To ask the Manager to commence an investigation into the oil pollution in the lake in Poppintree Park, to visit local businesses and to fine where necessary if evidence is found of pollution. 22. Motions NW/115/15 Motion in the name of Councillor Anthony Connaghan That the Manager provides a report on Boiler Maintenance. Can the Manager provide costings for maintenance of boilers to include all services, repairs and general maintenance. How many are seen to on a yearly basis and what is the average time spent on the different inspections at properties. Can the Manager outline whether or not successful tenderers are permitted to use contractors for work carried out. ORDER: Report to Councillor. That the Area Committee writes to the Minister to request that the funding be provided for further insulation works in Dublin North West. Some of the council properties which are showing the effects of dampness could be properly insulated to prevent this issue re-occurring. Numerous tenants are consistently complaining that the dampness comes back regardless of the measures taken to reduce it. Replies from the council to tenants, asserting that the problem is with condensation and telling them that the responsibility lies with the tenant, are disgraceful and a poor response. The funding is necessary to continue the programme for insulation and this Committee should demand that it is provided urgently. ORDER: Report to Councillor. Councillor Carney Boud expressed her disappointment with the report received. Mr. Byrne to forward the Councillor information on controlling condensation and mould. To call on the Local Area Office to publish any of their proposals for future realignment of Community Forum structures and to ensure an adequate timeline for consultation and feedback from residents in this respect. Dunmanus Senior Citizens Development

Main Contractors Tender:

We received 22 submissions for the pre-qualification stage on Friday last. The tender

assessment is currently underway and we hope to have a shortlist of 8 contractors within two

weeks on completion of the due diligence and clarification stage.

Programme:

The original programme has slipped a little. However, we are still due to be on site in the

month of October. This is dependent on timely approvals from both DCC and the DECLG on

receipt of the tender figure, the recommendation for the main contractor and the overall

project budget. Construction completion (16 - 18 Months) January 2017 – March 2017.

Budget:

The pre-tender construction estimate is higher than anticipated and in excess of our

approved budget. This will result in new Capital Advance Leasing Finance (CALF), Capital

Assistance Scheme (CAS) and Housing Finance Agency (HFA) applications for funding. We

propose to do this on tender issue in June and again based on actual tender figures in late

August. We hope that this will not slow down the programme and will happen in tandem as

much as possible.

Luas

Linda Carroll has been appointed as the Local Liaison Officer for Luas. Fergus Synnott will

be making contact with her to discuss her role with residents.

Pelletstown Naming and Numbering – Castlethorn Application

Castlethorn have been advised of the councillors’ rejection of their naming scheme and have

been invited to re-submit. Their revised application is awaited. Meanwhile, Ballymore have

submitted an application for the same development which will be put to this meeting.

Phibsborough Local Area Plan (LAP)

A draft copy of the LAP was sent to the North West and Central Area Managers who will

review it with the Planning Department with a view to presenting it to councillors at the June

North West Area Committee meeting.

The previous LAP had a lifespan of 6 years from Oct 2008. LAPs as statutory documents

must be made, reviewed or revoked every 6 years. Both the legislation and the Department

are quiet as to the status in between a 6-year end and a new plan in place. Council have

voted to amend the 2008 Plan, and that is what we are working towards. In the interim the

Development Plan is the statutory framework with the 2008 LAP providing some guidance.

Ratoath Road Community Liaison – Irish Rail Project

The latest phase of the project is the planned erection of a boundary wall to protect houses

in Ratoath Estate from environmental noise and visual intrusion from traffic on the flyover. It

is due to be completed toward the end of May. The Committee next meet on Tuesday 26th

May in the Cabra office at 4pm. We have also submitted requests to the Traffic Department

for improved signage for Pelletstown/Ashtown and Finglas.

Royal and Grand Canal Day of Action

Despite awful weather The Dublin City Canals Day of Action was a great success which is a

tribute to our volunteers, many of whom were from overseas and not used to our testing Irish

climate. We cleaned the full length of the Royal Canal from North Strand to Ashtown. The

fact that we could cover so much ground attests to the improving quality of the canal due to

the regular monthly clean ups. The Lord Mayor generously showed his appreciation by

sponsoring a reception for volunteers in the Mansion House on May 6th which was hosted by

Cllr Larry O’Toole in his absence.

COMMUNITY AND SOCIAL DEVELOPMENT

Phibsboro Tidy Towns Initiative

The launch of the Phibsboro Tidy Towns Initiative took place on Saturday 18th of April in the

setting of Phibsboro Library Garden following a Spring Clean of the neighbourhood. It was

launched By The Lord Mayor Councillor Christy Burke, who planted a tree to mark the

occasion. The group acknowledged the support provided by Dublin City Council

Departments and volunteers from the community. Refreshments were provided by local

traders and the music was by a Barber Shop Quartet and a Traditional Ensemble. Many of

the attendees from the area are also involved in the Pride of Place Competition entering the

Basin Park and surrounding streets.

Community Plant Sales are taking place during the last two weeks in May. Many of the

environmental groups will be selling plants to their neighbours, at a much reduced cost, to

plant in their gardens and window boxes, and communal areas. The plants are always in

great demand every year.

Altona Terrace resident Tommy Hodnett and some volunteers held a plant sale on Saturday

9th May and raised €1,500 for animal welfare. He also opened up his home, which is a period

style house, and hosted a coffee morning for neighbours on the North Circular Road. This is

his 6th year to host this gathering for a cause close to his heart

The Bealtaine Festival celebrates creativity while ageing and runs for the month of May.

