NOTICE INVITING QUOTATIONS FOR RUNNING OFFICE CANTEEN/CAFETERIA ON

CONTRACT BASIS.

Sealed quotations are invited from persons/agencies, possessing requisite license and having two years’ or more experience in catering service for running Public Canteen and Staff Canteen in the Govt. offices/organizations for running Canteen/Cafeteria in the office of Food Corporation of India, D.O., Nagaon, Assam for a period of two years.

The tender forms can be obtained from the office of the Area Manager, FCI, D.O.,

Nagaon between 10:00 AM and 05:00 PM on all working days from 15.03.2016 to 25.03.2016 on payment of non-refundable fee of Rs. 500/- by way of Cash. It may also be downloaded from our website www.fci.gov.in and be used for submission. In case of the downloaded tender document, the Cost of Rs. 500/- in the form of separate Demand Draft drawn in favor of “FOOD CORPORATION OF INDIA” payable at NAGAON should be enclosed with the tender documents.

The tender documents containing the scope of work and terms and condition of the contract is available on our website www.fci.gov.in. The duly filled in Tender Document with relevant supporting documents is to be submitted to the Office of the Area Manager, FCI, D.O., Nagaon along with a Demand Draft for Rs. 2,000/- as Earnest Money, drawn in favor of “FOOD CORPORATION OF INDIA” payable at NAGAON on or before 25.03.2016 by 2.00 p.m. The Financial Bid of the Tender shall be opened on 25.03.2016 at 3.00 pm in the presence of the bidders.

Before submitting the Tender, the interested parties/agencies may visit FCI Distt.

Office, Nagaon and take a stock of the situation. They may also seek clarifications, if any, from this office.

The decision of the Area Manager, FCI, D.O., Nagaon with regard to acceptance

or rejection of all tenders without assigning any reason will be final and binding.

Annexure ‘C’

Terms and Conditions for Running Canteen/Cafeteria (A) CANTEEN/CAFETERIA PREMISES:

(1) The Office Canteen/Cafeteria is situated on third floor of the office building.

(B) SECURITY DEPOSIT, LICENSE FEE, etc.:

(2) The Licensee shall deposit an amount of Rs.2,000/- (Rupees two thousand only) towards security deposit.

(3) The Licensee shall pay License Fee at Rs.200/- (Rupees two hundred only) per month or at the rate as may be fixed by the Competent Authority from time to time.

(4) The Licensee shall pay the monthly license fee to the Licensor every month in advance, on or before the 5th day of the month.

(5) If the said monthly license fee or any part thereof falls in arrears and remains unpaid for a period of 60 days or more from the due date, it shall be lawful for the Licensor to terminate the License, without any notice in that behalf.

(C) PERIOD OF LICENSE, RENWAL, etc.:

(6) The period of license shall be two year from the date of allotment.

(7) The Licensor will have the discretion to renew the License on the same terms and condition and at the same rates on written request made by the Licensee at least two calendar months before the expiration of the License for such further period and at such license fee as the Licensor may deem proper.

(8) The Licensee shall not sublet or part with possession of the demised premises or any portion thereof in favour of anyone else.

(9) The Licensee shall not use the premises for any other purpose except for running the canteen.

(D) INFRASTRUCTURE FACILITIES, MAINTENANCE,

ELECTRICITY CHARGES, TAXES, etc.:

(10) The Licensee shall not remove from the canteen/cafeteria any of the articles or fixtures & fittings provided by the Licensor.

(11) The general maintenance of the demised premises will be carried out by the Licensee at his/her own expenses.

(12) The Licensee shall also pay license fee, deposit for the Gas Cylinders connection including for recurring Gas consumption.

(13) The Licensee shall have to obtain necessary License, if any, from the Competent Authority for running canteen immediately from the date of granting the License and before starting the canteen.

(14) The Licensee shall keep the canteen premises inside and outside absolutely neat and clean.

(15) The staff of the canteen will not be permitted to use the canteen premises as rest room or lodging house.

(16) The FCI shall provide basic infrastructure such as space (Dining, Kitchen, Store and Washing area). The Licensee shall keep the same in clean and good condition. The agency should make its own arrangement for any special equipment, if required.

