In accordance with Article III, Section 3.10, of the Official Code of the City of Buda, the minutes of this meeting consist of the preceding MinuteRecord and the Supplemental Minute Record. The City Council may retire to executive session any time between the meeting’s opening and adjournment for the purpose of consultation withlegal counsel pursuant to Chapter 551.071 of the Texas Government Code; discussion of personnel matters pursuant to Chapter 551.074 of theTexas Government Code; deliberation regarding real property pursuant to Chapter 551.072 of the Texas Government Code; deliberation regardingeconomic development negotiations pursuant to Chapter 551.087 of the Texas Government Code; and/or deliberation regarding the deployment,or specific occasions for implementation of security personnel or devices pursuant to Chapter 551.076 of the Texas Government Code. Action, ifany, will be taken in open session.

This agenda has been reviewed and approved by the City’s legal counsel and the presence of any subject in any Executive Session portion of theagenda constitutes a written interpretation of Texas Government Code Chapter 551 by legal counsel for the governmental body and constitutesan opinion by the attorney that the items discussed therein may be legally discussed in the closed portion of the meeting considering availableopinions of a court of record and opinions of the Texas Attorney General known to the attorney. This provision has been added to this agenda withthe intent to meet all elements necessary to satisfy Texas Government Code Chapter 551.144(c) and the meeting is conducted by all participantsin reliance on this opinion.

1. Background/History The City Council ordered the November 8, 2016 City Council Election on August16, 2016 per Resolution #2016-R-20.

2. Findings/Current Activity The city contracts for its elections with Hays County. Hays County provides earlyvoting dates, polling locations, and election workers. Early voting began October24th and ended November 4th. City Hall was an early voting polling place onTuesday, November 1st through and Friday, November 4th as well as the mainpolling location on Election Day, November 8th.

The election returns must be reviewed and canvassed by the Council. Thecanvass must be conducted at an open meeting between Wednesday,November 16th and Tuesday, November 22nd. Only two officers are needed fora quorum for a canvassing meeting (E.C. 67.004(a)).

Once the returns are canvassed, the post-election procedures maybeconducted. The Runoff Election maybe ordered between November 16ththrough November 28th. A runoff candidate has until the 3rd day after thecanvass of returns to withdraw from the runoff election.

RESOLUTION #2016-R-__ AN ORDER CANVASSING RETURNS OF A GENERAL ELECTION HELD FOR THE PURPOSE OF ELECTING CANDIDATES TO THE OFFICE OF THE CITY COUNCIL OF THE CITY OF BUDA, TEXAS, FOR AN ELECTION HAVING BEEN HELD ON NOVEMBER 8, 2016; DECLARING RESULTS OF THAT ELECTION; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE

WHEREAS, pursuant to Resolution No. 2016-R-20 of the City of Buda, Texas, adopted on the 16th day of August, 2016, an election was duly held on the 8th day of November, 2016, for the purpose of voting on a City Council Member Place One and a City Council Member Place Two; and

WHEREAS, said election was held with the solemnities and formalities necessary to make it a valid election,

all notices having been posted in the manner and for the length of time required by law; and WHEREAS, only duly qualified resident voters of the City of Buda, Texas, voted at the General Election called

and held on 8th day of November, 2016; and WHEREAS, section 67.003 of the Texas Election Code, as amended, generally provides that each local

canvassing authority shall not convene earlier than the eighth (8th) day or not later than the eleventh (11th) day after the November election date for the purpose of canvassing the election results; and

WHEREAS, section 67.004(a) of the Texas Election Code, as amended, establishes the quorum level required

to canvass election results; and WHEREAS, a quorum of the City Council met on Thursday, November 17, 2016, and duly canvassed the

election returns of the above mentioned election, hereby attached as Exhibit “A”. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BUDA, TEXAS: Section 1. The findings set forth above are incorporated into the body of this resolution as if fully set forth herein.

Section 2. That the City Council officially finds and determines an election was duly ordered to be held in the City of Buda, Texas on the 8th day of November, 2016, for the purpose of electing a City Council Member from Place One and a City Council Member from Place Two to three (3) year terms of office; that proper notice of said election was duly given; that proper election officers were duly appointed prior to said election; that said election has been made and delivered; and that the City Council has duly canvassed said returns all in accordance with law. Section 3. That the City Council officially finds and determines that only qualified resident voters of the City were allowed to vote at said election, and following votes were cast at said election, and that the canvass of the votes cast in said election and returns thereof, which is attached hereto as Exhibit “A”, were made in accordance with the law.

