“Repairing ,overhauling and assembly of one old 20 HP diesel engine of pump set and pipe laying along with foot valve from well to Gara Nala and connection of suction and delivery line of the pump in

Mechua Village.of Bhatin mines.” The tenderer or contractor has to complete the activities as per SL. No – 1-13.The tenderer or contractor has to examine old 20 HP diesel engine of pump set and pipe laying in Mechua at Bhatin Mines. before submitting the quotation. Any modification, repair, addition of parts, which will be required for the completion of the system will be in the scope of the contractor irrespective of whether it is indicated in the proposal or not. The tenderer or contractor has to complete overhauling of engine and pipe lines with footvalve and mount the pump set on foundation frame in Mechua pump house. Finaly trial run will be carried out by tenderer .

Nature of Work: - SL. No – 1-13

1. Repairing and overhauling of diesel engine for smooth running for the pump. 2. Pipe line laying along with foot valve from well to Gara Nala and connection of suction and delivery line

of the pump. 3. Dismantling and assembling of diesel engine. 4. Collection of fuel pump’s spares and its calibration. 5. Collection of crank bearings and grinding etc. 6. Collection of cooling pumps spares and repairing etc. 7. Collection of self starter and its installation including ring gear etc. 8. Dynamo repairing. 9. Collection of piping for diesel etc. 10. Collection of spares for other sub assemblies. 11. Collection of foot valve leather type. 12. Foundation fabrication. 13. Pipe laying with foot valve etc.

Scope of Contractor

1. The contractor has to examine the condition of engine and note detail of engine and shift the engine at own site if it is required for overhauling the engine.

2. The contractor has to make the list / drawing and get approval of drawing or list of spares by the engineer in charge, if it is required to him for completion of the job.

3. The contractor has to take all the raw material as per terms from our store and shift to the working site. 4. The contractor has to purchase / arrange all the material for diesel engine in his own cost. 5. The contractor has to arrange all the repairing/machining jobs like crank grinding, cooling pump, valve

setting, etc in his own cost. 6. The contractor has to arrange all the spares and jobs related to diesel engine on his iwn cost for overhauling

the engine. 7. The contractor has to purchase Foot valve leather type, ring gear, pipes for fuel (diesel) line, crank brg, self

starter/dynamo in his own cost. 8. The contractor has to fabricate the foundation frame for pump set if required as per approved drawing/

instruction. 9. The contractor has to lay GI pipes 6”/4” and fix the foot valve in it. 10. The contractor has to overhaul the engine and arrange tools and tackles for it. 11. The contractor has to supervise the job and get it inspected by engineer in charge time to time.

12. The contractor has to Install and commission of one old 20 HP diesel pump set with pipe laying in Mechua Village.

13. The contractor has to show the trial for at least 100 hours.

Scope of UCIL

1. All the materials like plate, channel,angles,fasteners,pipes etc for fabrication of foundation frame and pipe laying will be supplied by UCIL.

2. All the consumables like Cement, concrete, gas cylinders, welding electrodes etc will be supplied by UCIL. 3. Welding machine,cutting torch,regulators and safety items will be supplied by UCIL 4. Hospital facility in case of IOW on chargeable basis. 5. Water pump with all fittings will be supplied by UCIL. 6. Fuel (Deisel) will be provided for trial run by UCIL.

If any change is otherwise required for the completion of the job the contractor shall include or exclude the portion as per actual requirements.

01. Security Deposit : The total amount of Security deposit shall be 10% of the value of the work (inclusive of EMD). You have to deposit 5 % of total value of the work in Cash / Demand draft from SBI – jaduguda / Jamshedpur or PNB – Jamshedpur within 15 (fifteen) days from the date of issue of this work order. In addition to the above further amount to the extent of 5% of the value of the total work will be deducted from your bills.

02. Completion period : Completion time of the work shall be 3(three) months which shall be reckoned from the date of commencement of the job.

03. Defect liability period : There shall be no defect liability period.

04. Scope of Work : As given in the ANNEXURE :-A.

05. Income tax / Sales tax : If applicable, shall be deducted as per norms of the corporation.

05a. Service tax : Extra.

06. Insurance : The insurance shall be covered as per surface working rules

and insurance coverage shall be for all of your workmen for the whole period of contract and shall be furnished to the corporation before the commencement of the work to indemnity Ms Uranium Corporation Of India Limited , against all risks , losses, claim for compensation etc , arising from the contract in question.