There is an activity packed brochure available in the local area office and the libraries or on

www.dublincity.ie

The Men’s Club in Cabra is growing in numbers and is getting involved with more community

groups. They have made signs for the Senior Citizens Complexes and are constructing bird

boxes at the moment. New members are welcome.

Social Inclusion Week (25th to 29th May)

Activities in Cabra: The Cabra History and Folklore Group are hosting an open morning on

Friday 29th and Christ the King Day Care Centre are hosting a Coffee Morning on

Wednesday 27th from 10am to 12 noon.

Hamilton Way, Hamilton Walk, Hamilton Rise and Hamilton View - Associated with the History of the Royal Canal and the Locality. These names are proposed for the area to the south of Spindrift Avenue, to the east of Bridge Avenue and west of Ratoath Road. Sir William Rowan Hamilton (1805-1865) was one of the world's most outstanding mathematicians. He was born in Dominick Street in Dublin and spent his youth on the banks of the River Boyne in Trim, Co. Meath. Hamilton was appointed Professor in 1827 while still an undergraduate at Trinity College, and lived at Dunsink Observatory for the rest of his life. He regularly walked along the banks of the Royal Canal while pondering his theories. It was during these walks that Hamilton developed the first non commutative algebra to be studied – “Quaternions”. He carved the formulae on the stone of Broome bridge on the Royal Canal (ref article: JJ O’Connor and EF Robertson – copy attached). Hamilton's quaternions opened up a whole new mathematical landscape in which mathematicians were now free to conceive new algebraic number systems that were not shackled by the rules of ordinary numbers. Thus, one can say that modern algebra was born on 16 October 1843, on the banks of the Royal Canal in Dublin. Having regard to Sir William Hamilton’s strong links to the locality it is considered fitting to incorporate his name within the Royal Canal Park development. This name is proposed to continue the nautical theme through the Royal Canal Park development. 1-27 Watermark Building, Spindrift Avenue, Royal Canal Park, Dublin 15 1-27 Foirgneamh an Chomhartha Uisce, Ascaill an Cháite, Páirc na Canálach Ríoga, Baile Átha Cliath 15 Watermark is the mark or line indicating the greatest height to which water has risen. This name is proposed to continue the nautical theme throughout the development. 1-19 Waterline Building, Ratoath Road, Royal Canal Park, Dublin 15 1-19 Foirgneamh Bharr an Uisce, Bóthar Ráth Tó, Páirc na Canálach Ríoga, Baile Átha Cliath 15

The waterline is the line on a hull of a boat to which the water rises. This name is proposed to continue the nautical theme throughout the development. Conclusion: The nautical theme was established in the naming schemes which were approved by Dublin City Council for the Phase 1 and Phase 2 developments in Royal Canal Park and for this reason it was considered appropriate that this theme should be continued through into Phase 3 and this is reflected in the names which are set out above and as shown on the O’Mahony Pike drawing LS00pa which is included with this submission. The numbering scheme for the streets and apartments is also noted on the O’Mahony Pike drawing. “The Heritage Officer is happy to recommend approval of all the proposed names of this

I would actually say the proposed names, notwithstanding their pre-existence in the already built sections of the development, are exemplary in how they fulfil the Dublin City Council Naming Circular. “ The names above are considered suitable and are recommended for adoption. With reference to the proposed disposal of the Council’s fee simple interest in

No. 58 Fassaugh Avenue, Cabra, Dublin 7.

Under Indenture of Lease dated 15th of May 1945 the property known as No. 58 Fassaugh Avenue, Cabra, Dublin 7 was demised by Dublin City Council to Thomas Devine for a term of 150 years from 29th September 1944 subject to an annual rent of €36.19. The current lessee is Mr. John Kearney. The Law Agent had previously confirmed that the lessee has a statutory entitlement to acquire the Council’s fee simple interest. Haughton McCarroll Solicitors acting on behalf of the current lessee have recently applied to Dublin City Council to open negotiations to complete the disposal of the fee simple. The Council’s Chief Valuer has reported that terms and conditions have been agreed and accordingly it is proposed to dispose of the Council’s fee simple interest in the premises known as No. 58 Fassaugh Avenue, Cabra, Dublin 7 to Mr. John Kearney subject to the following terms and conditions:

1. That the disposal price in full and final settlement shall be in the sum of €7,500 (seven thousand five hundred euro).

2. That the transaction shall close no later than three months from the date of approval of the disposal by the Council. Interest at the rate of 12% per annum shall apply to any outstanding amounts.

3. That the property is as shown outlined on the attached copy Map Index No. SM-

2011-0543.

4. That the property is held from the Council by way of Indenture of Lease dated 15th May 1945 for a term of 150 years lease from 29th September 1944 at a current rent of €36.19 (thirty six euro and nineteen cent) per annum.

5. That all outstanding charges, rent, rates and taxes (if any) on the property, for which

the applicant is liable shall be cleared prior to completion of the transaction.

6. That the applicant shall pay the Council’s legal costs of transfer, together with a Valuers fee of €800 plus V.A.T.

7. That the above proposal is subject to satisfactory proof of title.

Tolka Area Partnership.

President Michael D Higgins opened the Green View Community Garden at Tolka Valley

Road on Tuesday 21st April at 11.00am. The event was a tremendous success and the

President and his wife spent some time meeting the allotment holders and local residents.

