MINUTES NEW COUNCIL CHAMBERS IN THE CIVIC COMPLEX

MARCH 6, 2018 The Regular Meeting of the City Council of the City of East Peoria, Illinois was called to order by his Honor Mayor David Mingus presiding at 6:00 P.M. with proper notice having been given. Upon the roll being called the following answered present: Mayor David W. Mingus, Commissioner Daniel S. Decker, Commissioner Timothy J. Jeffers, and Commissioner John P. Kahl. Absent: None. The invocation was given by Commissioner Jeffers. Mayor Mingus led the Council and the audience in the pledge of allegiance to the flag. Motion by Commissioner Kahl, seconded by Commissioner Decker; Mr. Mayor, I move that the minutes of the Regular Meeting held on February 20, 2018 be approved as printed. Yeas: Commissioner Decker, Jeffers, Kahl and Mayor Mingus. Nays: None. Mayor Mingus declared the motion carried. Commissioner Decker and Director of Planning and Community Development, Ty Livingston, discussed the code amendment. Yeas: Commissioners Decker, Jeffers, Kahl and Mayor Mingus. Nays: None. Mayor Mingus declared the motion carried. Resolution No. 1718-118 by Commissioner Decker; WHEREAS, Shawn Naylor, Greg Zook, Steve Martin and Roger Wilsdorf all served as City of East Peoria police officers; and

WHEREAS, at varying times all four individuals ceased active service in the East Peoria Police Department by reason of a disability; and

WHEREAS, none of the individuals applied for a regular retirement pension from the City of East Peoria Police Pension Fund, but all four applied for disability status and were granted disability benefits from the East Peoria Police Pension Fund; and

WHEREAS, Shawn Naylor, Greg Zook, Steve Martin and the Estate of Roger Wilsdorf (now deceased) filed claims seeking payment for unused, accumulated sick leave that had accrued at the time they ceased active service and as authorized at the time of retirement under the collective bargaining agreement governing their employment with the City; and

WHEREAS, all of the parties in an effort to avoid further litigation of the wage claims participated in a mediation led by a retired circuit court judge, which culminated in tentative mediation settlement agreements subject to City Council approval; and

WHEREAS, it is in the best interests of the City of East Peoria to settle all pending wage claims; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF EAST PEORIA, TAZEWELL COUNTY, ILLINOIS, THAT: Section 1. The above recitations are found to be true and correct. Section 2. The City approves and ratifies the mediation settlement agreement, with Shawn Naylor, dated January 25, 2018. Section 3. The City approves and ratifies the mediation settlement agreement with Greg Zook, dated January 25, 2018. Section 4. Page 4 Resolution No. 1718-116 by Commissioner Kahl; WHEREAS, Title 1, Chapter 5, Section 2.1 of the East Peoria City Code authorizes the City Council to determine from time to time by Resolution the number of individuals to hold each rank on the Fire Department; and WHEREAS, there are three pending openings in the East Peoria Fire Department; and WHEREAS, the East Peoria Fire Department would like to begin the hiring process as soon as possible so that the new probationary firefighters may attend the upcoming Fire Academy in April; WHEREAS, it is in the best interests of the City of East Peoria to temporarily increase the total number of individuals holding the rank of firefighter on the East Peoria Fire Department from 30 to 33; and WHEREAS, it is in the best interests of the City that after the pending openings become effective, the City of East Peoria decrease the total number of individuals holding the rank of firefighter on the East Peoria Fire Department from 33 to 30;

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF EAST PEORIA, TAZEWELL COUNTY, ILLINOIS, THAT: Section 1. Effective immediately, the Fire Department of the City of East Peoria shall consist of the following personnel:

REPAIRS AND REPAVING FOR 2018.

DISCUSSION: We propose that $450,000 be allocated for the 2018 Street Maintenance Program. There is an engineering agreement with Patrick Meyer & Associates for engineering services for this work already in force. The cost for the engineering is dependent upon the type of maintenance that is being done, and shall be in accordance with our existing agreement. The City will receive approximately $450,000 in MFT funds. Because we are still paying back the 2015 street maintenance program where we spent $2.5 million, borrowing from the 2016, 2017 and 2018 Street Maintenance programs, $245,000 will go to repay this debt. IDOT regulations prohibit the City from using MFT funds to repay past street maintenance programs, but we can use MFT funds to buy road salt. We propose to use $245,000 of the MFT Funds to buy road salt. We will then use $245,000 from line item 11-00-0-122, plus $205,000 of MFT funds for street maintenance. This effectively allows the City to spend $450,000 on Street Maintenance in 2018. Please see the attached resolution for the Illinois Department of Transportation detailing the $450,000 street maintenance program. RECOMMENDATION: Approve $450,000 in Motor Fuel Tax (MFT) funds to repair, repave and sealcoat streets as prioritized by the Street Department and Patrick Meyer & Associates.

include an appropriation of Motor Fuel Tax Funds (“MFT Funds”) in the amount of $450,000; and

WHEREAS, in order to utilize MFT Funds for the 2018 Street Maintenance Project it

will be necessary for the City to submit to the Illinois Department of Transportation (“IDOT”) a resolution appropriating MFT Funds and an IDOT approved engineering agreement in the form attached hereto labeled as “Exhibit A” (the “MFT Documents”) together with any other documentation required by IDOT; and

services related to the 2018 Street Maintenance Project with Patrick N. Meyer & Associates in the form included with the MFT Documents (the “Engineering Agreement”). The rate of compensation for engineering services will conform to the Illinois Department of Transportation guidelines and the amount of compensation will depend upon the nature of the maintenance work the City deems appropriate to undertake;

The services to be performed by the consulting engineer, pertaining to the various items of work included in the estimated cost of maintenance operations (BLR 14231 or BLR 14221), shall consist of the following:

PRELIMINARY ENGINEERING shall include: Investigation of the condition of the streets or highways for determination (in consultation with the local highway authority) of the maintenance operations to be included in the maintenance program: preparation of the maintenance resolution, maintenance estimate of cost and, if applicable, proposal; attendance at meetings of the governing body as may reasonably be required; attendance at public letting; preparation of the contract and/or acceptance of BLR 12330 form. The maintenance expenditure statement must be submitted to IDOT within 3 months of the end of the maintenance period.

