Narrative Summary:
On 06 May 12 at 0003hrs I was working as OPD Patrol Unit 3L34. I wore a full police uniform and drove fully marked patrol vehicle 1753.
At the above time, I heard Ofc. J. Fesmire 8757P advise on the radio that he was at 9oth Avenue and Olive Street. Ofc. Fesmire asked dispatch to raise his partner (Ofc. M. Masso 9059P) on the air and have him advise of his location and stated his partner was in a foot pursuit.
Ofc. Masso came on the air and advised "Shots Fired" at 0003hrs. The officers were also able to update their location to the 9200 block of Birch Street.

Narrative (Co~ued) At this point, a ~as initiated by Sgt. T. Mark.
Scene Summary:
Ole. A. Nash 9027P, Ole. R. Curtin and R. Brown were first units to arrive to the scene. Officers Brown and Curtin deployed their department issued rifles when exiting their patrol car. Once on scene they observed Ole. Masso with his handgun still pointed at S1, who was laying motionless on the ground. Ole. Brown and Curtin both stated that 81 did not appear to be moving and they also noticed that the officer was shot.
Ole. C. Marie 8611 P arrived on scene and conducted a pat search of S1's person while 81 remained in a supine position. 81's head was facing north and his feet were facing south. Ole. Marie observed that 81 was motionless and peeled away his clothing, at which point Ole. Marie observed 81 had three gunshot wounds on his person. Ole. Marie applied pressure to 81's wound using a towel he obtained from a bystander and initiated CPR on 81. Ole. Manguy 8717P arrived on scene and also assisted with rendering medical aid to 81.
Ole. M. Castro 8614P arrived on scene and contacted Ole. Fe,;mit·e Castro saw that there were two subjects (later identified as 82, inside the patrol vehicle. Ole. Fesmire directed Ole. Castro to

Ole. Castro advised that due to the fact an officer was shot by an armed suspect and that -and-were possibly associated with the suspect, Ole. Castro elected to conduct pat searches for weapons on ~~~~inees. Ole. Castro conducted the pat search of their persons with negative results and separated the two subjects by placing in the back of his patrol vehicle. Ole. Lord a, who was also on scene with Ole. Castro, transferred- in rear of Ole. H. as ro's patrol vehicle.
When I arrived on scene at 001 Ohrs, I saw that OFD 2566 and PMP 3166 were rendering medical aid to 81.
Per PMP Paramedics~ighland Hospital pronounced 81 at 0020hrs landwire. It appears that 81 sustained a single gunshot wound tq, his ~g~nshot wound to his left collar bone, and another single gunshot wound to his right rib cage.
PMP transported 81 to Highland Hospital.
I noticed there was a puddle of blood located on the north side walk in front of 9230 Birch Street. There were also several bloodied shoe prints in close proximity to the pool of blood. There was also a parked Toyota Camr~in the driveway. The vehicle was only partially parked with its rear blocking the sidewalk and roadway.

Technicians A. Goddard 8721P, B. Chistensen 8395P, J. Haymond 4075 were on scene and processed the scene of the shooting. I was later advised by investigators that the technicians recovered four .40 caliber casings from the scene (See technician's report for details).
Ofc. D. Jager was directed to remain with the firearm on scene until he was relieved of his post by Ofc. Nash. The firearm was subsequently recovered by the technicians on scene and submitted as evidence.
I also contacted dispatch via service and confirmed that they received the report from Shot Spotter of 4 shots fired at 0003hrs in the area of 9246 Birch Street.

PARAMEDIC PLUS# 3166 THEN ARRIVED WITH 81. PARAMEDICS BLACKWOLF AND ARMATA THEN PUT S1 IN ROOM NUMBER #5 OF THE EMERGENCY ROOM. S1 HAD A YELLOW SHEET OVER HIS BODY AND WAS WEARING BLUE JEANS AND BLACK NIKE'S.
SGT TISDALLE WAS ON SCENE AND INSTRUCTED ME TO GUARD 81'S BODY.
ALCO DEPUTY A. HUYNH #1792 CALLED THE CORONER AND DEPUTIES U. SOLOMON #1914 AND WILLIAMS# 1998 RESPONDED TO HIGHLAND HOSPITAL AND TOOK CUSTODY OF 81'S BODY. DEPUTY SOLOMON THEN GAVE ME A COPY OF THE CORONERS RECEIPT.

