Textbook Adoption

• § 115C-85. Defines textbooks
• § 115C-86. Directs the State Board of Education to select and adopt textbooks aligned to the Standard Course of Study
• § 115C-89. Requires the SBE to develop rules and procedures for publishers to submit bids and sign contracts

…"textbook" means systematically organized material comprehensive enough to cover the primary objectives outlined in the standard course of study for a grade or course. Formats for textbooks may be print or nonprint, including hardbound books, softbound books, activity-oriented programs, classroom kits, and technology-based programs that require the use of electronic equipment in order to be used in the learning process.

At no time during the adoption process (from the time the State Board approves the call letter until the State Board adopts the list of textbooks) may the Commission or any of its members meet privately with any publishers’ representatives.

Frequently Asked Questions
Q: Publishers may only submit bids in two categories. Does that mean two of the seven program areas?
A: K-12 Mathematics is considered to be one category. Publishers may submit bids for any grade levels for math; however, publishers must list the grade for each textbook on the bid form.

Q: How do you submit, “buy one, get one free?”
A: North Carolina does not allow free items. All bid materials must be listed on the bid form. For example, workbooks that may accompany a student textbook may be listed on the bid form (A) as non-inventoried Accompanying Student Materials.

Q: For evaluation purposes, does the material have to be in final format?
A: Materials do not have to be in final format for the evaluations, but all print materials must be in a format where pages will not come apart.

Q: If a publisher lists items on the bid form, may the publisher remove some items from the bid form?
A: A publisher that wants to remove specific items from the bid form must submit the request in writing to Donna Brown prior to the evaluation week. For 2014, requests to withdraw items from the bid must be received by July 11, 2014.

Q: Does the surety bond cover one year or all five years of the contract?
A: The surety bond must cover all five years of the contract.

Q: May local education agencies (LEAs) purchase materials that are not on the State-adopted list?
A: Yes. Districts/schools have the flexibility to use any materials that meet the needs of their teachers and students. Schools may use state textbook funds as long as school improvement plans include provisions for using textbooks that have not been adopted by the State Board of Education. See G.S. 115C 98 b2 (1).

Q: May local education agencies (LEAs) use funds other than state textbook funds to purchase instructional materials from the State-adopted list?
A: There is no specific prohibition from using other local, state, or federal funds to purchase materials from the State-adopted list. However, for some state and federal fund sources, there may be state or federal requirements specific to each fund source or grant that must be considered.

Q: Are publishers allowed to attend conferences or workshops during the “blackout” period?
A: Publishers are not prohibited from attending workshops or conferences; however, publishers may not advertise any items that will be evaluated for the adoption.
Q. For the bid samples, do Textbook Commission members receive accompanying student material (ASM)and teacher enrichment material (TEM)?
A. Textbook Commission members will receive
all items listed on the bid proposal form A including ASM and TEM.

Q: Are publishers allowed to share materials with teachers at any time during the “blackout” period?
A: Publishers may not speak privately to Commission members from the approval of the invitation until the SBE approves the textbooks. However, publishers may speak with teachers and promote materials after the evaluation week is over. For 2014, that period would be after July 25, 2014.

Q: When can textbooks be substituted?
A: After the textbooks have been approved. PART IV (12)Revised or Later Copyrighted Editions: The Seller shall furnish to the State Superintendent of Public Instruction the new edition for both the pupil edition and the teacher edition of the new or revised edition with Form M submitted with the new or revised edition. A list of changes must accompany the new or revised edition.

Q: Will there be a textbook caravan for 2014?
A: Due to the limited amount of funds available, there will not be a textbook caravan for the math adoption. Publishers may market materials to schools and teachers once the State Board has approved the list of adopted textbooks (i.e., the end of the “blackout” period).