ENGINEERING INSPECTION shall include: Furnishing the engineering field inspection, including preparation of payment estimate for contract, material proposal and/or deliver and install proposal and/or checking material invoices of those maintenance operations requiring engineering field inspection, as opposed to those routine maintenance operations as described in Chapter 14-2.04 of BLRS Manual, which may or may not require engineering inspection.

For furnishing preliminary engineering, the engineer will be paid a base fee PLUS a negotiated fee percentage. For furnishing engineering inspection the engineer will be paid a negotiated fee percentage. The negotiated preliminary engineering fee percentage for each group shown in the “Schedule of Fees” shall be applied to the total estimated costs of that group. The negotiated fee for engineering inspection for each group shall be applied to the total final cost of that group for the items which required engineering inspection. In no case shall this be construed to include supervision of contractor operations.

Service LLC ______________________________________________________________________ DISCUSSION: In June 1998, the City entered into a 20-year franchise agreement with McLeodUSA Telecommunications for the non-exclusive use of City rights-of-way for installation and maintenance of certain telecommunication lines owned by McLeodUSA Telecommunications. McLeodUSA Telecommunications has requested that the City enter into a new 20-year agreement when this 1998 agreement expires on May 31, 2018. Pursuant to this new 20-year franchise agreement, McLeodUSA Telecommunications will continue to pay the City under Section 3-1-4 of the City Code, which imposes a 1% telecommunications infrastructure maintenance fee on telecommunication services provided by McLeodUSA Telecommunications within the City. Additionally, the other provisions of the franchise agreement that will continue in the new 20-year agreement include (1) prior notice to the City regarding any work conducted in a City right-of-way; (2) maintaining a sufficient level of insurance coverage that complies with the City’s contractor insurance requirements set forth in Section 1-8-4.13 of the City Code; and (3) providing a local contact for addressing emergency situations that involve or interfere with any McLeodUSA Telecommunications’ telecommunication lines. RESOLUTION APPROVING A RIGHT-OF-WAY USE AGREEMENT WITH MCLEODUSA TELECOMMUNICATIONS SERVICES

WHEREAS, the City into a 20-year franchise agreement with McLeodUSA

Telecommunications Services in June 1998 whereby McLeodUSA Telecommunications Services was granted a non-exclusive license to use the City’s public rights-of-way for the installation and maintenance of telecommunication lines owned by McLeodUSA Telecommunications Services; and

WHEREAS, City officials have negotiated a new 20-year franchise agreement with

McLeodUSA Telecommunications Services starting on June 1, 2018, attached hereto as “Exhibit A” (the “Franchise Agreement”); and

WHEREAS, the Franchise Agreement has been updated to be consistent with

current State law, which includes the continuation of the payment to the City of the 1% telecommunications infrastructure maintenance fee on telecommunication services provided by McLeodUSA Telecommunications within the City; and

WHEREAS, the Franchise Agreement also requires McLeodUSA

Telecommunications Services to maintain general liability insurance coverage at required levels set forth in the City Code under Section 1-8-4.13 for contractors doing business in the City when McLeodUSA Telecommunications Services undertakes work in the City’s right-of-way; and

WHEREAS, the City of East Peoria hereby finds that it is in the best interests of

the City and its citizens to enter into the Franchise Agreement with McLeodUSA Telecommunications Services for another 20-year term (as provided in Exhibit A);

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF

RIGHT-OF-WAY AGREEMENT This Agreement entered into this 1st day of June, 2018, by and between McLeodUSA Telecommunications Services, LLC., an Iowa limited liability corporation (hereinafter the “Grantee”), and the City of East Peoria (hereinafter the “City”), a municipal corporation located in the County of Tazewell and State of Illinois. WHEREAS, Grantee desires to maintain underground and overhead telecommunications facilities, including, but not limited to, fiber optic cable, cable splices, cable and splice enclosures, opto-electrical devices, telecommunications equipment, and related equipment for the electronic transmission of voice, sound, data, images, or other forms of communication in the public right-of-way; and WHEREAS, the City is the owner of the public right-of-way in question; NOW, THEREFORE, in consideration of the mutual covenants herein, the sufficiency of which is hereby acknowledged, the parties agree as follows: 1. The City agrees to grant Grantee a non-exclusive right to install, construct,

operate, maintain, inspect, protect, repair, replace and retain a communications system for intra-exchange, local service, inter-exchange and/or long distance service, including, but not limited to, fiber optic cable, cable splices, cable and splice enclosures, opto-electrical devices, telecommunications equipment, and related equipment for the electronic transmission of voice, sound, data, images, or other forms of communication in the City’s right-of-way, as well as the right-of-way in any future annexations. Notwithstanding the provisions of this paragraph, the City does not grant to Grantee the right to operate a community antenna television system (CATV), more commonly known as cable television system, and Grantee will not knowingly provide fiber optic service to any entity or person operating a cable television system unless that entity or person has a valid licensing or franchise agreement with the City.

2. Before commencing any non-emergency installation or repair, the Grantee shall

submit a written request for a permit to the City’s Director of Public Works which request describes the nature and location of the work to be performed. Within a reasonable time after receipt of the application, the Director shall issue a permit to the Grantee which authorizes the Grantee to undertake the work described in the application and describe the conditions under which the work may proceed.

3. In the event that the City, in its sole discretion, finds it necessary to relocate any

of its water mains, sanitary sewer mains, storm sewer mains or appurtenances thereto or to widen or otherwise improve streets, sidewalks and other public facilities, and in the event that the City concludes that such work can be most efficiently accomplished if facilities installed by the Grantee are relocated, then the Grantee shall, at the Grantee’s sole cost and expense, promptly relocate its

lines in accordance with the direction of the City. Grantee shall not interfere with the use or placement of any other facilities installed or operated in the public right-of-way by any other public or private entity including, without limitation, water lines, sanitary sewer lines, electric transmission lines, gas transmission lines, cable television lines, or telecommunications lines.

