: fisheries administration at international, national, local levels
S Enforce catch quotas agreed internationally at local level
S Data collection
![Page 23: Ocean Policy and Transboundary Resource Management Grace Mallor… · Ocean Policy and Transboundary Resource Management Tabitha Grace Mallory, Ph.D. China Ocean Institute and University](https://reader033.vdocuments.site/reader033/viewer/2022060417/5f1460602b9c8368d50605b3/html5/thumbnails/23.jpg)

Regional Marine
Environmental Mechanisms
S Three different types of mechanisms:
S Regional Seas programs
S Regional Fishery Bodies (RFBs)
S Regional Fisheries Management Organizations (RFMOs)
S Advisory RFBs
S Large Marine Ecosystem (LME) mechanisms
S Trend away from traditional, issue-by-issue, single-stock approach
S More holistic and integrated governance approach, ecosystem-based management
![Page 25: Ocean Policy and Transboundary Resource Management Grace Mallor… · Ocean Policy and Transboundary Resource Management Tabitha Grace Mallory, Ph.D. China Ocean Institute and University](https://reader033.vdocuments.site/reader033/viewer/2022060417/5f1460602b9c8368d50605b3/html5/thumbnails/25.jpg)

Fish Stock Assessment
S Do not have good data on stocks even though heavy fishing activity
S Need to understand what is there before we can manage
S Fishery-dependent data: based on how much was caught
S Methods: self-reporting, onboard observers, portside surveys, telephone surveys or vessel-monitoring systems
S The most common sources of data are landings records and port samples. Landing records, which result directly from the sale of caught fish, provide information only on landed catch. The data is often in the form of total weight and rarely in total numbers of fish.
S Fishery-independent data: determining how much is out there based on surveys, done systematically, understand spawning grounds
S Methods: trawl, acoustic, video and side-scan sonar research surveys and some tagging experiments
S The vast majority of fishery-independent data comes from research surveys conducted by national governments
![Page 33: Ocean Policy and Transboundary Resource Management Grace Mallor… · Ocean Policy and Transboundary Resource Management Tabitha Grace Mallory, Ph.D. China Ocean Institute and University](https://reader033.vdocuments.site/reader033/viewer/2022060417/5f1460602b9c8368d50605b3/html5/thumbnails/33.jpg)
Fish Stock Assessment
S No country can do this alone
S Need to get existing data from SCS countries; establish rules on
sharing data
S Need understanding of life-cycles of species; how climate change
will affect this
S Which scientific institutes will participate?
S Which stocks to assess?
![Page 34: Ocean Policy and Transboundary Resource Management Grace Mallor… · Ocean Policy and Transboundary Resource Management Tabitha Grace Mallory, Ph.D. China Ocean Institute and University](https://reader033.vdocuments.site/reader033/viewer/2022060417/5f1460602b9c8368d50605b3/html5/thumbnails/34.jpg)

Moving Forward
S ―Meta-sovereignty‖ or ―post-sovereignty‖ ideas
S Turn Spratlys into marine peace park (McManus)
S Marine Protected Areas Network
S Refugia
S Incorporate SCS into Western and Central Fisheries Commission (WCPFC) or create new RFMO

SCS Strategic Action Plan
S Seven participating countries: China, Vietnam, Philippines, Indonesia, Thailand, Malaysia, Cambodia
S Address important species during critical stages of their life-cycle
S What they’ve done that’s useful:
S Tons of data collection
S Identified sites most in need of protection: 26 mangrove sites; 43 coral reef sites; 26 seagrass sites; and 40 wetlands sites
S Regionally agreed high-priority ranked lists of 58 pelagic and 29 demersal fish species, 15 cephalopods, and 18 crustaceans in SCS and Gulf of Thailand
S Identification of 52 known spawning and nursery areas
![Page 37: Ocean Policy and Transboundary Resource Management Grace Mallor… · Ocean Policy and Transboundary Resource Management Tabitha Grace Mallory, Ph.D. China Ocean Institute and University](https://reader033.vdocuments.site/reader033/viewer/2022060417/5f1460602b9c8368d50605b3/html5/thumbnails/37.jpg)

Other Considerations
S Legally binding versus nonbinding arrangements? Nonbinding has been easier in the SCS
S Coast guard partnerships
S Climate change
S Effects
S To drill or not to drill?
S Network of scientists?
S How do socio-economic development issues affect this?
S Pollution
S 80 percent of marine pollution comes from land
S Agricultural runoff
S Toxic waste
S Human waste
S Plastics
S Shipping waste—fishing gear, illegal discharge, illegal dumping
S What about Taiwan?