(17) The contractor will have to submit an affidavit at the time of signing the agreement indicating that all employees of the contractor are paid the minimum wage as per Minimum Wages Act of Assam Government.

(18) The contractor will be solely and exclusively responsible to adhere to meet out all statutory obligations under Indian law in respect of compliance of all the rules, regulations and directions given by a statutory authority with regard to safety, labour laws, PF&ESI remittance or any other prevalent laws both of Central and State Enactments.

(19) The contractor will also submit a medical certificate on yearly basis that all his/her employees handling food are not having any contagious diseases.

(20) The contractor will ensure that neat and clean clothes and aprons are used by his/her employees handling food at all times.

(21) FCI reserves the right to ask & require the contractor to remove any person deployed by the contractor without assigning any reason or notice.

(22) The contractor will ensure high standard of cleanliness, hygiene and sanitation in the kitchen and canteen. The contractor will make the arrangements for keeping all eatables in covered showcase, free from flies and insects. Adequate number of dustbins will be provided by the contractor to ensure proper disposal of garbage.

(23) There should not be any littering of unused food or any other articles within the canteen. The contractor will also ensure that no used utensils viz Cups, Thalies are lying in the FCI premises and these should be removed immediately.

(24)The contractor will ensure that the cooked and uncooked food is stored properly and

no stale food is served. In case of any food poisoning, the contractor will be held solely responsible and will be penalized besides legal action.

(E) QUALITY OF FOOD ITEMS:

(24) The Licensee shall provide all the food articles, eatables as well as tea, coffee, beverages etc., of good quality in hygienic condition at quoted rates and quantity as approved by the Authorities of the FCI and shall display such details on a board at a conspicuous place in the canteen.

(F) CONDUCT OF THE LICENSEE:

(25) Behaviour of the Licensee himself/herself as well as his/her staff must be courteous and cooperative towards the employees, students and public visiting the canteen. (26) The staff of the canteen shall put on uniform provided by the licensee at his own

Cost.

(27) The Authorities of the FCI shall make inspection from time to time to ascertain whether the Licensee complies with the terms agreed upon and the Licensee shall comply with the instructions in this regard issued by the Area Manager or any competent authority.

(28) The Licensor shall not be liable for any damage caused to or loss incurred by the Licensee either by the act of God or for any other reason.

(29) The Licensee shall run the canteen throughout the year on all working days between 9.00 a.m. to 6.00 p.m.

(30) The Licensee shall not keep, store, sell, deal with or allow the sale of nor shall deal with any item which is prohibited by law and which is injurious to health viz. Bidi, Cigarettes, Gutkha etc.

(31) The Licensee shall be subject to the regulation of the Labour Law. No child labour be employed at any cost.

(G) TERMINATION OF CONTRACT, VACATION OF THE CANTEEN/CAFETERIA etc.:

(32) The Licensee shall give one month’s notice to the Licensor in case he/she intends to vacate the demised premises.

(33) The Licensee will at the expiration of the period of License, peacefully and quietly hand over vacant possession of the demised premises to the Licensor without raising any

dispute whatsoever.

(34) The Licensee shall not put up any permanent structure or make any alterations or additions to the demised premises without the prior consent in writing of the Licensor.

(35) The Licensee will be at liberty to remove all the movable articles brought by the Licensee in the demised premises during the continuance of the contract, before delivering possession of the demised premises.

(36) In case of loss or damage caused to any of the furniture, fixtures, fittings, etc., provided by the licensor the cost thereof shall be recovered from the licensee and the same shall be deducted from the security deposit.

(37) If the Licensee commits breach of any of the aforesaid terms and conditions, the License will stand terminated forthwith and the Licensee shall have to hand over vacant and peaceful possession of the premises to the FCI (Licensor) without raising any dispute whatsoever.

(38) In case of the Licensee going in liquidation, the License will be treated as cancelled and legal heirs/representatives or successors of the Licensee will not be entitled to claim any right over the demised premises.

(39) The water and electricity facilities will be provided by FCI.

(40) The Licensee shall pay all the dues of the FCI towards license fee and/or rent before vacating the demised premises.

(H) REGISTRATION FEE:

(41) The expenses for drafting execution, registration charges, stamp duty etc., relating to the agreement shall be borne by the licensee.