Sadly, some damage was done to the garden two days later and 80 sq meters of grass turf

laid by the City Council was stolen from outside the site. The garden is on Dublin City

Council owned land and Dublin City Council have assisted T.A.P. with the development of

the garden.

Kilshane Drive

New railings will be fitted around the green area on Kilshane Drive within the next 6 weeks.

These railing are to prevent quad bikes using the open space.

Finglas Civic Office Mellowes Road

The car park and parks depot at the rear the Finglas Area Office have been broken into on 4

occasions over the last few weeks. Windows in the vans belonging to the Youth Centre, The

Tolka Area Partnership, Citizen’s Advice Bureau and Dublin City Council were all smashed.

Tools and equipment were also stolen from the vans.

Insulation Program

Work is in progress on improving the energy efficiency of:

12 houses in the Cardiffsbridge Area

15 houses in Barry Close

9 houses in the Cappagh Green area

The work is mainly improved attic insulation and cavity fill insulation. The insulation work will

continue in the Finglas area, to houses that are suitable for cavity insulation.

Prospect Hill

The Fire Consultant MSA reporting to the receiver has to complete the review of block 2 on

the same basis as other blocks in Prospect Hill. We are expecting a report back from MSA

consultants in early June. Unfortunately the allocation of the units in block 2 will now be

further delayed. A transfer of block 2 from the receiver to Dublin City Council cannot take

place until this review is complete. On the overall remediation works in the apartments in

Prospect Hill the receiver has now put a project team in place and expects to tender the

works in late June. Works are likely to commence in September.

COMMUNITY AND SOCIAL DEVELOPMENT Finglas Summer Project Launch 2015

Dublin City Council Community and Social Development Team are continuing to work and

support local summer project committees in the Finglas Area.

Dublin City Council provides financial support to Summer Projects. In addition, projects can

avail of resources such as Fun Inc. (a 2 hour play programme), summer students to assist

where possible and the facilities at Finglas Leisure Centre.

Bealtaine Festival

“Creaking” a dance theatre workshop promoting older people being active through stories,

dance and movement will take place on Monday 25th May at 2.30 p.m. in St Helena’s House,

St Helena’s Road, Finglas South.

“There is Nothing Like a Dame”, an evening of music will take place on 20th May at 8 p.m. in

the Atrium in Ballymun Civic Centre. Dublin City Council Community and Social

Development team in Finglas distributed up to 60 complimentary tickets to local community

groups in the Finglas Area.

Community Information Gatherings

A series of meetings with community and voluntary groups in Finglas will take place over the

next number of months. The purpose of the meetings is to invite groups to celebrate and

share information about their organisations and to network informally with each other.

A meeting for Finglas south was held on Thursday 23rd April in St Helena’s House, the

meeting was well attended with representatives from up to 30 community and voluntary

groups from the area who shared information and made informal links.

Environmental Project

Dublin City Council Community Development Team ordered a limited number of bedding

plants and shrubs for community groups to enhance their estates.

Community/Environmental Groups were contacted in relation to the programme, groups

were invited to apply in writing for the plants and agreed to provide “before and after”

photographs of the areas they wished to plant. Groups received their plants on Wednesday

6th May and are now in the process of planting their area.

Social Inclusion Week

The Finglas West Community Hub open day will take place on Wednesday 28th May at

10.00 a.m. The Hub caters for a wide range of community groups in the area i.e. Breakfast

Club for St Kevin’s BNS, Pavee Points Men and Women’s Groups, Finglas Youth Resource

Centre, Youth Club and Mother and Toddler groups.

Age Friendly Cities Older Person’s Council

The North West Area Age Friendly Cities Older Person’s Council undertook a walk ability

study in Poppintree Park on Wednesday 22nd April. In general the park was praised except

for a few minor issues in relation to signage and seating. The findings of the group will be

passed to the Parks Section of Dublin City Council.

The Older Person’s Council also met their counterparts in Fingal County Council to discuss

issues of concern, the main topic was transport. The Older Person’s Council are due to

meet again on Wednesday 17th June in Finglas Civic Centre.

Finglas Festival 2015

Dublin City Council staff continue to support the Finglas Festival Committee with advice,

funding and resources. Dublin City Council is involved in delivering the following: “Opera in

the Open”, “Finglas Poetry Night” and the Finglas Festival Family Fun Run/Walk.

Job Shadow Day in Finglas

We participated in the Irish Association of Supported Employment’s annual Job Shadow Day

for the first time this year on the 22nd April. Dublin City Council has taken part in this

innovative national day of awareness for three years. The aim of the initiative is to highlight

and promote the valuable contribution people with a disability make to the workplace. The

Chief Executive, Owen Keegan presented scrolls to each of the participants at the end of

their Job Shadow Day.

Land in the ownership of Dublin City Council was incorporated into the apartment Development at The Fuel Yard, 13a Church Street, Finglas, Dublin 11. It is now proposed to dispose of the Council’s interest in this land to Search 4 Alpha (Ireland) Limited subject to the following terms and conditions:

1. The subject plot comprises a long strip of land with a total area of approx. 40 square metres and area of window cills over pathway at Finglas Road as shown outlined red and coloured green on the attached Map Index No. SM-2013-0331.

2. The disposal price shall be €10,000 (ten thousand euro), plus VAT (if applicable) in full and final settlement.

3. This transaction is part of a total settlement of €100,000 (one hundred thousand euro) to satisfy both Part V requirement plus this disposal.

4. This proposed disposal shall be completed by 1st August 2015.

5. The purchasers shall pay the Council Valuers’ fee of €1,000 (one thousand euro),

plus VAT and the Council’s reasonable legal fees.