Section 4. Pursuant to the applicable provisions of the Texas Local Government Code, Texas Election Code, and the City of Buda, Texas Home-Rule Charter, the City Council officially finds and determines and declares the results of said election to be that:

(1) That no candidate for the position of City Council Member for Place One received a majority of votes cast and a runoff election is hereby ordered for December 13, 2016 between Lee Urbanovsky and John Hatch;

(2) Wiley Hopkins is elected Council Member for Place Two to a three (3) year term of

office by majority vote of the voters; Section 5. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this Order are severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation of this Order of any such unconstitutional phrase, clause, sentence, paragraph or section. Section 6. This Order shall be effective immediately upon its passage. DULY PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF BUDA, TEXAS ON THE 21st DAY OF NOVEMBER, 2016.

1. Background/History The Resolution ordering the Runoff Election is a routine action required by theElection Code 3.005(a) to set the date of the runoff election and place for earlyvoting. A runoff election may be ordered no less than 20 or more that 45 daysafter canvassing of the votes. The canvass was held on November 21, 2016;therefore, the runoff will be held on December 13, 2016.

2. Findings/Current Activity The Runoff Election will be conducted to fill a full term for Place 1.

The city contracts with Hays County to conduct the election. The City Councilvotes on the early voting schedule and polling locations which will be held at CityHall in the Council Chambers.

Since the presentation to Council on November 15, 2016, the early vote datescheduled for Saturday, December 3rd is scheduled to be conducted at thesame time as the BudaFest Event. Several concerns have been raisedregarding the time and possible conflicts with the attendees of the event, paraderoute, and available parking for both attendees and voters. The event will beheld in the green belt close to the Library; however, attendees utilize the north 11

parking lot which is adjacent to the entrance of the early voting polling location. One solution is to designate "voter only parking" in the area. Another solution isto move the early voting to Tom Green Elementary.

3. Financial Impact The total 2016 election budget is $8,800.00. Of that amount, we have budgeted$3,000.00 for the runoff election.

4. Action Options/Recommendation Staff seeks Council's consideration to adopt the Resolution ordering the RunoffElection on December 13, 2016 and consideration regarding the location forearly voting on Saturday, December 3rd.

RESOLUTION NO. 2016-R-__

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BUDA, TEXAS ORDERING A RUNOFF ELECTION TO BE HELD IN THE CITY OF BUDA, TEXAS, ON TUESDAY, DECEMBER 13, 2016 FOR THE PURPOSES OF ELECTING ONE CITY COUNCILMEMBER FOR PLACE ONE BY THE QUALIFIED VOTERS OF THE CITY OF BUDA; ESTABLISHING AN EARLY VOTING LOCATION AND POLLING PLACE FOR THIS ELECTION; AND MAKING PROVISIONS FOR THE CONDUCT OF THE ELECTION

WHEREAS, the City of Buda (“hereinafter “City”), has found a necessity under the Charter of the City of

Buda, Texas and the laws of the State of Texas to hold a runoff election to fill the position of Councilmember, Places 1; and

WHEREAS, the Texas Election Code places a legal duty upon the City to call the election by order; and WHEREAS, the City’s Charter requires a runoff election to be called and the City has chosen to call the

runoff election by resolution; and WHEREAS, the City Council of the City finds that approving a runoff election in this instance is in the

best interest of the public and the City and hereby authorizes the execution, delivery, approval or acceptance, as applicable, of the documents referenced herein; and

WHEREAS, the City will hold a runoff election on December 13, 2015 to fill the position of

Councilmember, Places 1, for a term ending November 2019, to be elected by a majority of those votes cast;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BUDA, TEXAS THAT: Section 1. RECITALS. The recitals set forth in the preamble hereof is incorporated herein and shall have the same

force and effect as if set forth in this Section. Capitalized terms used herein shall have the meaning assigned in the preamble hereof, unless otherwise defined.

