What makes them want to come and do the yard work. Us: Opp: Can they do the yard work? Reciprocal obligation? Us Opp: Want mutual apology, just want the neighborhood to see that Reubens are friend with here again. She was hurt by the threat of the legal action without any negotiation. She is pained. Us: We can talk to them about mutual apology. Opp: Don’t want to go to trial. - She wouldn’t be satisfied if animals were taken away from her. - animal was a neighborhood problem including reubens, has to be a neighborhood initiative - decreased standing in the community is a major issue for Mrs. Andover - can they work something out regarding strays, but set something to help shelters by donating their time or helping them in someway.

Us: if she notifies somebody such as the Reubens, can they call somebody?

Opp: that might be doable.

Us: if $3000 not used for surgery, could be donated?

Opp: She doesn’t want animals to be killed, she has humanitarian concern about the way animals are treated, doesn’t want animal control to be called.

Settlement from OPP: community back together, mutual apology, willing to give some money to help with surgery, her abilification is a major concern, don’t want to live in a hostile community, will be mentally harmful, doesn’t want her to go to a trial, they are confident that she is not the owner of the animal though.

- not comfortable with covering all of the out of pocket costs, as Reubens contributed to the incident as well. Agreement should be confidential, if it gets out then people would know she paid all the money, would dirty her name.

- $1600 + $3000 as contingent half and half for out of pocket says that it wasn’t her fault entirely- Willing to pay $3000 to maintain good terms.

Our offer $3000 upfront, cut contingent in half if there is surgery and release insurance claim.

Opp: If no surgery then also she will end up paying the total amount?

Us: we are not including upcoming appointments and after surgery care.

Opp: Potential for this information to get out? There could be detrimental effects. She doesn’t want to take further action against Reuben if that happens. - 2K upfront 2K contingent = she will take over majority expenses, but shouldn’t show that it was her fault.- Reubens was present when this happened, was her responsibility to not let billy go under the porch.- There will be bad blood between them if she is made to pay.

- Final Offer: $2200 upfront + $2000 contingent; confidentiality agreement- goodwill returned in the community, insurance claim dismissed; another third party will be called at reubens discretion whom she contacts or party of her choosing but she won’t harbor; no stray domesticated animals or pests, Reubens won’t have strays either, reubens will help with yard work, children will play in yard, healing time to interact with animals in some controlled environment, mutual apology.