4. Grantee agrees to perform all work on the public right-of-way according to written

City specifications. Pavement will not be applied to any such repairs until the City first has the opportunity to inspect the base which will support the pavement. Grantee shall have the responsibility of notifying the City prior to the application of pavement.

5. Grantee shall comply in all respects with Section 3-1-4 of the East Peoria City

Code titled “Telecommunications Infrastructure Maintenance Fee”, as enforced through Section 5-25 of the “Simplified Municipal Telecommunications Tax Act” (35 ILCS 636/5-30). Section 3-1-4 of the East Peoria City Code imposes a telecommunications infrastructure maintenance fee, as such provision now exists or may from time to time hereafter be amended.

6. Grantee agrees to hold the City free and harmless from any liability to persons or

property resulting from the work performed by Grantee and agrees to the reasonable relocation of the cable and related equipment to accommodate City needs. All reasonable costs associated with such relocation will be borne by Grantee. As long as the Grantee exercises the rights granted to it by this Agreement, the City will not, by ordinance or otherwise, vacate any street, alley, or public way in which the Grantee has underground conduits or vaults, poles, fiber optic cable, cable and splice enclosures, or other telecommunications devices installed without reserving the easement rights of the Grantee in and to the street, alley, or public way to be vacated.

7. Upon the effective date of this Agreement, Grantee shall comply in all respects

with Section 1-8-4.13 of the East Peoria City Code titled “Contractor Insurance and Hold Harmless Requirements” regarding insurance coverage and hold harmless provisions. Grantee shall furnish proof that satisfactory liability insurance policies are in force at no less than in the minimum amounts established under Section 1-8-4.3, as amended from time to time. Should the City increase the minimum coverage amounts set forth in Section 1-8-4.13 of the City Code, the Grantee shall not be required to bring the Grantee’s coverage into compliance until 180 days after receiving written notice from the City of such change to Section 1-8-4.13.

Grantee shall have the City and all of its officers and employees, and Council members, included as additional insureds on the policies referred to in this Section. All such policies shall provide that the issuing insurance company will not cancel them without thirty (30) days’ prior notice to the City and Grantee. All such policies shall be taken out and maintained with generally recognized and

responsible insurance companies qualified to do business in the State of Illinois, subject to approval by the City’s Risk Manager. The liability insurance policies shall be maintained throughout the duration of this Agreement. Grantee shall deposit an updated certificate of insurance demonstrating the required minimum coverage amounts with the City Clerk no later than thirty (30) days after the effective date of this Agreement, and no work in a City right-of-way shall be commenced until such certificate of insurance is on file with the City Clerk. Thereafter, Grantee shall file updated certificates of insurance with the City Clerk on an annual basis and before Grantee commences any work in a City right-of-way under the term of this Agreement. Bond Requirements. At such time that Grantee engages in major construction projects within the City (as opposed to using existing underground vaults and other facilities already occupying the City’s right-of-way), the City may require Grantee to comply with standard bonding requirements applicable to similar businesses operating within the City.

8. This Agreement shall be binding upon and inure to the benefit of the parties

hereto, their successors or assigns. Neither party shall assign or otherwise transfer this Agreement or any of its rights and interest to any firm, corporation or individual, without the prior written consent of the other party, except either party shall have the right to assign, convey or otherwise transfer its rights, title, interest and obligations under this Agreement, in whole or in part, to any entity controlled by, controlling or under common control with a party hereto, or any entity into which a party may be merged or consolidated or which purchases all or substantially all of the assets of such party.

9. This Agreement shall be governed by Illinois law and the situs of the contract is

East Peoria, Illinois. 10. If any part of this Agreement is declared invalid, it will not invalidate the entire

Agreement. 11. This Agreement will remain in full force and effect for twenty years from the date

of its acceptance by the City Council of the City of East Peoria, East Peoria, Illinois, provided that the Grantee accepts such Agreement in writing within thirty (30) days after the City’s action thereon.

12. When the City notifies Grantee that an emergency situation exists which requires

the prompt location of Grantee’s fiber optic system and related equipment, the City shall contact Grantee’s designated operating representative, and Grantee shall provide the appropriate locating service within two (2) hours of receiving notice from the City. For purposes of this section, an emergency situation exists only when there is a substantial likelihood that significant property damage will occur or that bodily injuries may result if there is no response. Without limiting

the generality of the foregoing provision, any water main break shall be considered an emergency situation. WHEREAS, the City has previously approved a Use Policy for the meeting

rooms and shared spaces in the Civic Complex on January 7, 2014; and WHEREAS, the City finds that it is necessary to establish rules and regulations

regarding the conduct of patrons while utilizing the shared spaces in the Civic Complex; and

WHEREAS, the rules and regulations, which are attached hereto as Exhibit A,

titled as Rules and Regulations for Patrons of Civic Complex, are consistent with the Use Policy passed on January 7, 2014, and the provisions of the City Code currently in full force and effect; and

WHEREAS, the City hereby finds that it is in the best interests of the City to approve the Rules and Regulations for Patrons of Civic Complex regarding the conduct of patrons while utilizing the atrium area and the shared public spaces in the Civic Complex; and WHEREAS, the City further finds that it is in the best interests of the City to make it unlawful for patrons of the Civic Complex to violate the Rules and Regulations in order to promote a peaceful and respectful environment for its residents, City staff, Fondulac Library District staff, and other patrons of the Civic Complex; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF EAST PEORIA, TAZEWELL COUNTY, ILLINOIS, THAT:

It is unlawful for any person to knowingly or willfully refuse or neglect to obey the rules and regulations established for patrons’ use of indoor facilities of the Civic Complex located in the Civic Triangle area of The Levee District. The Civic Complex consists of the East Peoria City Hall, the Fondulac Library, the Atrium area between these two facilities, and the associated meeting rooms, hallways, storage rooms, and restrooms. The indoor areas of the Civic Complex include the Atrium area (open space) between the Fondulac District Library and East Peoria City

RULES & REGULATIONS FOR PATRONS OF CIVIC COMPLEX

The City of East Peoria generously provides amenities for use in the public areas of the Civic Complex. The Civic Complex consists of all indoor areas, including the Atrium area (open space) between the Library and City Hall, all hallways and public facilities, and the meeting spaces when open to the public.