Section 2. CALLING OF A RUNOFF MUNICIPAL ELECTION. A runoff election will be held on the 13th day of December, 2016, in the City of Buda, Texas,

for the purpose of electing a regular City officer as listed below:

a. one (1) City Councilmember be elected for Place 1 by a majority of those votes cast; and Section 3. ELECTION, ELECTION DATE, POLLING PLACES, AND ELECTION JUDGES.

Election. The City is located in Hays County and therefore the Hays County Elections Administrator is conducting the election pursuant to an election agreement (the "Election Agreement") between the City and Hays County as authorized under Section 31.092 of the Texas Election Code.

Election Date. An election shall be held in the City as prescribed by applicable law between the hours of 7:00 A.M. and 7:00 P.M. on December 13, 2016.

Precinct and Polling Place. The City election precinct and polling place will be located at the City of Buda, City Hall, 121 Main Street, Buda, Texas. Hays County's election equipment shall be used to conduct the election.

Election Judges. The election judges shall be appointed in accordance with the Election

Agreement and the Texas Election Code, as amended. The Hays County Elections Administrator is conducting such election for the City pursuant to

the terms of the Election Agreement. The City Council hereby appoints, for the term of such election, the presiding election judge(s) and alternate election judge(s) as being those designated by the Hays County Elections Administrator.

Section 2. ELECTION CLERK. Unless otherwise directed by the County, the Presiding Judge shall appoint not less than two

nor more than five resident qualified electors of the City to act as clerks to properly conduct the election. However, if the Presiding Judge appointed actually serves, the Alternate Presiding Judge shall serve as one of the clerks. The appointment of such clerks must include a person fluent in the Spanish language to serve as a clerk to render oral aid in the Spanish language to any voter desiring such aid at the polls on election day. In the absence of the Presiding Judge, the Alternate Presiding Judge shall perform the duties of the Presiding Judge.

Section 3. EARLY VOTING. Dates, Times, and Places for Early Voting. Early voting in the election by personal

appearance shall be conducted at the dates, times, and polling places as follows:

Early Voting Clerk. The City Council hereby appoints the Hays County Elections Administrator as the City of Buda Election Officer and Early Voting Clerk. The Early Voting Clerk's mailing address to which applications for ballots by mail may be sent is as follows:

Applications for ballots by mail for must be received by 5:00 p.m. on December 2, 2016 in

accordance with law. Section 4. EARLY VOTING BALLOT BOARDS. The early voting ballot board is hereby created to process early voting results, and the

Presiding Judge of the board will be appointed by the Hays County Elections Administrator. The Presiding Judge shall appoint not less than two nor more than eighteen resident qualified electors to serve as members of the Early Voting Ballot Board.

Section 5. VOTERS. All resident, qualified electors of the City of Buda, Texas, shall be entitled to vote at the

election. Section 6. CUSTODIAN OF ELECTION RECORDS. The Hays County Elections Administrator shall serve as the custodian of voted ballots, and

the City Secretary of Buda, Texas, shall be appointed as custodian of all other election records.

Section 7. NOTICE. Posting. A copy of this Ordinance, with such omissions authorized by law, shall serve as a

proper notice of the election. Such notice, including a Spanish translation thereof, shall be posted on the bulletin board used by the City to post notices of meetings and at City Hall not less than twenty-one (21) days prior to the date the election is to be held, and shall remain posted through election day. In addition to the forgoing, this Ordinance, including a Spanish translation thereof, shall be (i) posted on election day and during early voting by personal appearance in a prominent location at each polling place; (ii) posted in three (3) public places in the boundaries of the City no later than twenty-one (21) days before the election; and (iii) posted on the City's Internet website during the twenty-one (21) days before the election, if the City maintains an Internet website.

Publication. A copy of this Ordinance, with such omissions allowed by law, shall serve as a

proper notice of the election. Such notice, including a Spanish translation thereof, shall be published in The Hays Free Press, a newspaper of general circulation in the City, occurring not earlier than the thirtieth (30th) day or later than the tenth (10th) day prior to the day of the election.

Authorization to City Secretary. The City Secretary is hereby authorized and directed to

publish and post the required notices in the manner and for the time periods required by law.

Section 8. VOTING DEVICES. Electronic optical scan voting devices may be used in conducting the election. The Hays

County Elections Administrator may also utilize a central counting station as provided by Section 127.000 et seq., as amended, Texas Election Code. Any central counting station presiding judge and the alternate presiding judge shall be appointed in accordance with the Election Agreement and the Texas Election Code. The Hays County Elections Administrator is currently using election systems and software certified by the Texas Secretary of State.

