Subject: Residential Parking Restrictions in the Vicinity of Noma Place (1410

RECOMMENDATION: Receive this report as information

PURPOSE: Provide information on parking at Noma Place and the

adjacent Residential Parking Permit zone. IMPLICATION OF RECOMMENDATION GENERAL: Lethbridge Family Services, Home Services Department is a

principal tenant of NOMA Place, 1410 Mayor Magrath Drive. The Home Services operation and other offices within NOMA Place attract a significant number of vehicles to the site on a regular basis. The parked vehicles include Home Services staff visiting NOMA Place for training, meetings and to pick up shift schedules. At times the parking demand extends beyond normal office hours. The original development permit for NOMA Place identified a developed area of 2538 square meters and a parking provision of 42 parking stalls. The land use was identified as a two storey office building within a commercial land use classification (C-13). The April 28, 1980 submission to City Council provided the following description of the C-13 district, “the standards in this proposed district are fairly restrictive as it is hoped that the uses in this area would be as compatible as possible to the adjoining residential areas.” Permitted uses in C-13 include offices, government offices, public utilities and signs. The Development review identified a permitted building size of 2108 square meters and a parking requirement of 43

stalls. The proposed development was 2538 square meters and the parking requirement was relaxed to 42 stalls. Bylaw 3574, the Land Use Bylaw in effect in 1980, identified a parking requirement of 1 stall per 46 square meters of gross floor area. Based on the developed area of 2538 square meters the bylaw required parking was 55 parking stalls. This indicates a shortfall of 13 stalls for the NOMA Place development. There are approximately 60 on-street public parking stalls within 200 meters of NOMA Place that are located outside of the residential community.

Residents in the adjacent community contacted Traffic Operations with concerns about overspill parking from NOMA Place. The residential parking permit program was identified as an option for residents to consider. Multiple petitions were created and circulated by community representatives. Following receipt of complete petitions a residential parking permit zone was implemented. A portion of the zone was initially petitioned to be Two Hour Parking, 07:00 to 16:00, weekdays; however, subsequent petitions converted the entire zone to Parking by Permit Only, 7 days per week, 24 hours per day. The residential parking permit zone includes the south side of 14 Avenue, west side of 26 Street, north side of 15 Avenue and east side of 24 Street. A petition process is currently underway to change the residential parking permit restrictions on 15 Avenue.

ORGANIZATIONAL: Traffic Operations staff worked with residents in the

community adjacent to NOMA Place to create a residential parking permit zone. Petitions were circulated and validated. Upon validation of the petitions signage was installed and permits were made available for residents within the zone. A petition is currently underway to modify the parking restrictions on 15 Avenue and changes to the zone will be completed upon receipt of a successful petition. Parking restrictions may need to be considered for on street public parking within the adjacent commercial area to improve turnover and create additional opportunity for short stay parking use close to NOMA Place.

Residential Parking Permit Information To avoid the potential of Institutional use (educational, health facilities, etc) vehicles parking on residential streets the City of Lethbridge will initiate a residential parking permit (RPP) program as follows.

1. The zone will be built out from the Institution. This means that for a street one block from Institution to be an RPP zone the next closest block must also be an RPP zone.

2. The zones will be initiated outward from the Institution upon a two thirds (2/3) petition response from the community.

3. The zone will be effective from 07:00 to 16:00 weekdays. If this time period is not effective residents will be able to petition to extend or retract the effective hours.

4. The posted time limit will be two hours. The entire RPP zone will be signed with a single time limit for efficient enforcement. If this time limit is not effective residents will be able to petition to extend or retract the posted parking duration. An hourly duration is recommended (one or two hours) as it will allow visitors an opportunity to park for short periods without a Visitor permit. A No Parking posting will require visitors to display a Visitor permit immediately upon parking.

5. All vehicles registered to households within the RPP zone will be eligible to receive a permit at no cost to the vehicle owner.

6. All households within the RPP zone will receive one visitor permit. Display of the visitor permit will allow vehicles to park for periods exceeding the posted time limit. If a Visitor permit is lost or stolen it will not be replaced until the following year.

7. Following receipt and confirmation of a petition the RPP zone request and associated budget requirements will be reviewed and may be brought forward to City Council if additional funding is required to implement or enforce the RPP zone.

RPP Questions How will the RPP zone be enforced? City of Lethbridge Regulatory Services may enforce the zone on an occasional basis. Vehicles without properly displayed permits will be recorded and if the vehicle remains parked after an elapsed time period it will be issued a parking tag. The enforcement process will be a random activity and may not occur every day/week/month or at the same time each day. Residents may call to request enforcement if vehicles without permits are abusing the posted parking duration. Requests are to the Lethbridge Police Service at 328-4444.