Any person who does not comply with these Rules & Regulations will be subject to immediate removal by City or Library staff. Refusal to vacate the premises when requested to do so by City or Library staff will result in removal from the premises by the East Peoria Police Department. 1. Children under the age of 10 must be accompanied by an individual 14 years of age

or older.

2. Patrons must keep all personal belongings with them at all times. The City is not responsible for unattended personal belongings that may be lost or stolen.

3. City and Library property, staff, and patrons must be treated in a respectful manner. 4. Screaming, yelling, laughing, talking or otherwise acting in an unreasonably loud

manner so as to disturb other patrons, City staff or Library staff is prohibited. Such activity is presumed unreasonably loud when it is clearly audible from a distance of 3 feet by another patron, City staff or Library staff.

5. The operation or use of any audio device, including but not limited to, cell phones, iPods, MP3 players, PDAs, tablets, laptop computers, musical instruments, and radios, in an unreasonably loud manner so as to disturb other patrons, City staff or Library staff is prohibited. Such activity is presumed unreasonably loud when it is clearly audible from a distance of 3 feet by another patron, City staff or Library staff. Such audio devices used or operated by City staff, Library staff, or other patrons authorized by City or Library staff to use or operate such devices are exempt from this prohibition.

6. Shirt, Shoes, and Pants must be worn at ALL times.

7. With the exception of service animals, all animals, insects and other living organisms are prohibited unless prior written permission has been obtained from the City or Library staff.

9. The use of the Civic Complex for any activity other than its intended purpose, including: sleeping, changing clothes, bathing (except for washing hands or face), shampooing, shaving, washing clothes or utensils, or preparing meals or food is prohibited.

10. Violence; threats of violence; the use of obscene, offensive or profane language; and otherwise acting or behaving in a manner which reasonably alarms or disturbs another patron is prohibited.

11. Entering while under the influence of drugs or alcohol in such a manner as that is unreasonably loud or obscene, or to such a degree that renders him/her incoherent, incapacitated or otherwise unable to control himself/herself is prohibited.

12. Except as permitted by law, possession of explosives, fireworks, or any dangerous weapon, including, but not limited to, firearms, knives, bludgeons, razor blades, bullets, and broken glass is prohibited.

13. Moving, altering or rearranging any furniture or equipment without permission of City or Library staff is prohibited.

14. Soliciting, selling, peddling, advertising, distributing, or posting of any kind is prohibited unless prior written permission has been obtained from the City or Library staff.

15. The use of any cigarette, cigar, tobacco product, and electronic smoking device is prohibited.

16. Physically blocking hallways, exits, or entrances in any manner, including by not limited to sitting or lying down is prohibited.

17. Destruction, injury, defacement, removal or disturbance to any building, structure, sign, equipment, statute, marker, or other personal property of the City or Library is prohibited.

18. Use of or being inside the Civic Complex outside the designated hours of operation is prohibited unless prior written permission has been obtained from the City or Library staff.

19. Creating or maintaining any condition which constitutes a public nuisance is prohibited. Any condition which substantially disturbs, injures, or endangers the health, safety, peace, or welfare of the public; or which greatly offends public morals or decency is considered a nuisance.

TO: The Honorable Mayor and the City Council THRU: Jeffery Eder, City Administrator FROM: Ty Livingston, Director of Planning & Community Development DATE: February 27, 2018 SUBJECT: Petition of the City of East Peoria for a text amendment to amend Title 5, Chapter 7 of the East Peoria City Code to modify parking requirements. BACKGROUND: The petitioner here, the City in this case, is seeking to modify parking code requirements for most commercial and industrial uses. Over the years, traditional zoning has always looked for minimum parking requirements to be met. However, excessively-sized parking lots impede additional development, increase storm water run-off issues and cost property owners more up front, as well as over the life of the parking lot. The proposal here is to essentially “flip” our requirements from minimums to maximums for commercial and industrial uses. Residential uses would still have minimum requirements. This change in thinking has been implemented by several municipalities throughout the nation and locally by the Cities of Peoria and Washington. Staff believes that it’s a good start in addressing on-going storm water run-off issues and should encourage a little more density in our commercial and industrial developments (less property needed for parking = more property available for productive development). The change here also offers a variance option through the ZBA should there be extenuating circumstances why these requirements cannot be followed. Lastly, there should be an initial as well as long-term cost-benefit to property owners of commercial and industrial properties who will have less parking lot to install and then maintain. The ZBA voted 7-0 at their meeting to recommend approval of this code change as presented. RECOMMENDATION: Approval.

ORDINANCE NO. 4373 AN ORDINANCE AMENDING TITLE 5, CHAPTERS 7 AND 11 OF THE EAST PEORIA

CITY CODE PERTAINING TO PARKING REQUIREMENTS

WHEREAS, the City of East Peoria has proposed amendments to certain zoning

regulations found at Title 5, Chapter 7, Sections 3 and 6 of the East Peoria City Code which proposed amendments are hereinafter set forth; and

WHEREAS, after hearing pursuant to duly published notice, the East Peoria Zoning

Board of Appeals has recommended approval of the proposed amendments; and WHEREAS, the City Council finds that adoption of the proposed amendments would

serve the best interests of the City of East Peoria and its citizens; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF EAST PEORIA, TAZEWELL COUNTY, ILLINOIS, THAT:

Section 1. Title 5, Chapter 7, Section 3 of the East Peoria City Code is hereby

amended to read as follows (additions are indicated by underline; deletions by strikeout):

5-7-3. Joint parking facilities; off-site facilities.

(a) Joint parking facilities. Facilities to serve one or more buildings or uses may be allowed provided such joint parking facility conforms to the provisions of this chapter, and provided further that the total number of spaces so located together shall not be less than the sum of the separate requirements for each use served by the joint facility.

(b) Off-site facilities. Off-site parking facilities may be allowed for nonresidential uses subject to the following:

(1) The city council director of planning and community development shall

approve such off-site facility.