07. Regulations/Rules & Acts : The work has to be carried out as per provisions of :-

i) Mines Act 1952. ii) Metalliferrous Mines Regulations 1961 iii) Mines Rules – 1955. iv) Indian Electricity Act v) Indian Electricity Rules vi) Minimum Wages Act. vii) Minimum Wages Rules. viii) Contract Labour (Regulation & Abolition) Act – 1970. ix) Contract Rules –1971. x) Employeis compensation act,1923

And all other rules and laws applicable to the metal mines in regard to the works awarded .You should arrange all necessary labour muster rolls, Workmen’s attendance registers etc before commencement of the work as per norms.

08. Payment : Payment shall be made by Running Account Bills.

09. Minimum Wages : Minimum wages of the skilled/ unskilled workmen engaged in the work shall be as per notification of the ALC ( C) , Chaibasa & NIT. In case of any increase in the minimum wages, the same has to be paid by you. The corporation against this work shall pay no escalation.

10. Certificate Of Liability : You have to give a Certificate of liability against the damage

done by your employees/ workers .

11. Address of your workers: You have to furnish detailed addresses of your employees / workers.

12. Variation of contract : Work up to a variation of 10 (Ten) % on the contract amount and quoted

rate shall remain firm within this limit.

13. Site Conditions : All the work shall be executed as per existing site conditions

and no extra claims shall be entertained.

14. Tools & Tackles : shall be arranged by you.

15. Job Conditions : All other terms and conditions like compensation for delay, termination of the contract etc shall be governed as per standard general practice of Ms Uranium Corporation Of India Limited

16. Safety : You shall maintain all precautions during the execution of the

work. You should provide your own safety appliances like safety belts, helmets etc for the work.

17. Vocational Training : All of your workers shall have to take necessary vocational

training for working in underground mines in our vocational training center for a period of seven days or you shall produce a certificate showing that the worker has undergone the necessary training at some training center within last twelve months.

18. Medical Fitness : The contractor’s employees working inside the mines including persons deployed on surface and underground should obtain the medical fitness certificate in Form “O” certified by a Registered Medical Practitioner. The certificate shall be deposited with the Personal Section of Jaduguda Mines.

19. Stoppage Of work : Interim stoppage of work for any reason during the execution of the work for which no extra claim will be entertained by the corporation.

20. Payment by contractor : If it is found that the labour payment on stipulated payment day is not followed by the contractor and non-issue of the wages slips to the labour engaged for this work the corporation shall compel you to stop the work, make necessary payments to your labourers and recover the amount from your bills / deposits.

21. Engineer- in –Charge : Sri S.K.Singh,Dy.Supdt. ( Mech ) shall be the Engineer- In- Charge for this job and Sri U.K.Sadhu, G.F/M (Mines) shall be engineer’s representative for this work.

22. Agreement : You are requested to execute an agreement on stamp paper in the prescribed form with the corporation within 10 (Ten) days from the date of issue of this letter.

23. Terms & Conditions : All the terms and conditions shall be as per above NIT UCIL /MECH/BTN/1/14-15 and special terms and conditions given in the NIT.

24. Acceptance : Please sign the duplicate copy of this letter as a token of your acceptance and return to the undersigned.

Scope of work as detailed enclosed with tender document. Special Condition:-

1. The tenderer or contractor has to examine the old 20 HP diesel engine of pump set and pipe laying in Mechua Village.of Bhatin mines before quote the rate.

2. Accommodation & Transportation for the contractor’s worker: - No accommodation in the company housing colony at Jadugora Mines/ Bhatin Mines shall be possible for the contractor’s or representative.

3. Carriage/ transportation for any material except otherwise stated, shall be paid by the department. Contractor shall quote their rates for the items accordingly.

4. Medical care :-

The contractor shall be fully responsible for any first aid and emergency medical treatment to the employees. Necessary arrangements for this purpose shall be made by the contractor at the site. In serious cases medical facilities of the Corporation may be made available on chargeable basis.

5. Payment terms :-

Contractor shall be paid as a one time lump sum of 100 % of the total value duly certified by the Engineer- In – Charge within thirty days of the satisfactory completion and running of the job.

6. All quoted rate shall be valid for 180 days from date of opening the tender.

7. Warranty period: - There shall be an warranty period of three months one hundred hours.

8. In case of stoppage of work by local people / bandh or any other reasons no idle charge will be paid by the corporation towards labour, plant and machinery etc. to the contractor for this work.

9.The contractor is required to arrange suitable handling devices, tools & tackles etc.as required for handling and erection purpose and all other materials required for proper implementation Of the job other than those provided by UCIL.

10. Completion period is three months from the date of commencement of the job.

11. Income Tax / Sales Tax: - If applicable, shall be deducted as per norms of the Corporation.

OTHER TERMS AND CONDITIONS:

1. SALES TAX: Sales Tax / Work Tax – if applicable – as per rule shall be recovered at source on gross value of the work executed. The contractor shall bear the additional amount, if due on this account against this work order and shall be responsible to deposit the same directly to the sales tax authority and obtain clearance from them.