Narrative Summary:
On 6 May 0015 hrs, I was working OPD unit 2L72. I was wearing full utili~~m and driving marked car #1436. Radio advised of an officer down in the area of 90th Ave and Birch. I responde until the advisement was made that units could slow Upon arr'1val I provided crime scene tape to officers at 90th and Birch Stand enetered the scene.
I met with commanding officers as well as on scene serggeant and began to coordinate additional work that needed to be completed.
I contacted the desk officer and initiated a call out of peer support, the city attorney, lAD, homicide, and traffic (TOTAL station).
No known witnesses.
I advised Lt. Meeks of the cal louts made.
I did not use or witness any force.

Narrative Today 5 May 2012, I was working the second watch district six supervisor, 2L76. I was in full OPD wool uniform and i vehicle 1081. At about 0003 hrs I was at the Eastman! substation when I heard 2A33 (Officers Fesmire and Masso) I recognized the voice as that of Officer Fesmire. He stated that his partner was in a foot pursuit and requested that dispatch get an update from his partner. At this time I responded to the area.
While on my way I heard Officer Masso come up on the air and advised i point I called- As I was continuing to the scene officers that had arrived on scene advised that Officer that they were going to transport Masso to ACH. Due to the fact that it was unknown if there were any outstanding reo~unuirr8 officers to set up a large perimeter. When I arrived on scene I met with Officer Fesmire who advised me that there were no outstanding suspects. I advised units responding to the scene of this and instructed the on scene officers to lock down the scene. I made sure that officers were providing first aid to the suspect that had been shot.
I took over scene command until relieved by the watch commander Lt Meeks. When Lt. Meeks arrived on scene I briefed him on the incident. Several sergeants responded to the scene and we coordinated the scene management. Sergeant Tisdell, who had responded to ACH, took the public safety statement from Officer Masso. He advised me via cell phone that Masso indicated that he was facing E/B on Birch when he fired his weapon and that he fired three times. I made sure that a canvass was conducted to look for any possible victims that we did not know about. I waited until the investigators arrived on scene at which point I briefed them and then conducted a walk thru of the incident.
At about 0330 I left Sergeant Doolittle (3L76) in charge of the scene and I responded to ACH to check on Officer Masso. I then responded to the PAB and remained no duty and waited for Officer Fesmire to complete his interview with the investigators.
I did not witness any UOF during this incident

While medical staff was treating Officer Masso I took a public safety statement from him. I asked Officer Masso if he remembered how many shots he fired from his firearm and location. Officer Masso stated he shot three rounds from his firearm at 92nd Ave. and Birch St. in an easterly direction. I called Sgt. T. Mark and advised him who was at the scene of the shooti~g.
I directed Officer R. Brown and Officer R. Curtin to stay with Officer Masso while he was being treated inside of the hospital.
I provided scene security at Highland Hospital until relieved by Sgt. Mark.
I did not use any force or observe any officer use force.
I did not contact any witnesses.

On 06May12 at approx 0003Hrs I was working with Off. R. Brown 8967P. We were working as OPD patrol unit 3A30, wearing full police uniform and driving marked patrol vehicle #1819. We responded to the 9200 Blk of Birch St to assist Off. M. Masso 9059P who advised over the radio that he was involved in a shooting and signaled ~
We responded to the scene and I did not know if Off. M. Masso was still actively engaging the suspect In a gun fight. For this reason, I elected to deploy my service rifle in a slung position, in front of my body. I walked towards Off. M. Masso and observed him with his service pistol standing ifo a MB, laying on his back. I did not see the MB moving.
Once in the hospital, I stayed with Off. M. Masso until he was medically cleared.
At approx 0115 hrs, I contacted Sgt. J. Doolittle 8007P and advised him of a use of force that Off. R. Brown had. This was the earliest time that we could advise of the use of force because of the fact that we were helping an injured officer. See Off. Brown's supplemental