The dates for the performances of any of the requirements of the proposed agreement may be amended at the absolute discretion of the Executive Manager. The disposal shall be subject to such conditions as to title to be furnished as the Law Agent in his discretion shall stipulate. Newly Appointed Environmental Liaison Officer

On Monday 11th May, Patrick Smith was appointed to the position of Environmental Liaison

Officer for the North West Area. The position has been vacant for over 3 years following the

retirement of Bob Ward. When trained, Patrick will have responsibility for a number of items

including the following:

promotion of good environmental practices in the area

liaising with businesses, schools and community associations, other City

Council departments and state agencies on environmental matters identifying

initiatives on environmental issues and initiate

preparation and implementation of Area Action Plans for the environment and

promoting sustainable environmental practices in communities

Assisting in the enforcement of legislation and bye-laws that are pertinent for

the improvement of the public domain and the wider environment. Including

Waste Management Act and the Litter Pollution Act. Control and Prevention of

Litter Bye-laws and the Presentation, Collection and Storage of Domestic /

Commercial Waste.

Ballygall Swale

On the 22nd April the Drainage Division completed works to the Ballygall swale. The top layer

of soil (which was essentially forming a barrier to the water draining away) was dug up and

removed. Additional land drains were installed in October 2014 and again in April 2015. the

A layer of stone was then placed over the full area of the upper and lower swales, which will

help water to drain through the ground.

Finally, the area was covered over with a layer of high quality top soil to allow the water to

drain through. They then engaged Plants & Planters to landscape the whole green area and

re-seeded it. Photo below of completed works.

Weed Spraying

Weed spraying commenced in the North West Area on 21st April and was completed on 11th

May by Greentown Environmental on behalf of Dublin City Council. During this period

spraying was postponed a number of times due to rain. It is advisable for spraying to be

completed during dry periods to ensure effectiveness. The area will be inspected over the

coming weeks to identify locations that may require additional attention. A second round of

weed spraying will take place in the North West Area in August.

Cabra Laneways

There area a number of problematic laneways in the Cabra Area that are currently under

close inspection a number of times weekly. These laneways are subject to large scale

dumping. The lanes to the rear of the local shops on Faussagh Avenue are attracting large

scale dumping as opposed to dumping of domestic waste. The laneways are of no real

benefit or short cut to the community and are mainly used by the adjoining businesses. The

other lanes in Cabra attract mainly dumping of domestic waste along with some household

items we will continue to monitor these lanes and deploy Litter Wardens to investigate,

where appropriate.

Finglas East Safety Forum

The Finglas East Safety Forum was held on Tuesday 5th May in St. Canice’s Boys School. It

was well attended by local residents. There were no serious safety issues raised. The

Gardai and Dublin City Council supplied updates from the previous meetings along with

current information and statistics of relevant issues, The next meeting is due to be help on

22nd September.

Drumcondra / Glasnevin Safety Forum

The next meeting of the Drumcondra / Glasnevin Safety Forum will be held on Wednesday

24th June at 7pm in the Maples Hotel.

1. Community Update

Ballymun Market

The Ballymun Market has now relocated to the Ballymun Plaza. The market will continue to

be a weekly market. At present the market has approximately twenty traders, a mix of both

community traders and commercial traders. Anyone interested in applying to become a

Environmental Projects

Dublin City Council, Community & Social Development Section are continuing to support

residents group with planting projects for their areas. Below is a list of areas that have had

plants given to them to plant in their planters, flower beds and tree bays. Another support

offered is equipment for clean ups.

Belclare Park, Belclare Place, Sandyhill Court, Marewood Crescent, Marewood Court,

Coultry Way, Willow Park / Ceaderwood, Crannogue Close, & Coultry Drive.

Continuing on the improvement at the Ballymun Library, another three planters have been

purchased for the civic area outside of the library.

Setanta’s Japanese Hurling Event

The Ballymun Area Office gave funding towards this event. The funding given was used for

event catering.

Summer Projects

The application date for projects to apply for funding from both Dublin City Council directly

and to Crosscare has now passed. Both Dublin City Council and Crosscare will now look at

each grant and endorse the funding to groups that meet the criteria. There will be seven

summer projects run within the Ballymun area this summer. Dublin City Council will be

advertising the project dates in the local newspaper in June. The Community & Social

Development Section are working closely with all 7 groups. If you require further information

Resident Engagement Actions

Two of the original CAFTA staff are currently engaging with residents from several different

areas, both Ballymun east and west. They are working with residents on environmental

projects and different actions in relation to their communities. The areas that they have

linked in with so far are, Belclare Place, Sandyhill, Doon Court, Knowth Court, Coultry Park

(shop van side), Sandyhill Court and Coultry Avenue.

Santry Community Centre

The Area Office provided funding to this centre to cover the costs of repairs to the “London

Wall” that allows the main hall to be sub divided. The wall is critical to the centre’s business

plan.

Glasnevin Musical Society

The Senior Community Officer met with this group and has arranged funding from the Area

Office and the Cultural, Recreation and Amenities Department. The group has agreed to

develop a working relationship with the Area Office into the future. It is anticipated that they

will be involved in the forthcoming Positive Ageing Concert in September

Beo Bhailemunna

This festival of traditional music will open on the 15th of June for one week. It will feature a

concert from the world renowned group, Altan on the 22nd. Lad Lane will open the festival

with a concert in The Council Chamber. The festival will also include a concert featuring local

artists, lunch time music, workshops and night time events at Setanta. Tickets for all events

went on sale on the 15th May.