Can I give my visitor permit to someone else to use? Visitor permits are designed for use by visitors to your residence. The community has identified parked vehicles as a problem within the community and use of your permit by someone other than a visitor does not reduce parking within the community. Where can visitors park? Visitor permits will be identified with your residential address. The permit is valid for use within one block of the address printed on the permit. What happens during evenings and weekends? A typical RPP zone provides a two hour parking time limit on weekdays from 07:00 to 16:00. In a two hour zone, vehicles will be able to park from 14:00 to 09:00 without risk of receiving a parking tag. On weekends the RPP zone will not be in effect and vehicles can park without permits for unlimited duration. Alternately the community may petition to have the RPP Zone in effect for all hours and all days of the week. How do I get permits? You will have to visit Infrastructure Services, 4th Floor City Hall with valid vehicle registration. If you do not own a vehicle a Visitor permit may be issued with proof of residence. Do the permits expire? The permits are valid for one year at a time. Expiry dates are printed on the permits. Where do I attach the permit to my vehicle? The present permit design is a hangtag which is attached to the vehicle rearview mirror. The Traffic Safety Act does not permit the operation of a vehicle when an object obstructs the drivers view, thereby requiring operators to be responsible for removal of hangtags when driving and reposition of hangtags when parked. Where will the permit allow me to park? The residential parking permit or visitor permit will allow you to park within the RPP zone between the zone signage. All other parking restrictions continue to apply such as parking too close to an intersection, lane or driveway, no parking at fire hydrants, no parking at bus stops, etc. I have a basement apartment, will my tenants also get visitor permits? Only one visitor permit is issued per residence. Multiple tenants in the same residence will have to share a single visitor permit. The visitor permit is issued to the property owner.

What happens if I buy or sell a vehicle? When you purchase a new vehicle bring the valid registration to City Hall to obtain a new permit. If you sell your vehicle you are responsible to remove the RPP permit prior to sale. What happens if my visitor permits are lost of stolen? Only one visitor permit will be issued per residence in a single calendar year. If your visitor permit is lost or stolen it can not be replaced until the following year. Damaged visitor permits may be replaced provided the majority of the permit is returned to Infrastructure Services. If you sell or move out of the residence the Visitor permit must stay with the residence for the next occupant to use. Can students from out of town get permits? A full-time student currently attending an educational institution who normally would not be a resident of Lethbridge can obtain a parking permit. Students must produce their vehicle registration, student identification card and a rental/lease agreement (or utility bill) showing their correct address in the parking permit zone to receive a permit. Our records must include date of issue, permit number, vehicle license number, province, name of person who picked up permit, signature of receipt and address permit is issued for. How do can changes occur to a RPP zone? The creation of an RPP zone is completed through a petition process initiated by a community champion(s). Petition forms are created by Infrastructure and the community champion(s) obtain signatures from property owners within the community. Two thirds of property owners are required to sign the petition to initiate the creation of an RPP zone or a change to the operation of an RPP zone. What changes can be made to an RPP zone? At anytime a petition can change the operation of a RPP zone. This includes adding or removing signs, changing time durations or even complete removal of the RPP zone. For any change to be implemented two thirds of the property owners on the affect road segment must sign a petition.

RECOMMENDATION: That the Heart of Our City Revitalization Committee continue

to examine alternatives or enhancements to the Downtown Redevelopment Incentive Policy, reporting back to City Council by March 1, 2010

PURPOSE: Heart of Our City Revitalization Committee’s response to the

referral from City Council regarding the Redevelopment Incentive Policy.

IMPLICATION OF RECOMMENDATION GENERAL: The Redevelopment Incentive Policy (RIP) for property in the

Downtown Business Revitalization Zone (BRZ) was put in place in 2003 for a five year period from 2004 to 2008. A provision in the policy stated “This policy will be reviewed for ongoing relevancy and necessity prior to December 31, 2008 with an option that it may continue in its present form or an amended form. City Council approved a one year extension to the 2004 RIP for the 2009 tax year and referred it to the Heart of Our City Revitalization Committee to evaluate the program and prepare recommendations for City Council by October 31, 2009 concerning the future of the program in conjunction with other potential downtown redevelopment initiatives. The Heart of Our City Revitalization Committee has reviewed the current Downtown Redevelopment Incentive Policy and will continue to examine alternatives or enhancements to the policy. It is expected that a full report and recommendations will be made to City Council by March 1, 2010.

FINANCIAL: The 2009 total rebate from the RIP was $62,789. It was

applied to eighteen properties, of which 3 were new applications.

IMPLICATION/ COMMUNICATIONS:

The targeted deadline of March 1, 2010 will ensure that the program is in place before the tax bylaw is contemplated.

The purpose of the Redevelopment Incentive Policy is to encourage redevelopment of Downtown BRZ property. The Heart of Our City Revitalization Committee is looking at all alternatives to ensure that the incentives will result in redevelopment.

BRIEFING SHEET Legislation & Policy City Council has the authority under Section 347 of the

Municipal Government Act to cancel a portion of a tax where it considers it equitable to do so.

RIP falls under the mandate of the Heart of Our City Revitalization Committee.

RECOMMENDATION: That City Council issue a notice by way of Form B in

accordance with City of Lethbridge Bylaw 3193, The Unsightly Premises Bylaw, to the owners of 1916 - 4 Avenue North, Andy Dormaar and Steven Dormaar And further that City Council set the date of November 30, 2009, for this matter to be reviewed at a Public Hearing.