(2) The facility shall be used to park only passenger vehicles.

(3) The facility is located in a nonresidential zoning district.

(4) The off-site parking facility shall be in the same possession, either by deed, easement or long-term lease, as the property occupied by the principal use. Any such instrument shall permit the principal use being served to maintain the required number of parking spaces at the off-site facility during the existence of said principal use. The instrument granting possession of the off-site facility to the holder of the principal

use shall be filed of record in the office of the Recorder of Deeds of Tazewell County, Illinois.

5-7-6. Schedule of parking requirements.

Other than for residential and institutional uses, not more than the number of Pparking spaces shall be provided as shown in the following schedule. Any use not specifically listed shall conform to the requirements of the most similar use based upon the determination of the director of planning and community development.

(a) Residential:

1. Residential dwellings

Two (2) parking spaces per dwelling unit.

2. Elderly or handicapped dwellings

Seven (7) parking spaces per ten (10) dwelling units plus one space for each employee.

3. Lodging, boarding or rooming houses

One space for each two (2) guests, plus one for the owners or managers.

(b) Institutional uses:

1. Church or temples

One space for each four (4) seats in the main auditorium or each eight (8) feet of pews.

2. Elementary and junior high schools

One space for each employee and administrator plus one for each six (6) seats in the auditorium or gymnasium.

3. Fraternities, sororities or dormitories

One space for each three (3) beds plus one for each staff two (2) residents, plus (1) space for each employee.

4. Medical, dental clinics and doctors offices

Five (5) spaces per doctor plus one space for each employee.

5. Nursery schools, day nurseries and child care centers

One space for each employee plus four (4) additional visitor spaces.

12. Libraries

One space for each four hundred (400) square feet of floor area plus one for each employee.

(c) Business uses: All of the following business uses shall provide one

parking space for each employee in addition to requirements set forth below:

1. Shopping centers

One space for each two hundred fifty (200)(250) square feet of usable retail floor area.

2. Beauty or barber shops One and one-half (1 1/2) parking spaces for each chair.

3. Bowling alley

Four (4) spaces for each alley plus additional space for accessory uses.

4. Convention halls, dance halls, skating rinks or other places of assembly

One space for each one hundred (100) square feet of floor area used for assembly.

13. Theaters, outdoor

Stacking space equal to ten (10) percent of capacity.

14. Theaters, indoor

One space for each four (4) seats.

15. Go-cart tracks

Fifteen (15) spaces for each track.

16. Car wash

A minimum of two (2) stacking spaces per wash bay plus two (2) dryoff spaces per bay.

Stacking spaces for three (3) vehicles per bay.

(e) Required parking for iIndustrial uses:

1. Warehouses and storage uses

One space for each two (2) employees in the largest shift including office workers.

2. Manufacturing and industrial uses, research and testing laboratories

One space for each two (2) employed the majority of the day.

(f) The Zoning Board of Appeals may in accordance with the procedures set forth at section 5-11-7 grant variations allowing parking facilities inconsistent with the requirements set forth in this section,

Section 3. Title 5, Chapter 11, Section 7(d) of the East Peoria City Code pertaining

to authorized variations is hereby amended to read as follows (additions are indicated by underline; deletions by strikeout):

(d) Authorized variations. Variations from the regulations of this Title shall be granted by the zoning board of appeals only in accordance with the standards established in this section, and may be granted only in the following instances, and in no others:

(1) To permit any yard or setback less than a yard or a setback required

by the applicable regulations;

(2) To permit the use of a lot or lots for a use otherwise prohibited solely because of the insufficient area or width of the lot or lots, but in no event shall the respective area and width of the lot or lots be less than ninety (90) percent of the required area and width;

(3) To permit the same off-street parking facility to qualify as required

facilities for two (2) or more uses; provided that substantial use of such facility by each user does not take place at approximately the same hours of the same days of the week;

(4) To reduce the applicable off-street parking or loading facilities

required by not more than one parking space or twenty (20) percent of the applicable regulations, whichever number is greater;

(5) To increase by not more than twenty five (25) percent the maximum

distance that required parking spaces are permitted to be located from the use served; and

(6) To increase the width of driveway or curb cuts in manufacturing

districts with respect to access to parking or docking facilities as set forth in section 5-7-3(f)4.

(7) To allow parking facilities inconsistent with the requirements set forth

at section 5-7-6. Section 4. This Ordinance is hereby ordered to be published in pamphlet form by

the East Peoria City Clerk and said Clerk is ordered to keep at least three (3) copies hereof available for public inspection in the future and in accordance with the Illinois Municipal Code.

CITY LIMITS AND CHANGE THE PROVISIONS REGARDING DELIVERY WHEREAS, the City of East Peoria has proposed amendments to certain liquor control regulations found at Title 3, Chapter 3 of the East Peoria city Code which proposed amendments are hereinafter set forth; and WHEREAS, the City Council finds that adoption of the proposed amendments would serve the best interests of the City of East Peoria and its citizens; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF EAST PEORIA, TAZEWELL COUNTY, ILLINOIS, THAT:

Section 1. Title 3, Chapter 3, Section 1.10 of the East Peoria City Code is hereby amended to read as follows (additions are indicated by underline, deletions by strikeout):

3-3-1.10. Licenses; limitation upon number issued. So that the health, safety and welfare of the people of the city shall be protected and minors shall be prevented from the purchase of alcoholic liquors, and temperance in the consumption of alcoholic liquors shall be fostered and promoted: (a) No additional class A licenses shall be issued under the

provisions of this chapter unless the number of such licenses in force at the time shall be less than seventeen (17);

(b) No additional class B licenses shall be issued under the

provisions of this chapter unless the number of such licenses in force at the time shall be less than twenty-six (26);

(c) Class C licenses may be issued without limit upon approval

by the liquor control commission; (d) No additional class D licenses shall be issued under the

provisions of this chapter unless the number of such licenses in force at that time shall be less than twenty-sevenfive (275);

(e) No additional class E licenses shall be issued under the provisions of this chapter unless the number of such licenses in force at that time shall be less than one (1);

organizations qualifying upon approval by the liquor control commission;