1916 funding

The Senior Community Officer hosted an information meeting on the 1916 fund for the youth

and education sector here in Ballymun. A number of other groups in the Ballymun Town

have been in contact and received support. It is proposed to have a two week show case

period for projects up to the 24th of April 1916.

Glasnevin

Glasnevin/Phibsborough Tidy Towns Committee was launched by the Lord Mayor on

Saturday 18th April in the Library garden. A very large crowd attended including Minister O’

Donohoe, Deputies O’ Sullivan, Lyons, Costello and the celebration included 2 musical

groups. Blessington Basin Pride of Place initiative is developing strongly and will impact

positively on the greater Phibsborough / Glasnevin area.

No changes to report on Iona and Prospect Avenue.

2. Housing/Estate Management

Remaining Blocks

The remaining blocks at Balbutcher Lane and Joseph Plunkett Tower are with a contractor

for demolition. They are now on site and have begun the internal stripping of the blocks. The

programme of demolition is likely to be in the region of 12 months.

C.C.T.V

The programmed maintenance of the system is underway and will be completed in two

weeks. This work includes the cleaning and checking of the system and the control room.

The system is being extended to cover the exterior of Poppintree Sports and Community

Centre and Meakstown Equine Centre.

Cleansing / Waste Management

Waste Management and the Area Office are continuing to combat illegal dumping at open

spaces. These measures include using the C.C.T.V system to monitor and identify those

responsible. The Area Office has targeted illegal dumping in Coultry, Marewood, Druid Court

and St Margaret’s Road over the last month and this resulted in a number of tenants being

called in and warned about illegal dumping. Our cleansing crew is continuing with the

cleaning of the Courts in Ballymun which are cleaned on a rota basis.

Retrofitting

Retrofitting of units in Sandyhill is complete, the work included units which were void.

Completed units have been handed back and have been let to housing and homeless cases.

The work carried out on these units include new pvc windows and doors, boiler upgrade,

insulation of attics, external cladding and pumping of wall cavities. Units in Balbutcher,

Coultry and Belclare have also had walls pumped and attics insulated. The older persons

units in Ard na Meala have been put forward for inclusion in the next round of works. It is

hoped that this work will be approved.

Ballymun West Area Report

Doon & Knowth Court

Dublin City Council has met with the residents of Doon and Knowth Court. There are a

number of small projects planned for the coming weeks. The residents are very enthusiastic

and a commitment has been given by all to engage in trying to improve the piece of land at

the end of the estate. Dublin City Council will be removing the boulders and replacing them

with a permanent structure. It has also been suggested to resurface the foot path that has

been damaged over the years. (Fire damage) It also proposed to paint the walls.

Graigue Court

A request for kissing gates has been made for the entrance/exit of this court. (1-12)

Belclare Green

There is constant illegal dumping on the green. The Public Domain Officer and Dublin City

Council will be carrying out a piece of work to identify who has a bin collection and calling to

those who don’t in an effort to stop the illegal dumping on the green.

CAFTA

Meetings have taken place with the residents of Bellaire Park in relation to planting new pots

and planters in Belclare. There are constant residents clean ups that are supported by

Dublin City Council. I have met with CAFTA and given a list of areas for them to engage

with over the coming months. Carton Court, Bellaire Place, Doon and Knowth Court and

Sandyhill. Dublin City Council has been engaging with residents in these areas around

estate issues, each have expressed an interest in estate enhancement and entering into the

tidy towns and neighbourhood competitions. I meet with CAFTA on a regular basis and

receive an update on the different projects they are working on.

Knowth Court

Dublin City Council is tackling the issue of illegal dumping and non compliance for domestic

waste collection. Estate Management and the Public Domain Officer have called to all the

houses in Knowth Court that have not provided evidence of their waste providers. Letters

were left and a second call to these houses will be made in the coming week. There are a

number of small painting projects planned for the spring at the back of Knowth Court.

Drainage Issues

There have been ongoing issues relating to sewage in several of the Courts. A meeting was

held between the Area Office, Drainage Division and Housing Maintenance in order to clarify

responsibility for this matter. It appears that it is the responsibility of the householder,

whether the house is a tenancy or privately owned. Irish Water has taken over responsibility

for sewers, and our Drainage division now deal with these only on request from Irish Water.

They are not responsible for drains, which are the responsibility of the householder. The

problems in the courts are relating to drains. To date Housing Maintenance has been

responding to these issues, despite not having responsibility for them. This will continue to

be the case but only when there is spare capacity as they are primarily involved in dealing

with issues in flat complexes. The ongoing problems are arising because of materials such

as baby wipes being flushed into the system. However the system, as in much of the city, is

not to modern standards, and similar issues do not arise as frequently where the system has

been renewed. It is intended to carry out a camera survey of the system to establish if there

are any areas that require immediate attention and it is also intended to seek funding for

necessary upgrades. As with other infrastructural works in the area, no source of funding

has yet been identified.

Ballymun East Area Report

Tidy Towns are trying to come up with new initiatives to encourage more community

involvement as the current initiatives are still growing at a slow pace but we still expect to

have residents and committees in place in time for spring clean ups. Along with the Tidy

Towns initiative we hope to enrol in the National Spring Clean for the month of April. Tenant

meetings are arranged now around current initiatives which are in place in Coultry and

Shangan area with more planned through the tenant engagement service.