Narrative On 6 MAY 12, at about 0015 hrs., Ole. J. Jochim and I were working as OPD patr-5. We were wearing OPD police uniform and operating marked vehicle #1763 (Ole. J. Jochim was driving). Dispatch advised of BFO 2 at 90th Av and Olive St. Dispatch advised of shots fired. We were en-route--
Upon arrival, multiple OPD units and PMP already on scene. The scene appeared to be secured.
I was directed by Acting Sgt. B. Reed to note the vehicles that were parked on the 9200 block Birch St on the north side. I noted the following vehicles:
Later, I followed PMP with the suspect to Highland Hospital where Ole. J. Buna took over.
I did not witness any uses of force and had no uses of force during this incident.

On 06May12, at about 0010 hrs, I was working Oakland Police Department patrol unit 3L 14. I was wearing full police uniform and driving fully marked vehicle #1847. I responded to the area of 90th Ave and Birch St to assist Officer Needs Help call.
Upon arrival, I was tasked with scene security due to the large amount of people gathering in the area.
I then cleared the scene around 0040 hrs, to assist with the high volume of calls in the rest of the city.
I did not use any force and I did not witness any officer use force. No PDRD issued at this time.

"'''':~ as 2L 12, wearing full police uniform, and driving fully marked patrol vehicle #1739. I was assist units on an officer having been shot. On arrival, I was directed by Sgt. J. Doolittle to
a scene to look for any possible casings or other evidence.
While I was conducting the canvass, I was redirected by Nlt. Whehrly to follow Paramedics Plus #3166, which had a subject who had been shot, to Highland Hospital. I followed PMP to ACH without further incident. Once I got on scene, I was advised by Ole. M. Nguyen that Ole. Buna would be relieving us from the hospital.
I did not recover or locate any casings or other evidence while I conducted the canvass.
I did not use any force nor did I observe any officer use force on anyone while on scene.
No further investigative leads.

On 6 May 12, at approx. 0003 hours, I was working as OPD Patrol unit 2L26, wearing full police BDU uniform and operating from fully marked patrol car #1752. While at MacArthur Blvd and Pierson St. on an unrelated call, I heard another unit (2A3~vise that one of the officers was in foot pursuit of a subject. Moments later, Ole. Masso came on the air and advised "shots fired". A -was called, and I responded ~o the scene.
Upon my arrival, I put up crime scene tape at 92nd Ave and Birch on theN side of the intersection. I went over to the scene, where I observed a MB being given CPR by another officer, who I did not recognize. Shortly thereafter, OFD 2566 and PMP 3166 arrived on scene and began providing basic medical attention to the subject.
I went back to my car and to other arriving cars, attempting to gather statement forms. When I returned to the scene, I was directed by Sgt. J. Doolittle to stay with Ole. J. Fesmire, who is Ofc. Masso's partner. I stayed with Ole. Fesmire, later taking him back to the Eastman! substation and then to the PAB CID. While I was with Ofc. Fesmire, he did not discuss the incident with me or anyone else.
I did not contact any witnesses on scene.
PDRD not used as it had run out of battery due to heavy use earlier in my shift.
No use of force.

On 06MAY12 I was working as Oakland Police Department's (OPD) marked patrol unit 2A24 with OPD Ofc. J. Pulsipher 8920. We were wearing full OPD uniforms and driving in marked OPD patrol vehicle #1823. I was the right front passenger and Ole. Pulsipher was the driver.
At approximately 0005 hrs we responded to the area of 90th Ave and Olive Street to assist with an officer involved shooting.
Upon arrival we took a outer perimeter post in the area of 94th Ave and Olive Street. I used our patrol vehicle to block NB/SB vehicle traffic in the 1900 blk of 94th Ave.
I held my perimeter post until directed to break down the outer perimeter post at this location.

Sgt West directed me to provide extra security at the ACH emergency lot area. I maintained this positron unit I was advised to secure.
We were then directed to provide traffic control at Stewart Stand E 31st St blocking all E/B traffic. We remained there until advised to secure.