(h) No additional class Z licenses shall be issued under the

provisions of this chapter unless the number of such licenses in force at the time shall be less than one (1);

(i) No additional class G licenses shall be issued under the

provisions of this chapter unless the number of such licenses in force at the time shall be less than one (1);

(j) No additional class RB licenses shall be issued under the

provisions of this chapter unless the number of such licenses in force at the time shall be less than four (4);

(k) No additional class H licenses shall be issued under the

provisions of this chapter unless the number of such licenses in force at the time shall be less than two (2);

(l) No additional class CR licenses shall be issued as a stand-

alone license or as a sublicense under the provisions of this chapter unless the number of such licenses in force at the time shall be less than four (4);

(m) No additional class CC licenses shall be issued under the

provisions of this chapter unless the number of such licenses in force at the time shall be less than one (1);

(n) No additional subclass 1 licenses shall be issued under the

provisions of this chapter unless the number of such licenses in force at the time shall be less than twenty-one (21);

(o) No additional subclass 2 licenses shall be issued under the

provisions of this chapter unless the number of such licenses in force at the time shall be less than one (1).

Provided however, that upon the surrender and cancellation of an existing license, the local liquor control commission may reissue such license to a person who has purchased the business or premises of the

prior licensee; and provided, further, that in the event of annexation of any territory to the city, in which territory there is located any business or property for which a valid county retail liquor license has been issued and in force at the date of such annexation, the local liquor control commission is empowered to authorize the issuance of a new license strictly under the provisions of this Code to the person named in the county retail liquor license issued for such business or property, notwithstanding the foregoing limitations upon the number of licenses to be issued.

Section 2. Title 3, Chapter 3, Section 4.15 of the East Peoria City Code is

hereby amended to read as follows (additions are indicated by underline, deletions by strikeout):

3-3-4.15. Delivery.

No licensee shall deliver or cause to be delivered off the premises any alcoholic liquors on Sunday, national holidays, or after 5:00 p.m. on any other day.It shall be unlawful for any person to deliver or cause to be delivered off premises any alcoholic liquor sold at retail except by a nationally recognized shipping and delivery carrier, which includes the United States Postal Service (USPS), FedEx, UPS, DHL, or other similar service provider.

Section 3. Title 3, Chapter 3, Section 4.16 of the East Peoria City Code is

hereby deleted in its entirety. Section 4. This Ordinance is hereby ordered to be published in pamphlet form

by the East Peoria City Clerk and said Clerk is ordered to keep at least three (3) copies hereof available for public inspection in the future and in accordance with the Illinois Municipal Code.

WHEREAS, Devin Birch (the “Petitioner”) has petitioned for a special use to allow

the construction of a senior living facility (rest home) on property zoned as “R-4, Multiple-Family Dwelling District” which property is shown and described at “Exhibit A” attached hereto and incorporated herein by reference (which property as so described is hereinafter referred to as the “Property”); and

WHEREAS, after hearing pursuant to duly published notice, the East Peoria

Zoning Board of Appeals has recommended approval of the proposed special use as proposed; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF EAST PEORIA, TAZEWELL COUNTY, ILLINOIS, THAT:

WHEREAS, Dan Carey (the “Petitioner”) has petitioned for a special use to allow a

This tax generates $6.6 million on an annual basis. Per our budget discussions, it was agreed to take a look at increasing the Non Home Rule sales tax by one-half of one percent (0.50%) for a new Non Home Rule sales tax rate of one and three quarters percent (1.75%) which would generate a little over $1.55 million dollars in 2018 as the increase would take effect on July 1. A full year increase would generate $2.64 Million The city must notify the State by April 1 of its intent to increase the Non Home Rule sales tax in order for it to become effective on July 1. The chart below outlines the various local sales taxes for East Peoria.

ORDINANCE NO. 4353

AN ORDINANCE IMPOSING AN ADDITIONAL ONE-HALF OF ONE PERCENT SALES TAX

WHEREAS, the City of East Peoria is a non-home rule municipality with a population of more than 20,000 but less than 25,000 persons; and WHEREAS, the City of East Peoria has prior to January 1, 1987, established a Redevelopment Project Area that has been certified as a State Sales Tax Boundary; and WHEREAS, the City of East Peoria has issued bonds or otherwise incurred indebtedness to pay for the costs in excess of Five Million Dollars ($5,000,000) which is secured in part by a tax increment allocation fund in accordance with the provisions of 11-74.4 of the Illinois Municipal Code; and WHEREAS, with the exception of certain items that are titled and registered by a agency of the State of Illinois and certain items of food, medications, and other materials as defined by Illinois statutes, the City has been empowered by Public Act 88-334 (effective August 13, 1993) to levy and impose a tax upon (1) all persons engaged in the business of selling tangible personal property, at retail in the municipality, and (2) all persons engaged in the business of making sales of service in the municipality; and WHEREAS, the authority for the City to impose these taxes as established in Public Act 88-334 have been codified as Sections 8-11-1.6 and 8-11-1.7 of the Illinois Municipal Code (65 ILCS 5/8-11-1.6 and 8-11-1.7), as amended from time to time; and WHEREAS, the City Council of the City of East Peoria hereby finds and determines that it is in the best interests of the City to generate revenues through additional sales tax, rather than increased real property taxes or other service fees, so that non-citizens are required to share the City's financial burden; and WHEREAS, the City Council further finds and determines that it is in the best interests of the City to impose an additional one-half of one percent (0.50%) sales tax on (1) all persons engaged in the business of selling tangible personal property at retail in the City, and (2) all persons engaged in the business of making sales of service in the City, subject to exceptions provided for below; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF EAST PEORIA, TAZEWELL COUNTY, ILLINOIS, AS FOLLOWS: Section 1. The findings and recitations hereinabove set forth are adopted and found to be true.