The City Council of the City of Buda, Texas, finds as follows: Section 61.012, Texas Election Code, requires that at least one accessible voting station

must be provided in each polling place used in a Texas election. Such system must comply with state and federal laws setting the requirements for voting systems that (i) fully comply with applicable laws relating to accessible voting systems which make voting accessible for disabled voters; and (ii) provide a practical and effective means for voters with physical disabilities to cast a secret ballot. The Office of the Texas Secretary of State has certified that the DRE - Election Systems and Software iVotronic is an accessible voting system that may legally be used in Texas elections.

Sections 123.032 and 123.035, Texas Election Code, authorize the acquisition of voting

systems by local political subdivisions and further mandate certain minimum requirements for contracts relating to the acquisition of such voting systems. As chief elections officer for the City of Buda, the Hays County Elections Administrator shall provide at least one DRE - Election Systems and Software iVotronic in each polling place at every polling location used to conduct any election. The DRE - Election Systems and Software iVotronic may be acquired by any legal means available to the City of Buda, including but not limited to lease or rental from Hays County or from any other legal source, as authorized or required by Sections 123.032 and 123.035 of the Texas Election Code.

UNA RESOLUCIÓN DE LA CIUDAD DE BUDA, TEXAS ORDENAR UNA SEGUNDA VUELTA ELECTORAL QUE SE CELEBRARÁ EN LA CIUDAD DE BUDA, TEXAS, EL MARTES, 13 DE DICIEMBRE 2016 PARA EL PROPÓSITO DE ELEGIR UN OFICIAL DE LA CIUDAD PARA PUESTO UNO DEL CONCEJO; Y EL ESTABLECIMIENTO DE UN CENTRO DE VOTACIÓN ANTICIPADA Y LUGAR DE VOTACIÓN PARA ESTA ELECCIÓN; Y HACIENDO DISPOSICIONES PARA LA CONDUCTA DE DICHAS ELECCIONES

EN TANTO QUE, la Ciudad de Buda ( adelante " Ciudad" ), ha encontrado una necesidad bajo la virtud de la Carta de la Ciudad de Buda, Texas y las leyes del Estado de Texas para celebrar la segunda vuelta electoral para de elegir un oficial de la ciudad para Puesto Uno del concejo; y

EN TANTO QUE, el Código Electoral de Texas pone un deber legal sobre la Ciudad de ordinar a la elección por orden; y

EN TANTO QUE, Carta de la Ciudad requiere una elección general a ser llamado y la Ciudad ha optado por llamar a la segunda vuelta electoral por medio de una resolución; y

EN TANTO QUE, el Consejo de la Ciudad considera que la aprobación de una segunda vuelta electoral en este caso es en el mejor interés del público y de la Ciudad y autoriza la ejecución, entrega, aprobación o aceptación, en su caso, de los documentos mencionados en este documento; y

EN TANTO QUE, la Ciudad va a celebrar elecciones generales el 13 de diciembre 2016 para elegir un oficial de la ciudad para Puesto Uno del concejo, por un período que termina noviembre 2019, que serán elegidos por una mayoría de los votos emitidos;

POR LO TANTO, EL CONSEJO DE LA CIUDAD DE BUDA, TEXAS DECRETA:

Sección 1. RECITALES.

Los considerandos establecidos en el preámbulo del presente documento se incorporan aquí y tendrán la misma fuerza y efecto que si se establece en la presente sección. Los términos mayúsculos utilizados en este documento tendrán el significado asignado en el preámbulo de este documento, a menos que se defina lo contrario.

Sección 2. LLAMADA DE UNA SEGUNDA VUELTA ELECTORAL.

Las segundas vueltas electorales se llevarán a cabo el día 13 de diciembre de 2016, en la ciudad de Buda, Texas, con el propósito de elegir a un oficial regular de la Ciudad que se enumeran a continuación:

a. un (1) Miembro del Concejo de la ciudad elegida para el Puesto 1 por mayoría de los votos emitidos.

Sección 3. ELECCIÓN CONJUNTA, FECHA DE LA ELECCIÓN, CASILLAS ELECTORALES, Y JUECES ELECTORALES.