Whiteacre Park

Tendering has started for the replacement of the play ground equipment which should allow

the playground to be finished in time for the summer. The contractors are still working on the

fencing around the play ground but this will be finished in time before the play ground work

starts. At this stage we will be getting the local kids involved in fixing up the playground, this

engagement will be looked after by the local area office community section. Waste

Management and the local Area Office are currently surveying the areas and houses to

Shangan

Snagging is still ongoing in the new houses on Shangan Avenue which is nearly completed

except for solar and roofing issues. Contractors are continuing to work with BRL over the

roofing issues and the solar systems. They hope to start repair works in the coming weeks.

Waste Management and the local Area Office are currently surveying the areas and houses

to establish the compliance with waste management by-laws. This is mainly being carried

out on bin collection days.

Coultry

New security doors have now been fitted in Coultry Green which will give added security to

residents and stop young people congregating on the stairs. Work on the shop van site is

completed in Coultry Park and tenants have been consulted about what to put in this space

such as a community garden, equipment and paint have been ordered for this project which

should start before the end of May. Surveys are at an advanced stage in Coultry Gardens to

alleviate the drainage and flooding problems in the area. It is hoped that the works will

include the resurfacing of the area. No funding is in place for this work. Waste Management

and the local Area Office are currently surveying the areas and houses to establish the

compliance with waste management By-laws. This is mainly being carried out on bin

collection days

Longdale and Woodhazel

All residents are active in cleaning the front gardens and the street outside each house

which has proved successful. Waste Management and the local Area Office are currently

surveying the areas and houses to establish the compliance if waste management by-laws.

This is mainly being carried out on bin collection days

Forrestwood and Sallowood.

Cleaning up of this area has been on going with local residents getting involved and

improving their area. This has been a bit sporadic in the past as one side of Forrestwood

achieved a gold award in the Tidy Towns and the other side is still a dumping black spot, so

there is a concerted effort to work on all communal gardens. Most complexes in the area

have now got a representative for clean up initiatives. It is hoped that Forrestwood and

Sallowood areas would work a lot better under the Tidy Towns initiative.

Magenta Crescent

A survey was carried out by the Public Lights Section and a new light is required outside 38

Magenta Crescent, a time frame for this is not clear yet as this installation was not in this

year’s budget. The waste ground around the Swiss Cottage has been cleaned of rubbish

and it is hoped the trees and bushes will be cleared at some stage soon. Resurfacing works

have been ongoing on the Swords Road.

3. Ballymun Town Civic Alliance

The Economic Sub Committee held a meeting on 23rd April 2015. Liam Barry gave an

update on work ongoing in relation to a PESTER- (Political, Economic, Social,

Technological, Environmental and Regulatory) analysis, he is collating relevant data which

he will present at the next meeting. He is also working on the economic plan for the area.

There is a proposal to put a unit on the side of the Civic Centre to enable free public access

Wi-Fi. It was agreed that this should be a pilot project with links to other sites. Liam Barry

will be meeting with a representative from the North Dublin Chamber to discuss how to

collaborate a joint initiative regarding the Business Expo.

A meeting of the Social Sub Committee was held on 11th May 2015, where Michael Bowe,

CEO of Tolka Area Partnership outlined Tolka Area Partnership’s plans for the Ballymun

Area. Christine Hodge from BRYR gave a presentation on the Jumpstart Programme. The

ongoing needs of this group were discussed.

The Physical Sub Committee held a meeting on 26th March, where an update was given on

the Town Centre/Shopping Centre, it was stated that a FAQ sheet on questions people may

have about the shopping centre would be included in the next Ballymun Ezine. There was

also an update on the northern site, the main plan is for a food anchor and some retail units.

There was an update on the LAP, approval has been given to appoint a temporary

Executive Planner. Interviews are scheduled for later this month. The LAP issues paper

has been drafted and once the Executive Planner is appointed work will commence. There

will be a management steering group to guide the LAP. A Communications Strategy was

discussed and it was agreed to invite Alan Breen, Press Officer to attend one the meetings,

it is hoped that by promoting events in the area through facebook and other social media it

will help to improve the image of Ballymun.

The second edition of the Ballymun Ezine was produced and distributed to community

groups in the Ballymun Area. There was an advertisement in the Ezine for community

representatives to apply to become members of the Civic Alliance, the closing date for

applications is 30th May 2015 and so far five applications have been received. The next

meeting of the Civic Alliance is scheduled for 9th July where the Chief Executive of Dublin

City Council will attend.

Economic Development Officer Report

Following my appointment on the 23rd February 2015 I spent the first number of weeks

meeting new staff and arranging meetings with all the relevant stake-holders in the

Ballymun. The purpose of these meetings was to find out what their function was and their

role in the Ballymun community. I also had several meetings with DCC to familiarise myself

with the available units in the area and the status of lands zoned for economic development.

I have met some of the local businesses in the area and have been able to guide them

towards supports available in the Local Enterprise Office Dublin City.

Economic Strategy

A lot of time was spent reading past economic strategy documents and learning what was

gone on during the implementation of the Master Plan. At my first economic sub-committee

meeting the committee requested a PESTEL analysis of Ballymun be carried out. To date I

have been busy collecting and collating the relevant data and hope to present the PESTEL

at the next sub-committee in June. The exercise has been useful to give me an

understanding of the political, economical, social and environmental landscape in Ballymun.

The PESTEL will form part of the overall strategy for Ballymun and once it is completed the

next step will be to conduct an in-depth SWOT analysis followed by some strategic actions

for the area.