Section 2. An additional tax is hereby imposed upon all persons engaged in the business of selling tangible personal property, other than an item of tangible personal property titled and registered with an agency of this state’s government, at retail in this municipality at the rate of an additional one-half of one percent (0.50%) of the gross receipts from such sales made in the course of such business while this Ordinance is in effect; and a tax is hereby imposed upon all persons engaged in this municipality in the business of making sales of service, at the rate of an additional one-half of one percent (0.50%) of the selling price of all tangible personal property transferred by such servicemen as an incident to a sale of service. Neither tax shall be imposed on the sales of food for human consumption that is to be consumed off the premises where it is sold (other than alcoholic beverages, soft drinks, and food that has been prepared for immediate consumption) and prescription and nonprescription medicines, drugs, medical appliances and insulin, urine testing materials, syringes, and needles used by diabetics.

The imposition of these non-home rule taxes are made in accordance with the provisions of Section 8-11-1.6 and 8-11-1.7, respectively, of the Illinois Municipal Code (65 ILCS 5/8-11-1.6 and 8-11-1.7). Section 3. The taxes hereby imposed, and all civil penalties that may be assessed as an incident thereto, shall be effective as of July 1, 2018, as soon as otherwise permitted by law. Section 4. The taxes hereby imposed, and all civil penalties that may be assessed as an incident thereto, shall be collected and enforced by the Department of Revenue of the State of Illinois. The Department of Revenue shall have full power to administer and enforce the provisions of this Ordinance.

Section 5. Title 3, Chapter 1, Section 1 of the Code of the City of East Peoria is hereby deleted in its entirety and replaced as follows:

3-1-1 NON-HOME RULE MUNICIPAL RETAILERS' OCCUPATION TAX:

(A) Tax Imposed: A tax is hereby imposed upon all persons engaged in the business of selling tangible personal property, other than on an item of tangible personal property that is titled and registered by an agency of the State of Illinois, at retail in the City at the rate of one and three-fourths percent (1.75%) of the gross receipts from such sales made in the course of such business while this section is in effect, in accordance with the provisions of Section 8-11-1.6 of the Illinois Municipal Code (65 ILCS 5/8-11-1.6) as amended from time to time. This tax shall not be imposed on the sales of food for human consumption that is to be consumed off the premises where it is sold (other than alcoholic beverages, soft drinks, and food that has been prepared for immediate consumption) and prescription and nonprescription medicines, drugs, medical appliances and insulin, urine testing materials, syringes, and needles used by diabetics.

(B) Returns to be Filed: Each such person engaged in such business in the

City shall file the report to the State Department of Revenue required by Section 3 of the Retailers’ Occupation Tax Act (35 ILCS 120/1, et seq.).

(C) Payment of Tax: At the time such report is filed, there shall be paid to the

State Department of Revenue the amount of tax hereby imposed on account of the receipts from sales of tangible personal property during the reporting period.

Section 6. Title 3, Chapter 1, Section 1.1 of the Code of the City of East Peoria

is hereby deleted in its entirety.

Section 7. Title 3, Chapter 1, Section 2 of the Code of the City of East Peoria is hereby deleted in its entirety and replaced as follows:

3-1-2 NON-HOME RULE MUNICIPAL SERVICE OCCUPATION TAX:

(A) Tax Imposed: A tax is hereby imposed upon all persons engaged in the City in the business of making sales of service at the rate of one and three-fourths percent (1.75%) of the selling price of all tangible personal property transferred by said servicemen either in the form of tangible personal property or in the form of real estate as an incident to a sale of service, in accordance with the provisions of Section 8-11-1.7 of the Illinois Municipal Code (65 ILCS 5/8-11-1.6) as amended from time to time. This tax shall not be imposed on the sales of food for human consumption that is to be consumed off the premises where it is sold (other than alcoholic beverages, soft drinks, and food that has been prepared for immediate consumption) and prescription and nonprescription medicines, drugs, medical appliances and insulin, urine testing materials, syringes, and needles used by diabetics.

(B) Returns to be Filed: Every serviceman required to account for non-home

rule municipal service occupation tax for the benefit of the City shall file the report to the State Department of Revenue required by Section 9 of the Service Occupation Tax Act (35 ILCS 1150/1, et seq.).

(C) Payment of Tax: At the time such report is filed, there shall be paid to the

State Department of Revenue the amount of tax hereby imposed on account of the receipts from transfers of tangible personal property or real estate incident to a sale of service during the reporting period.

Section 8. Title 3, Chapter 1, Section 2.1 of the Code of the City of East Peoria

is hereby deleted in its entirety.

RESOLUTION ESTABLISHING SET ASIDE OF REVENUES FROM NON-HOME RULE SALES TAX REVENUES FOR

CITY’S RESERVE FUND

WHEREAS, the City Council has implemented an additional one-half of one percent (0.50%) non-home rule sales tax by Ordinance 4353, which is being adopted simultaneously with this Resolution; and

WHEREAS, due to recent financial challenges and economic conditions faced by the City, the City’s reserve funds have seen a reduction in recent years; and

WHEREAS, the City Council intends to use a portion of the non-home rule sales

tax revenues generated by the additional one-half of one percent (0.50%) implemented by Ordinance 4353 to supplement the City’s reserve funds to ensure that the City’s reserve funds are maintained at a financially responsible level; and

WHEREAS, the City Council hereby finds that it is in the best interests of the City

to designate and set aside a specified amount of the non-home rule sales tax revenues generated by the additional one-half of one percent (0.50%) implemented by Ordinance 4353 on an annual basis until the City’s reserve funds are maintained at a financially responsible level; and

WHEREAS, the City Council hereby further finds that it is in the best interests of

the City and fiscally responsible to set aside these additional revenues incrementally on an annual basis until the City’s reserve funds are increased to such financially responsible level;

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF EAST PEORIA, TAZEWELL COUNTY, ILLINOIS, THAT:

Section 1. The above recitations are found to be true and correct. Section 2. For the 2018-2019 fiscal year, the City shall set aside $250,000 of

revenues generated by the additional one-half of one percent (0.50%) non-home rule sales taxes implemented by Ordinance 4353 into the City’s reserve fund for the City’s general fund.