Narrative On 6 May 12, at about 0003hrs, I was working as 3L28, wearing full pollee uniform and driving marked patrol vehicle 1832. I responded code 3 to the. area of 9oth Av and Olive St to assist on the scene of an officer Involved sl1ooting. Upon arrival I took a perimeter position at 92nd Av and Olive St until units advised that the suspect was taken into custody and there was no further outstanding suspects.
I then responded to 92nd Av and Birch St where I was approached by Off Fesmire 8757 who gave me t11e key to his patrol vehicle (1750) and told me that he had two subjects detained In the back. Off Fesmire requested that I standby with the subjects.
Off H. Castro 8955 and I walked ove1· to Off Fesmire's patrol vehicle which was parked ln.-lth two male blacks in the rear. They were already handcuffed. These subjects verbally identified themselves'\ and Obelion, Ronell
Due to the ciJ·cutnstances that an officer had been shot with a firearm, and I belleve~nd Obelton were assosclated with the shooting suspect, I elec~earch for weapons of._, and Obelton. During this pat search I removed a lighter and small pocket knife flum , For officer safety reasons I also removed his cell phone. I also removecl two lighters from Obelion's pant pocket and his cell phone.
I tool< custody of Obelion and placed him IRO of my patrol vehicle. I advised Sgt's Doolittle 8007 and Mork.
At approx. 0120hrs, Sgt Sem (2L75) directed me to keep Obelton detained and tmnsport him to CID.
I transported Obelion to CID and placed him In interview room 2·11.
I used my PDRD during this 1ncident.
I didn't use or observe any UOF.
I located no known witnesses.

Narrative Summary: On Saturday, 05 May 12, I was working as the District 5 Supervisor, 3L75. I was in full police uniform, (wools), and driving fully marked OPD vehicle 1112. At about 2330 hours, Sgt.(s) R. Supriano, 3X74, T. West, 3L74, J. Doolittle, 3L76 and I were in a meeting with Lt. J. Meeks at the Eastman! Sub-station. At about 0003 hours, Sgt. Doolittle advised there was a po,:sible foot chase somewhere in BF02. I was approximately eight feet away from Sgt. Doolittle, but I did not hear i As Sgt. Doolittle stated this, I then "officer down".

The injured officer. M. Masso is in Sgt. Mork's squad. As I walked towards them, I observed an OPD officer administering CPR to a male black lying in the driveway of 9230 Birch St. I then asked Sgt. Doolittle what else needed to be done. Sgt. Doolittle was also speaking with Officer M. Lee, 3L34, and assigned her as the report writer. He then assign,ed other officers to various tasks, including ensuring perimeter posts were maintained, canvasses were begun, and witnesses identified. I then advised Sgt. Doolittle that a crime scene log needed to be maintained. Sgt. Doolittle briefed me on the incident and what led up to the DIS. He advised that Officers J. Fesmire and M. Masso observed three male black subjects in the area of 90th Ave. and Olive St. The three were standing in shadows and appeared to be handling a firearm. When the officers attempted to stop the three subjects, one of them fled on foot with officer Masso pursuing him. Officer Masso pursued the subject to the 9200 block of Birch St. where he had his use of force.

Narrative (Continued) Sgt. Doolittle advised the two other subjects with the suspect were detained by Officer Fesmire. Sgt. Doolittle asked me to ensure these two subjects were kept separated from each other. Sgt. Doolittle th~urtin and ask for an update on Officer Masso. I called and Officer Curtin advised Officer Masso sustaine d was in stable condition. I also asked Officer 1n o c ec on a hit and run victim from 98th Ave. and International Blvd. This incident happened shortly before the OIS. The unidentified pedestrian victim had been struck by a northbound car on 98th Ave. The suspect vehicle then continued northbound and hit another car. The suspect vehicle was disabled and the driver fled the scene on foot. Once the victim was transported to ACH by PMP, the officers there responded to the OIS. After ascertaining Officer Masso's and the pedestrian's conditions, I asked Sgt. Doolittle if there was anything else that needed to be done. He advised there was not and I cleared the scene at 0102 hours. I then responded to 98th Ave. and International Blvd to supervise the scene of the hit and run, Incident 120505001011. I did not witness any use of force, and did not have a use of force. PDRD was not activated as I did not contact any suspects, or have any investigative detentions. I did not contact or identify any witnesses.