Tolka Area Partnership and Local Enterprise Office (LEO)

Tolka Area Partnership was the successful SICAP bidder for the North West Area and over

the next few weeks I will be meeting with them to discuss plans for the future and how we

can both work together. I will play a role in supporting enterprise activity in the area by

linking in with the BTWA and SYOB participants. I hope that we can implement some

interesting initiatives in the area. We will link in with the LEO to provide supports for these

initiatives such as presentations on the supports available for micro-enterprise and the

provision of advice clinics to anyone in the area with a business idea or running a business.

There are opportunities to avail some funding supports towards specially tailored business

support programmes and I will be liaising with local businesses to ascertain if there is an

appetite to run a retail programme.

Communications

Free Wi-Fi for Ballymun town Centre – Pilot

With the assistance of Mark Kellett, CEO Magnet and Chairman of the Economic sub-

committee and Dublin City Council we are working on a proposal to provide free Wi-Fi in the

Ballymun town Centre. I will be working on this over the next few months to help make it

happen. It will be the starting point in our efforts to make Ballymun become a destination.

Social Media

Social media is now a powerful tool of communication. A Facebook page to support the e-

zine ‘Ballymun Matters’ will be set up to communicate latest news and events in the area.

Business Expo

Meetings with the North Dublin Chamber of Commerce have taken place and we are

considering the possibility linking in with their annual business expo. This will include a

designated area for Ballymun Town Centre to showcase local businesses, and projects /

initiatives in the area. Participants will be able to avail of expertise such as ‘Meet the buyer’

on the day.

Summary of Applicants Reasons for Seeking Addition/Deletion The old chimneystack should be listed as a protected structure as it is a significant and elegant local landmark and a monument to the previous use for the site. It was afforded a certain degree of protection when the Local Area Plan was drawn up for the site. However, listing it as a protected structure will afford it even greater protection and will ensure that it is retained in the event of the LAP being abolished as is currently proposed. Furthermore the Phibsborough/Mountjoy Local Area Plan includes a key RPS objective (Objective 7) that the chimneystack be included in the Record of Protected Structures: Chimneystack, former Smurfit Printing Works (circa 1920-1930), round red brick chimney, representing a local landmark and the former industrial use of the site. 2011-2017 Development Plan Zoning & location map: The location of the chimneystack is shown in red. The zoning objective for the site is Z10: To consolidate and facilitate the development of inner suburban sites for mixed use development of which office, retail and residential would be the predominant uses.

Summary Description: Red brick chimney stack, built circa 1935, with square base and tapered circular profile chimney shaft on south side of former tobacco factory site. The facade of the former tobacco factory and associated front boundary which fronts Botanic Road is already a protected structure: ‘Former Player’s factory: granite facade, including railings, gate, piers and plinth walls’. Historical Background 2008 Record of site from the Dublin City Industrial Heritage Record: Exterior Description: Former tobacco factory built c.1935, later functioning as a printing works and now in various uses. Multiple-bay, single-storey and a half granite entrance front (west elevation) with advanced terminating bays to north and south. Central Portland limestone entrance with carved detail incorporating 'JPS' monogram grouped under a segmental-headed pediment. Mansard roof to entrance front with alternating segmental and pedimental dormer windows. Granite entrance piers, cast-iron railings and gates to front of site (Botanic Road). Extensive single, two and three storey factory and warehouse range to rear (east) comprising a wide range of building phases. Features include north-light roofs, mild steel casement windows and loading bays. Red brick free-standing chimney to southeast of site with adjacent mass concrete water tower. Appraisal: The former 'Players' factory illustrates the growth and development of the tobacco industry during the interwar period when cigarette sales were reported at an all time high. Though now in use as office and storage space, the external elevations appear to have altered little in recent years and as such the complex represents a rare surviving example of a purpose-built twentieth-century factory building. The architectural grandeur and impact of the entrance front façade and boundary railings contrast sharply with the utilitarian and functional factory ranges where decorative detail is at a minimum. The incorporation of the 'JPS' monogram, symbolising John Player & Sons, within the entrance reflects a confidence and faith in the longevity of their enterprise often no longer present in modern industry. As a major employer in the Dublin area, the site is also of social interest. Significance/NIAH Rating: The National Inventory of Architectural Heritage (NIAH) has not been carried out for this area; however, its categories of special interest (architectural, historical, archaeological, artistic, cultural, scientific, technical & social) and its rating system has been used to assess the buildings in question. The NIAH identifies five categories of rating in seeking to rank buildings. The NIAH rating values are International, National, Regional, Local and Record Only (I, N, R, L, O). Structures which are considered of International, National, and Regional significance are deemed worthy of inclusion on the RPS. Using the NIAH System of rating this structure is considered to be of Regional significance. This is a structures or sites that make a significant contribution to the architectural heritage within their region or area.

October 2008). Assessment of Special Interest Under the Planning & Development Act 2000 The structure is considered to be of special interest under the following headings:

1. Architectural: This structure, constructed, circa 1935, is an important part of the

former tobacco factory complex and is a local landmark visible from several vantage

points in the area. It is also a reminder of the former industrial use of the site.