Section 4. For each fiscal year after the 2019-2020 fiscal year, the City shall

continue to set aside $300,000 of revenues generated by the additional one-half of one percent (0.50%) non-home rule sales taxes implemented by Ordinance 4353 into the City’s reserve fund for the City’s general fund until the City’s reserve fund reaches $4.0 million. When the City’s reserve fund reaches $4.0 million in total funds, these revenues generated by the additional non-home rule sales taxes authorized by Ordinance 4353 shall only be used thereafter as needed to supplement the City’s reserve fund in order to maintain the $4.0 million minimum level throughout the applicable fiscal year.

Section 5. The City Treasurer shall take the necessary steps to implement the

provisions of this Resolution during the 2018-2019 fiscal year and every fiscal year thereafter as provided herein. The City budget for the 2018-2019 fiscal year and every year thereafter shall allocate the respective amount of non-home rule sales tax revenues for the City’s reserve fund as provided in this Resolution.

Section 6. This Resolution shall be effective upon the implementation of the

additional one-half of one percent (0.50%) non-home rule sales taxes established by Ordinance 4353, and this Resolution shall remain effective until further action specifically addressing the provisions of this Resolution is taken by the City Council.

RESOLUTION APPROVING CONTRACT WITH OPTIMUM HEALTH SOLUTIONS FOR ASSISTING WITH EMPLOYEE WELLNESS PROGRAM

WHEREAS, the City’s employee Wellness Committee will be holding a health and

wellness fair for all City employees on April 12, 2018, as part of the annual employee health plan enrollment and wellness activities held each year; and

WHEREAS, the Wellness Committee has determined that in order to develop and implement wellness programs and activities for City employees, City employees should be given the opportunity to participate in a current health risk assessment program as a means to provide meaningful individual wellness programs and activities for participating City employees; and

WHEREAS, the Wellness Committee recommends that the City enter into a

contract with Optimum Health Solutions, Inc., for the purpose of conducting health screening and health risk assessment programs for City employee participating in the City’s Wellness program and for employees and retirees participating in the Wellness Incentive under the City’s Group Health Care Plan; and

WHEREAS, Optimum Health Solutions, Inc., has been assisting the City with the

City’s Wellness Program and related wellness initiatives for the past several years; and WHEREAS, based upon the recommendation of the Wellness Committee, the City

Council hereby finds that it is in the best interests of the City to approve and enter into a contract with Optimum Health Solutions, Inc. (attached as “Exhibit A”), for conducting a health risk assessment program for City employees;

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF EAST PEORIA, TAZEWELL COUNTY, ILLINOIS, THAT:

Section 1. The City adopts the recommendations made by the Wellness Committee, as set forth above, and approves the contract (Exhibit A) with Optimum Health Solutions, Inc.

Section 2. The Mayor, or his designee, and the City Clerk are hereby authorized and directed to execute the contract with Optimum Health Solutions, Inc., attached as “Exhibit A”, together with such changes therein as the Mayor in his discretion deems appropriate; provided, however, that the City shall have no obligation under the contract with the Optimum Health Solutions, Inc. until such time as an executed original of such documentation has been delivered to the Optimum Health Solutions, Inc.

ORDINANCE NO. 4380 AN ORDINANCE AMENDING THE RESIDENCY PROVISIONS OF THE

CITY OF EAST PEORIA PERSONNEL POLICY MANUAL

WHEREAS, the City of East Peoria established its Personnel Policy Manual by Ordinance No. 2474 in November 1990, which has been subsequently amended and updated by various ordinances including a significant revision and re-issuance in July 2014 by Ordinance No. 4173; and

WHEREAS, City officials have recently reviewed the City’s residency policy with

regard to residency requirements for certain director and department head positions; and WHEREAS, City officials have determined that the permissible area for the residency policy can be extended on a limited basis without diminishing City readiness and services; and

WHEREAS, the City Council finds that the adoption of the revised residency policy as provided herein is in the best interests of the City and its employees;

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF

EAST PEORIA, TAZEWELL COUNTY, ILLINOIS, THAT:

Section 1. Section 2.7 of the City’s Personnel Policy Manual is hereby amended as follows (additions are indicated by underline; deletions by strikeout):

Section 2.7 – Residency Requirement. To foster community involvement

and the employment of its citizens, the City will give consideration to City residents for employment within the City where other factors are equal. Individuals holding specified City positions who are not residents of the City at the time of employment shall move to the City and establish residence as soon as practicable following employment, and shall become, and thereafter remain, City residents during the continuance of their employment, within twelve (12) months after the commencement of employment. For those current employees other than those in fire and police service, residing in the City on May 19, 1991, the employee shall maintain residence within the City so long as the employee remains employed by the City as a condition of continued employment. For the purposes of this Section, “City residency” means residency within the City’s corporate limits or outside the City but within one and one-half (1.5) miles of the City’s corporate limits in an unincorporated area. This residency requirement shall apply to the following specific City positions: Police Chief, Fire Chief; City Administrator; City Clerk; Director of Public Works; Director of Planning and Community Development; and Director of Tourism, Special Events, and Facilities. Employees subject to this requirement who fail to comply with this requirement after receiving written notice of their non-compliance from the City, may be terminated from employment. If an

employee does not become a City resident within nine (9) months after commencing employment with the City, the City will provide written notice to the employee that the employee must become a resident by the employee’s 12-month anniversary date. In any case, the employee will have no less than 90 days to comply with this requirement after receiving written notice of non-compliance. For all other City employees, as a condition of employment, the employee shall maintain residence within twenty (20) miles of the City limits while employed by the City. All City employees are urged to become involved in civic programs within the City for the betterment of the community.

Section 2. This Ordinance is hereby ordered to be published in pamphlet form by

the City Clerk and said Clerk is ordered to keep at least three (3) copies hereof available for public inspection in the future and in accordance with the Illinois Municipal Code.

Section 3. This Ordinance is in addition to all other ordinances on the subject and shall be construed therewith except as to that part in direct conflict with any other ordinance, and in the event of such conflict, the provisions hereof shall govern.

Section 4. This Ordinance shall be in full force and effect from and after its passage, approval, and ten (10) day period of publication in the manner provided by law.

Section 5. The City’s Human Resources Director is directed to furnish a copy of

these changes to the Personnel Policy Manual to all City employees when future updates are provided to City employees.