Narrative Summary: On 6MAY12 at about 0003 hrs, I was working as OPD patrol unit 2A31 with Ofc. J. Snyder. We were w~~ full police uniform and I was driving fully marked police vehicle #1835. We responded to the 9200 block of Birch St. to assist with a We responde~ith the lights and siren activated.
Upon arrival, I assisted with scene security until I was directed by Sgt. T. Mork to secure a firearm which was located on the west side of 9230 Birch St. The firearm was in the center of the driveway with the muzzle facing westbound and the pistol grip facing northbound. The firearm appeared to be in battery and the magazine appeared to be seated. I examined the firearm and noted it was a Sig Arms, 9mm Kurz, serial: S157777.
I conducted a file check with dispatch on Service 2 which revealed no records found.
I advised Evidence Technician B. Christensen (8395) of the firearm.
I was relieved of my post by Ole. A. Nash.
I did not locate any witnesses.
I activated my PDRD.

While viewing the recorded footage, on 5 May 12, at approx. 2359 hrs., I observed a MB, wearing what appeared to be a black hoodie run northbound on 9oth Av., from Birch St. and then run eastbound on Olive St, through "Booker's" parking Jot holding his front waistband followed by an Officer approx. 10- 15 feet behind him. Both the MB subject and the Officer then runs out the camera's view.
Upon viewing the recorded footage I requested for a technician respond to our location·to retrieve the evidence. Tech. 8. Christensen. responded and tool< over the investigation at "Booker's"

On 06May12, approximately 0003 hrs, Ole. J. Garcia (8888P) and I were working OPD Patrol Unil2A34, wearing full police uniforms and I was driving fully marked patrol vehicle #1700.
I heard Ole. J. Fesmire advise he was located at 9oth Ave and Olive 81, and requested that his partner, Ole. M. Masso, give an update on his position. Dispatch began speaking about .another unrelated incident, until Ole. J. Fesmire requested the all· to be held and for Ole. M. Masso to give an update to his position.
Ole. M. Masso spoke up on the radio, and advised he was located at 92nd Ave and Birch St. Ole. M. Masso advised shots were fired on the radio,. Ole. J. Garcia and I responded to the 9200 Blk of Birct1 81, wllh red lights and sirens (Code 3).
Upon our arrival, Ole, supine on the sid•sw,,114. in providing first aid to the
on scene. I observed Ofc. C. Marie attempting to give first aid loan UNK MB that was I UNK MB's head was pointing NiB, and his feet were pointing 8/B. I assisted Oft. C. Marte
ground.
I observed there was bleeding on the front of tho UNK MB's upper torso. I observed a gunshot wound on the UNK MB's upper torso. I observed his eyes were open, he was unresponsive, and not breathing. I checked his pulse by placing my index finger and middle finger on l1is carotid artery, end I did not fool a pulse. I began chest compressions on the UNK MB, checl<ed his pulse, and continued chest compressions unlil paramedics arrived an scene .

Fong was driving fully marked OPD patrol vehicle #1766. We were dispatched to a call of an officer needing assistance in the 9200 block of Birch Street.
When I arrived on scene, I was contacted by OPD Sgt. Dooliltle who told me to obtain the license plates numbers of all of the vohioles on the south curb line of Birch St from 90th Ave to 94th Ave. Beginning at 90th and wall<ing east, the vehicles liocated are as follows:

On 6 May 2012 at about 0003 l1rs, I was working as OPD patrol unit 2A24 with my partner OF c. J. Romero. We were both riding In fully marked OPD patrol car 1823 and wearing full OPD patrol uniform.
At about 0005 hrs, we responded to area of 9oth Ave and Olive St. to assist with and officer Involved shooting.
Upon arrival we took an outer perimeter post at 94th Ave and Olive St. Ole. Romero remained with our patrol car and block NIB and SIB vehicle traffic.
I responded to the 9200 blk of Birch to meet with Sgt. Doolittle. I was directed to begin canvassing:

Narrative Today's date at 0009 hours, I was working as patrol supervisor 3L74. I responded to ACH in response to an officer involved shooting to meet with an injured involved officer who was being transported y patrol car.
As I arrived, 3A30 (Ofcs Curtain and Brown) were arriving w.lf of 2A33 (Ofc. Masso). I followed them to the trauma room and it appeared that Ofc. Masso was suffering from a GSW to the As the medical staff removed Ofc. Masso's uniform, firearm and safety equipment, I collected them and took them to my patro venicle (#1043) and placed them in the trunk.
Sgt. Tisdell (2L74) and I coordinated the scene at the hospital and insured that Ofc. Masso's . Ofc's Curtain and Brown were ordered to stay with Ofc. Masso until they were relieved.
OPD Evidence Technician P. Yager (2C64) arrived on scene at ACH. Tech Yager photographed the items collected and I released them to him with the exception of Ofc. Masso's PDRD, wallet and .....
I released the PDRD to Sgt. Donelan when he arrived on scene at approximately 0340 hours. I released the wallet and- to Ofc. Masso's supervisor, Sgt. Mork (2L 76) upon his arrival at the hospital.
Once Sgt. Mork confirmed he did not require any further assistance, I cleared the scene.

Narrative Summary:
On 06 May 2012, at approx 0003 hrs, I was working as OPD patrol unit 3A30, along with Ole. R. Curtin 8973P. We were wearing full police uniforms and Ole. Curtin was driving marked patrol vehicle #1819. We were on a vehicle stop on 77th Ave, South of Macarthur Blvd. We heard Ole. Fesmire come over the radio and ask for his partner to-date his location. We knew by the sound of his voice that the Ofc's were possibly in danger. We broke our vehicle stop and responde to the area of 90th and Birch St. Ole. Masso later came on the radio and advised that he was in an officer involved shooting in the 00 blk of Birch St. Upon our arrival, the following transpired. l • · f '
Ole. Curtin parked our vehicle approx 15ft, West of Ole. M. Masso's location. Ole. Masso was on the North side of the street, in the 9200 blk of Birch St. :•. '
I exited my vehicle and ran to Ole. Masso's location with my duty AR-15 patrol rifle. I noticed that Ole. Masso had his gun pointed at a MB that was lying face up on the sidewalk. I pointed my patrol rifle at the suspect because I did not know if he was still armed or not. I also wanted to provide cover for Ole. Masso. I noticed that the MB was not 'moving.
I asked Ole. Masso if he was ok and he stated that he had been shot in the leg. I advised over the radio that Ole. Masso was shot and asked for code three medical. ""'' .~i
Ole. Curtin escorted Ole. Masso towards our patrol vehicle and we decided to self transport Ole. Masso to ACH instead of waiting for the ambulance.