2. Social: As a major employer in the Dublin area the site is also of social interest.

Conclusion & Recommendation: The Chimneystack at the former Player’s Factory is considered to be of Regional significance. It is an important element of the former factory complex and is a local landmark. It is a reminder of the former industrial use of the site and reminder of the site’s once important role as a major employer in the area. It is therefore recommended that the Chimneystack, Former Player’s Factory, 57-75 Botanic Road, Dublin 9 be added to Dublin City Council’s Record of Protected Structures under Section 55 of the Planning & Development Act 2000. Development Department Civic Offices 13th May 2015 To the Chairman and Members of the North West Area Committee. Meeting: 19th May 2015. Item No: 19 _________________________________________________________________________

With reference to the proposed disposal of site at Balcurris Road / Main Street,

Ballymun, Dublin 11 to Alanis Group.

It is proposed to dispose of a site located at Balcurris Road/ Main Street, Ballymun, Dublin 11. This site is part of a brown field site that was once occupied by three blocks of high rise flats which have since been demolished to allow for future development to take place. The site has an area of approximately 0.76 Ha. and is shown outlined in red and coloured pink on Map Index No. SM-2015-0209, a copy of which is submitted with this report. Dublin City Councils Chief Valuer has now reached an agreement through Lisney, Chartered Surveyors, in respect of this proposed disposal subject to the following terms and conditions:

1. That the proposed disposal price is in the amount of €1,810,000 (One Million Eight Hundred and Ten Thousand Euro) plus VAT, payable in the following manner: a) 10% upon signing of the Agreement for Lease. Agreement for Lease to be

signed and returned to the Council’s Solicitor within 10 days of issue;

b) 80% upon receipt of full planning permission;

c) 10% upon grant of leasehold title.

A 12% p.a. interest rate shall apply to any outstanding sums.

2. That the proposed purchaser will lodge a planning application for the proposed scheme within six weeks of the elected members of Dublin City Council granting approval to the disposal. The purchaser will be responsible for all costs in relation to the planning process. In the event that the development proposed for the site does not receive full planning permission the contracts will be rescinded and the deposit returned.

3. That should the development not be practically complete within 18 months following

the grant of planning permission, the vendor (Dublin City Council) reserves the right to rescind the contracts and return the deposit to the proposed purchaser.

4. That title to be conveyed will be a 500 year lease from Dublin City Council at a nominal annual rent subject to review at 5 yearly intervals linked to variations in the Consumer Price Index (CPI). Title will be conveyed once practical completion has been certified. The developer will be allowed enter on the lands under a licence agreement, on standard terms following a final grant of planning permission.

5. That the Works Licence and Agreement for lease shall not be transferable save, if applicable, in the case of a financial institution which has entered into a mortgage with the purchaser. The mortgage must be approved by the Council in writing and must have been entered into specifically for the purposes of financing the purchaser to undertake the development of the site.

6. That the Ballymun Town Centre Facilities Charge shall apply to the site. The

Ballymun Town Centre Facilities Charge means a contribution to the cost to DCC of providing the Ballymun Town Centre Facilities which the purchaser as lessee shall pay DCC if demanded, under the Lease being a yearly sum of €2.69 per square metre of the gross floor area of the buildings from time to time erected on the Property calculated, in the first instance (but subject to revision thereafter under the terms of the Lease), upon the practical completion of the development in accordance with the SCSI Code of Measuring Practice, such contribution to be CPI linked as provided in the Lease.

7. That each party shall be responsible for their own costs and fees in this matter.

The disposal shall be subject to such conditions as to title to be furnished as the Law Agent in his discretion shall stipulate. The dates for the performance of any of the requirements of the proposed agreement may be amended at the absolute discretion of the Assistant Chief Executive. No agreement enforceable at law is created or is intended to be created until exchange of contracts has taken place.

With reference to the proposed grant of a Sublease of office accommodation at Third Floor South, Ballymun Civic Centre, Dublin 9 to Health Service Executive.

Agreement has been reached to grant Health Service Executive a sublease of part of the Third Floor South, plus twenty basement car spaces at Ballymun Civic Centre, Ballymun Main Street, Dublin 9. The demised premises extends to approximately 842.5 sq.m. or thereabouts, shown shaded in yellow on the attached Map Drawing No. 009-1004, plus twenty basement car spaces (location and numbers to be confirmed). It is therefore proposed to grant a sublease for the above property subject to the following terms and conditions:

1. That the sublease shall be for a term of five years commencing as soon as practically

possible in 2015, for office use only.

2. That the Lessee shall be subject to the terms and conditions of the twenty five year

lease between Clemhill Limited & Others (Landlord) and Dublin City Council (Tenant) dated 31 December 2002, with the exception of the clauses relating to rent.

3. That the Lessee shall pay a rent of €149,000 (one hundred and forty nine thousand

euro) plus VAT per annum, payable quarterly in advance by standing order or electronic funds transfer.

4. That the Lessee shall be responsible for fully repairing and insuring the demise.

5. That the Lessee shall be responsible for the payment of rates, facilities/service

charges, utilities, taxes and all other charges for the demised offices and car spaces.

6. That the Lessee shall not assign or sublet the demise without the prior written

consent of Dublin City Council.

and agreed between the parties prior to the granting to the sublease. The agreed

Schedule of Condition report shall be attached to the sublease.

9. That the Lessee shall indemnify Dublin City Council against any and all claims arising

from its use of the property. The Lessee shall hold Public Liability Insurance

(minimum of €6.5 million) and Employers Liability Insurance (minimum of €13 million)

and contents insurance.

10. That the Lessee shall be responsible for the payment of any Stamp Duty and VAT

liability that may arise on the creation of this lease.

11. That each party shall be responsible for their own fees and costs incurred in this

matter.

The disposal shall be subject to such conditions as to title to be furnished as the Law Agent in his discretion shall stipulate.