2. SECURITY DEPOSIT: The total amount of security deposit will be 10% of the total value of the awarded work. You have to deposit 5% of the total value of the work awarded towards Initial Security Deposit before signing of the agreement, In addition to the above, further amount to the extent of 5% of the awarded value of Work will be deducted from your bill.

3. COMPLETION PERIOD: Time of completion of this work shall be 03 (Three) months from the Date Of Commencement of the job / Date Of Issue of Work Order (as mentioned in the Work Order). The Date of Commencement of the work shall in any case shall not exceed 10 (Ten) days from the date of receipt of the Work Order.

4. WORKING HOURS: The work shall normally be carried out either in“G” or “A” & “B” shifts of normal working hour of Jaduguda Mine ie between 7.00AM to 12.00MN & 2.00 PM to 5.00 PM or 7.00AM to 3.00 PM & 3.00 PM to 11.00 PM by deploying your personnel on shift basis.

5. The extension of work beyond working hours if any shall be carried out after obtaining prior permission of the Engineer-In-Charge / Mines Manager for which no extra claim shall be entertained.

6. You shall obtain necessary insurance coverage for all of your workmen with names and addresses and shall submit the same to the Corporation before commencement of the Work to indemnify Uranium Corporation Of India Limited against all risks, losses, damages and claims arising from the contract in question.

7. The awarded rate shall be firm and no escalation on any account whatsoever shall be paid against this work. 8. You have to give a certificate of liability for damages done by your employees / workmen .You have to

provide details of address of all of your workmen / employees. 9. No tools & tackles shall be provided by the Corporation for this work. 10. There shall be defect liability period for 100 hours only. 11. You should hand over the clear site to the Corporation after completion of the job after removing all the

Surplus material – if any, spoils, debris etc failing which the Corporation reserves the rights to 12. Retain the final bill till site clearance is completed or engage some other agency to carry out site clearance at

your risk and cost. 13. In case of stoppage of the work by local people / bandh or by any other reasons, no idle charges shall be paid

by the Corporation towards plants, machineries, labour etc to the contractor against this job. 14. You shall have to provide facilities under the provisions of the Contract Labour (Regulation & Abolition)

Act, 1970 Section – 16,17,18 &19, Chapter-V, Welfare and Health Contract Labour. 15. Quality of any individual item may vary to some extent and all awarded rates shall remain firm within this

limit. 16. UCIL shall not issue any Plant and / or Machinery for this work whereas otherwise stated.

17. You should ensure one experienced Engineer / Supervisor deployed on regular basis for this work. 18. Usage of cooking gas (LPG) is strictly prohibited for this work. 19. You shall arrange drinking water and first aid facilities at site at your own cost. 20. Safety precautions shall be maintained by the contractor during the execution appliances like helmet, gum-

LABOUR EMPLOYMENT CONDITIONS.

LABOUR

01. The contractor shall employ labour in sufficient number to maintain required rate of progress and of quality to ensure workmanship of the degree specified in the contract and to the satisfaction of the engineer-in charge. The contractor shall not employ in connection with the works any persons who has not attained the age of eighteen years.

02. Contractors should employ only the persons with established identity.

03. Dy. commandant, CISF will issue temporary identity cards to persons actually engaged in the work and may exercise checks as considered necessary to ensure that strangers are not permitted inside the work premises, Contractors are required to surrender the identity cards on completion of job to Dy. Commandant, CISF who will issue clearance certificate.

04. CISF control room will not allow any interstate labour as a contact labour in any case.

05. The contractor shall furnish to the Engineer-in-charge at the interval mentioned in schedule-F, a distribution return of the number description by trades of work people employed on the works. The contractor shall also submit on the 4th and 19th of every month to the Engineer In charge a true statement showing in respect of second day of the preceding month and the first half of current month (i) the accident that occurred during the said fortnight showing the circumstances under which they happened and the extent of damage and injury caused by them and (ii) the number of female workers who have been allowed Maternity Benefit as provided in the Maternity Benefit Act 1961 or rules made thereunder and the amount paid to them.

06. The contractor shall pay to labour employed by him wages not less than fair wages as defined in the Contract Labour (Regulation & Abolition) Act. 1970 and Rules made thereunder.

07.The contractor shall in respect of labour employed by him comply with or cause to be complied with the Contract Labour (Regulation & Abolition) Act. 1970 and Rules made thereunder in regard to all matter provided therein.

08. The contractor shall comply with the provisions of the payment of Wages Act 1936 , Minimum Wages Act. 1948 , Employees Liability Act.1938 , Workmen Compensation Act. 1923, Industrial Disputes Act. 1947 , Maternity Benefit Act.1961 and Mines Act.1952 or any modifications thereof or any other law relating thereto and rules made thereunder from time to time.