Elección. La ciudad se encuentra en el condado de Hays y por lo tanto el Administrador de Elecciones del Condado de Hays está llevando a cabo la elección por virtud de un acuerdo de elección (el "Contrato de Elección") entre la Ciudad y el Condado de Hays autorizado bajo la Sección 31.092 del Código Electoral de Texas. 18

Fecha de Elección. Una elección se celebrará en la Ciudad según lo prescrito por la ley aplicable entre las horas de 7:00 de la mañana y 7:00 de la tarde el 13 de diciembre de 2016.

Precintos y Centros de Votación. Los precintos electorales de la Ciudad y los lugares de votación dentro de la Ciudad en City Hall, 121 Main Street, Buda, Texas. Equipo electoral del Condado de Hays se utilizará para llevar a cabo la elección.

Jueces Electorales. Los jueces electorales serán nombrados de conformidad con el Acuerdo de Elecciones y el Código Electoral de Texas, según enmendada.

El Administrador de Elecciones del Condado de Hays está llevando a cabo dicha elección para la Ciudad de conformidad con los términos del Acuerdo de Elección. La Ciudad presente designa, por el término de dicha elección, el presidente del tribunal electoral(s) y el juez electoral alternativo(s) como los designados por el Administrador de Elecciones del Condado de Hays.

Sección 2. SECRETARIA ELECTORAL.

A menos que se indique lo contrario por el Condado, el Juez Presidente designará a no menos de dos ni más de cinco electores calificados residentes de la Ciudad para que actúen como empleados para llevar a cabo adecuadamente la elección. Sin embargo, si el Juez Presidente designado sirve, el Juez Presidente Alterno actuará como uno de los empleados. La designación de estos empleados debe incluir una persona que domine el idioma español para prestar ayuda oral en el idioma español a cualquier votante que solicite este tipo de ayudas en las urnas el día de las elecciones. En ausencia del Juez Presidente, el Juez Presidente Alterno desempeñará las funciones del Juez Presidente.

Secretario de votación anticipada. El Consejo designa la Administrador de Elecciones del Condado de Hays como encargado Oficial de Elecciones de la Ciudad y de votación anticipada. La dirección postal del Oficial de votación anticipada para las solicitudes de boletas por correo es el siguiente:

Sección 4. JUNTA DE VOTACIÓN ANTICIPADA.

El consejo de boletas de votación anticipada se crea para procesar los resultados de votación anticipada, y el Juez Presidente de la Junta será nombrado por el Administrador de Elecciones del Condado de Hays. Además de lo anterior, la presente Ordenanza, incluyendo una traducción al español de la misma, deberá ser (i) publicados, el día de las elecciones y durante la votación anticipada en persona en un lugar visible en cada centro de votación ; (ii) publicado en tres (3) lugares públicos en los límites de la ciudad a más tardar veintiún (21) días antes de la elección ; y (iii) en el sitio web de Internet de la Ciudad durante la veintiún (21) días antes de la elección si la Ciudad mantiene un sitio de Internet .

Publicación. Una copia de la presente Ordenanza, con tales omisiones permitidos por la ley, servirá de aviso apropiado de la elección. Dicha notificación, incluyendo una traducción al español de la misma, se publicará en el Hays Free Press, un periódico de circulación general en la Ciudad, un publicación que ocurre no antes del trigésimo (30th) día o más tardar el décimo (10th) día antes del día de la elección.

Autorización al Secretario de la Ciudad. La Secretaria de la Ciudad se autoriza y ordena publicar y publicar los avisos requeridos en la forma y para los períodos de tiempo requeridos por la ley.

Sección 8. DISPOSITIVOS DE VOTO.

Dispositivos de votación de escaneo óptico electrónicos pueden ser utilizados en la realización de las elecciones. El Administrador de Elecciones del Condado de Hays también puede utilizar una estación de conteo central a lo dispuesto por la Sección 127.000 et seq., en su forma enmendada, el Código Electoral de Texas . Cualquier estación central de conteo juez presidente y el presidente del tribunal suplente será nombrado de conformidad con el Acuerdo de Elecciones y el Código Electoral de Texas. El Administrador de Elecciones del Condado de Hays está utilizando actualmente los sistemas electorales y de software certificadas por el Secretario de Estado de Texas.

El Consejo Municipal de la Ciudad de Buda, Texas, se encuentra de la siguiente manera:
