NOTICE OF OPPOSITION In the matter of the application of Exxon Mobil Corporation (hereinafter referred to as the

“Applicant”), for registration of the mark INFOCUS (“Applicant’s Mark”), U.S. Application No.

88/620,252 (“the Application”), published in the Trademark Official Gazette on January 28, 2020, InFocus

Corporation (hereinafter “Opposer”), a corporation organized and existing under the laws of the State of

Oregon, with a business address at 13190 SW 68th Parkway, Suite 120, Portland, Oregon 97223, believes

it will be damaged by registration of the Applicant’s Mark, and hereby opposes registration.

Opposer timely filed 90-day extension of time and consented 60-day extension of time to file an

opposition and this Notice of Opposition is filed within the extension period.

The grounds for Opposition are as follows:

1. Opposer is a corporation organized and existing under the laws of the State of Oregon, with

a business address at 13120 SW 68th Parkway, Portland, Oregon 97223.

2. Opposer has been and continues to be engaged in the business of manufacturing and selling

software and other technology products and services related to a number of technology fields, including

audiovisual communication, networking, and interactive conferencing solutions, and related hardware and


accessories, throughout the United States and abroad under the mark INFOCUS and variants thereof in

the United States and abroad.

3. Since at least as early as 1988, Opposer has used and continues to use in interstate

commerce the mark INFOCUS as its primary house mark. Opposer further has developed and used a

family of INFOCUS variants, including but not limited to INFOCUS THUNDER, INFOCUS

LIGHTCAST and (the “INFOCUS Marks”), among its other marks, to identify and

distinguish Opposer’s goods and services.

4. Among its registrations, Opposer owns the following United States trademark registrations

for its family of INFOCUS Marks. A printout of the current TSDR database records and registration

certificates for the below registrations are annexed hereto as Exhibit A.

5. Through use of the INFOCUS Marks, in the United States and abroad, Opposer has accrued

common law rights for the INFOCUS Marks, including common law rights in relation to software and

software applications and other related goods and services.

6. Opposer has used and continues to use the INFOCUS Marks and its variants, and the goods

and services in connection therewith have been popular and the subject of significant advertising and

promotional activities over the years.

7. Opposer’s use of the INFOCUS Marks has been valid and continuous since at least as early

as the dates of Opposer’s first use, and Opposer has not abandoned the INFOCUS Marks. Opposer’s

INFOCUS Marks are symbolic of extensive goodwill and consumer recognition built up by Opposer

through substantial amounts of time and effort in use, advertising, and promotion. Opposer’s INFOCUS

Marks identify and distinguish Opposer’s goods and services from the goods and services of others, and

identify the source and origin thereof, both in industry circles and to the public.

8. Opposer’s INFOCUS Marks are distinctive and famous as that term is defined under 15

U.S.C. §1125, and became famous long prior to September 17, 2019, the date on which Applicant filed its

intent-to-use application No. 88/620,252 for the mark INFOCUS.

9. Opposer’s INFOCUS Marks became famous prior to Applicant’s use, if any, of the mark

INFOCUS.

10. Notwithstanding Opposer’s rights in and to the INFOCUS Marks, Applicant, on September

17, 2019, filed Application Ser. No. 88/620,252 shown in the chart below for registration of the mark


INFOCUS in class 9. The application was filed and remains based on an allegation of intention to use under

section 1(b) of the Trademark Act. The application was published in the Trademark Official Gazette on

January 28, 2020 for the goods below, in International Class 9.

14. Applicant’s claimed first use dates will be subsequent to all of Opposer’s first use dates,

including dates at least as early as Feb. 2002 for Opposer’s INFOCUS mark in connection with software.

15. Applicant’s first use dates will also be subsequent to Opposer’s filing dates for all the

INFOCUS Marks, including for Opposer’s registered INFOCUS, IN FOCUS, and marks.

16. Applicant’s first use dates will also be subsequent to the date upon which Opposer’s

INFOCUS Marks became famous.

17. Applicant’s use of INFOCUS, if and when it commences, will dilute Opposer’s famous

INFOCUS Marks.

18. Applicant’s INFOCUS mark is identical to Opposer’s INFOCUS mark, and highly similar

to the other INFOCUS Marks, such that consumers are likely to be confused between the marks.


19. Applicant’s recited goods are overlapping with, complementary to, and /or similar to the

goods and services offered by Opposer under Opposer’s senior INFOCUS Marks, including goods and

services provided under Opposer’s registered INFOCUS, IN FOCUS and marks, and

goods and services in connection with which Opposer has accrued common law rights.

20. Applicant’s trade channels and consumer audience are likely to be similar to and/or

overlapping with the trade channels and consumer audience for Opposer’s goods and services sold and/or

provided under Opposer’s INFOCUS Marks.

21. Applicant’s Mark, when used in connection with the goods and services set forth in its

application, is confusingly similar to Opposer’s use of its INFOCUS Marks. Consumers will likely be

confused as to the source of any goods and services offered by Applicant under Applicant’s Mark, due to

Opposer’s senior use of INFOCUS and registration for Opposer’s INFOCUS Marks for the goods and

services provided under the INFOCUS Marks.

22. Registration of Applicant’s Mark for the applied-for goods in the U.S. is likely to cause

confusion, mistake, or deception among consumers. Registration of Applicant’s Mark is also likely to

damage the goodwill and consumer recognition that Opposer has built up in its INFOCUS Marks.

23. Registration of Applicant’s Mark for the applied-for goods in the U.S. is also likely to

dilute Opposer’s distinctive and famous INFOCUS Marks, in violation of Section 43 (c) of the Trademark

Act. Specifically, Opposer claims that (1) it owns famous marks, the INFOCUS Marks, that are distinctive,

(2) that the Applicant’s use of its applied-for mark (if any) in commerce will dilute Opposer’s famous

INFOCUS Marks, (3) that Applicant’s use of its applied-for mark (if any) will begin after Opposer’s

INFOCUS Marks became famous, and (4) that Applicant’s use of its applied-for mark (if any) is likely to

cause dilution by blurring or by tarnishment.

WHEREFORE, for the reasons set forth above, Opposer believes that it will be damaged by

registration of Applicant’s Mark in Ser. No. 88/620,252 and prays that registration be denied.


Opposer authorizes the Commissioner for Trademarks to charge the fee for filing this Notice of

Opposition, or any other additional fees that may be due, to Deposit Account 601570.