PURPOSE: To provide notice to the property owners, Andy

Dormaar and Steven Dormaar, that the Regulatory Services Manager has reported to City Council that an investigation of the property has determined that the premises falls within the definition of unsightly premises according to Bylaw 3193 and to set a date for a Public Hearing where the property owner can make a presentation to City Council setting forth reasons why an Order should not be made to remedy the condition on these premises.

IMPLICATION OF RECOMMENDATION

GENERAL: A complaint was received with respect to the condition

of this property, and the subsequent investigation revealed the property contains: 4 unlicensed vehicles, as well as 1 unlicensed and dilapidated truck with body parts removed as identified in the photographs provided. In accordance with section 4 of Bylaw 3193, a notice to the owner and occupant to remedy the conditions found to be in violation of the Bylaw was posted at the address as prescribed in section 7. The owner has failed to remedy the conditions stated in the notice. Form A.

That City Council set a Public Hearing date approximately 30 days from the date that the Form B is issued to allow the owner the opportunity to make representation to City Council and set forth reasons why an Order should not be made. Following the Public Hearing, pursuant to City of Lethbridge Bylaw 3193, failing compliance, an Order of City Council may be made by way of Form C advising that the property owner has fifteen (15) days to remedy the untidy or unsightly condition of the property or the City may take the necessary action to remedy the condition of the property, and add the costs to the tax roll of said property.

a) all uses, terms, requirements and processes are as described in b) Sections 1-39 of Land Use Bylaw 4100, c) the general rules for all districts, as described in Sections 40-62 of the Land Use Bylaw 4100, apply to uses of the land described above. d) the general rules for commercial districts, as described in Section 63 of the Land Use Bylaw 4100, apply to uses of the land described above.

5. Uses and Rules Development at this location will be governed by the rules of the C-H (Highway Commercial) District with the following additions: a) add to permitted uses:

Mini-Storage Facility which means development for the storage of goods entirely within buildings. This is to be developed in general accordance with site and elevation plans attached to this bylaw as “Schedule B”. Other than RV storage, no outdoor storage is allowed. One office / retail store serving the mini-storage facility is allowed as a supplementary use. Rental of trailers, half-ton trucks, and cube vans is allowed as an accessory use. “Warehouse, Wholesale”, “Vehicle Sales, Rental”; and “Freight and Storage” are separate uses.

Unsightly Premises Bylaw Amendment 655-B

WHEREAS under the Municipal Government Act, Revised Statutes of Alberta 2000,

Chapter M-26, City Council has the power to pass Bylaws for municipal purposes

respecting unsightly properties

AND WHEREAS Unsightly Bylaw 3193 was originally passed by City Council in 1973

and has not been amended since 1988

AND WHEREAS the current process is somewhat lengthy and cumbersome

BE IT RESOLVED THAT that Administration undertake a review of the Unsightly Bylaw

3193 to identify options which will reduce the time between identification of an unsightly

property to resolution of the issue and report back to City Council with recommended

changes by December 14, 2009.

Unsightly Bylaw

Municipal Government Act “A council may pass bylaws for municipal purposes respecting the following matters: . . . (c) nuisances, including unsightly property”. (Section 7) Section 7 goes on to state that for the bylaw can impose a fine not exceeding $10 000 or imprisonment for not more than one year. Unsightly condition is defined as

(i) in respect of a structure, includes a structure whose exterior shows signs of significant physical deterioration, and (ii) in respect of land, includes land that shows signs of a serious disregard for general maintenance or upkeep.” (Section 546(0.1)(b))

Section 546 (0.1) outlines the process to issue an order to remedy unsightly property. The designated officer may require the owner of the property that is in an unsightly condition to

(i) improve the appearance of the property in the manner specified, or (ii) if the property is a structure, remove or demolish the structure and level the site. (Section 546(0.1)(1)(c))

The order may

(a) state a time within which the person must comply with the order; (b) state that if the person does not comply with the order within a specified time, the municipality will take the action or measure at the expense of the person. (Section 546(0.1)(2))

The MGA does allow a review by council if the person requests it within 7 days after the date the order is received. After reviewing the order, the council may confirm, vary, substitute or cancel the order. (Section 547) City of Lethbridge - Unsightly Bylaw 3193 - process is a notice is given to the Owner by the Building Inspector

(Regulatory Services), giving a date of compliance - after the date of compliance, Regulatory Services prepares a notice to

Council - Council directs that a notice in writing be served upon the owner (Form “B”).

Notice gives option to owner to make representation to the Council (schedule Hearing)

- After Hearing, Council may choose to send out notice to remedy within 15 days (Form “C”)

- Where the owner does not remedy the condition, the City can remedy the situation, charging costs to the owner

City of Edmonton – Community Standards Bylaw 14600 - City Manager may by written order require any person responsible for the

contravention to remedy it - His powers can be delegated to another employee - Bylaw does not mention a hearing City of Calgary - Community Standards Bylaw 5M2004 - Any appeals from a Remedial Order goes to the License and Community