09. The contractor shall be liable to pay his contribution and the employees contribution to the employees State Insurance scheme in respect of all labour employed by him for the execution of the contact , in accordance with the provision . The employees State Insurance Act 1948 as amended from time to time and as applicable in this case.

10. In case the contractor fails to submit full details of his account of labour employed and the contribution payable, the Engineer in charge shall recover from the running bills of the contractor an amount of contribution as assessed by him . The amount so recovered shall be adjusted against the actual contribution payable under Employees State Insurance Scheme.

11. The Engineer in charge shall on a report having been made by an inspection staff as defined under the contract Labour (Regulation & Abolition) Act 1970 and rules made thereunder, shall have the power to deduct from the money due to the contractor any sum required or estimated to be required, for making the good the loss suffered by a worker or workers by reason of non-fulfilment of the conditions of the contract for the benefit of workers , non-payment of wages or of deductions made from his or their wages which are not justified by the contract or non-observance of the said Act.

12. The contractor shall indemnify the Corporation against any payment to be made under and for observance of the contract Labour (regulation & abolition Act. 1970 and the rules made thereunder without prejudice to his right to claim indemnity from his sub-contractors.

13. In the event of the contractor committing a default or breach or any of the provisions of aforesaid Act. and Rules made thereunder /amended from time to time or furnishing any information or submitting or filling any Forms /Register / Slip under the provisions of the law which is materially incorrect, then on the report of the Inspecting Officer , the contractor shall without prejudice pay to the Corp[oration a sum not exceeding liabilities for such defaults including liquidated damages etc. for every default, breach for furnishing, making, submitting, filling materially incorrect statement as may be fixed by the Labour Department and the contractor should indemnify the Corporation against all such liabilities

MODEL RULES FOR LABOUR WELFARE;

1.1.1 The Contractor shall at his own expense comply with or cause to be complied with Model Rules for Labour welfare as provided under the rules framed by the appropriate Government from time to time for protection of health and making sanitary arrangements for workers directly or indirectly on the works. In case the contractor fails to make arrangement as aforesaid, the engineer in charge shall be entitled to do so and recover the cost thereof from the Contractor.

1.1.2 Failure to comply with Model Rules for Labour welfare, safety code or the provisions relating to report on accidents and to grant Maternity Benefit to Female workers shall make the contractor liable to the corporation as liquidated damages an amount not exceeding Rs.50.00 for each default or materially incorrect statement. The Decision of the engineer in charge in such matters based on reports from the Inspecting Officers shall be final and binding and deducting officers shall be final and binding and deductions for recovery of such liquidated damages may be from any amount payable to the contractor.

SAFETY OF CONTRACTORS EMPLOYEES

The Contractor shall at all times, take all reasonable precaution for the safety of employees, including these of sub-contractors in the performance of his contract and shall comply with all applicable provisions of both Central as well as the State Safety Laws. In addition to the safety provision already included in the tender, the contracting officer shall include the safety requirements recommended by the Health Physics Unit, Jaduguda for a specified contract. In the event that the contractor fails to comply with these provisions, the contracting officer may, without prejudice to any other legal or contractual rights, issue an order stopping all or any part of the work, thereafter a start order for resumption o work may be issued at the discretion of the contracting officer. The contractor shall make no reason of or in connection withsuch stoppage.

2. Contractors shall have a full time Safety Officer/Engineer when the contractor employees 500 or more persons or when engaged in specially hazardous work. In the case of contractors employing fewer than 500 persons his safety representative shall be an employee in a high supervisory capacity and his safety duties may be in addition to other technical administrative duties.

3. Contractors shall have at least one person fully trained in First Aid present at the site of work all the time.

4. Contractors must report to the Health Physics Unit, Jaduguda through their contracting officers every accident involving.

Contractors must report to the Health Physics Unit, Jaduguda immediately on becoming

aware of any accident of Type-A (see Appendix-1) giving the following information :

4.1.1 Contractors shall submit their investigation reports, through their contracting officer, to the Health Physics Unit immediately but not later than 3 working days after the occurrence of accident in the form-A (see Appendix –2)

In the case of Type – B accident (see Appendix – 1), contractors shall submit their investigation reports, through their contracting officers, to the Health Physics Unit immediately but not later than 3 working days after the accordance of accident in the form – A.Monthly summary of accidents and cases of fire shall be prepared by each contractor in form-B(see Appendix –3) and be sent to the Health Physics Unit, Jaduguda by the 7th of the next month.

Prime Contractor report shall include the man days lost and occurrence of accidents under the jurisdiction of the Sub-contractors.