ON 6 MAY 12, I WAS WORKING AS UNIT 3L76, THE SUPERVISOR FOR DISTRICT 6 PATROL UNITS. I WORE FULL OPD WOOL UNIFORM AND I DROVE FULLY MARKED OPD VEH 1041. AT ABOUT0003 HOURS, I WAS IN A MEETING WITH LT MEEKs AND SGTS WEST, SUPRIANO, PORRITT AND ENCINIAS AT THE EASTMONT MALL WHEN I HEARD A FOOT PURSUIT ON ASKED WHAT WAS HAPPENING AND THEN I HEARD OFFICERS BROADCAST THAT SHOTS HAD BEEN FIRED AND WAS DECLARED. I DROVE TOWARDS THE AREA AND I HEARD THAT AN OFFICER HAD ALSO BEEN SHOT. I HEARD OFFICEI'S BROWN AND CURTIN HAD IMMEDIATELY TRANSPORTED THAT OFFICER (I LATER LEARNED THAT IT WAS OFFICER MASSO) TO ACH AND HAD LEFT THE SCENE.
I RESPONDED CODE 3 AND HEARD SGT MORK SET UP A PERIMETER. I ENSURED THAT 90TH AVIBIRCH STREET WAS COVERED BY A UNIT, THEN PARKED MY CAR IN THE 9100 BLK OF BIRCH. I SAW OFFICERS FESMIRE AND CASTRO NEAR 92ND AVIBIRCH STAND ASKED WHAT HAD HAPPENED. OFFICER FESMIRE TOLD ME THAT HE AND HIS PARTNER, OFFICER MASSO HAD DONE A WALKING STOP ON 90TH AVON 3 PERSONS, THAT HE WAS DETAINING 2 OF THEM AND THAT OFFICER MASSO HAD CHASED A THIRD. HE SAID THAT THEY ENDED UP FURTHER EAST, ON BIRCH. I TOLD OFFICER CASTRO TO REMAIN WITH OFFICER FESMIRE AND TO ENSURE THE SAFETY OF THE TWO DETAINEES. CASTRO SAID THAT HE WAS FIRST GOING TO SEARCH THE DETAINEES AND SEPARATE THEM SINCE ONE OF THE ORIGINAL GROUP WAS ARMED WITH A FIREARM.
I WALKED FURTHER EASTBOUND AND MET WITH SGT MORK. I SAW OFFICERS LEE AND NASH ON SCENE. LASSIG NED OFFICER LEE TO BE THE REPORT WRITER. I HAD NASH ASSIST HER IN COLLECTING AND ORGANIZING DOCUMENTS AND TRACKING THE OFFICERS ON SCENE. I ASSIGNED OFFICER PULLEN TO ORGANIZE A LIST OF ALL PERSONS DETAINED AND INTERVIEWED THAT WOULD BE GOING TO THE PAB FOR INTERVIEW. I ASSIGNED OFFICERS TO RECORD ALL LICENSE PLATES OF VEHICLES PARKED ON THE STREET. I HAD TWO OFFICERS RESPOND TO EASTMONT AND RUN CRIMINAL HISTORY ON THE TWO DETAINED PEF~SONS.

I HAD OFFICERS WALK FROM THE STARTING POINT, IFO '1931 90TH AV ALONG THE PATI-1 OF FLIGHT THAT THE SUSPECT AND OFFICER MASSO WERE REPORTED TO HAVE TRAVELLED. THEY DID NOT DIRECT ME TO ANY ITEMS OF EVIDENTIARY VALUE.

On today's date, 06 May 12, I was working as OPD patrol unit 2A27 with Ofc. D. Pullen 8854P. We were wearing a full police uniform and I was the driver of our fully marked police vel1icle #1722. At approximately 003 hrs, we responded to the area of 90th Ave and Olive Street to assist other officers investigate a report of an officer involved shooting.

On 6May12 at about 0003hrs, I was working with OfcA Manguy 8717P as OPD Patrol Unit 2A34, Wo were both wearing full Police uniforms and Ole Manguy was driving OPD Patrol car ·[700. I heard Ofc ,J Fesmire (2A33) advise over the radio "Code 33"
I heard Sgt T Mark declare
Ofc M Masso advised til at he was in the 9200 block of Birch St and stated that shots were fired.
Ole Manguy and I responded In "Code 3" (lights and siren) status.
Upon our arrival (about 0008hrs), I obse1ved a male Black In tho supine position in the drive way of 9230 Birch St. The male appeared to be unresponsive.
I noticed that there were other Officers on scene. I spoke to Officer Fesmire who directed me to 1923 and 1931 9oth Ave to conduct a seat·ch of the front yards for evidence. Ole Fesmire told me that tho walldng stop (on three) had started In front of the above location and the subjects. I was mot with negative results for weapons and narcotics.

I was directed by Sgt. J. Doolittle to retrace the I'Oute that Ofc. M. Masso ·followed when he chased after the suspect. I relraced and searched the route. I walked NiB on the 1900 blk of 9oth Ave to Cilerry St. I walked E/B on Cherry St, along the south sidewalk, I walked SiB on 92nd /'we, on both the east and the west sidewalks. I walked E/B on the 9200 blk of BlrcilSt on tho north sidewalk. I did nollocate any further evidence during my search of the route.
